STREET LIGHT AGREEMENT
Thi, Strut LiSht Agreement is made and enteml into between the CITY OF MERIDIAN
and mllview DeveIopmeDi Corp., pertaining to the øtreet1ights in Champion Park #1
Subdiviøion a residential development in Meridian, Idaho.
For good and valuable coosideratiOll, the rec:eipt of which is hereby sclmowledged. the
p&r1Íeø agree 88 follows:

HiUview Development Corp. bas provided 488. si. and lea double street light poles,
conerete pole bases, fbr.1ures, bulbs, and componel1t$ to the residential development
known 88 Champion Park ##1 Subdivision in Meridian, Idaho. The parties acknowledge
that the 4ea IÏI\Q!e and lea double street light poles and appurtenances were specially
ordered items, not customarily used in residential developments in Meridian, Idaho.
HiUview Development Corp. or it's assigns, agree to replace. repair and provide my
required mainteœnce of any of the above mentioned stræt lights, and/or appurtenances
thereof; that may hereafter be broken, damaged, or deteriorated, or require maintelllUlCe,
at its own CXpeDlle; 8Pd it is further agreed that HilMew Deve!opment Corp., or ita heirs,
successors and assigns, sha!1 keep the lights operational at all times, it being 'understood
by the City that bulbs, aoðJor ballast, do bum out and that the City will allow reasonable
time to replace them.

It is agreed that the City of Meridian authorize and pay for the electrical service to be
supplied to the 14 street lights located in as Champion Park # 1 Subdivision in the umal
and customary mlDJleI'.
It is agreed that the City of MeridiaD, because Idaho Power Company will not maintain
the bulbs and ballast or provide any mail1l:en8nce, will enter into a Schedule 40
AgreemeDt with Idaho Power Company, and not a Schedule 41 Agreement, which in
proper cases provide that Idaho Power Company would provide 11Iaintenance. bulbs, and
ballast. It is aiso asreed tl1at lighting saved under the Schedule 40 Agreement must be
controlled by a photo electric device or the "fail oft" type.

It is understood and agreed that Hillview Development Corp. willassÎgl1 its rights and
obligations hereunder to Champion Park #1 Homeowners Associatíon when said
HoDlllÓWllers Association is formed and operational.
