Corrie: Shari.
Stiles: Mr. Mayan and Council this is the ~- it was submitted as a preliminary and
fin2~l plat. That's why it's came to you without a public hearing. This is the
prpperty that is directly across the street from the proposed John Biss project. It
was held up a little bit at P &. Z because same items were missing from the plat
as well as we didn`t have any covenants submitted. You'll notice in your packets
that you do have I Nape that you da have covenants. They're very sparse and
don't really put any kind of restrictions on the develppment as far as what kind of
construction or anything like that. (don`t know if that is something that ypu want
to think about. Mr. Thomas had proposed this development a long time ago back
when he was working on the Godfather's and Blimpies. He does want to sell off
these individual Ivts now. That's the reason for the plat. The canal has been
fully piped. I don't know what kind of sewer and water issues are with this
project, but -sewer and water is already in to serve the parcels.
Rountree: It's just to establish one of those two lots on Meridian Road; right?
Stiles: Yes, and then the existing lots or the lots where the existing buildings are.

Gigray: Mr. Mayor and members of the Council and staff, (just point out again I
had another memo which is addressing procedure on this one that prior action of
the Planning and Zoning Commission that I could glean from the record was
approval of the preliminary and final plat which can be recommended and you
have an ordinance provision that specifically allows that. I would caution Mayor
and Council that the Planning and Zoning Commission has no conditions
whatsoever on it and you may want to elicit from staff what conditions go along
with this because we are at the final plat stage, so that when I at your direction
prepare the final the order of approval of final plat, we have the appropriate
information in it_ And if it's all in accordance with the plan that's before then I just
want to clarify that we're doing what we need to do here, and if it is a conditional
approval, I have to specify what the conditions are.
Rountree: Mr. Mayor question I would have for Shari is as it relates to the
frontage on Merid'+an Road for landscaping. If it's compliant with our ordinance
since it's already annexed and ecetera, 15 feet of setback for landscaping.
Stiles: Councilman Rountree, Mayor and Council the way our ordinance
currently reads they could have as little as 4 feet.
Rountree: Again that`s our option.
Stiles: Yes.
Rountree: Do you have a recommendation?
Stiles: I would like to see 20 feet, but another problem with this is that he had
gone through some prior approvals where he based his whole deve{opment plan
on providing that 15 feet. And a point was brought up at the Planning and Zoning
Commission that a lot of it depends an how you ls~ndscape it_ Somebody can
have 50 feet of landscape setback and it doesn't look any better than somebody
else that does 15.
Bentley: Mr. Mayor I have a question for Shari. Do yvu remember discussions
that were had with the Tdm Scott properties back there with their landscaping on
Meridian Raad?
Stiles' Yes.
Bentley: What did we decide on that? Seeing that the question is in the air as to
what was going to be done with that road.
Stiles: I'm not sure what the setback ended up on that- I'd have to go back and
look at their plan. We still da have bonding, a band in place for that. I just Can't
recall what -how many feet it was.

Rountree: Gary, did you have any specific recommendations that you see as
conditions on this?
Smith: No, sir, I don't. Sewer has been extended across the north boundary of
the property and serves the two buildings the complexes that presently exist
there. Water is being stubbed through the development as it's taking place to be
carried on around the south side of the boundary of the property, so 1 don't have
any concerns with it.
Rountree: Mr. Mayor, l would move that we approve the preliminary and final
plat for this application Wild Shamrock for the first Meridian Plaza with the
condition that a minimum of 15 feet of quality landscaping be provided on
Meridian Road.
Bentley: Second.
Carrie; Motion made by Mr. Rountree second by Mr. Bentley to approve the
preliminary and final plat for 16t Meridian Plaza by Wild Shamrock with the
conditions set forth by Mr. Rountree. Any further discussion? Hearing none, all

Rountree: If you would like a definite, what I meant by quality I could enter that
into the record. Would that help? Do you need it in the form of a motion?

Gigray: If you get the permission of the second, I would just restate the motion.
Bentley: Yvu have my permission.
Rountree: Mr. Mayor f would restate the motion that we approve the preliminary
and final plat for this application subject to the condition that it have a minimum e
15 feet of quality landscaping an Meridian Road, and by quality t mean that the
landscaping be designed by a licensed landscape architect in the State of Idaho.
That the landscaping be maintained in an aesthetic manner minus weeds and/or
any litter and debris.

Corrie: At this time I would like to enter the name to be considered for Deputy
Clerk position of Ange) Sims, who is now employed in the City Clerk's office.
Anderson: Mr. Mayor I would move that we appoint Angel Sims as the Deputy
Clerk for the City of Meridian, authorize the Mayor to do that.
Bentley: Second.
Corrie: Motion made by Mr. Anderson second by Mr. Bentley to approve the
Mayor's appointment of Angel Sims as the Deputy City Clerk. Any fiurther
discussion?
Rountree: In terms of performance of those duties, would that be evaluated and
performance be judged by the Mayor or the City Clerk or a combination of both
so if the appointment apparently isn't going to work out that we would know how
the performance is going to be brought back to the Council and the Mayor.
Gorrie: I guess
Rountree: The individual at this point now is supervised by the City Clerk.
Currie: I would say that the appraisal would be by the City Clerk and then my
appraisal would be of the City Clerk so he can have -
Rountree: Well that's only fair. That's the chain of command.
Corrie: Yeah.
Rountree: I just want to make sure that there isn't an implied change in the chain
of command.
Corse: Yeah, that's the way I looked at it.

On November 17, 1998, the Meridian City Council approved the final plat for First Meridian
Plaza Subdivision. According to City Ordinance 12-3-8.A., final plats "must be filed with the
County Recorder within one year after written approval by the Council; otherwise, such approval
shall become null and void, unless prior to said expiration date an extension of time is applied for
by the applicant and granted by the Council." According to records from the Ada County
Recorder's Office, the First Meridian Plaza Final Plat was recorded on September 25, 2000,
which exceeds the maximum one (1) year timeframe set by ordinance. Since you have not
submitted and City Council has not approved a time extension request, the final plat has become
null and void.
In order for the subject plat to be considered valid by the City of Meridian and before any zoning
certificates or building permits can be issued on any of the four (4) lots within the subdivision, a
Variance application must be submitted to the Planning and Zoning Department and
subsequently approved by City Council. A copy of the Variance application form is enclosed.

Land Group and prepared a quick cost take-off from the approved plan.

The final plat mylars have been submitted to the City of Meridian for signature. Gary Smith, the City
E~rgineer, signed the play and forwarded it to Will Berg, Jr. for signature as the Gity Clerk.
As i told you in our telephone conversation, I spoke with Mr. Berg last week. As i understand it, the
only issue to be resolved is for the Developer, Wild Shamrock Partnership, to provide a guarantee for
the landscaping to be done in accordance with the approved landscape plan. Mr. Berg requested that i
work through you to determine the amount for the landscaping surety. Base on the submitted plan, the
landscaping costs are estimated to bc:
24 Ea. - 3-inch caliber trees a(; $330.00 = $7920.00
8,000 S.F. Lawn/irrigation Sys. @ $0.60 = $4800.00
Total Irrigation Costs $12,720.00

to make any comments that is pertinent to the subject we're working on. After that we'll
call the applicant forward to make a statement about his project, his or her project and
then we'll call if it happens to be a public hearing we'll call the public and I will call per
our new layout from our attorneys I'll call those people who are for the project. I will
then call all of the people who are sitting here who are opposed to the project to have
them speak. We ask that each one of you as you come up here to speak keep it short if
you can to five minutes or less, keep it pertinent. If somebody has already said what
you've said, that's fine. It's been recorded. It's all on tape and it goes down in typed
form after that so if your concern has been recorded, feel assured that it will be listened
to and read as a concern of your own. After we finish the round with the public the
applicant is asked to come back forward to answer any comments that he's heard from
the public pro or con. Then we'll close the public hearing and the commissioners will
discuss that and make their recommendation. Is there any questions by the way? I
have gone through this thing just kind of briefly and I think once we get started you'll

we requested. The applicant is proposing a 15 foot setback for landscaping on Meridian
Road. A five foot setback on Gem Avenue. They have submitted some proposed
covenants that will be forwarded to City Council for their review. Other than that I
believe they have addressed the comments that we've made on the project.

That's interesting nobody else. Commissioners what's your direction? This is a
continued public hearing.
Smith: Mr. Chairman I guess just a comment. I guess I'm confused why we are only
requiring a 15 foot landscape setback on this parcel and we're asking Mr. Biss across
the street to provide 35 foot. Maybe Shari can talk to that.
Stiles: Mr. Chairman, Commissioners, when the Biss property along with Troutner
Business Park was annexed which was recently since our comprehensive plan was
adopted that was a specific requirement as part of their annexation. This property has
been annexed for many years and we don't have the ability to impose a development
agreement on property that's already been annexed. I don't know. Maybe legal

counsel can advise whether we can set minimum landscape requirements on a plat.
Rossman: You know that's a question on the ordinance as to whether there's a
provision in the ordinance. I'm not aware of any that will allow you to do such a thing. I
do believe if in fact Mr. Biss's property was part of the development agreement in the
annexation the 35 foot setback or 35 foot landscape then that certainly can be imposed,
but with property that has already been annexed and part of the city, I'm not aware of
any provision, but I certainly could reserve and advise you on that later, but I don't know
of any provision in the ordinance that will allow that.
Smith: This was something that was tied to the entrance, gateway, corridor text.
Stiles: The Biss annexation, is that what you are talking about?
Smith: No, just entrance gateway corridors into the city.
Stiles: There is no set requirement for a minimum in the ordinance. The 35 foot was
what was established by policy as being requested of new annexations.
Borup: Mr. Chairman I would just like to say 1 had the same concern that was just
expressed and mainly because of the gateway aspect of it. But I guess I felt if a nice
landscaping job was done, that it would accomplish the purpose that we're trying to on
the gateway. So I think maybe that's in my mind I decided maybe that's what we're -
maybe be the benefit is a nice landscaping job. A nice landscaping job on 15 feet could
look as nice as lousy landscaping job on 35.
MacCoy: You raise a good point. Okay that's discussion and we can continue that
later. What about the public hearing?
Borup: I move we close the public hearing.

Smith: To vote.

Dear Councilmen:
I have reviewed the plat for Ashford Greens No. 3 & No. 4 and find that it includes
approximately 44 homes assuming a median value of $150,000. We also find that this
development is located in census tract 103.10 and in the attendance zone for Linder
Elementary School, Eagle Middle School and Eagle High School. We can predict that
these homes, will house thirteen elementary aged children, twelve middle school aged
children, and ten senior high aged students. As you know, even small developments such
as Ashford Greens Subdivision No. 3 & No. 4 will eventually cause overcrowding in all
three schools.
The cost per student for newly constructed schools, excluding site purchase price and
offsite improvements, exceeds $5,000 per elementary student and $10,000 per middle or
high school student. As a result of continued growth in the Meridian School District we
would appreciate any help in locating and purchasing additional school sites within our
school boundaries.
At this time we will approve this subdivision but once again would appreciate any help
with the constant growth in our school district.

weren't prepared to deal with at that time. On September 2"d we met with two
ACHD's representatives, Meridian P & Z representative, my client and a
representative from the school district. ACHD had requested that the turn around
or the way we had designed the street intersection at the south west corner of
the subdivision would be changed to reflect how we designed them. The other
intersection at the south east corner. So at that meeting, we worked out the
details of that particular intersection and the plat you have reflects that. The
utilities that we intend to have the public utilities within the public street. Move
that manhole that is outside of that public right-of--way and that corner and put
that within the street five feet off of the lip of gutter and also move the fire hydrant

Borup: Has that corrected copy been turned in to staff?
Iverson: Frankly that's my fault, when we got postponed and then I put it on the
back burner and that will be added prior to the final plat.
Borup: Could you expand a little bit more on-you said you didn't think the
landscaping plans were applicable.
Iverson: Well I can see it and you know, as I say, the two buildings that have
been constructed down there, the landscaping plans were required during the
building permit process. They had to be submitted and approved. To do it
during the platting process, when you don't really know what is going to be
constructed on those particular lots, there is two lots remaining to be developed.
After platting, since you already have control down the line when it's decided
what the buildings are, I see no need to really impose that restriction at the plat
level.
Borup: So you are saying, you would like to do the landscaping as part of the
building.
Iverson: I could understand maybe in a subdivision of residential or industrial
subdivision where you have lots or areas that are common areas...
Borup: Would future buildings change any of the setback areas on the road.
Any landscaping they should have a long the, in this case, I guess it would be
Meridian Road.
Iverson: Meridian Road, no again, that's...
Borup: So that area is going to stay the same, either way I assume.
Iverson: Yeah, and the zoning (Inaudible).
Borup: I think the other question staff had, was that the landscaping be
completed prior to occupancy. Of course that would be after the buildings are
built. You didn't have a problem with that part of the...
Iverson: The occupancy permits are part of the building.
Borup: So your comment was just on the detailed landscaping plan.
Iverson: Well the detailed landscaping plan and the letter of credit prior to
signature for the final plat. We don't think any of that should be associated with
the final platting process, but it's covered under the building permit process.

De Weerd: Mr. Chairman, I guess the only point that I had was, Commissioner
Borup had raised about the location of the amount of lateral easement. That it's
not on the plat that we have and we are looking at the request for preliminary and
final plat for this proposal. So, I guess my question is, Mr. Chairman, can we
consider this if we don't have the final plat in front of us?
MacCoy: We can consider it, but it's up to you as commissioners, how do you
feel about it? If you want to wait till you see some more material, that's up to it.
Iverson: I'm wondering what your concern is as far as the city. Would it hold up
this stage, the public hearing stages?
De Weerd: That this was a request and it's needed on the final plat and our-
what we're looking at is the request for preliminary and final plat approval and we
don't have the final plat if this still needs to be changed.
Borup: To expand on that, our directions from the City Council is they want to
have everything complete before we pass it on to them. That's been driven
home to us very strongly the last couple of months. So we were making long
efforts to comply with that.
Iverson: I can tell you that throughout the development (Inaudible) the existing
building and (Inaudible) we've worked with Nampa/Meridian as you are probably
aware that the eight mile lateral is in effect and pipe across the property. There
is a license agreement that I've been trying to get with the district because frankly
there is a little bit of confusion as to-through their paperwork as to how that
came about. We're trying to iron that out. They definitely worked with us to get
the lateral pipe and the license agreement allows the parking to be constructed
over into the easement as it has been done. They've been aware of it through
the whole process. I can understand that it is a requirement to be shown on the
plat and again, I understand that-I just think that the public hearing process, we
can definitely get it on there. I just hate to see it be tabled or anything for that
reason.
Borup: There is no question on the location of the easement is there?
Iverson: No, it's 45 feet, so it's canal center line.
(Inaudible)
Iverson: Mr. Chairman, I don't know if anyone else has any questions, but I have
some for staff.
MacCoy: Before you do, we've all received the staffs comments and item eight
on the first section of the comments on top of page two in review of what

Commissioner De Weerd brought up to get consideration. You can go ahead
and ask the staff.
Iverson: I think along with that item six through nine are all plat correction items.
Granted, I submitted a letter back to staff responding to their conditions and
stating that these items would be corrected. I had waited also to have response
back from ACHD and as well as the Ada County surveyors that all changes could
be made at the same time and not change on then another and back and forth. It
was just a matter of waiting. I thought that having these pointed out, these errors
pointed out in (Inaudible) would be corrected as the final plat progressed for
(Inaudible). I didn't really feel that it was, frankly, my feeling was that it wasn't
required at this stage in the process.
MacCoy: Well we have the point to review it, we like to make sure that
everything is in place and the I's are dotted before we put it to council, because
we know that this is the review board and the council doesn't do the resorts that
we do at this level here.
Iverson: I'm a little confused with that. My understanding is the next step is
findings of facts, it is not (Inaudible).
MacCoy: Commissioner Borup, you were going to ask the staff a question or
two.
Borup: We want to clarify that for the applicant.
Iverson: Is that correct?
Borup: Because a plat doesn't require

Prior: ...this plat should've been complete with all the corrections that were
requested and the final product is submitted to the Planning and Zoning
Commission. Planning and Zoning Commission puts their stamp on this thing
and it goes onto the City Council for them to do their review and then it goes
forward, there are no findings. Basically once again, you could ask the
commission to give you till the 8~' to get this thing up to what the conditions are
stated and get the final product and they would look at it on the 8cn and you
basically wouldn't be loosing any time once again. If you think you could do it
within that time frame. That might be a request that you may want to consider.
Iverson: Sounds logical. I would request that this be, that I would be allowed to
submit the final plat for the P & Z Commission on the 8cn
MacCoy: Mr. Borup? Did you want to?

Borup: I still have some questions on that.
MacCoy: Yes you want to go ahead on that?
Borup: Specifically, a couple covenants is that something that is necessary in a
commercial development? Has been done in the past?
Stites: It's required of all plats.
Borup: Commercial or residential? Okay, perhaps, I don't know that you need to
have a homeowners association necessary to have a covenant. So that can be
done with out that, I believe, am I correct, or am I incorrect?
Stiles: I would think they would have something in place to take care of the cross
access and cross parking, those kinds of issues and what kind of maintenance
they will be required, and the maintenance of their landscaping. Those kinds of
issues al- need to be address.
Borup: Which can be with or without an association but something is going to
need to be addressed there. The other question is on the landscaping plans. In
requesting detailed landscaping plans, I-we're talking just around the perimeter
of the property, I assume we all realize you can't have plans if you don't have a
building. In this stage of plat without a building.
Stiles: Yes, I have had landscaping plans submitted in the past. The two
buildings that are there both underwent through the conditional use permit
process. So those detailed plans were included as part of their process before
they ever submitted for a building permit application.. My main concern is the
adequate set back from Meridian Road, that's been agreed to by the owner and
that's a consistent process that is done at the same time when the curb, gutter
and sidewalk, when all of that is completed there, so you don't-so it has an
uniform appearance for people coming down the street.
Borup: so you are looking at landscaping detail on Gem and Meridian?
Stiles: Yes.
Borup: I don't know that the applicant understood that. So you are not looking
for interior landscaping around the building or anything?
Stiles: No.
Borup: Did that clarify that sir?

Iverson: What I don't get, itdoesn't-doesn't the zoning and ordinances dictate
that the landscape is set along Meridian and (Inaudible) avenue for that zoning,
isn't there a zoning requirement?
Stiles: No, there is a building setback, but the landscape setback is not in the
ordinance, that was agreed to when this whole property was proposed to be
developed.
Iverson: Instead of detailed plans, I could discuss with the developer, if we show
as mentioned just the easements for the landscape easements.
Borup: You might want to get a little closer to the microphone, I'm not sure if
that's picking up.
Iverson: As mentioned in the condition, there is a mention of landscape
easements will that pretty well cover everything else? I mean detailed landscape
plans and letter of credit if this point again...There is no enforcement under the
building permit process for insuring that landscaping is provided.
Borup: Are these buildings going to be coming back for conditional use?
Stiles: No.
Borup: No design review?
Stiles: No.
Borup: So this is it?
Stiles: Yes.
Borup: Sir you do know where your access points are going to be?
Iverson: One I think...
Borup: So then there is no real reason why you couldn't develop a landscape
plan, you know you've got your access points already determined and you know
what your landscaping setbacks are going to be. So it looks like...

Everson: I assume under the building permit process that the zoning
requirements for not only building setbacks, but for landscaping and...
Borup: There is if it's conditional use or design review, which you are getting
away with not having to do that. So at this point, I believe the building

department is going to review the building and the structural aspects of that. This
started with the information he needed. It looks like it complies with items two
through ten, on the site specific comments.

First Meridian Plaza is a 4-lot commercial subdivision on 4.2-acres. The site is located on the
south side of Gem Avenue, between East 1st Street and Meridian Road. This development is
estimated to generate 500 additional (900 total) vehicle trips per day based on the Institute of
Transportation Engineers Trip Generation manual.
On April 5, 1995, the Commission acted on MCU-6-95, a restaurant with adrive-thru window
located on the west side of East 1st Street, approximately 200-feet south of Gem Avenue. On
April 9, 1997, the Commission acted on MCU-11-97, a restaurant located on the southwest
corner of East 1st Street and Gem Avenue. This report addresses the entire 4.2-acre site south of
Gem Avenue, between East 1st Street and Meridian Road.

Meridian Road is currently being improved to a 41-foot street section with curb, gutter and
sidewalk.
B. On April 5, 1995, the Commission acted on MCU-6-95, a restaurant with adrive-thru window
located on the west side of East 1st Street, approximately 200-feet south of Gem Avenue. On

April 9, 1997, the Commission acted on MCU-11-97, a restaurant located on the southwest
corner of East 1st Street and Gem Avenue. The applicant for those t~vo applications was
required to construct a 5-foot wide detached sidewalk on East 1st Street and provide a deposit
to the Public Rights-of--Way Road Trust Fund for the street improvements on Gem Avenue.
These requirements have been constructed and the moneys have been deposited.
C. Utility street cuts in new pavement less than five years old are not allowed unless approved in
writing by the District. Contact Construction Services at 387-6280 (with file numbers) for
details.
D. There is an existing 30-foot wide curb return driveway on East 1st Street located approximately
215-feet north of the south property line in alignment with Watertower Lane. District policy
requires 220-feet of separation between Gem Avenue and driveways on East 1st Street. This
driveway location was approved by the Commission on April 9, 1997, in MCU-11-97. Staff
recommends that the previous approval of this driveway location be re-affirmed with this
application.
E. There is an existing 24-foot wide driveway on Gem Avenue located approximately 185-feet
west of East 1st Street (measured near edge to right-of--way line). This driveway location was
approved by the Commission on April 9, 1997, in MCU-11-97. Staff recommends that this
driveway location be re-affirmed with this application as well.
F. The District is currently reconstructing Meridian Road with curb, gutter and sidewalk to a 41-
foot street section. The District's approved construction drawings for the Meridian Road
project show the applicant's driveway on Meridian Road located 300-feet south of Gem Avenue
(measured near edge to face of curb). This driveway will be constructed as a 30-foot wide curb
return driveway with 15-foot radii. This location meets District policy's required 220-feet of
separation between the driveway and Gem Avenue.
G. District policy states that direct access to arterials and collectors is normally restricted and that
the developer shall try to use combined access points. In accordance with District policy the
applicant should be required to provide a recorded cross access easement among all internal lots
and to the parcel to the south for access to .the public streets prior to issuance of a building
permit (or other required permits). The District intends to require a similar agreement of the
owners of the parcel to the south if they are the subject of a future development application.
H. Graveled driveways abutting public streets create maintenance problems due to gravel being
tracked onto the roadway. In accordance with past action by the District the applicant should
be required to pave the driveway its full width and at least 30-feet beyond the edge of pavement
of Meridian Road.
As required by District policy, restrictions on the width, number and locations of driveways,
may be placed on future development of this parcel.
J. The existing transportation system will be adequate to accommodate the additional traffic
generated by this proposed development with the requirements outlined within this report.

The following Site Specific Requirements and Standard Requirements must be met or provided
for prior to ACHD approval of the final plat:
Site Specific Requirements:
1. The existing 30-foot wide driveway on East 1st Street, located approximately 215-feet north of
the south property line in alignment with Watertower Lane, is approved with this application.
Install a standard 36"x 36" STOP sign at the driveway intersection.
2. The existing 24-foot wide driveway on Gem Avenue located approximately 185-feet west of
East lst Street (measured near edge to right-of--way line) is approved with this application.
Install a standard 36"x 36" STOP sign at the driveway intersection.
The District is currently constructing a 30-foot wide curb return driveway on Meridian Road
with 15-foot radii located 300-feet south of Gem Avenue (measured near edge to face of curb).

6. Other than the access points specifically approved with this application, direct lot or parcel
access to East 1st Street and Meridian Road is prohibited. Lot access restrictions, as required
with this application, shall be stated on the final plat.
Standard Requirements:
A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACHD Planning and Development Supervisor. The req ~ s
ACHl~ Commission action Those items shall be rescheduled for discussion with the
Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action
do not provide sufficient time for District staff to remove the item from the consent agenda and
report to the Commission regarding the requested modification, variance or waiver. Those
items will be acted on by the Commission unless removed from the agenda by the Commission.
After ACRD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two weeks of the
action and shall include a minimum fee of $110.00. The request for r . onsid ration shill

specifically iden ify each reariirement to he reconsidered and include written documentation of
data that was not available to h ommission at the time of its original decision The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless awaiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.
Conclusion of Law:
ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

Brian Iverson (Earth Tech) has mentioned to me that the application for this
subdivision has been re-scheduled to 8-31-98. After review of the comments
there are two other items that I would like to discuss. These items are:
1. Item ten under Site Specific Comments relates to restrictive covenants.
My intentions are not to have an owners association and therefore see no
need for restrictive covenants. The planning and zoning process is restrictive
enough.
2. Under General Comments and Site Specific Comments there is no mention of
landscape requirements. I believe that this is proper, because there should be
no landscape requirements during a commercial subdivision process. The
landscape issue is part of the building permit process.

Gentlemen:
We have reviewed the staff comments on the application for the above project and the
following responses correspond numerically with those comments:
GENERAL CONDITIONS
1. The Eightmile Lateral crossing the north pazt of the project was tiled in the Spring of
1997. Prior to tiling the lateral, approval of the Nampa & Meridian Irrigation District
ant the City of Meridian was obtained.
2. No existing wells or septic systems have been found on the property.
3. Test pit have been dug on the property and ground water elevation determined. The
plans and construction of Phases I and II of the development (Godfathers/Blimpies &
Rockets Restaurant) established the information requested.

4. A 5' wide sidewalk has been constructed along Last li' Street with the approval of the
City and ACI-ID. The sidewalk along Meridian Road will be constructed under
ACHD's Meridian Road project currently under construction. The Developer has
paid moneys to ACHD's Trust Fund for the curb, gutter and sidewalk improvements
along Gem Avenue.
5. The Plat is being reviewed by the Ada County Street Name Committee. Upon
approval of an acceptable name, a letter of approval will be provided.
6. During Phases I & II two fire hydrants were installed after coordination with the
Water Works Superintendent. Future phases will also be coordinated with the
Superintendent through the building permit process.
7. A review or FEMA's "Map of Flood Prone Areas' for the area shows no flood plains
effecting the project area.
8. This response will be submitted prior to 12:00 noon, August 11 `". Ten copies of the
revised Preliminary plat will be submitted.
SITE SPECIFIC COMMENTS
1. No comment required.
2. Landscape easements will be added to the plat. The Applicant does not agree that
landscape plaru and a letter of credit or cash for the landscape improvements should
be a condition for the City's signature on the final plat. The City has the authority to
assure compliance with landscaping regulations through the building permit process.
Phases I & l!'s landscaping was approved and constructed under this process.
3. The location of the Eightmile Lateral easement will be shown on the final plat and
Note 7 revised.
4. The plat will be stamped and signed by a registered land surveyor and the owner will
sign the Certificate of Owners and cause the execution of the Acknowledgment.
5. Scale bat will be corrected
6. The south line of Lot 1 will be dimensioned.

This Declaration and Imposition of Easements, Restrictions,
Covenants and Conditions is made this day of November, 1998, by
Wild Shamrock Partnership, an Idaho limited liability partnership,
12301 West Explorer Drive, Suite 240, Boise, Idaho 83703,
hereinafter called "Declarant".
ARTICLE I
RECITALS
1.1 The Declarant is the present record title holder of
certain real property situated in the County of Ada, State of
Idaho, more particularly described as First Meridian Plaza
Subdivision, according to the official plat thereof, on file in the
office of the County Recorder for Ada County, State of Idaho, and
recorded as Instrument No.
in Book pages
and Book of Plats, hereinafter referred to as the
"Property"
1.2 The Declarant is desirous of subjecting the Property to
cross-easements for access to the lots located within the Property
and to covenants, conditions, restrictions and reservations
hereinafter set forth to ensure proper design, development,
improvement and use of the Property, by Declarant and persons,
associations, corporations and other entities who or which may
subsequently acquire an interest in the Property.

ARTICLE II
IMPOSITION OF EASEMENTS
2.1 Declarant hereby declares and imposes upon the Property
those .certain non-exclusive cross-easements for ingress and egress
for vehicular, pedestrian, and utility access for the benefit of
lots 1 through 4 as more particularly depicted and superimposed on
a copy of the plat, attached hereto as Exhibit A, which easements
are more particularly described on Exhibit B attached hereto. The
easements depicted on Exhibit A and described on Exhibit B shall
hereinafter be referred to as "easements".
2.2 Restriction on Use of Easements. The owners of the lots
located within the property shall have the right to use the
easements so long as the use of the easements is in compliance with
applicable laws, restrictions, and rules imposed by Declarant and
its successors.
2.3 Maintenance and Repair of Easements. The respective
owners of the lots located within the subdivision shall be
responsible for the costs of normal maintenance and repair of the
easements based upon the proportionate use of the owners of the
respective lots within the property, their agents, guests, .and
invitees.
2.4 Relocation of Easements. Declarant reserves the right to
relocate the easements from time to time at Declarant's sole
discretion, so long as the relocation is at Declarant's expense,
and does not materially impair the access from public right-of-ways
to the respective lots located within the Property.

OWNER'S ASSOCIATION
At such time as Declarant conveys to a third party ownership
of one or more of the lots within the Property, an Owner's
Association shall be established for the operation, maintenance and
control of the easements. The terms and conditions of the Owner's
Association shall incorporate standard terms and conditions of
Business Park Owner's Associations then in use in Southwest Ada
County at the time of the first conveyance of the lot within the
Property.
ARTICLE IV
SUCCESSORS AND ASSIGNS
The easements and conditions thereof shall inure to be binding
upon the successors, transferees, and assigns of Declarant.

(Request for Preliminary/Final Plat Approval)
We have reviewed this submittal and offer the following comments, as conditions of the
application. These conditions shall be considered in full, unless expressly modified or
deleted by motion of the Meridian City Council:
GENERAL COMMENTS
1. Any existing irrigation/drainage ditches crossing the property to be included in this
project, shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by
the appropriate irrigation/drainage district, or lateral users association, with written
confirmation of said approval submitted to the Public Works Department. No variances
have been requested for tiling of any ditches crossing this project.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape irrigation.
3. Determine the normal high groundwater elevation, and submit a profile of the subsurface
soil conditions as prepared by a soil scientist with street development plans.
4. Provide 5' wide sidewalks in accordance with City Ordinance Section 11-9-606.8.
5. Please submit a copy of the Ada County Street Name Committee's final approval letter
for the Subdivision name, lot and block numbering, and street names. Make any
corrections necessary to conform.
6. Coordinate fire hydrant placement with the City of Meridian's Water Works
Superintendent.

7. Indicate on the final plat map any FEMA Flood Plains affecting the area being platted,
and detail plans for reducing or eliminating the boundary.
8. Respond, in writing, to the each of the comments contained in this memorandum by
12:00 noon Tuesday, August 11~`. Submit ten copies of the revised Preliminary Plat Map
to the City Clerk's Office a minimum of one week prior to the meeting before the
Meridian City Council.
SITE SPECIFIC COMMENTS
Sanitary sewer and water service to this site was installed with the construction of the
GodfathersBlimpies phase.
2. Submit detailed landscaping plans, including sizes and species of vegetation and details
of walkways, for approval prior to signature on the final plat. A letter of credit or cash
will be required for these improvements prior to signature on the final plat. All
landscaping is to be completed prior to obtaining certificates of occupancy. Add
landscape setback easement lines to plat.
3. Indicate on the final plat map, the location of the Eight Mile Lateral easement, and revise
note #7 to specifically state "Eight Mile Lateral".
4. The final plat map must be stamped and signed by an Idaho licensed land surveyor, and
the owner must sign the Certificate of Owners and cause the execution of the
Acknowledgement.
5. Correct the scale bar shown on the final plat map to show 1"=50' as shown.
6. Add the distance dimension to the south line of Lot 1, Block 1.
7. Please add or correct the following final plat notes:
(3.) ...time of resubdivision,
(8.) ...established seasenel normal ground water.. .
8, The delta angle shown on the face of the plat, for curve 2, differs from the same
information in the Certificate of Owners.
9. Please add the delta angle, as noted in the Certificate of Owners, to the face of the plat for
the spiral curve.
10. Submit a copy of the proposed restrictive covenants for review by City legal counsel and
approval by the Meridian City Council.

STORMWATER MANAGEMENT RECOMMENDATIONS
We recommend that stormwater be pretreated through a grassy Swale prior to
discharge to the subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of this project
should obtain current best management practices for stormwater disposal and
design a stormwater management system that is preventing groundwater and

First Meridian Plaza (Phase I)
The District would normally require a cash bond of $1,'785.00 for 210-
feet of 5-foot wide sidewalk at a rate of $8 .50 (includes 10 o for admin. ,
engineering) for subject street frontage. I have signed off the Permanent
Occupancy for the first phase of this project without collecting the cash in
anticipation that the City of Meridian will require the developer to
construct the sidewalk this spring. Sheri Stiles of the Planning Department
assured me that your staff would follow up on this requirement. This will
prevent our two agencies from double charging the developer for the same
