STAFF RECOMMENDATION Staff recommends approval of the subject application. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located north of Chinden Boulevard and west of N. Linder Road in the southwest 1/4 of Section 23, Township 4 North, Range 1 West. B. Owner/Applicant: The Club at Spurwing, LLC 3405 E. Overland Road, Suite #150 Meridian, ID 83642 C. Applicant's Statement/Justification: Please see applicant's narrative for this information. V. PROCESS FACTS A. The subject application is a request to vacate public right-of--way. Per Meridian City Code, a public meeting is required before the City Council on this matter. The Council's decision represents consent for the Ada County Highway District to process the vacation application. The District is the final decision making body. VI. LAND USE A. Existing Land Use(s): The area is developed as a single family residential community and private Spurwing Subdivision -VAC-12-006 Page 1 golf course. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The subject property is surrounded by either planned or existing residential development or golf course. The majority of the surrounding properties are zoned R-8 and RUT. C. History of Previous Actions: • In 1995, the roadway was platted as part of the Spurwing Subdivision. Currently this is the main roadway into the Spurwing Subdivision. In 2011, City Council approved the annexation, rezone, preliminary plat, conditional use permit, development agreement modification and variance to develop a new nine (9) hole executive golf course and estate lot subdivision known as Spurwing Challenge. A new road alignment was approved with this subdivision that depicts a new public street at the half mile consistent with city ordinance. The approval of the variance allowed N. Spurwing Way to remain as right-in/right-out only roadway. D. Utilities: 1. Public Works: a. Location of sewer: Currently installed to each lot. b. Issues or concerns: None. VII. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. Please refer to the public record for the application file for any written comments that may have been submitted by other agencies. VIII. ANALYSIS Analysis Leading to Staff Recommendation: The applicant requests approval to vacate a portion of the existing N. Spurwing Way right-of--way (1.39 acres) platted with the Spurwing Subdivision. Currently, N. Spurwing Way serves as the main entrance into the Spurwing Subdivision. The right-of way is being vacated and exchanged in order to construct a new roadway that aligns with N. Long Lake Way at the half mile consistent with the Spurwing Challenge Subdivision approvals (see Exhibit A.2). N. Spurwing Way was approved as a right-in/right-out only access road by a variance. Since the roadway is requested to be vacated, the access to Chinden Boulevard is no longer needed. The applicant is proposing to close the access and convert the roadway into a private street with a future final plat application. No utility easements are being requested for vacation with the subject application. In order for ACRD to act on the applicant's request to vacate the existing right-of--way, ACRD must receive a recommendation for approval (consent) from the City Council. Because the applicant is closing access to Chinden Boulevard and a new roadway is planned at the half mile consistent with the UDC, staff recommends approval of the vacation as proposed in Exhibit A.3.
