Page 1 of 1 DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR DEE JAY SUBDIVISION TO BE COMMONLY KNOWN AND REFERRED TO AS STRATFORD BUSINESS PARK The undersigned Howell -Murdoch Development Corporation, an Idaho Corporation (hereinafter referred to as "Declarant" or "Grantor"), being the owner of that real property located in Ada County, Idaho and legally described on Exhibit "A" attached hereto hereby adopts the following Declaration of Covenants, Conditions and Restrictions which shall apply to and run with that property described on Exhibit "A" attached hereto. (Said property is legally described as Dee Jay Subdivision. However, it shall be known as and commonly referred to as "Stratford Business Park".) The Covenants, Conditions and Restrictions applicable to Stratford Business Park are as follows: Article 1: Covenants Running With The Land; Equitable Servitudes 1.1 Covenants, Conditions and Restrictions: This Declaration hereby establishes and sets forth for the mutual benefit of Declarant and future owners of the property or any Lot therein, protective provisions, covenants, conditions, restrictions, agreements, charges, liens and other matters herein set forth (collectively referred to herein as the "Restrictions" or CCR's"), which are binding upon the Property. These are expressly and exclusively for the use and benefit of the Property and of each Lot and of each and every person or entity who now or in the future is an owner, user or occupant of the property or any Lot therein. These Covenants may be enforced by Declarant or by any Owner after Declarant no longer owns any property in the subdivision or property annexed into the subdivision. 1.2 Runs with Land: These Restrictions shall run with the land described in Exhibit A. Nothing herein shall be construed to cause this Declaration to apply to or bind any other property of Declarant not specifically described in DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 1 of 14 Exhibit "A". However, these Restrictions are intended to benefit other property of Declarant in proximity to the subject property, but which other property may not be bound by these Restrictions. 1.3 Common Plan; Preservation of Value: Declarant intends to subdivide and sell and/or lease the Property for various office, business, commercial and/or industrial uses and desires to subject the Property to these Restrictions in order to implement a uniform, general and common plan designed to preserve the value and high quality of the property for the benefit of the Declarant and other owners of the Property. 1.4 Appropriate Development: The Property is subjected to these Restrictions to insure appropriate development, improvement and maintenance of each Lot; to protect the Declarant and Owners of Lots against improper use which could depreciate the value of their Lot; to preserve the natural beauty of the Property after development in accordance with these Restrictions; to provide a means of preventing the erection of improperly designed or constructed structures; and, in general, to provide for a high quality of improvement on the Property, and thereby to enhance the value of investments made by Declarant, and Owners of Lots or of adjoining property owned by Declarant. 1.5 Transfers Subject to these Restrictions: The Property and each Lot or any part of the property shall be held and shall be conveyed, transferred, sold, hypothecated, encumbered, leased, rented and used subject to these Restrictions. Any documents executed in connection with any type transaction described herein or any similar transaction should include reference to this Declaration. Any such transaction shall hereinafter be referred to as a "transfer". 1.6 Acceptance of Restrictions: The acceptance by any person of a deed, lease or other instrument of transfer of any property legally described on Exhibit A, or which is in the chain of title, including judicial foreclosures, trustees' sales and tax sales shall be deemed an acceptance of all of such Restrictions. The burden and obligation to perform in accordance with the Restrictions shall be part of the consideration for the transfer of any Lot pursuant to such Deed or other instrument of transfer and shall be deemed an agreement by such person that Declarant and each of the other Lot Owners shall be entitled to enforce all of such Restrictions. DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 2 of 14 1.7 Exclusion of Pressurized Irrigation Lot from CC&R's: Any Lot in this subdivision or any part of the property therein which is dedicated to the use of a pump house for the pressurized irrigation system shall be excluded from the effect of these CC&R's. Article 2: Plans: Approvals 2.1 Design Standards: All improvements and landscaping of any kind shall conform to these CC&R's and to the Design Standards referred to below. 2.2 Approval by Board (the Architectural Control Committee): No structure, improvement or landscaping shall be constructed, nor alteration to the exterior of a structure or improvements of landscaping be made (hereinafter collectively referred to as the "Improvements" or the "Construction") unless such has received the prior approval of the Architectural Board ("Board") which shall act as the Architectural Control Committee. Plans shall include drawings and specifications showing adequately for interpretative purposes the landscaping plan, the building and other improvements, the elevations, colors, grading, parking, loading areas and drainage. 2.3 Basis of Approval: Approval shall be based among other things on adequacy of site dimensions; conformity and harmony of external design with neighboring structures and uses; effect of location and use of improvements on neighboring sites, operations, improvements and uses as well as compatibility with surrounding development. 2.4 Plans Submission: Prior to submission to governmental authorities, the Owner shall submit Plans, in such form as may reasonably be required by the Board for approval. As quickly as possible but within thirty (30) days after receipt, the Board shall either (a) approve the Plans or (b) reject the Plans, stating the reason for the rejection and where appropriate, the changes, modifications and/or correction which the Board demands, as a condition for approval. In the event the Board fails to approve or disapprove the Plans within thirty (30) days after receipt thereof, such approval will not be required. 2.5 Disapproval: The Board may disapprove any and all Plans submitted on any reasonable ground including but not limited to any of the following: (a) failure to comply with any of the provisions set forth in this Declaration or the Design Standards attached hereto; (b) failure to include information in the Plans DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 3 of 14 as may have been reasonably requested by the Board; (c) incompatibility of exterior design or material with any existing structure or any structure proposed and previously approved by the Board; (d) inadequacy of the number of on-site parking spaces or objection to the design and location of the parking area or spaces, loading docks, storage and refuse areas, walls, fencing, irrigation, lighting, utility placement, landscaping, signage, grading or color scheme; (f) objection to the color scheme, finish or portion, style of architecture, height, bulk, appropriateness of any proposed improvement in relation to other improvements existing or proposed and approved by the Board; (g) objection to the landscaping plan as not conforming; (h) any other matter which in the reasonable judgment of the Board would render the proposed improvements or use discordant with the improvements on the Property, either then existing or planned and previously approved by the Board. 2.6 Approval Good for Three Years: In the event Owner does not commence construction within three (3) years after approval of Plans, said approval shall then terminate, in which event Owner shall be required to resubmit the Plans to the Board for approval prior to engaging in construction. After construction of any improvement has commenced, the work shall be diligently completed and in any event shall be completed within one (1) year of commencement of construction. Failure to comply with this section shall constitute a breach of these Declarations and subject the defaulting party or parties to all enforcement procedures set forth herein in addition to any remedies provided for in equity or at law. 2.7 Code Compliance: In the event any portion of these CC&R's are at a variance of governmental ordinances or the like, then these shall be deemed amended to comply with the governmental requirements. Responsibility for compliance with any and all applicable governmental rules, building codes, laws, ordinances, regulations and other codes shall be the responsibility of each individual Owner. No approval hereunder shall be construed to impose any liability on Declarant or the Board in the event the Plans fail to so comply. Neither Declarant nor the Board shall be responsible for structural or other inadequacy or defects of any kind or nature whatsoever in the Plans or in the structure or improvements erected in accordance therewith. Article 3; Regulation of Uses 3.1 Allowed Uses: Any and all Lots may be used for any of the following: Hotel; Motel; Restaurant; Commercial (as allowed by Meridian Zoning DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 4 of 14 Ordinance); Retail; Service -commercial; Financial; Athletic facilities; Office; Research and development; Warehouse; Distribution or Manufacturing purposes; "Flex -Space buildings; or any related and compatible uses. Declarant may designate that certain portions of the Property still owned by Declarant shall be restricted for only certain uses at its sole discretion, and Declarant may, on any Lots still owned by Declarant, restrict future uses thereon. All uses of any part of the property shall be in conformity with all Meridian City Zoning ordinances and building codes, and any other applicable local, state or federal standards. In the event that a Meridian zoning rule or ordinance is in conflict with a designated use, then the zoning rule or ordinance shall apply. 3.2 Prohibited Uses: The following uses are prohibited in this subdivision: Oil drilling, oil development, gravel operations, refining, mining operations or the like, slaughter house or rendering operation, dog or animal kennels unless completely contained indoors, livestock or poultry operations, auto body shop, auto or equipment wrecking yard. 3.3 Hazardous Materials: No toxic materials as regulated or defined by any city, state or federal laws, rules or regulations shall be disposed of on, in or under the property described herein. For purposes here "toxic materials" includes but is not limited to "hazardous substances", "hazardous materials" or "toxic substances" defined in any local, state or federal statutes or regulations including but not limited to the Comprehensive Environmental Response Compensation on Liability Act, 1980, as amended 42 USC 961 et. seg.; Hazardous Materials Transportation Act, 49 USC 1801 et. sea.; The Resource and Conservation Recovery Act, 42 USC 6901 et. sea.; and related laws. No commercial storage of such materials shall be allowed at any time. Any owner may use such materials in the owner's business conducted on the premises so long as such use complies with all local, state and federal rules, laws and ordinances and so long as no other owners are adversely affected by such use. 3.4 Offensive Activity; Nuisance: No noxious or offensive trade, business or activity shall be carried on, about or upon any Lot nor shall anything be done thereupon which may be or become an annoyance or nuisance within the Property or which would adversely affect the property values of other Lots including without limitation distillation of bones, dumping disposal, incineration, DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 5 of 14 or reduction of garbage, sewage, offal, dead animals or refuse, fat rendering, stockyard or slaughter of animals. 3.5 Petroleum: No Lot shall be used for the refinery of petroleum or its products. No storage of petroleum or like products shall be allowed except that a gas station or service station shall be allowed so long as all governmental rules regarding the storage tanks are complied with. Fuel or manufacturing materials to be actually used on the premises may be stored on the premises (in such amounts as is the minimum necessary for the manufacturing process or use) so long as the storage facilities meet all local, state and federal statutes, rules and regulations concerning such storage and the owner assumes all liability relating to said use and storage. 3.6 Exteriors; Driveways: All driveways, parking areas, loading areas, and any vehicle or equipment storage areas shall be paved and properly maintained. Structure exteriors and other outdoor areas on each Lot shall be maintained in a clean, neat and careful manner commensurate with high quality standards of care. All portions of any Lot not built upon, or paved, whether before or after the construction of improvements, shall be kept weed free. In the event that any Owner fails to keep weed free after 15 days notice from the Board or Declarant, then the Board or Declarant may remove the weeds and the Owner shall pay the cost thereof plus a 25% management fee to the Board or the Declarant. 3.7 Landscaping Requirements: Each Owner owning a Lot abutting Stratford Street shall install and properly maintain, water and fertilize a twenty (20) foot landscape buffer along Stratford. This 20 feet is measured from the property line not from the back of the sidewalk. In addition to this 20 foot landscaping strip, the Owner shall install and maintain similar landscaping from the back of the sidewalk to the property line. (The net effect is that the landscape buffers along Stratford Street will be approximately 26 feet in total width.) On all Lots abutting Water Tower or any other public street then this landscape buffer shall be 15 feet in width measuring from the back of the curb. All landscaping area shall be composed of sod, an underground sprinkler system, and at least one tree for every 100 feet of frontage or portion of 100 feet.(For example 150 of street frontage would have 2 trees.) Shrubs are encouraged. Bare ground is not permitted. In the event that this buffer area is DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 6 of 14 not properly landscaped the Declarant and/or the Board (in addition to any other rights created herein) shall have the right, but not the obligation, to properly landscape or maintain this buffer area at the sole expense of the Owner and the cost thereof plus a management fee of 25% shall be paid by the Owner. All other landscaping shall be maintained in a quality manner and all Lots shall have an underground pressurized sprinkler system to all areas of Landscaping. All Landscaping shall be completed within 60 days of completion of the building. 3.8 Exterior: The exterior of all structures shall be maintained in good, neat condition and repair, including regular maintenance, painting, window washing and replacement. 3.9 Other Buildings: No trailer, mobile home, shed or other out building may be erected or located on any Lot except in the course of a diligently pursued construction project and then only for the reasonable period of construction. Following construction such shall be removed. All construction shall be performed in a manner designed not to interfere with the use of other Lots by their Owners and shall be performed as provided in the Design Standards. 3.10 Auxiliary: Structures: Auxiliary structures, antennas, aerials, cables or other mechanisms related to communications, all electrical and mechanical apparatus, equipment, fixtures, conduit, ducts, vents, flues and pipes mounted or placed upon the roof surface, or extending above the roof line of any building or structure, shall be reasonably screened from view from the streets and from buildings on other Lots in an architecturally treated manner, or as approved by the Board. 3.11 Fences: Any Lot adjoining a canal or water lateral shall have a fence (which is in compliance with Meridian and Nampa -Meridian Irrigation District Rules and Regulations), approved by the Board, restricting access to the canal or lateral. Said fence shall be installed (if not already done by Declarant) and maintained by the Lot Owner. Any other fences shall be approved by the Board. Any chain link fence on the sides or front of a Lot MUST have vinyl slats for a visual barrier. If a perimeter fence is installed, that portion of the perimeter fence on any Lot Owner's property shall be maintained by that respective Owner. DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 7 of 14 3.12 Parking and Loading: For each building constructed, there shall be provided parking areas on the Lot, laid out and constructed in accordance with the Design Standards and the City of Meridian. Such parking areas shall be constructed of all weather, dust -free surface. For any Improvement constructed on a Lot, sufficient parking areas must be located on the Lot so as to accommodate the foreseeable parking requirements of the Improvement's users. No off-site parking shall be permitted by Owners, employees, customers or delivery trucks. The number of parking spaces shall be at least the number required by the City of Meridian parking ordinances. All loading and unloading of vehicles shall be conducted upon the Lot. Sufficient loading and unloading places shall be provided on each Lot to serve all buildings thereupon. Article 4: Architectural Board The initial Board shall be Kevin A. Howell, Dave Williams and James W. Kiser, and the signature of approval by any one of them shall constitute approval of the Board. The address of said Board shall be: Stratford Business Park c/o Kevin Howell Construction, 1087 W. River St., Suite 250, Boise, Idaho 83702. No Board member shall be personally liable in any way for any action or any inaction taken or not taken pursuant to these Covenants, Conditions and Restrictions or the Design Standards attached. Each Owner by accepting a deed to a parcel or Lot in Stratford Business Park agrees to and does waive any and all claims against the Board or a member of the Board for any action or inaction of the Board or a member thereof. Article 5: Water Rights; Pressurized Irrigation 5.1 Water; Water Rights. Each party accepting and recording a deed to any property in this Subdivision or occupying any property in this Subdivision acknowledges and understands and agrees to the following: a) that such property is in an irrigation district, including but not limited to Nampa & Meridian Irrigation District; b) that the water in said district has not been transferred from this property; c) that each Owner of any Lot is subject to all assessments levied by any irrigation district or water supplier; d) that each Lot Owner shall be responsible to pay any levies of the irrigation entity, or the water supplier attributable to that Lot; e) that these assessments are a lien upon the Lot. Each Owner or occupant of any Lot in this subdivision DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 8 of 14 specifically releases and waives any and all claims of any kind against Declarant, its agents, employees, officers and directors relating to water or irrigation water in this subdivision. 5.1 .1 Irrigation District Agreements. The Lots in this Subdivision shall be subject to any existing or future recorded agreements or license agreements with Nampa & Meridian Irrigation District or other irrigation entity regarding this Subdivision and irrigation water. These agreements include but are not limited to the following: a) (in progress will add recoding data when done). 5.2 Pressurized Irrigation System. Irrigation water, when seasonally available, will be supplied through Nampa & Meridian Irrigation District ("District") via a pressurized underground irrigation system (PUIS) constructed for this subdivision. This system shall be owned maintained and operated by District. Each Lot Owner shall pay pro -rata for the costs of water, maintenance and operation of the PUIS. Each individual Lot will have a control valve on the pressurized irrigation system to allow irrigation water onto that individual Lot. Each Lot Owner shall be responsible for his own irrigation system on his own Lot downstream from this control valve (e.g. filters, screens, sprinkler lines and sprinkler heads). Each Owner shall install a sufficient sand screen or similar filter set up to keep sand and other irrigation ditch debris out of the Owner's irrigation system. Each Owner shall clean and maintain their own screens and filter systems. Any Owner damaging the main PUIS system shall be responsible for all of the costs of that damage. 5.3 Water Costs. All irrigation water costs shall be paid by the Owners either from individual assessments against each Lot by Nampa & Meridian Irrigation District, or other water suppliers. Each Lot Owner shall pay their pro - rata share of all the water costs regardless of actual water used. Each Lot Owner shall use all reasonable efforts to conserve and not waste irrigation water. 5.4 Warranty: Declarant shall transfer to District (as the case may be) any manufacturer's warrantees on any of the materials, pumps, or parts that were put into the PUIS. Declarant may warrant to District that each phase of the PUIS as it is completed and transferred to District will be free of defects in DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 9 of 14 materials or workmanship for one full year following the date of completion of that part of the PUTS. In the event a defect is discovered during that one year time period Declarant agrees, at Declarant's expense to repair or remedy that defect. After that one year period, Declarant shall have no further liability to District, or any Lot Owner for any repairs to the PUIS. 5.5 Cross Connects Prohibited. No Lot Owner, tenant or occupant of any Lot in the subdivision shall install any cross connections or tie-ins, or allow any to exist on a Lot, between the PUIS referred to in this agreement and any other pipes, conduits or water systems whether such other systems are carrying potable domestic water or carrying other used, waste or irrigation water, unless such are specifically approved and agreed to the entity supplying supplemental or extended season water and the District. The Owner of any cross connects shall have full liability and responsibility for any losses, injuries or damages caused by or related to that cross connection. District or Declarant or the entity supplying the potable water (or their designated agents) shall have the right at any time to go onto any Lot or parcel of the property covered by this Agreement and remove any unapproved cross connections and an easement is specifically granted therefore. The cost of removal of any unapproved cross connects shall be paid by the Owner of the Lot where the cross connect was located within 10 days of billing. 5.6 Water Unreliable. The area of the country where this subdivision is located is desert. Irrigation water is not always reliable and the water is not unlimited. Irrigation water may not be available due to drought, harsh weather conditions, government actions, system breakdowns, transmission failures, overuse by Lot Owners or any other causes. 5.7 Rotation. No Lot or any Lots annexed into the subdivision shall have any right to, or assurance of, a continuous or unlimited supply of irrigation water from the PUIS. Nor is any Lot guaranteed enough water from the PUIS to irrigate all of the landscaping on the Lot. Each Lot shall be subject to, and each Lot Owner by accepting a deed to a Lot in this subdivisions agrees to be bound by, and to comply with, any rules or regulations for the use and rotation of irrigation water between the Lots as set out by the Declarant or by District. The Board or District may establish a water rotation schedule for all Lots and common areas in this Subdivision and general rules for the times and use of irrigation water. Failure to adhere to the rotation schedule or rules may, following notice from the Board, result in suspension of the right to use irrigation water. 5.8 No Liability. Neither the District nor the Declarant shall have any liability OF ANY KIND to any Lot Owner, tenant, or any others for any losses or damages relating in any respect to the irrigation system, or irrigation water, or the lack thereof, including but not limited to damages to, or loss of lawns, landscaping, trees, shrubs, gardens or the like caused by the lack of or shortage of irrigation water. Each Owner accepts the risk of loss or damage due to the unavailability, shortage or lack of irrigation water. Each Lot Owner, by accepting a deed to the property, and each tenant or occupant, by occupying the premises, specifically waives any and all claims of any kind against the District and Declarant, their agents, employees, officers directors and shareholders for any loss or damage relating in any respect to the water, or the supply of water. Each Lot Owner and occupant agrees, during times of shortage or lack of water, to use their own domestic water supply. 5.9 Supplemental Water. Supplemental water (in addition to the irrigation water from District) for the irrigation system may be supplied by the City of Meridian, another entity or from another source. The costs of this supplemental water shall be paid pro -rata the same as the other irrigation waters set out herein. Article 6: Easements; Miscellaneous. 6.1 Easements of Access: Grantor expressly reserves, for the benefit of all the Property, reciprocal easements of access, ingress and egress for all Owners to and from their respective Building Lots for installation and repair of utility and drainage services in the easement areas designated on the plat, and for necessary maintenance and repair of any Improvement including fencing, retaining walls, lighting facilities, mailboxes and sidewalk abutments, trees and landscaping. 6.2 Drainage and Utility Easements: Notwithstanding anything expressly or impliedly contained herein to the contrary, this Declaration shall be subject to all easements heretofore or hereafter granted by Grantor for the installation and maintenance of utilities and drainage facilities that are required DEE JAY SUBDIVISION [STRATFORD BUSINESS PARK] COVENANTS, CONDITIONS AND RESTRICTIONS Page 11 of 14 for the development of the Property. In addition, Grantor hereby reserves the right to grant additional easements and rights-of-way over the Property, as appropriate, to utility companies and public agencies as necessary or expedient for the proper development of the Property until close of escrow for the sale of the last Building Lot in the Property to a purchaser. 6.3 Term: The easements created hereunder shall be perpetual, subject only to extinguishment by the holders of such easements as provided by law. The covenants, conditions, restrictions and equitable servitudes of this Declaration shall run until December 31, 2025, unless amended as herein provided. After December 31, 2025, such covenants, conditions and restrictions shall be automatically extended for successive periods of ten (10) years each, unless amended or extinguished by a written instrument executed by three-fourths (3/4) of the Lot Owners subject to these CC&R's. 6.4 Amendment by Grantor: Until the first deed is recorded, the provisions of this Declaration may be amended, modified, clarified, supplemented, added to (collectively, "amendment") or terminated by Grantor by recording a written instrument setting forth such amendment or termination. 6.5 Amendment By Owners: After the sale of the first Lot is recorded, then these CC&R's may be amended by recorded instrument reflecting the votes, if a vote is held, or the written consent of Owners, holding two thirds (2/3) of the votes of the Owners. For voting purposes Grantor shall have three (3) votes for every Lot owned and every other Lot (except the pump house Lot) shall have one vote. Such amendment shall be effective upon its recording with the Ada County Recorder. Statement of Intent 1.1 It is our intent to build, with the help of our buyers, owners, builders and tenants, a respected and desirable business park in the City of Meridian. This goal can be accomplished through the application of design standards and the cooperation of all those performing under them. The proper landscape design, building elevations and attention to detail will assure the creation of a pleasant working environment which will lead to business success and property value enhancement. 1.2 The design standards described here are intended to apply to developments within Stratford Business Park and apply to all parcels in the business park except for the Common Area pump house lot for the common pressurized irrigation system. 1.3 The Architectural Control Board shall be the Board of Directors of the Lot Owners Association, and shall be referred to here and in the CC&R`s as the "Board". The Board may allow variance from these Standards for particular cases. This variance from the Standards will only apply in their specific cases and parcels, and will not set a precedent for other variances. 1.4 We encourage innovative design but discourage the flamboyant. This property is located off Stratford Drive, directly north of the State Law Enforcement facility and south of Meridian Cemetery property. A variance application was submitted and approved for block lengths exceeding 1,000 feet. The City Council waived the requirement for tiling of the Hunter Lateral that crosses the northeast comer of the property. GENERAL REQUIREMENTS 1. Any existing irrigation/drainage ditches crossing the property to be included in this project shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. r 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. We have assumed that the 20 -foot setback area will be landscaped in Lot 2 of Block 1 and Lot 1 of Block 2 when those lot owners submit their individual site plans for approval by the City.. There is not commonownership landscape lot or strip that would require landscaping by the developer. A clarification of this. issue is requested of the City. Also, a detailed fencing plan was submitted with the improvement plans on Sheet 3. 3. A six-foot perimeter chain link fence will be constructed along the northern and eastern boundaries of DEE JAY Subdivision as shown on Sheet 3 of the improvement plans. Currently, a six-foot chain link fence exists along the southern boundary. Also, since a landscape setback is reserved along S. We have reviewed this submittal and offer the following comments as conditions of the application. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: GENERAL COMMENTS The final plat conforms to the approved preliminary plat. This property is located off Stratford Drive, directly north of the State Law Enforcement facility and south of Meridian Cemetery property. A variance application was submitted and approved for block lengths exceeding 1,000 feet. The City Council waived the requirement for tiling of the Hunter Lateral that crosses the northeast corner of the property. GENERAL REQUIREMENTS 1. Any existing irrigation/drainage ditches crossing the property to be included in this project shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non- domestic purposes such as landscape irrigation. 3. Coordinate fire hydrant placement with the City of Meridian Public Works Department. 4. Make any corrections necessary to conform to the Ada County Street Name Committee's final approval letter for the subdivision name, lot and block numbering, and street names. Submit three copies of the revised final plat map to the Public Works Department SITE SPECIFIC REQUIREMENTS 1. Applicant is to comply with all terms and conditions of the preliminary plat. 2. Submit detailed landscape and fencing plan for review and approval prior to signature on the final plat. A letter of credit or cash will be required for the improvements prior to signature on the final plat. 3. Permanent perimeter fencing on the north, east and south boundary lines is to be installed prior to applying for building permits. Coordinate details with City staff. A letter of credit or cash for these improvements will be required prior to signature on the final plat. 4. Provide five -foot -wide sidewalks in accordance with City Ordinance Section 11-9-606.B. 5. Sanitary sewer service to this site will be via an extension from the existing mainline in Stratford Drive. Applicant will be responsible to construct the sewer mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Sewer manholes are to be provided to keep the sewer lines on the south and west sides of centerline. 6. Water service to this site will be via an extension from the existing main line in Stratford Drive. Applicant will be responsible to construct a 12 -inch water main to and through this proposed development. Subdivision designer to coordinate routing with the Public Works Department. 7. All street signs, road base, street lights, pressurized irrigation system, domestic water system (activated fire hydrants), and fencing, if required, are to be installed prior to obtaining building permits. 8. Applicant has not indicated whether the pressurized irrigation system within this development is to be owned and maintained by the Nampa & Meridian Irrigation District or if it is their intention for the system to be owned and maintained by the business owners association. If the system within this development is to remain private, complete plans and specifications shall be reviewed by the Public Works Department as part of the development plan review process. A draft copy of the pressurized irrigation system O&M manual must be submitted prior to plan approval, and the final complete copy, including as -built drawings, shall be required prior to the City's final subdivision approval. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. Install 250 -watt, high-pressure sodium streetlights at locations designated by the Public Works Department. Typical locations are at street intersections and/or fire hydrants. Streetlights are to be operable prior to obtaining building permits. All streetlights shall be installed at subdivider's expense. A letter of credit or cash will be required for streetlights prior to signature on the final plat. 10. Verify approvals from Ada County Highway District and Meridian City -Rural Fire District for configuration of temporary turnaround. They have a road coming through here that will stub into this 20 -acre parcel where the Police Department's apparently taking 10 acres of this site. I would like to amend one of our site-specific requirements on Page 2, Site - Specific Requirement No. 2 to delete the last sentence of that paragraph that we won't require a letter of credit or cash. We wanted the detailed landscape plan just so we had that on record so that we could have a consistent treatment, landscape treatment on Stratford and didn't have to negotiate with each lot owner as they came in. The preliminary plat approval required a 20 -foot landscape setback be provided along S. Stratford Drive. This setback is shown on the final plat as submitted. However, the preliminary plat approvals were not specific on what landscape plan is required and where. We have assumed that the 20 -foot setback area will be landscaped in Lot 2 of Block 1 and Lot 1 of Block 2 when those lot owners submit their individual site plans for approval by the City. There is not common ownership landscape lot or strip that would require landscaping by the developer. A clarification of this issue is requested of the City. Also, a detailed fencing plan was submitted with the improvement plans on Sheet 3. , A six-foot perimeter chain link fence will be constructed along the northern and eastern boundaries of DEE JAY Subdivision as shown on Sheet 3 of the improvement plans. Currently, a six-foot chain link fence exists along the southern boundary. Also, since a landscape setback is reserved along S. Stratford Drive, it does not appear that a fence is warranted along the western boundary. 4. Five-foot sidewalks will be constructed along both sides of E. Watertower Street as shown on the detail thereof on Sheet 2 of the Development Plans. However, as required by ACHD, a seven -foot sidewalk will be constructed along S. Stratford Drive. Sanitary sewer main line extensions are planned to extend through the development as shown on Sheets 6 thru 8 of the, Development Plans. The sizes of the main line sewers are adequate to serve the property to the east and this development. 6. Domestic water main line extensions are planned to extend through the development as shown on Sheets 6 thru 8 of the Development Plans. The water main line is to be a 12" as shown. 7. It is the developer's plan to complete the construction of the street signs, road base, street lights, pressurized irrigation system, domestic water system and fencing prior to requesting building permits. 8. The developer has submitted.a request to Nampa Et Meridian Irrigation District to assume the operation and maintenance of the pressurized irrigation system. If the request is denied, the system will be owned and operated by the DEE JAY Subdivision Business Owners Association. 9. Street lights (250 watt) will be installed within DEE JAY Subdivision. These lights will be located once the Idaho Power electrical plan is made available. However, in general, they will be situated at street intersections and at fire hydrant locations.
