BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE REQUEST FOR PRELIMINARY AND FINAL PLAT FOR CHERRY CROSSING SUBDIVISION HAWKINS COMPANIES, Applicant Case No. PFP-03-004 RECOMMENDATION TO CITY COUNCIL 1. The property is approximately 3.775 acres in size and is generally located on the north west comer of Cherry Lane and N. Linder Road. Z. The owners of record of the subject property are Boise Surplus 200?, LLC, 8645 W. Franlin Road, Boise, Idaho 83709. 3. Applicant is Hawkins Companies, 8645 W. Franklin Road, Boise, Idaho 83709. 4. The subject property is currently zoned C-N (Neighborhood Business District). The zoning of C-Nis defined within the City of Meridian Zoning and Development Ordinance Section 11-7-2. 5, The subject property is within the city limits of the City of Meridian. 6. The entire parcel is included within the Meridian Urban Service Planning Area as defined in the Meridian Comprehensive Plan. 7. The Applicant proposes to develop the subject properly as a commercial subdivision. 8. There are no significant or scenic features of major importance that affect Che consideration of this application. RECOMA~IENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the preliminary and final plat as requested by the applicant for the property described in the application, subject to the following: A. Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF PREL]MINARY AND F[NAL PLAT FOR CHERRY CROSSING SU6DIVISION -PFP-03-004 -Page 1 SITE SPECIFIC COMMENTS -PRELIMINARY/FINAL PLAT 1. All landscaping will be required per 'the approved plans on the original plat (FP- 02-O11) and the revised Conditional Use Permit (CUP-03-013). Any incomplete landscaping shall be bonded for prior to signature on the final plat. 2. Sign the Certificate of Owners and notarized the accompanying Acknowledgment (Sheet 2 of the final plat). 3. Sanitary sewer and water service to this development shall be via service line extensions from the existing City of Meridian mains adjacent to the project. 4. Pressurized irrigation within this development will be from the existing system that was installed as part of Cherry Crossing. 5. Label the '/a Corners o6ection Z on the face of the final plat. 6. Please revise the bearing and distance information to show the larger bold text only on the exterior boundary of the area being subdivided. Other dimensional text should be shown in the smaller, lighter weight fonts. 7. Add the two segment distances along the south sides of Lots 1 and 2. 8. Revise the year of platting to "2004." 9. Add "Block 1" to the situate statement. 10. Correct the ownership information in the final plat Certificate of Owner. ll. Correct the bearing of the fourth to the last line of the legal description of the Certificate of Owners (S 90°00°00'00"E) 12. This application is subject to the conditions of approval for the original plat (FP- 02-O1 1) and the revised Conditional Use Permit (CUP-03-Oli), except as revised by this report. B. Adopt the Recommendations of the ACRD as follows: Site Specific Conditions of Approval 1. No additional access points have been proposed and none are approved with this application. The following four driveway locations were approved with Cherry Crossing Subdivision. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF PRELIMINARY AND FINAL PLAT FOR CHERRY CROSSING SUBDIVISION - PFP-03-004 -Page 2 r Aright-in/right-out driveway on Cherry Lane is located approximately 220-feet west of Linder Road. The driveway is restricted to right-in/right-out operations with an on-site median, and appropriate signage. A full access driveway on Cherry Lane is located approximately 470-feet west of Linder Road. Aright-in/right-out driveway on Linder Road located approximately 285-feet north of Cherry Lane. The driveway is restricted to right-in/right-out operations with an on-site median, and appropriate signage. - The driveway on Emerald Falls Drive is located approximately ] SO-feet west of Linder Road. 2. Other than the access point(s) specifically approved with Cherry Crossing Subdivision, direct lot or parcel access to Linder Road and Cherry L uie is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. 3. Comply with all Standard Conditions of Approval. Standard Conditions of Approval 1. Any existing irrigation facilities shall be relocated outside of the right-of--way. 2. All utility relocation costs associated with improving sheet fiontages abutting the site shall be borne by the developer. 3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development Contact Construction Services at 387-6280 (with file number) for details. 4. Utility street cuts in pavement less than five years old are not allowed rmless approved in writing by the District. Contact the District's Utility Coordinator at 387- 6258 (with file numbers) for details. 5. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 8. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #198, also known as Ada County Highway District Road Impact Fee Ordinance. 9. It i s t he responsibility o f the applicant to v erify all existing utilities w ithin the right-of--way. The applicant at no cost to ACRD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DIGLIIVE (1-800-342-1585) at least two full business days prior to breaking ground within ACRD light-of-way. The applicant shall contact ACRD Traflic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. 10. No change in the Cenns and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicanC to obtain written confirmation of any change from the Ada County Highway District. 11. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules; regulations, o rdinances, plans, o r o they r egulatory and l egal r estrictions i n force a t t he time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. G Adopt the Recommendations of the Meridian Fire Department as follows: 1. Provide afire-flow per the International Fire Code Appendix D to service the project. Fire hydrants shall be placed an average of 400' apart. 2. All internal roads shall have a turning radius of 28' inside and 48' outside. 3. All access roads within the project shall have a clear driving surface with a minimum width of 20' available at all times. D. This proposal can be approved for central sewage & central water afrer written approval from appropriate entities is submitted. ?. The Applicant's central sewage and central water plans must be submitted to and approved by the Idaho Department of Health & Welfare, Division of Environmental Quality. Run-off is not to create a mosquito breeding problem. 4. Stormwater shall be pretreated through a grassy Swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 5. The Engineers and architects involved with the design of the subject project shall obtain current best management practices far stormwater disposal and design a stormwater management system that prevents groundwater and surface water degradation.
