After the hearing for this project on January 17, 2013, it was brought to my attention that a
written letter of testimony from Chris Broer was submitted directly to the applicant and included
in the application submittal (see attached). Typically, public testimony is submitted directly to the
City Clerk's office and transmitted as such after the application is submitted. For this reason, l
was unaware of this letter and therefore, did not bring it to the Commission's attention or discuss
it at (lie hearing. Mr. Broer is concerned that the Commission did not see the letter and thus may
not have taken it into consideration in their decision.
In essence, the letter requested the northernmost structure be reduced to 2 stories in height to
provide a transition between the existing single -story townhomes across Blue Heron Lane to the
north and the proposed 3 -story apartments. The letter was based on the original plan (see
attached) which showed a separation of approximately 90 feet between the closest structures; the
current, Conunission-approved revised plan (see attached) shows a separation of approximately
160 feet. No restrictions were placed on the height of the structures by the Commission at the
hearing on the 17th.
Staff requests the Commission remove the findings for this project from the Consent Agenda and
address at the hearing whether or not the letter of testimony from Mr. Broer was taken into
consideration in their decision. If so, then Staff recommends the Commission move forward with
approval of the Findings. If the Commission did not review the letter, and the Commission
determines the issue warrants further discussion, the project should be rc-noticed for another
public hearing before approval of the Findings.

Subject: Cant make tonight's proposed Meridian Apartment Project meeting, but have a
question/concern
We live just northwest of the proposed project In R-4 Waterbury Park. When our homes were completed in the 1990's (I
moved Into my home In 1993, for example), the southeast corner of N Meridian Rd and E Blue Heron Ln wasn't zoned
for R-40 high density. Although it has been rezoned subsequently for such high density, can the northernmost proposed
building, which would be Immediately across from the single level homes north of E Blue Heron Lane, be reduced from 3
stories to 2 stories? Several of the homes on E Waterbury Ln have backyards along E Blue Heron Ln that would be as
close as 50 feet from the proposed 3 story apartment buildings, and it would be a better transition from those single
level homes to such high density by having the apartment building closest to E Blue Heron Ln only two stories.
