FP-03-067 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code § 12-3-7 on January 13, 2004, and the Council finding that the Administrative Review is complete from Sonya Allen, Planner for the Planning and Zoning Department, and Bruce Freckleton, Engineering Technician III, dated: City Council Date: January 13, 2004, to the Mayor, Council, and Planning and Zoning Commission, and that Anna Powell Planning Director for the Planning and Zoning Department, commented at the January 13, 2004 hearing, and the Council having considered the requirements of the preliminary plat the Council takes the following action: ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT / (FP-03-067) Page 1 of 5 IT IS HEREBY ORDERED THAT: The Final Plat of Cedar Springs Subdivision No. 4 "PLAT SHOWING CEDAR SPRINGS SUBDIVISION NO. 4, A PORTION OF THEW % OF THE NE '/ OF SECTION 36, TOWNSHIP 4 NORTH, RANGE 1 WEST, BOISE MERIDIAN, MERIDIAN, ADA COUNTY, IDAHO 2004, 11922-Draftingldwg\11922FPl.dwg, 11/24/03, HANDWRITTEN DATE: 11-25- 03, SHEET 1 OF 5, HOWELL-MURDOCH DEVELOPMENT CORP. -DEVELOPER, J-U-B ENGINEERS, INC. -ENGINEERS", Howell-Murdoch Development Corporation, Developer, is Conditionally Approved subject to those conditions of Staff comments as set forth in the -_-~ --Memorandum to the Mayor and City Council from Bruce Freckleton, Engineering Technician III, -~~_- and Sonya Allen Planner for the Planning and Zoning Department, dated: City Council Date: January 13, 2004, listing 13 SITE SPECIFIC COMMENTS and 4 GENERAL REQUIREMENTS, a true and correct copy of which is attached hereto marked Exhibit "A", and consisting of three pages, and by this reference incorporated herein, and the reference to agreement with the Staff report conditions by Daren Fluke in his email dated January 13, 2004 to Will Berg, is on file with the Clerk's office, and the additional requirements from the action of the Council taken at their January 13, 2004 meeting as follows, to-wit: 1.1 Comply with the wnditions of the Meridian Fire Department as follows: The following will be the requirements and/or concerns to provide minimum levels of fire protection for the proposed project: 1. That afire-flow as required by the International Fire Code is provided to service the entire project. Fire hydrants shall be placed an average of 350' apart. ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT / (FP-03-067) Page 2 of 5 2. Acceptance ofthe water supply for fire protection will be bythe Meridian Water Department. 3. Final approval of the fire hydrant locations shall be by the Meridian Fire Department. Additionally, internal fire hydrants will be required for the project. 4. The phasing plan may require that any roadway greater than 150' in length that is not provided with an outlet shall be required to have a turn around. 5. All entrances and internal roads shall have a turning radius of 28' inside and 48' outside. 6. Operational fire hydrants and access roads are required before combustible construction begins. - _ ~ 7. All building uses and processes to comply with the fire code in effect at the time of construction. 8. No vertical obstructions or mature landscaping which obstructions the outlets of the fire hydrant within 10'. 9. Vertical clearance for driveways shall be 13'6", this may affect tree placement in landscaping areas. 10. All fire lanes shall have a clear driving surface which is20' wide available at all times. 1.2 Comply with the conditions of the Central District Health Department as follows: The Central District Health Department requires after written approval from the appropriate entities are submitted, they can approve this proposal for central sewage and central water; that plans must be submitted to and approved by the Idaho Deparhnent of Health and Welfare, Division of Environmental Quality for central sewage and central water; that run-off is not to create a mosquito breeding problem; and it is suggested that stonnwater be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality; that engineers and architects should obtain current best management practices for stormwater disposal and design a ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT / (FP-03-067) Page 3 of 5 stormwater management system that is preventing groundwater and surface water degradation. Manuals for guidance: 1. State of Idaho Catalog Of Stormwater Best Management Practices For Idaho Cities And Counties. Prepared by the Idaho Division Of Environmental Quality, July 1997. 2. Stormwater Best Management Practices Guidebook. Prepared by City of Boise Public Works Department, May 2000. 2. The final plat upon which there is contained the Certification and signature of the City Clerk and the City Engineer verifying that the plat meets the City's requirements shall be signed only at such time as: The Plat dimensions are approved by the City Engineer; and 2. The City Engineer has verified that all off-site improvements are completed and/or the appropriate letter of credit or cash has been issued guaranteeing the completion ofoff--site and required on-site improvements. NOTICE OF FINAL ACTION AND RIGHT TO REGULATORY TAKINGS ANALYSIS The Applicant is hereby notified that pursuant to Idaho Code 67-8003, the Owner may request a regulatory taking analysis. Such request must be in writing, and must be filed with the City Clerk not more than twenty-eight (28) days after the final decision concerning the matter at issue. A request for a regulatory takings analysis will toll the time period within which a Petition for Judicial Review may be filed. Please take notice that this is a final action of the governing body of the City of Meridian, pursuant to Idaho Code § 67-6521. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY The applicant, Howell-Murdoch Development Corporation, has requested approval for the fourth phase of Cedar Springs Subdivision, located approximately 1/amile west of N. Meridian Road on the south side of W. Ustick Road. This phase includes 61 single-family residential building lots and 22 common lots on 35.81 acres of land. The subdivision will have a gross density of 1.7 d.u./acre with a net density of 3.2 d.u./acre. The submitted final plat complies with the approved preliminary plat (PP-02-027). The preliminary plat was approved under the name of Cedar Springs North Subdivision. Staff recommends approval of the final plat for Cedar Springs Subdivision No. 4, with the comments and conditions stated in this report. LOCATION The subject property is located approximately '/< mile west of N. Meridian Road on the south side of W. Ustick Road, in the NE Y of Section 36, T.4N., R.1 W. SURROUNDING PROPERTIES North: Rural residential/agricultural property, zoned RUT (Ada County). East: Rural residential/agricultural property, zoned RUT (Ada County). West: Rural residential/agricultural property, zoned RUT (Ada County) and single-family residential (Baldwin Park Sub.), zoned R-4. SITE SPECIFIC REQUIREMENTS/FINAL PLAT Applicant is to meet all terms of the approved preliminary plat (PP-02-027) and non- development agreement (Inst. No. 103192357). Submit compaction test results to the Meridian Building Department for any building pads within lots receiving engineered backfill. 3. Any drainage areas (detention/retention basins) must be designed to ensure that water will percolate or discharge within a period of time not to exceed 24 hours for all storms up to and including a 100-year storm event. Side slopes within drainage areas shall not exceed 3:1. 4. Street signs are to be in place, water system shall be approved and activated, pressurized irrigation system approved and activated, drainage lots constructed, perimeter fencing installed, and road base approved by the Ada County Highway District prior to applying for building permits. All development improvements shall be installed and approved prior to obtaining certificates of occupancy. A letter of credit or cash surety in the amount of 110% will be required for all fencing, pathways, landscaping pressurized irrigation, sanitary sewer, water, etc., prior to signature on the final plat. 5. Landscaping is approved per the landscape plan dated 10/24/03. 6. Sanitary sewer service and municipal water to this development shall be via extensions from mains being installed in previous phases. Applicant will be responsible to construct the sewer and water mains to and through this proposed development, thereby making them available to adjacent properties. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Applicant shall execute City of Meridian standard form of easements, for any mains that are required to provide service. Applicant shall be required to pay Public Works development plan review, and construction inspection fees, as determined during the plan review process, prior to signature on the final plat per Resolution 02-374. 8. Developer shall coordinate mailbox locations with the Meridian Post Office. 9. The applicant has indicated that this phase will be a continuation of the Settler's Irrigafion District pressure irrigation system being installed in previous phases. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. If a creek or well source is not available, asingle-point connection to the FP-03-06] Cedar Springs No4. FP Planning & Zoning Commission/Mayor & City Council Hearing Date: January 13, 2004 Page 3 culinary water system shall be required If a single-point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. 10. Complete the Certificate of Owners and accompanying Acknowledgment. 11. Add "REAL POINT OF BEGINNING" text to thee 1/16`h Corner shown on sheet 3 of 5 12. Please add or revise the following plat notes: Complete the recording information lines of plat note 12, 13, and 16. 13. Staff's failure to cite specific ordinance provisions or terms of the approved preliminary plat does not relieve Applicant of responsibility for compliance. GENERAL REQUIREMENTS Tile all irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided per City Ordinance 12-4-13. Submit written confirmation of plan approval from the appropriate irrigation/drainage district, or lateral users association to the Public Works Department. 2. Remove any existing domestic wells and/or septic systems within this project from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. (Wells may be used for non-domestic purposes such as landscape irrigation.) 3. Install 250-watt and 100-watt, high-pressure sodium streetlights at locations designated by the Public Works Department. Street light contractor shall obtain an approved design and permit from the Public Works Department prior to commencing installations. 3. Replace any tree over four (4) inch caliper that is removed from the property with an equivalent number of caliper inches of trees. (Required landscape buffer trees will not be considered as replacement trees for those trees that have to be removed.) 4. Coordinate with the Meridian Public Works Department and the Meridian City/Rural Fire Department to determine fire flow requirements. Provide a letter from the Fire Department stating required fire flow requirements prior to final plat approval. RECOMMENDATION Staff recommends approval of the final plat, with the above stated comments and conditions.
