It is our interpretation of the approved CUP that more than one building /tenant could be constructed without going through an additional full CUP, assuming that the buildings limited it's use to the approved CU plan per CUP-01-009 dated 06/22/01. In the case of a professional office, daycare, or retail we would expect to go through a CUP process, however in the case of an approved I-L use we would expect to go through a Certificate of Zoning Compliance and a building permit along with the require off-site improvements. As with every construction project, timing is always a huge factor, if we-could could receive clarification from you on this item it will enable us to more accurately provide a prospective tenant with a construction schedule that will mee their needs. ' The TVTC property is currently eligible for one additional building permit without a conditional use permit. The location o' the project must be on the remaining existing legal lot. The project must substantially conform to the approved site plan and elevations. Such a project would go through a Certificate of Zoning Compliance (staff level review) and Building Perm its. Per the findings, any building that is intended for professional office, retail, or day care use must go through the Conditional Use Permit (CUP) process regardless of timing. Future building applications that adhere to the approved CUP plan and are an approved, permitted use may be approved at staff level. Any projects that include any significant changes to the location, siting, or height of the buildings shown on the approved plan will also require a separate CUP. We have applied for a Conditional Use Permit to approve a conceptual Planned Unit Development for the Treasure Valley Technical Center. In making this application, our intention is to work with the city openly in developing a first class technical center that we all can be proud of and that will effectively serve the employment needs of the area. Consequently, we applied for numerous additional uses to allow us to be able to more effectively market the space. Though the Planning and Zoning Commission voted to recommend approval of our conceptual plans, they did not approve any of the additional uses requested. Frankly, we did not engage in any meaningful discussion of the listed uses before the public hearing was closed. There was no opposition of any kind to our application either in writing or at the Planning and Zoning public hearing. Since the list of additional conditional uses (in addition to already allowed uses under the current L-1 zone) for which we originally applied is admittedly lengthy, we wish to clarify our intent by modifying the list to only include: 1. Daycare center 2. Professional and sales offices 3. Community and neighborhood shopping center Only with approval of these additional uses along with our conceptual plans for the Planned Unit Development do we feel we can effectively develop the Treasure Valley Technical Center. Obviously, specific plans will still need approval through the Conditional Use Permit process once tenants or participants commit to the project. We respectfully request, that our proposed written approval of this application specifically address the fact that this Planned Unit Development not be limited to the conceptual number of buildings, square footages specified, or uses as submitted. Even though the site plan, type of buildings, and parking configurations, etc., are a reasonable expectation of the final development, what actually happens will be driven by market demand. With our first building, we have attempted to demonstrate our willingness and intent to improve the quality of life, and the economic prosperity of this community. For this reason, we will limit our development plans to the general uses found on the attached list. We did not submit a blanket list of every possible use, since we hope to develop a technical park with uses second to none in our region. It is to our financial advantage to beautify and improve the total appearance of this park and the access and entrances thereto. For this reason we propose a sign program with at least two monument signs for each additional building similar to what we have constructed for the first building. We hope to add additional signage on access road and the freeway as may be permitted. We also will submit a traffic study to ACRD, prior to approval indicating ways that the trips might be less inherent by developing quality employment near planned residential subdivisions yet to be built. We have also approached, and are working with the City Public Works department to insure that fire flows and potable water supplies, as well as other utilities are readily available. In short, the common areas and visual as well as practical uses of this park will set the standard for future project developments in the City of Meridian. Please note that we will post the property seven days prior to any hearing and that we will pay all associated fees with our construction, we hope will be forthcoming during this calendar year. Estate February 14, 2001 City of Meridian Planning and Zoning Department 200 East Carlton Avenue, Suite 201 Meridian, ID 83642 Re: PUD request for Treasure Valley Technical Center Gentlemen/Ladies: Pursuant to the accompanying request for planned development application in accordance with Meridian Zoning Ordinance Section 11-17, this letter is given to satisfy the conditions set out in Numbers 11 and 13 of the Conditional Use Application checklist furnished by the City. The property which is the subject of this application for planned development is a quarter quarter section _ (excluding the portion taken up by I-84) less than a mile from the Meridian and I-84 interchange and abutting the freeway. Already constructed on a portion of the property is a 100,000+ square foot manufacturing and office facility owned by DBSI Industrial Limited Partnership. The balance of the property (now owned by Meridian Freeway Associates, a limited partnership), presently unimproved but no longer appropriate for agricultural purposes, is suited well for similar development of light industrial and/or office complexes and other allowed PUD uses, as conceptualized in the accompanying proposed plans. Utilities to service [he proposed development and drainage issues, etc. have been addressed in the construction of the present building, and the previous study and planning for these items and their expansion will particularly enhance the orderly development of the complex. The property's exposure to the freeway is excellent, but the entrance itself to the property (on Overland Road) is sufficiently removed from Meridian proper and the Meridian/I-84 interchange to promote proper traffic flow. Improvements to Overland Road are already forthcoming which will enhance the egress/ingress to the property. This development has the potential to enhance Meridian's business and job climate with little or no downside.
