Attached are the following: Aerial photograph identifying the subject property Vicinity map further identifying the subject property Legal description of the subject property Generally, this is a portion of a 10 -acre parcel which was annexed into the city by ordinance number 184, dated April 21, 1969 (copy attached). Lee: My name is Gary Lee with JUB Engineers in Boise. This project called Pine Bluff Apartments was a development that was proposed and approved by the City of Meridian in the early part of 1991 for a piece of property on Pine Street to develop 120 units apartment complex. The conditional use was granted for this particular project, it is currently situated in a L-0 zone. Which this particular use is an allowed use with a conditional use. The sewer and water plans were submitted and approved by both the City Engineer and the State Health Department. Site plans were completed and submitted and approved. License agreements are in the works with Nampa Meridian Irrigation District and U.S. Bureau of Reclamation for the Nine Mile Drain which traverses the property. Ada County Highway District had approved all of the plans and got to a point in development where it was being bid and ready to go to construction. The only short come at that particular time was submitting for building and actually starting construction. The project was put on hold by the owner who is still currently the same owner. At this point in time they would like to proceed and start the construction of the apartment complex. We have reviewed the conditional use process and the city ordinance with the City Planner Shari Stiles. And in the specific section on conditional uses it doesn't speak to any particular time element involved in commencing construction after the conditional use is approved. There are sections of the subdivision ordinance that address time elements for subdivision projects, final plats, preliminary plats and alike. We would like to at this point I guess ask the Council's opinion and request their approval to proceed with this apartment complex under the current conditional use permit. Will, did you have a chance to hand out those documents on the plan? Berg: Yes Lee: If you have any questions, I would be glad to entertain those at this point. Tolsma: Is this the same complex that was proposed? Lee: Same thing, same set of plans. Tolsma: The storage facilities. Lee: The storage facilities were part of a separate piece of property. That was under a planned unit development that was put together by a different person, a different property owner. This 7 1/2 acres where this Pine bluff sites stands alone is owned by a separate Meridian City Council July 19, 1994 Page 10 entity and it was a separate application process. But it sits next door to it. Yerrington: I have a question, how much of an extension of time are you asking for? Lee: They are in the process right now of putting together the plans to resubmit for building permit. And the last I heard they want to start construction this fall. Corrie: Mr. President, Mr. Lee, I have 3 questions, 1 to Gary Smith and 2 to you. You say nothing has changed it is still going to be 2 1/2 story complex, half a story being underground. Open space, you are still requesting 120 units, separate pressurized irrigation system and how about the well? Lee: There will be an irrigation well for pressurized irrigation. Corrie: You are going to continue with the well site. I guess Gary, my question to you is has anything changed as far as sewer and water, that has been 4 years ago we weren't as ambitious as we are now with all the subdivisions. Smith: I haven't looked at the plans again since they were approved at that time, I assume in talking to Gary Lee that everything is the same as it was. We did have some minimum grade on sewer there but that had to do with the depth of the sewer in Pine. It was the only way it could be sewered. Corrie: You seem satisfied as far as water capability and sewer and all of that to be able to facilitate that big of complex. Smith: Well, we would want to make sure that we looked at that again based on the number of units that we have here and water supply. Corrie: I guess I have one other question to the Counselor, is there enough changes here that this needs to go back to a public hearing. Crookston: No Lee: Can I make a comment about the water and sewer, Gary and I worked on the sewer and water easement at the time and that was about the last thing we got accomplished in our interaction on the project. We did get the last minute things changed and the sewer and water easements were assigned by the owner. We have those in hand but they haven't been recorded. So, I guess there is a chance there that we could look at those one more time too if there is any need to change. We do want to ourselves rereview our own set of plans and I believe Gary's staff wants to take another look at the water and Meridian City Council July 19, 1994 Page 11 sewer as well. State Health Department will require it be reviewed again, they do have a one year requirement on construction. So we will go through at least those steps. In addition there are probably some uniform building codes that will have to be looked at on the structures themselves. Morrow: I have a question for Gary, if the project is built now then it does not have a grandfather right in terms of water and sewer type of construction. It would be built to today's requirements, is that correct? Smith: Right Morrow: And Wayne where does the issue come from with time on conditional use permits? Do we have anything that covers time? Crookston: The Council has on various occasions set limitations on how long a conditional use will be allowed. 1 don't see that it is in the findings, I don't agree with Gary Lee that probably the subdivision and development ordinance does have time restrictions for development. I am not sure that they apply to conditional use permit. Morrow: The next question would be then is by virtue of the conditional use it does not give it grandfather rights with respect to building permits because they were never applied for. Crookston: That is correct. Morrow: So they would be current codes both for the sewer and water and building permit standpoint, Uniform building code standpoint. Crookston: That is correct. Morrow: And you are in agreement with those things? Lee: Yes Tolsma: I think we need a motion to approve or disapprove the extension. Yerrington: I make the motion that we approve the extension for one year from this date. Gary Lee, 1990 Turnberry Way, Meridian, was sworn by the attorney. Lee: I am with JUB Engineers, we represent Fiscal Funding Company. They are the owners of the property for which we are requesting the Conditional Use Permit for. We are requesting a modification in the density of a portion of this property and also to seek a Conditional Use for a new owner of the parcel. The density on the parcel was modified and also the original concept plan was changed to better optimize the open space. Before we had many more buildings planned for the same seven and a half acres, two story units. This revised plan is based on two -and a half story complex, the half story being underground, which provided a much more open space to the ^Ioject. We are requesting 120 units, the maximum density is 135. We have met all the quirements for the City. On site plan itsself we have 12,18 & 24 unit buildings, all are two and a half story. There will be a mixture of different sizes, anywhere from one to three bedroom or one to two bath. The square footage will vary from 700 to 1100 sq. ft. per unit. There will be a separate pressurized irrigation system. The Nine Mile Drain contains a 100 ft. easement which we won't be able to build on, however we are working with the U.S. Bureau of Reclamation to modify that drain, to bury a pipeline to reconstruct the side slopes on the drain to landscape it. ACHD has reviewed these plans and the only requirement they have is along Pine Street we'll be installing a five foot sidewalk. (Drawings were shown to the Council) Kingsford: Have you seem the Engineer's comments? Lee: Yes we have and we have revised the parking. Tolsma: They were going to put some kind of sodded road around the back side of this for access. Lee: What we've done on that is relocated a couple of our covered stalls to allow access to that one side of the building. So now we do have the minimum distance required. Giesler: How does the price range for these units compare to what was in the other proposal? Lee: About the same market, maybe a little less. _ ngsford: Anyone else to testify? The primary causes of the flood plains are culverts under roadways. The culvert that crosses the culvert that carries Nine Mile Creek causes a back up. Based on what is shown on the southeast side of this development on Nine Mile Creek, that your going to see some kind of a flood plain through this project. They do have some restrictions that deal with heigth of floor levels concerning that flood plain. I don't know how this will affect the project but I wanted you to be aware of this. Giesler: Regarding the pressurized irrigation, is that just going to be dry lines or did you have a solution for when this comes on line it will be charged. Lee: Right, it will be ready to go. I think we are going to go with a well on this system. One thing I might say about the floor level, these particular buildings the way they are designed, the actual floor in most cases is above natural ground, and then we build a five foot high burm to raise the ground up artificially. Is there a representative present who would like to come forward and address the Commission? Gary Lee, 1990 Turnberry Way, Meridian was sworn by the Attorney. Lee: I represent Fiscal Funding Company, the owner of the property with JUB Engineers. Gave breif history of project. We requested a rezone to L -O (Limited Office Space) with a PUD Concept with a Conditional Use Permit for different uses. Those uses included Multi -family housing, child care facilities, nursing home, retirement center, mini storage units with a planned unit development overlay. That of course was granted, the zoning was changed annexation procedures were completed and accepted. Sometime in September a portion of that was sold and that's what you see before you tonight. .ou have the over-all site plan before you you can see where that is. The piece :.hat we are looking at tonight is the strip along the easterly border about 7.5 acres. We were advised by the City Clerk that Conditional Use Permits weren't transferable without authorization from the previous owner and a petition to the City Council. Apparently the previous owner Equities International didn't want to grant a transfer, so that is one of the reasons we are here before you tonight, to apply for a new Conditional Use Permit under the new owner, Fiscal Funding and we've increased the density on this site from 108 units to 120. The allowable on this particular use multi -family in that zone I believe is about 135 on that 7.5 acres so we are shy of that by quite a few units. In addition the new Concept here, the site plan before you, was redesigned to make better use of the property. He's used a different concept in building configuration, style, shape, and by doing so we've been able to maximize the open space. As you can see we have quite a few more clusters of buildings than what we show now. Johnson: Were those original clusters one level or two? Lee: I believe that these were two level. This particular plan is three level we have six buildings on the site for apartments and one for recreational facility. There will bea pool and a basketball court exterior. The building plans include one twelve unit structure up on the Pine Street side. We have three twenty four unit structures and two eighteens. These units will consist of one bedroom, one bath, two bedroom, one and a quarter bath, two bedroom two bath and three bedroom two bath. Johnson: How many three bedroom units are there? -Lee: I don't know for sure. We have originally planned to start this month. We've taken bids on the site work. As soon as we get our Conditional Use Permit straightened out we will probably start construction. The improvements, as before we've got city water and sewer that'll traverse along the Main road. We have two hundred forty one spaces for parking, these spaces will be covered. I met with Ada County Highway District yesterday during their teck review process, the only comments that they had was to have adequate separation from our entry to 11th Street, and the addition of a five foot sidewalk on Pine Street. We are going to provide a pressurized irrigation system for sprinklingthe entire site. I met with US Bureau of Reclamation and the Nampa -Meridian Irrigation District on the Nine Mile Drain and we are working on details to finish that particular design. What we will end up with there is a piped crossing on the spine road and in addition to that we will have smaller pipe in the open areas that we will cover and we will develop a landscaped slope. Johnson: What's the lighting for this project? Lee: We are working on plans for that right now. I don't know how it's going to be. Johnson: Was that just a minor alteration you had to make when you were a couple parking spots short? Lee: Yes it was. Rountree: You show alot of common ground recreation areas, is that going to be a responsibility of a rental association or is that going to be the owners responsibility? Lee: There will be a Maintenance Manager on site to take care of the entire project. Rountree: Will this be done in phases or is it going to under construction all at once? Lee: The original concept was to build the units north of Nine Mile Drain first. With it scheduled they may just go ahead and build the whole thing at once, but we will at least do the front three. Rountree: Your concept and your illustrations show kind of an upscale kind of facility. What kind of rental market are you looking at as far as who will be renting these. Johnson: What's your minimum size unit? Lee: I don't know. Rountree: What kind of renter are you looking for? Lee: From previous submittals they were looking at rental ranges from $350.00 to $550.00 I suppose. I don't know for sure what their market analysis shows. It will be an upscale market. Alidjani: Have you read what the City Engineer's comments were? One of those was that it was two spaces short. Lee: I talked to Eng. Smith and we have done some modifications on that plan to provide for this. It was 241. MERIDIAN PLANNING & ZONING \NUARY 22, 1991 AGE #3 Alidjani: The second item listed in the comments states that the parking spaces shall be 9' wide and 19' long, for the 90 parking shall be 251,side parking lot do not have a 25' foot one. Lee: Right that's one of the items we corrected as well. Alidjani: Do you have an idea of the height of the building? Lee: I will let Don answer some of those questions. Hepper: How about turn arounds for emergency vehicles, is there plenty of room? Lee: Yes. Don Gile, 2009 Rock Ridge Rd., Boise, was sworn by the attorney. Gile: I am the architect on this project. There are three levels of units, it's really classified as a two and a half story not a three story, with the lower level classified as a basement although it's like a half basement. From entry level you go down a half level and up a half level. The overall height of thebuilding is not to ,iifferent than a two story building, about 4Z feet is the difference. The smallest #iit is 673 square feet and the largest is 1100 square feet. All units have outside private decks, most of the units have walk in closets, most of them also have master bath access. The lower units have ramp access, the corridors and the doors are sized so that they are handicap adaptable. Johnson: What about exterior lighting? Gile: It will have some area lighting, like in the common area and the parking area, it would be down lighting so it wouldn't affect any of the adjacent neighborhoods. Johnson: How was Gary's estimate on the range of rent? Gile: Pretty close. Alidjani: What would be your estimation of the front elevation from the ground to the roof? Gile: About 20 to 23 ft.. Alidjani: Voiced concerns about fire fighting at that height. Have you spoke with the Fire folks? -Gile: It just varily makes the 22 stories. That has already been considered. -DISCUSSION - TAPE ON FILE- Atty. Riddlemoser: Is there anything about the financing for this project that's going to put any special conditions on it or the use of it? Gile: It's just a normally financed conventional financing, not HUD subsidized or anything like that. E.;..res J:n. 21, 1994 WATER EASEMENT, Page 2 uo'k& NOTARY PUBLIC for IJV Residing at L Commission Expi es: Z/ SANITARY SEWER EASEMENT THIS INDENTURE, made this .: J/ day of 22rQ21�// , 1990, between Fiscal Funding Company, Inc., a California corporation, the party of the first part, and hereinafter called the Grantor, and the City of Meridian, Ada County, Idaho, the party of the second part, and hereinafter called the Grantee; WITNESSETH: WHEREAS, the Grantor desires to provide a sanitary sewer right-of-way across the premises and property hereinafter particularly bounded and described; and WHEREAS, the sanitary sewer is to be provided for through an underground pipeline to be constructed by the Grantor; and WHEREAS, it will be necessary to maintain and service said pipeline from time to time by the Grantee; NOW, THEREFORE, in consideration of the benefits to be received by the Grantor, and other good and valuable consideration, the Grantor does hereby give, grant and convey unto the Grantee the right-of-way for an easement for the construction, operation and maintenance of a sewer line over and across the following described property: A parcel of land 15.00 feet in width lying 7.50 feet either side of and parallel with the following described line, said land being a portion of Lot 3, Westlawn Subdivision, as filed for record in the office of the Ada County Recorder, Boise, Idaho, in Book 2 of Plats at page 94 and more particularly described as follows: Beginning at a brass cap marking the Northwest corner of the SW 1/4 of Section 12, T.3N., R.1W., B.M., Ada County, Idaho; thence North 89°30'16" West 1052.99 feet along the Northerly boundary of said SW 1/4 to a point; thence leaving said Northerly boundary of said SW 1/4 South 0°32'18" West 30.00 feet to the REAL POINT OF BEGINNING; thence South 0°15141" East 147.17 feet; thence South 10059'13" West 160.61 feet; thence South 11030'41" East 116.84 feet; thence South 34000'34" East 112.87 feet; thence South 45°16'10" East 89.51 feet; thence South 0°00'55" East 200.51 feet; thence South 44059127" West 44.85 feet; thence South 89013'32" West 160.14 feet to the POINT OF ENDING of the above described permanent easement; AND ALSO: Beginning at the Northwest corner of said SW 1/4; thence North 89030'16" West 894.54 feet; thence South 0032'18" West 805.00 feet to the REAL POINT OF BEGINNING; thence South 89059'05" West 30.70 feet to the POINT OF ENDING of the above described permanent easement. The easement hereby granted is for the purpose of construction and operation of a sanitary sewer line and allied facilities, together with their maintenance, repair and replacement at the convenience of the Grantee, with the free right of access to such facilities at any and all times. TO HAVE AND TO HOLD, the said easement and right-of-way unto the said Grantee, its successors and assigns forever. IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto, that the Grantor will complete the work of laying the sanitary sewer line and restoring the premises used therefor to a condition comparable with that existing prior to exercising this easement; that, in making future repairs, the Grantee will expediently replace and restore the premises to a condition comparable to that existent prior to undertaking such repairs and replacements. THE GRANTOR hereby covenants and agrees that he will not place or allow to be placed any permanent structures on the area described for this easement which would interfere with the use of said described easement for the purposes stated herein. IT IS HEREBY FURTHER AGREED that the Grantor does hereby give and grant to the Grantee the right of use during initial construction a temporary construction easement over a strip of land described as follows: N/A SANITARY SEWER EASEMENT, Page 1 IT IS UNDERSTOOD that the strip of land described in the previous paragraph is for the purpose of constructing said sewer line herein described, the same to expire when the initial construction is completed. IT IS UNDERSTOOD AND AGREED that the Grantor will restore said strip to a condition comparable to that existent prior to the undertaking of the construc- tion of such sewer line. THE GRANTOR does hereby covenant with the Grantee that he is lawfully seized and possessed of the aforementioned and described tract of land, and that he has a good and lawful right to convey said easement, and that he will warrant and forever defend the title and quiet possession thereof against the lawful claims of all persons whomsoever. O The purpose of this request is to ask that the City of Meridian allow the developer of this apartment complex to proceed with plans to construct this facility, which had been previously approved by the City. As you are aware, a Conditional Use Permit was requested and granted P by the City on February 19, 1991. In addition, site plans, sewer and water plans, and easements were reviewed and approved by the City Engineer on December 28, 1990. yAfter reviewing the City's Zoning and Development Ordinance No. 430, Title XI, Section 2-418, pg. 79, regarding Conditional Use Permits, a time limitation is not mentioned, addressing when construction should begin after a CUP approval is given. We also spoke with Shari Stiles about the time element; she is still investigating the ordinance for restrictions on time for CUP's. We wish to ask the City's consideration in allowing the development to proceed to the building permit stage, assuming that the current Conditional User Permit is valid which, we believe, is. In addition, we spoke to Gary Smith, City Engineer, concerning the plans' review and approval process. As mentioned earlier, Mr. Smith had approved the previous Sewer, Water and Site Plans in 1990. However, he would like a second opportunity to re -review the plans. We believe this to be a reasonable request. Enclosed for your information is a copy of the following items: 1. City of Meridian City Council minutes for the February 19, 1991 Council meeting approving the Findings of Fact and Conclusions of Law and approving the Conditional Use Permit.
