The situation on Meridian's "head- ache curve" also has affected mer- chants at nearby shopping centers, who say business has waned since work to improve the intersection began last fall. It'll be a blessing when it's done," said Richard Proulx, owner and manager of The Palace card shop at Cherry Plaza. But, he said, "the long- term effects will be far greater than people realize now." Although blocked entrances have cut sales at The Palace and other stores, Proulx said the installation of a traffic signal in front of the shop- ping center and grading and widen- ing of the road "can't help but make it better.' The triangular intersection, pre- viously controlled by three stop signs, is being redesigned into a "T" shape with a free -running lane for traffic from East Ist Street turning right onto Fairview Avenue. A single traffic light will control the intersec- tion. Left -turn bays also are being provided for traffic attempting turns into downtown Meridian from Fair- view Avenue and onto Cherry Lane from East Ist Street, Ron Santi of the Idaho Transportation Department .said. Average traffic flow through the intersection now is about 12,000 ve- hicles a day, Santi said, with double that amount expected by the year 2000. To Meridian Mayor Joe Glaisyer, improvements at the junction of Cherry Lane and Fairview Avenue with East Ist Street are long over- due. "There have been some very se - merchants' nerves vere accidents there. It was con- gested and wasn't good for anybody. This should be a remarkable im- provement for everyone concerned," Glaisyer said, adding that much of Meridian's growth in the past few years has been in the area. of Cherry Lane and Fairview Avenue. The mayor said he had received a few complaints since construction at the intersection began. Most have been from Cherry Plaza merchants, who are upset that an access is not being provided near Round Table Pizza. The access was sought so that sup- pliers and emergency vehicles would not have to drive through the shop- ping center's parking lot to get to stores on the eastern end of the inter- section. Blaine Sessions, District 3 engi- neer, said the proposed access was not feasible, because it would be too close to the main intersection and could pose hazards. He said the inter- section could be closed down, if nec- essary, to let emergency vehicle enter the shopping center quickly. If required by the Department's District Engineer, the Permittee shall give at least% hours rdvance notice prior to commencing initial work or any future work which would restrict the flow of traffic. , 2. During the progress of the work such barricades, lights and other traffic control devices shall be erected and maintained as may be necessary or as may be directed for the protection of the traveling public. Local Roads Engineer SAfE TRANSPORTAT/ON WWAVS PROGRESS EQUAL OPPORTUNITY EMPLOYER R E S O L U T I O N WHEREAS, the Idaho Transportation Department, Division of Highways, has submitted Amendment Number 1 to the Cooperative Agreement stating obligations of the State and the City of Meridian, Idaho, for construction under Federal - Aid Project M-8673(003), of 0.34 mile of highway at the intersection of U.S. Highway 30 and Cherry Lane within the corporate limits of the City of Meridian, Ada County, Idaho, which improvement is to consist of grading, base, draining, curb -gutter, surfacing, lighting, signalization, sprinkler system, landscaping, sidewalk and traffic control; and WHEREAS, the allotment of Federal and State funds for the improvement is contingent upon compliance with the laws governing State highways and State highway traffic, availability of necessary right of way and adequate provision for the maintenance of the completed improvement, and the establishment of traffic control measures and means of enforcing them. NOW THEREFORE, BE IT RESOLVED: 1. That Amendment Number 1 to the Cooperative Agreement for Federal - Aid Project Number M-8673(003) is hereby accepted and approved. 2. That the Mayor and the City Clerk are hereby authorized to execute Amendment Number 1 to the Cooperative Agreement on behalf of the City of Meridian. 3. G' CiW Cle (SEAL) ; �9- leo. i, 5(.� AMENDMENT NUMBER 1 rr COOPERATIVE AGREEMENT U.S. Highway 30 and Cherry Lane Intersection Meridian, Ada County, Idaho M-8673(003) THIS AGREEMENT, made and entered into this day of 1980, by and between the IDAHO TRANSPORTATION DEPARTMEN , DIVI- SION OF HIGHWAYS, hereafter called the "State"; the ADA COUNTY HIGHWAY DISTRICT, acting by and through its Board of Commissioners, hereafter called the "Highway District"; and the CITY OF MERDIAN, IDAHO, acting by and through its Mayor and Council, hereafter called the "City". WITNESSETH: WHEREAS, the State,Highway District and City entered into a Cooper- ative Agreement on 6 August 1979, covering reconstruction of the U.S. Highway 30 and Cherry Lane Intersection within the City of Meridian; and WHEREAS, it is in the public interest to amend the Cooperative Agree- ment by providing for a change in the scope of work to include install- ation of a sprinkler system and landscaping in lieu of paving the traffic island at the intersection of U.S. Highway 30 and Cherry Lane; and WHEREAS, authority for this Agreement is established by Section 40-120, Idaho Code. NOW THEREFORE, in consideration of the premises and the several promises to be faithfully performed by each as hereafter set forth, the parties do mutually agree to amend the aforementioned Agreement as follows: -1- 1. Section II shall be changed by adding paragraph 9, as follows: 9. By Change Order, delete certain items of work and make substitution therefore, as shown on Exhibit "B", attached to and made a part of this Agreement. 2. Section III shall be changed by adding paragraph 18, as follows: 18. Agrees to the changes as referred to in Section II, Paragraph 9 and as shown on Exhibit "B". 3. Section IV shall be changed by adding paragraphs 8 through 11 as follows: 8. Will, at City expense, furnish, plant and maintain low - growth vegetation within the confines of the traffic island to be constructed as a part of this project at the intersection of U.S. Highway 30 and Cherry Lane. 9. Will operate and maintain the sprinkler system at City expense, providing all the water necessary to support the vegetation to be planted. 10. Will ensure that none of the sprinklers to be in- stalled as a part of this project will be directed onto the traveled way. 11. Will keep the traffic island free and clear of all trash, weeds, paper, dead vegetation and other foreign materials. The Highway District represents that its Board of Commissioners is authorized by proper resolution to enter into this Agreement; the City represents that its Mayor is authorized by proper resolution, a copy of which is attached hereto, to enter into this Agreement, and the State represents that the Idaho Transportation Board has, by proper resolution, authorized the Administrator, Division of Highways, to enter into this Agreement. -2- IN WITNESS WHEREOF, the State has caused these presents to be exe- cuted by its State Highway Admininistrator, attested to by his Secretary, and the seal of the Division of Highways affixed hereto; the Highway Dis- trict by its Commissioners, attested to by its Director and the Seal of the Highway District affixed �_Iereto; and the City, by resolution of the Council, has caused these presents to be executed by the Mayor, attested to by the Clerk, and its corporate seal affixed hereto. The representatives of the Red Lion were informed that it would be at the developers expense to have the power poles relocated and that thirty feet face of curb to face of curb, or thirty-one feet back to back is required for the width of the street to keep the street the same width all the way through. The curb will be next to the sidewalk. Commissioners to review the plans again after they are drafted and the License Agreement will be drafted after that review. DEMEYER ESTATES - Al Marsden presented the plans and stated that the original isscussion and agreen;e-t with the Commission was to allow sidewalk on only one side of the interior streets in subject project, and there doesn't seem to be anything in the records to tie that down. He also stated that one street would be reduced from thirty-six feet back to back to thirty-one feet back to back. Commissioner Silva had asked for something in writing stating what will be happening in the area before any final decisions are made. Property ownership of the area was discussed. Further discussion. Mr. Marsden stated that there is a letter on file from Hewlett Packard stating that there is no objection to this plan. Commissioner Fairbanks asked for letters from Mr. Ted Johnson and the other property owner involved, stating that they are in concurrence with the plan. The Commission gave preliminary approval of subject plan with sidewalks on only one side and a thirty-one foot back to back street, subject to letters being placed in the file showing agreement by all property owners involved. Further discussion held concerning the proposed develop- ment. No further action taken. SUBDIVISIONS - PRELIMINARY PLATS - John Joines presented the preliminary plats as submitted on the Subdivision Plat agenda of July 17, 1980. The Commission was in agreement with all requirements placed by staff. Cinnamon Grove No. 2 was the only preliminary plat submitted. ADA COUNTY CONDITIONAL USES, ETC. 80 -17 -CU- David Reibe; 80-21-ZC - Farwest Steel; 80 -19 -CU - John Browning; 80 -20 -CU- Messina -Marrs, Inc., were all presented and the Commission agreed with staff comments. 80-18=CU - Watts Burgess - 38 Unit Mobile Home Park - John Joines stated that the Commission might want to put additional requirements on this particular conditional use. He stated that it will be taking access onto Hampton, Road and the road is sub -standard. He asked if the Commission would want to require the developer to improve Hampton to Fairview from the proposed development, in addition to what the staff is requiring on the Subdivision Plat Agenda of July 17, 1980. Much discussio followed. It was decided that the developer be required to trust for 50% of one side of Hampton Road down to Fairview, over the existing twenty-four foot pavement. Discussion held concerning the Five Mile Loop Road and it is felt that nothing will be happening on that for some time. DIRECTOR'S REPORT West 40th Street L.I.D. - Gary Funkhouser explained that Garden City has denied the L.I. and_thiere ore the Highway District will not proceed with the L.I.D. Letter from Mr. Moseley - Discussion held concerning the letter and the action that coul-d-Fe - take nor —Moseley. Much discussion followed concerning the L.I.D. and how the assessments were made with regard to the two streets that were not dedicated previous to the assessments. Letter from Board of Corrections - Pleasant Valley Road - Gary Funkhouser explained the letter and the request for maintenance -on Pleasant Valley Road. He further explained the reasons the road is in such bad condition and stated that it will have to have extensive road work to put it in good condition. Discussion held. Mr. Funkhouser said the road wasn't designed for the kind of traffic that has been using it and would be a very expensive project to rebuild. John Joines was instructed to write the Deputy Warden and explain the problems with the budget considerations and to tell him that we will do the best we can to make it drivable. Discussion held concerning the possibility of putting a load limit on the roadway. Alley Between Jefferson, State, 16th and 17th Street - Designate One-Wa _ Frank Capshaw asked for Commission-aut�Fio-rization to designate the east -west alley between. Jefferson and State and 16th and 17th Streets, one-way to solve some problems with sight distance. He said there is a parking lot that will have to be adjusted but it shouldn't be much of a problem. Commissioner Wardle moved to designate the subject alleyway as one-way for a period of ninety -days. Commissioner Fairbanks seconded. Motion carried unanimously. Cherry Lane Median - Meridian - Gary Funkhouser explained that he received a letter from the Mayor of Meridian stating that he doesn't believe that a hearing is necessary and explained why. Meridian would like the Highway District to put in the asphalt R at this time. The Commission agreed that the hearing be abandoned and that the island be installed. Discussion held concerning the way to take care of the inside of the island and it was determined that an asphalt cap should probably be used. Portland Cement Association Invitation - Gary Funkhouser explained that the Commission has been invited `Tattend a lunch with the Portland Cement Association on July 15, at 11:30 a.m. atthe Crane Creek Board Room. The Commissioners were not going to be available and suggested that the meeting be re -scheduled for after the 17th of July. Commissioner Fairbanks moved to adjourn. carried unanirrnously. He stated the Chamber of Commerce is paying for the plants, but the city would be responsible for getting the water to and maintenance. The Motion was made by Brewer and seconded by Williams that the mayor be authorized to sign the resolution amendment to the agreement with the State of Idaho T sportation Department. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea. The mayor announced that the council was invited to a Senior Citizens picnic at 12:00 noon, Tuesday, July 15th at the park. Williams inquired about the activity on the SE of Linder and Cherry Lane. Stuart reported that they are leveling to clean up weeds and discourage motor bike trespassing. Park Commissioner Orton reported that there had been considerable damage to the restrooms at the park. Orton asked for increased police patrol on weekends. He also proposed that there be no permits for beer at the park and stick to our present policy. Chief Sherwin agreed that this would only invite problems. The State will not give the Highway District a permit to haul those gravels. Further discussion. Chuck Smith explained that others have applied for use of those gravels also. It was decided that Chuck Smith should check with the airport people and the foundation people to see if something can be worked out to get the gravel for the roadway. Letter from Kuna Re uestin Seed Bumps - Gary Funkhouser explained that he has sent a reply and a copy of a court decision regarding speed bumps. All legalities to be taken care of. FIVE MILE SEWER PROJECT - John Joines explained the problem with the drainage pipe thi has developed in subject project. The Highway District is going to have to install about 850 feet of drain to drain into another drain at Granger. Mr. Joines recommend( that one of the drain projects planned for this year be dropped so that this drain ca( be installed. There will have to be a modification in the Agreement with the City to allow this additional drain. Discussion followed. The Commission agreed that staff should proceed to have the drain installed in the most inexpensive and legal way possible. Agenda 2 Clyde Henman - Jehova Witness Church Mr. Henman was present to request placing a house trailer by the Kingdom Hall on W. Broadway for about two weeks in August. Henman displayed a sketch of intended placement and stated this trailer would be used during a workshop. There is water and sewer connections set up. Agenda 3 Flouride Water Mayor Glaisyer stated that the Meridian Chamber of Commerce had advocated a study to put flouride in the water and that there had been a lot of controversy. The mail response was approximately two to one against. Williams expressed concern toward obtaining a Federal Grant every time a proposal came around. If the people of Meridian want flouirde in their water, then it should be put on a referendum and voted upon. Kingsford agreed. Orton stated that the study for installation of flouride into the water as well worth the effort and the process of sending the request of all water users opinion in each statement would be a type of referendum. The response was 104 "yes flouride" to 193 "no flouride". The Motion was made by Kingsford and seconded by Orton that the Mayor and Council stop any further application toward flouridization of city water. I will have our Transportation Director, Frank Capshaw, get with your Police Chief, Mr. Sherwin, and develop the traffic analysis necessary to to justify the installation of this improvement. I would anticipate that a hearing could not be held for at least two weeks and we would notify all the property owners within the area and would advertise it in the Valley News and the Statesman, so that anyone interested in the improvement could attend the hearing. Wy in Street - Gary Funkhouser presented a petition from people on Wyoming Street asking teat t -eir street be paved. It is located between two subdfvorsthesimprovements people living along the unimproved section that would have to pay under a L.I.U. do not want it but the people in the interior of the subdivisions want the street improved. Gary Funkhouser to correspond with property owners to see if they want a L.I.D. CHERRY LANE CHANGE ORDER - John Joines presented the Change Order for the water system on Cherry Lane in Meridian, in the State contract, the Highway District just has to approve it locally. Commissioner Fairbanks moved that the change order for the Cherry Lane project No. M-8673(003) be approved. Commissioner Jeppesen seconded. Motion carried unanimously. LETTER FROM MIKE GREEN - Commissioner Jeppesen explained that Mr. Green is objecting to the hold up of the project on North Cole. He has stated that the requirement for a traffic study is holding up the project. Discussion of the area followed. Gary Funkhouser explained that the Highway District has approved the access points and that we are not backing up on what we told the developer. The traffic impact is a different question. John Joines to check to see what the City has commented on the plat. Further discussion followed. FIVE MILE AND HIGHWAY 20 - Commissioner Fairbanks asked that if a plat is ever sub- mitted at the corner of Five Mile and Highway 20 to see if right-of-way can be dedicated to get that road through to the highway. Mr. Funkhouser explained that a land exchange may be possible during the current development in the Hewlett Packard area. Further discussion. AGC Meeting - Gary Funkhouser asked when the Commission would like to have a meeting with the Associated General Contractors after the 6th of November. Meeting scheduled for Friday, November 9, 1979, at 10:00 a.m. Discussion of the topic for discussion followed. United Way - Commissioner Jeppesen asked how the drive is coming for contributions and Marcia True explained that the employees are being shown a film and we will wait a few days for the pledges to come in. Fees for Garden City - It has been brought to the attention of staff and the Commission that Garden City did not budget for the increased fees. Mr. Funkhouser explained that overall the cost to Garden City will probably be reduced rather than increased and doesn't feel it will impact them as much as Garden City thinks it will. Letter from Jerry Decker - Letter was received asking the Highway District to pave their alley. Commissioner Fairbanks suggested that we send a letter stating the policies for a L.I.D. 15th Street - Commissioner Fairbanks asked about the do not enter signs, and Frank Capshaw explained that the signs have been removed. Maple Grove Railroad Crossing - Discussion of the railroad crossing followed. Gary Funkhouser to write a letter to the Railroad Company to have something done to the crossing. Russett Street - Commissioners explained that Mr. Bowman had telephoned them stating that t e road is too narrow. Gary Funkhouser explained that the road was built as designed and it is an adequate width for the short street. Mr. Funkhouser to send a letter stating that because there is no additional funds for relocating that irrigation line, the street will have to be left as it is. Commissioner Jeppesen to sign the letter if Mr. Funkhouser wishes him to. Further discussion. Rose Hill Shrub - Commissioner Fairbanks reported a sight obstruction on Rose Hill for anyone entering Rose Hill of Eiden. The bush is about 12 block east of Eiden. Staff to take care of the problem. Job Classification Schedule - Gary Funkhouser explained that when the Job Classification, Schedu e was submittedthat Signal Foreman was inadvertantly left out; and that since Marcia True has taken on additional duties, he would like to re-classify the Admini- strative Assistant position to Range 13. Compensation changes will be made to the people who have taken on the additional responsibilities immediately. The Commission agreed that the request be approved as presented. Vivian, Maxwell, Schmeizer Lane - Gary Funkhouser explained that the staff is confused as to what the Commission would like done in all instances similar to these problems. Discussion of the problems with allowing individuals to pave streets followed and also; the fact that these streets have been hanging for so long without a firm decision. Mr. Funkhouser recommended that if the property owners have applied for a L.I.D. or want to upgrade their street, they should have to come up to a standard and perform anything that they would have to do under a L.I.D. Discussion followed. Mr. McCoy is under the impression that the Highway District is going to do some of the work, prepare the base, etc. Further discussion followed with Mr. Funkhouser explaining the reasons the Highway District should not expend funds in this manner. He said he can understand the Highway District proceeding with Vivian and Maxwell because the property owners have been told so many things, but we should not be doing this as a Meridian City Hall .4. Stuart, Public Works Superintendent, reported on East Carlton Water Line improvement. There was discussion on Latecomer's Charge. The Motion was made by Williams and seconded by Brewer that the City Attorney be instructed to prepare a Latecomer's Fee Charge in favor of the City. Mayor Glaisyer presented the State Agreement on improvement of East First Street and Cherry lane intersection Water Line, concern has been put into the agreement. The Motion was made by Williams and seconded by Bodine that the Mayor be authorized to sign the Agreement with the State of Idaho, Cherry Lane - Fairview Intersection project. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. There was discussion concerning customer refusal of not paying water bills because of the "onion flavor and smell." It was the consensus that payment should be required for water that flows through the meter. Williams commended J -U -B Engineers Staff and Earl Ward and Staff for an excellent job getting the Waste Water Treatment Plant on line. City Clerk (SEAL) COOPERATIVE AGREEMENT M-8673(003) US -30 & CHERRY LANE INTERSECTION Meridian, Ada County, Idaho THIS AGREEMENT, made and entered into this day of 1979, by and between the IDAHO TRANSPORTATION DEPARTMENT, DIVISION OF HIGHWAYS, hereafter called the "State", the Party of the First Part; the ADA COUNTY HIGHWAY DISTRICT, acting by and through its Board of Commissioners, hereafter called the "Highway District", the Party of the Second Part; and the CITY OF MERIDIAN, acting by and through its Mayor and Council, hereafter called the "City", the Part of the Third Part. WITNESSETH: WHEREAS, the Parties have mutually agreed that it is in the public interest to reconstruct the intersection of U.S. Highway 30 and Cherry Lane, which improvement is to consist of grading, base, draining, curb -gutter, SPP --4': el�-locate Water System surfacing, lighting, signalization, and traffic controls on 0.34 mile of highway within the City of Meridian to be constructed under Federal -Aid Project No. M-8673(003); and WHEREAS, the City by authority of Idaho Code, Title 50, may adopt and enforce traffic control ordinances within its corporate limits; and WHEREAS, the improvements to be constructed under Project No. M-8673(003) are a recommended part of the Ada County Planning processes; and WHEREAS, the Parties are agreeable to assuming such portions of the costs and obligations of such improvements as are hereafter set forth. NOW THEREFORE, in consideration of the premises and the several promises to be faithfully performed by each Party as hereafter set forth, the Parties agree as follows: SECTION I, Definition of Terms 1, Project Limits. Where used in this Agreement, the term "Project Limits" shall mean the boundaries of that part of the State highway and local streets to be improved in accordance with the attached plans, entitled Exhibit "A" and made a part of this Agreement. SECTION II. That the State Will: 1. Assume its share of all construction and engineering costs ' of the project including: acquisition of rights of way, excavation and grading, base, draining, curb -gutter, surfacing, lighting, signalization, other traffic controls, and miscellaneous items necessary to complete the work, excepting items hereafter stated as obligations of the Highway District and City, in accordance with Exhibit "A" of this Agreement. 2. Designate a resident engineer and other personnel, as the State deems necessary, to supervise and inspect construction in accordance with the plans, specifications and estimates in the manner required by applicable State and Federal regulations. This engineer, or his authorized representatives, will prepare all monthly and final contract estimates, and initiate change orders when required to be submitted to the Highway District for its approval. 3. In cooperation with the Highway District, establish and cause to be maintained all detours deemed necessary to best serve the public interest and expedite the work. 4. Furnish and install all official guide signs at junctions of the urban extensions of the State Highway System and all confirming and reassurance route markers and guide arrows along the urban extensions of the State Highway System necessary to properly identify the State highways and keep the motorist sure of the route. 5. Furnish, as its share of the cost of the traffic signal installation, all of the signal and illumination materials, including: poles, signal heads, detector amplifiers, cabinets, controller with cabinet and luminaires with lamps. 6. Upon request by and at no cost to the Highway District, furnish individual replacement parts, except lamps or equipment as a unit, necessary to maintain standard operation of the traffic signal equipment to be installed in accordance with Exhibit "A" of this Agreement. 7. Upon request of and at the expense of the Highway District, perform the maintenance necessary to provide standard operation of the traffic signal equipment. -2- 8. Upon completion of the project, after all costs have been accumulated and the final audit accomplished, provide a statement to the Highway District summarizing-theestimated and actual costs, indicating any adjustments, and further, will remit any money which may be due the Highway District. SECTION III. That the Highway District: 1. Hereby approves the aforementioned plans. 2. Will not maintain, erect or install any traffic control devices or signs within the. project limits except in conformity with the Manual of Uniform Traffic Control Devices for Streets and Highways, as adopted by the State. 3. In the future, will not vacate or close any right of way within the project limits without concurrence of the State. 4. In the future, will not accept any street or alley right of way entering the project limits without concurrence of the State. 5. Agrees to cooperate with the State in the selection and designation of suitable detour routing during project construction. 6. Will comply with all pertinent sections of the State's Division of Highways Standard Specifications for Highway Construction in accomplishing all future trench backfill and pavement repairs on the State highway within the project limits. 7. Without prior concurrence of the State, will not plant or permit the planting of any trees, shrubs or flowers on the State highway right of way within the project limits. 8. Agrees that the use and occupancy of the right of way of this project by utility facilities will be controlled by the State's Policy for the Accomodation of Utilities Within Rights of Way of the Federal -Aid Highway System in the State of Idaho. 9. Will pay to the State, immediately following execution of this Agreement, the amount of ELEVEN THOUSAND, TWO HUNDRED NINETY SIX FIFTY HUNDREDTHS DOLLARS ($11,296.50), which sum is the District's share of the estimated project cost. -3- 10. Will furnish all the labor, equipment and miscellaneous materials not furnished by the State necessary to install the traffic singal in accordance with Exhibit "A" of this Agreement. 11. Agrees to assume all operation and maintenance responsibilities and the cost thereof, except as provided in Section II, Item 6 of this Agreement, required to maintain the traffic signal equipment in continuous operation in conformity with the justifying warrants as set forth in the Manual of Uniform Traffic Control Devices for Streets and Highways, as adopted by the State. 12. Agrees that should the Highway District fail to maintain the signal installation in standard operation, the necessary maintenance will be performed by the State, at Highway District expense. 13. Will not remove, alter or abandon the traffic signal equipment without concurrence of the State. At the time a major signal modification is necessary or the signal is to be abandoned, the traffic signal equipment will be divided equally between the two parties on the basis of the salvage value of the equipment at the time of salvage. 14. Will not, without prior concurrence of the State, use the traffic signal poles or cables for any purpose other than to support traffic control devices. 15. Will provide the State with copies of vouchers and records confirming all labor, equipment and material costs expended on this project. 16. Will retain its records of the project for a period of three years after completion. 17. Following completion of the project, will pay to the State the amount of any final costs which may exceed the estimated amount indicated in Section III, Item 9 of this Agreement. SECTION IV. That the City: 1. Hereby approved the project. 2. Agrees to enforce all existing applicable laws and ordinances so that the total design effectiveness of the improvements shall be realized. 3. Agrees to obtain concurrence of the State prior to installing or constructing any new, or relocating any existing City owned sanitary sewer or other facilities on the State highway within the project limits. 4. By appropriate ordinance and police action, will prohibit the use of any part of the right of way within the project limits for the purpose of advertising or for displaying, selling or dispensing any merchandise or goods, or the erection of any sign or structure that will encroach upon the right of way. 5. Will prohibit parking of motor vehicles or trailers within the project limits. 6. Agrees to accept from the State, upon completion of this project, ownership of all highway and street lighting equipment to be installed within the project limits and to assume all operation and maintenance costs required to maintain the equipment in continuous service during hours of darkness and will not remove, alter or abandon the lighting equipment without prior concurrence of the State. In the event that the "Average Maintained Foot Candles" of the lighting system drop below 70% of the original installed values, the City shall cause the light intensity to be restored to approximately the original values. Any combination of relamping and/or cleaning of fixtures may be used to achieve the necessary desired intensity. 7. Will not, without prior concurrence of the State, use the light pole or traffic signal poles for any purpose other than to support traffic control devices. This Agreement shall become effective on the first date mentioned above and shall remain in full force and effect until amended or replaced upon the mutual consent of the parties hereto. The Highway District represents that its Board of Commissioners is authorized by proper resolution to enter into this Agreement; the City represents that its Mayor is authorized by proper resolution to enter into this Agreement; and the State represents that the Idaho Transportation Board has by proper resolution authorized the Administrator, Division of Highways, to enter into this Agreement. 5 IN WITNESS WHEREOF, the Parties have caused these presents to be executed, the Party of the First Part by its State Highway Administrator, attested to by his Secretary and the Seal of the Division of Highways affixed hereto; the Party of the Second Part by its Commissioners, attested to by the Director and the Seal of the Highway District affixed hereto; and the Party of the Third Part by the Mayor, attested to by the City Clerk and the Seal of the City affixed hereto.
