We have reviewed this submittal and offer the following comments, as conditions of the applicant. These conditions shall be considered in full, unless exxprressly modified or deleted by motion of the Meridian City Council: On behalf of Farmers & Merchants Bank, the applicant, CSHQA, has requested approval of a conditional use permit (CUP) for a new 16,000 square -foot full service bank building with three (3) drive-through teller lanes. This report is based on the revised plan submitted by the applicant on December 2, 2003 and transmitted on December 3, 2003. The building elevations submitted with the original application included a single -story, hip roofed, pad -style, 7,344 square foot building. Bank executives then met with representatives of The Hudson Company, a consulting firm currently preparing a downtown market strategy for the Meridian Development Corporation (MDC), Meridian's urban renewal agency. They discussed the project and the precedent it sets for future downtown structures, as well as the project's ability to serve as a catalyst for additional redevelopment. As a result of the meetings and further evaluation by the project owners, the applicant has submitted the revised plans showing a two-story, flat roof with parapet, 16,000 square foot building. Staff is pleased with the building revisions. They create a more historically accurate fagade comparable to other existing buildings in the downtown core. The applicant proposes to have the option of removing the existing bank structure and replacing with parking and a small plaza with a flag pole and three benches or to leave the existing building intact. Staff prefers the option leaving the existing structure intact. The other site improvements and circulation remain relatively unchanged on the revised site plan. Staff has a handful of special considerations for the Commission and Council related to the site improvements. Upon resolution of those items, staff recommends approval of the project with the conditions noted in this report. The fallowing uses surround the subject property: North — First Federal Savings & Loan and City Hall, zoned O -T. South — The Creamery, a city -owned parking lot, and the Sheik gas station, zoned O -T. East — Harry's Bar & Grill, zoned O -T. West — Existing Residences and American Legion Had, zoned R-8. OWNER OF RECORD The owner of record is Farmers & Merchants State Bank, and they have given their consent for the applicant to submit the requested conditional use permit. STANDARDS FOR CONDITIONAL, USES The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms of the following, and may approve a conditional use permit if they shall find evidence presented at the hearing(s) is adequate to establish (11-17,3): A. That the site is large enough to accommodate the proposed use and all yards, open spaces, parking, landscaping and other features as may be required by this ordinance; Staff finds that the subject property, as depicted, is large enough to accommodate the required open spaces and landscaping required by the ordinance, but not parking. The site accommodated the required number of parking stalls for the original submittal; but the revised plan does not meet parking requirements based on the larger structure. However, staff supports the proposed building modifications, as they are more historically accurate and compatible with existing historic structures in downtown. Therefore, staff will support a Variance to the parking requirements for the revised structure. If a Variance is approved for the project, staff finds that the project will meet this requirement. The proposed revised bank building is 16,000 sI Ordinance requires 1 off-street parking space per 200 s.f of gross floor area, for a total of 80 spaces. The proposed site plan shows 46 off-street parking stalls, 11 of which are on the existing Fanners & Merchants site. There are also 13 diagonal on -street parking spaces proposed on Broadway Avenue adjacent to the project, for a total of 59 stalls. If the existing structure remains, there will be a total of 48 spaces. B. That the proposed use and development plan will be harmonious with the Meridian Comprehensive Plan and in accordance with the requirements of this Ordinance; CUP -03.050 Fannia Maduoas BmkcUP Planning & Zoning Commission/Mayor & City Council December 18, 2003 (Hearing Date) Page 3 The Comprehensive Plan Land Use Map designates the property as "Old Town" and it is currently zoned O -T. Old Town `Includes the historic downtown and the true community center. Uses would include offices, retail and lodging, theaters, restaurants and service retail for surrounding residents and visitors.... In order to provide and accommodate preservation of the historical character, specific design requirements may be imposed" (see Comprehensive Plan, p. 99). Ordinance 11-8-1, Schedule of Use Control, allows for banks and drive-in establishments through the conditional use process in the O -T zone. Staff finds that the requested use will be in compliance with the approved Future Land Use Map if design requirements are imposed that preserve the character of Old Town. Staff fiuther finds that if the project is approved as a CUP it will be in compliance with the MCC. C. That the design, construction, operation, and maintenance will be compatible with other uses in the general neighborhood and with the existing or intended character of the general vicinity and that such use will not adversely change the essential character of the same area; The surmunding properties vary greatly and include City Hall, a bank, a bar, a gas station, the Creamery, the American Legion hall, and residences. Old Town is intended as a mixed use zone. Therefore, staff finds that the proposed development will not adversely change the existing or intended character of the general vicinity. The revised design of the building is compatible with existing historical structures in the area. D. That the proposed use, if it complies with all conditions of the approval imposed, will not adversely affect other property in the vicinity; The proposed site plan places the drive-thru along Meridian Road, across from existing residences, which may be affected. Staff would prefer a site layout that accesses the drive- thru from the alley, instead of placing it along the Meridian Road frontage. However, given existing traffic levels and associated noise along Meridian Road (see item G below) staffdoes not anticipate that the proposed use will adversely affect adjacent properties. In the case of the Creamery, the proposed project should actually add further incentive for redevelopment. The Commission and Council should rely upon public testimony to determine if the development will adversely affect any properties in the vicinity. E. That the proposed use will be served adequately by essential public facilities and services such as highways, street, police, and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; The project proposes vehicular access from Broadway Avenue and from the alley between Meridian Road and Main Street. The Commission and Council will need to reference any CUP -03-050 Farmers Maawlla BMLCUP Planning & Zoning Commission/Mayor & City Council December 18, 2003 (Hearing Date) Page 4 written or verbal testimony submitted by the Meridian Police and Fire Departments regarding their ability to adequately service this project. ACRD approved the proposed project with the conditions noted in their report. The major change required by ACHD was modifying the two-way alley to be one-way, except for a two-way section to access the drive-thru. Water and sanitary sewer service to the project is readily available to the site via mains installed adjacent to the property. The comment from Meridian Water Dept. states that no water line is stubbed into this property, yet several are depicted on the Preliminary Site Utility Plan. The applicant should confirm the existence of the services shown on their plans, with the Meridian Water Department. F. That the proposed use will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; If approved, the applicant will finance the extension of sewer, water, utilities and pressurized irrigation to serve the project. The primary public costs to serve the future project will be fire and police services. Staff finds there will not be excessive additional requirements at public cost and that the proposed use will not be detrimental to the community's economic welfare. G. That the proposed use will not involve activities or processes, materials, equipment, and conditions of operation that will be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; ACRD estimates that the traffic volume would be 900 additional average daily trips (1048 existing) for the originally proposed bank building. This number has not yet been updated for the larger revised building. Traffic congestion is an ongoing issue for downtown, the resolution of which is beyond the scope of this project. ACHD staff finds that the additional traffic created by a revised building should not be excessive. Staff also finds that no smoke, fumes, glare or odors will result from the proposed use. H. That the proposed use will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; As discussed above, vehicular approaches are proposed from Broadway Avenue and from the existing alley. Staff finds that the proposed use will not create significant interference with traffic on the surrounding public streets. Please refer to ACHD comments for additional detail on this issue. According to ACHD staff, the project does not require action by the ACHD Commission and was approved at staff level on October 7, 2003. The revisions made to the plan will not trigger a new report because it complies with the original conditions. L That the proposed use will not result in the destruction, loss or damage of a natural, scenic or historic feature considered to be of major importance. The existing street trees shall be protected during all construction and demolition activities. The existing magnolia tree near the entrance of the existing structure should also be protected. ! Y SI I Y 1► I. Exiaft Structure: The applicants' proposal is for a plaza and parking area to replace the existing Farmers & Merchants building and drive-thru. Also, "Farmers & Merchants requests that this portion of the development be approved as submitted, but not required, if the bank desires to retain the existing building." Staff actually prefers to have the bank retain the existing building. Since it is on a separate legal lot, it can be sold or leased to another tenant. The existing building helps provide a more continuous facade along Main Street, which is already suffering from gaps in the urban fabric in the form of vacant or underdeveloped property. The existing building is a quality brick structure that fits well with the existing streetscape and surrounding buildings. Ii, however, the Commission and Council find that the existing building should be allowed to be demolished, staff notes the following positive elements of the proposal, which should be required per the proposed site plan. The parking is separated from Main street by a plaza with pavers, trees in grates, landscaping, three benches and a flagpole. The existing drive•thru curb cut on Main Street is abandoned. 2. Parkins: Staff has committed to support a parking variance required by the additional floor area in the revised (larger) building structure. The revised building structure is much more historically compatible with other structures in the vicinity. The original proposal was for a standard office -park style building. The revised building borrows facade elements from existing historic structures in the downtown. Therefore, staff supports a parking variance to allow the larger building. See Condition #2. Currently, the site has 59 parking spaces on it, 9 of which are reserved for Farmer's & Merchants customers only. The other 50 spaces are used by City Hall and the general public. With the proposed new building, parking may not be available for City Hall as it has in the past. The City does own a parking lot on the south side of Broadway, adjacent to the Creamery. To facilitate pedestrian movement from the city parking lot to City Hall, the site plan does provide pedestrian access with pavers or stamped concrete crosswalks across the drive aisles and alley. Staff recommends shifting the striping for the on -street parking in front of the proposed building approximately 9 feet to the west. This will reduce conflicts between parked cars and vehicles exiting the site and turning right from the main access on Broadway. See Condition #3. 3. Signa : The applicant is proposing that the existing Farmers & Merchants pylon sign with manual readerboard remain at the intersection of Main and Broadway. They are also proposing anew pylon sign along Meridian Road to match the existing one. The currentsign ordinance is silent on standards for signs in Old Town, so the proposed signage requires conditional use approval with the subject application. The Commission and Council should review the proposed signage and determine what is appropriate for the site. Staff suggests that only one freestanding sign should be approved for the project; this would be consistent with the freestanding sign allowance in other zoning districts. Staff further suggests that the new fi-eestandmg sign on Meridian Road would be more appropriate as a monument sign than a pylon sign. As depicted, the Meridian Road pylon sign overhangs the sidewalk; staff recommends that any sign be set a minimum of 2 feet behind the sidewalk. For wall signs, the applicant is proposing a logo and business name on the south and east elevations. No wall signs are proposed for the west or north elevations. The applicant should verify the location and maximum size for all signs at the hearing. If the building is a multi - tenant structure, all future signs for tenants will require conditional use approval, unless the sign type, size, and location are approved with this application. Therefore, staff strongly recommends that the applicant verify that all desired signage is reviewed with this application. A planned sign program should also be required for the project. See Condition A. 4. Drive-thru: Staff continues to maintain a preference for a site plan that brings the building up to Meridian Road with an urban -style fagade/street interface and places the drive-thru along the alley instead of along the Meridian Road frontage. However, this would require significant modifications to both the structure and site plan. Therefore, staff simply raises the issue for discussion among the Commission and Council. 5. Streetscane: Staff is very pleased with the proposed streetscape improvements along Broadway and Meridian Road. The streetscape is designed to match the existing streetscape along Main Street, with wide sidewalks, pavers, and trees in planters. The existing tree wells along Main Street have proven too small to provide healthy tree growth over the long term. The applicant should coordinate the design of the tree wells with the City Parks Dept. The Parks Dept. comments from 9/23/03 stating "no commetW' were recently revised in a memo from Elroy Hufl, dated 12/9/03 containing 13 conditions related to the street trees. The revised Parks Dept, comments should be made conditions of the project. 6. pavers: The ACHD report prohibits the use of pavers within the right-of-way. City staff desires the use of pavers around the tree wells and along the curb, as depicted on the proposed site plan. It matches the existing pavers along Main Street and Idaho Ave. Staff is working with ACHD on the issue and will report on the status at the public hearing. The applicant shall submit a Variance application for parking to accompany this application to the City Council hearing. Shift the striping for the on -street parking in front of the proposed building approximately 9 feet west. 4. Wall signs are approved as submitted on the revised building elevations. One freestanding sign will be allowed for the project --either the existing Farmers & Merchants pylon sign or a monument sign on Meridian Road located at least 2 feet behind the sidewalk, dimensions to comply with L -O standards in the sign ordinance Table C. Any additional signs will require a modification of the Conditional Use Permit. A planned sign program will be required for any additional tenant signs. 5. This conditional use permit shall be subject to the expiration provisions set forth in MCC 11- 17-4.B. 6. All 90 -degree parking stalls shall be at least 9 feet wide and 19 feet deep per Ordinance 11- 13-4.0. All two-way drive aisles adjacent to parking shall be at least 25 feet wide. Drive-tlmt lanes shall be constructed as depicted on the submitted site plans. All parking and drive aisles shall be paved for all uses, in compliance with the submitted plans. Handicap parking spaces shall be signed and striped in compliance with Federal accessibility guidelines. 8. Sanitary sewer and water service shall be from main lines currently existing adjacent to the subject property. 9. All exterior lighting, whether attached to the building or located within the parking lot, shall be down -shielded or otherwise altered so that the light does not spill over onto adjacent properties or right-of-way. All parking lot fighting shall be in accordance with Ordinance 11- 13-4C. 10. All signage shall be in accordance with the standards set forth in this report and Section 11-14 of the City Zoning and Development Ordinance. All construction and site improvements shall conform to the requirements of the Americans with Disabilities Act and the adopted building and fire codes. 12. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-I-91) for all off-street parking areas. Storm water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval, The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 13. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the proposed development. A temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for temporary occupancy. " o o1"u-NI. Provide a fire -flow per the International Fire Code Appendix D to service the project. Fire hydrants shall be placed an average of 400' apart. 2. All internal roads shall have a turning radius of 28' inside and 48' outside. 3. All Fire Lanes leading into and within the project shall have a clear driving surface with a minimum width of 20' available at all times. 4. The revised plans will require that the building be fire sprinklered. I have been working on a new set of standards for care of downtown trees, tree box construction and the tree grates. I feel it is paramount for the City to maintain downtown street trees to insure continuity of the hardscape, forest canopy and irrigation. These standards have not been drawn up by an architect. Here are some of the new standards: 1. Tree Box Diameter 6'x 6'1.D. 2. Walls — 8"W x 16" D with re -bar 3. A tree grate frame must be set into the box before pouring concrete. 4. Center of the tree is 36" back of curb. 6. A tree grate will fit each frame with the grate specifications being 6' x 6' with a French pattern made of cast iron with no finish. 6. Grates will come to Meridian Parks and Recreation Department then sent out to have a powder coat paint finish applied. 7. Planting depth — root flare 4" below bottom of tree grate. B. Irrigation — Each tree will have irrigation that will meet Parks Arborist approval. 9. All irrigation and power will be routed outside of the tree box walls. 10. Each box will have a small traffic rated steel box next to it with an isolated irrigation valve. 11. Irrigation should be in an in -ground double check back flow with an electronic valve and timer. 12. Native soils sufficient for tree root growth will be on the outside area of the tree boxes. 13. Main Street is currently improved with 3 -traffic lanes with curb, gutter and sidewalk. 8. Existing Right -of -Way Broadway Avenue currently has 80 -feet of right-of-way (40 -feet from centerline). Meridian Road currently has 63 -feet of right-of-way (33 -feet from centeriine). Main Street currently has 80 -feet of right-of-way (40 -feet from centerline). The alley currently has 16 -feet of right-of-way (8 -feet from centerline). 9. Existing Access to the Site The site currently has three driveways that intersect Broadway Avenue and three driveways that intersect the alley. 10. Site History The District has not previously reviewed an application for this site. Capital Improvements Plan/Five Year Work Program Main Street is not scheduled within the District's Five Year Work Program or Capital Improvements Plan. Meridian Road is not scheduled in the District's Five Year Work Program, but is scheduled in the District's Capital Improvements Plan to become 3 to 44anes with curb, gutter and a 5 -foot detached concrete sidewalk within 70 to 84 -feet of right-of-way. B. Findings for Consideration Right -of -Way and Sidewalk for Arterials District policy requires 96 -feet of right-of-way on arterial roadways (Figure 72-F1 B). This right-of-way allows for the construction of a 5 -lane roadway with curb, gutter, 5 -foot concrete detached sidewalks and bike lanes. District policy requires 5 -foot wide (minimum) concrete sidewalk on all collector roadways and arterial roadways (7204.6.5). Meridian Road Meridian Road is not listed as a proposed project in the District's currently adopted Five -Year Work Program, but is in the currently adopted 20 -year Capital Improvements Plan. As such, the applicant may receive reimbursement for dedicated right-of-way from available collected impact fees. The Board of Commissioners authorizes the expenditure of available collected impact fees for the purchase of right-of-way dedicated by the applicant, with the applicant constructing a sidewalk as described below. However, if funds cannot be secured, the applicant shall do one of the following: a. Dedicate by donation (or through a development offset agreement whereby the applicant is reimbursed from impact fees to be collected solely from the applicant's specific development project) an a total of 35 -feet of right-of-way (from centerline) along Meridian Road, and construct a minimum 5 -foot wide concrete sidewalk along Meridian Road, located a minimum of 28 -feet from the centerline of the right-of-way. b. Do not dedicate additional right-of-way, but construct a minimum 5 -foot wide concrete sidewalk along Meridian Road, located a minimum of 28 -feet from the centerline of the right-of-way, in an easement provided to the District. c. Do not dedicate additional right-of-way, but construct a minimum 5 -foot wide concrete sidewalk along Meridian Road, located at the back edge of the existing right-of-way. Accomplish all necessary adjustments to properly accommodate existing drainage and utilities. Main Street Main Street currently has 3 -traffic lanes and is fully improved with curb, gutter and sidewalk. Due to the fact that Main Street is fully improved and is not in the District's Five Year Work Program or Capital Improvements Plan, staff recommends that the applicant not dedicate any additional right-of- way at this time. Broadway Avenue Broadway Avenue currently has 80 -feet of right-of-way. This right-of-way is sufficient to construct the 70 -foot street section with curb, gutter, a 5 -foot concrete sidewalk and the angle parking that is approved with this application. 2. Right -of -Way for Alleys District policy 7204.10.1 requires the dedication of additional right-of-way to obtain a minimum width from the centerline of the alley of 8 -feet fro residential uses and 10 -feet for all other uses. Dedicate a total of 10 -feet of right-of-way from the centerline (maximum of 12 -feet from centerline) of the alley abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will not be compensated for this additional right-of-way because the alley is classified as a local street and is to be brought to adopted standards by the developers of abutting properties. Street Section for Broadway Avenue and On Street Angle Parking The applicant is proposing to construct on half of a 65 -foot street section with angle parking on Broadway Avenue. The District does not prohibit angle parking, but does have some concerns with it. The concerns with on street angle parking include: • Who will maintain the angle parking and the striping? • Who will be responsible if an accident were to occur? The applicant should provide a minimum of one half of a 65 -foot street section within the existing right-of-way. The 65 -foot street section will provide a 5 -foot concrete sidewalk with curb, gutter, 15 - feet for the on street angle parking stall, 7.5 -feet of back up space and a 10 -foot travel lane. The applicant (or the City) should also obtain a license agreement from the District to maintain and stripe the on -street parking. The applicant (or the City) should also provide the District with a hold harmless agreement for the angle parking. El The applicant is proposing to taper the curb line from the bulb out at the corner of Main Street and Broadway Avenue to the curb line of the angle parking. The applicant should provide a minimum of an 18 -foot curb radius. 4. Driveways District policy F2 -F4 (1) and 72-F4 (2), requires driveways located on commercial/industrial roadways to offset a controlled and/or uncontrolled intersection a minimum of 50 -feet (measured near edge to near edge). An access to an alley shall be located a minimum of 25 -feet from the nearest public street (District policy 7204.10.2). The applicant is proposing to construct a 28 -foot wide driveway that intersects Broadway Avenue approximately 50 -feet east of Meridian Road (West 1" Street). This driveway meets the minimum offsets established by District policy. Due to the fact that the proposed driveway meets District policy, the applicant may construct a 28 -foot wide driveway that intersects Broadway Avenue approximately 50 -feet east of Meridian Road, as proposed. The applicant is proposing to construct a 25 -foot wide driveway to intersect Broadway Avenue approximately 255 -feet east of Meridian Road. This driveway meets the minimum offsets established by District policy. Due to the fact that the proposed driveway meets District policy, the applicant may construct a 25 -foot wide driveway to intersect Broadway Avenue approximately 255 -feet east of Meridian Road (West 1$` Street), as proposed. The applicant is proposing to construct 3 -driveways to intersect the alley. The applicant is proposing to construct a 35 -foot wide driveway that intersects the alley approximately 40 -feet east of Meridian Road. This driveway meets the minimum offsets established by District policy. Due to the fact that the proposed driveway meets District policy, the applicant may construct a 35 -foot wide driveway that intersects the alley approximately 40 -feet east of Meridian Road (West 1 s` Street). The applicant is proposing to construct a 28 -foot wide driveway that intersects the alley approximately 195 -feet east of Meridian Road. This driveway meets the minimum offsets established by District policy. Due to the fact that the proposed driveway meets District policy, the applicant may construct a 28 -foot wide driveway that intersects the alley approximately 195 -feet east of Meridian Road. The applicant is proposing to construct a 28 -foot wide driveway that intersects the alley approximately 255 -feet east of Meridian Road. This driveway meets the minimum offsets established by District policy. Due to the fact that the proposed driveway meets District policy, the applicant may construct a 255 -foot wide driveway that intersects the alley approximately 40 -feet east of Meridian Road. The applicant inquired with staff in regard to widening the alley to obtain a larger access to Meridian Road. Staff is supportive of the applicant widening the alley access and utilizing the alley as a two- way driveway/alley from Meridian Road to the drive-thru aisles that are proposed to intersect with the alley. The applicant may widen the alley to a maximum width of 30 -feet. Traffic Services staff has reviewed this proposal and have agreed that the driveway/alley will function appropriately with this design. Alley District Policy 7204.10.3 states a minimum of back -of -curb radius of 15 -feet is required at all alley intersections. For the reconstruction of existing alleys, the back -of -curb radius may be less than 15 - feet when it is impractical to remove existing obstructions. Access is allowed to and from a fully improved alley (District policy 7204.10.2). Parking shall be designed so the minimum clear distance from the back of the parking stall to the opposite side of the alley is 22 -feet for perpendicular parking. An access to an alley shall be located a minimum of 25 -feet from the nearest public street. The applicant is proposing to construct alley loaded parking. District policy requires parking within an alley to be located a minimum of 25 -feet from the nearest public street. The parking should be designed so the minimum clear distance from the back of the parking stall to the opposite side of the alley is 22 -feet for perpendicular parking. The applicant is proposing to convert an existing one-way alley to provide a segment of the alley to function as a two-way alley. The District's Traffic Services staff has examined this scenario and has recommended that the alley remain one-way until the entire alley can function as a two-way alley due to the increased traffic conflicts and confusion that may occur. Although the District will require that the alley remain one way until such time that the entire alley can function as a two-way alley, the District would consider switching the direction of the alley if is desired by the applicant and the City of Meridian. 6. Pedestrian Ramps The pedestrian ramps at all roadway and driveway intersections should be constructed to ADA standards. 7. Streetscape Due to maintenance concerns, the applicant should utilize stamped concrete as opposed to pavers. The applicant (or the City) should obtain a license agreement for any landscaping or alternative surface (other than concrete) that will be located within the public right-of-way. C. Special Note to the City of Meridian The District will be acquiring a total of 70 -feet of right-of-way (35 -feet of right-of-way from the centerline) on Meridian Road. The right-of-way that the District will be acquiring will accommodate for 3 -traffic lanes with curb, gutter and a 5 -foot detached concrete sidewalk. If the City requires a wider sidewalk, the City of Meridian should acquire additional right-of-way or note that the planter strip that is anticipated to be located between the curb and the sidewalk will be eliminated. D. Site Specific Conditions of Approval 1. The Board of Commissioners authorizes the expenditure of available collected impact fees for the purchase of right-of-way dedicated by the applicant, with the applicant constructing a sidewalk as described below. If the City would like the applicant to construct angle parking on Broadway Avenue, provide one half of a 65 -foot street section within the existing right-of-way. Obtain a license agreement from the District to maintain and stripe the on -street parking and provide the District with a hold harmless agreement for the angle parking. 4. Provide a minimum 18 -foot curb radius for all curb lines. 5. Construct a 28 -foot wide driveway that intersects Broadway Avenue approximately 50 -feet east of Meridian Road (West 1' Street), as proposed. 6. Construct a 25 -foot wide driveway to intersect Broadway Avenue approximately 255 -feet east of Meridian Road (Vilest 1" Street), as proposed. Construct a 35 -foot wide driveway that intersects the alley approximately 40 -feet east of Meridian Road, as proposed. 8. Construct a 28 -foot wide driveway that intersects the alley approximately 195 -feet east of Meridian Road, as proposed. 9. Construct a 28 -foot wide driveway that intersects the alley approximately 255 -feet east of Meridian Road, as proposed. 10. Widen the alley access and utilize the access as a two-way driveway/alley from Meridian Road to the drive-thru aisles that are proposed to intersect with the alley, as proposed. The maximum width of the alley/driveway will be 30 -feet. 11. Continue to utilize the existing alley as a one-way roadway until the entire alley can function as a two- way alley (with the exception of the two-way driveway/alley from Meridian Road to the drive-thru aisles that are proposed to intersect with the alley). 12. Design the alley loaded parking to provide a minimum clear distance from the back of the parking stall to the opposite side of the alley of 22 -feet. 13. Construct all pedestrian ramps in accordance with ADA standards. 14. Obtain a license agreement for any landscaping or altemative surface (other than concrete) that will be located within the public right-of-way. 15. Comply with all Standard Conditions of Approval. D. Standard Conditions of Approval 1. Any existing irrigation facilities shall be relocated outside of the right-of-way. 2. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details. 5. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 7. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 8. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #197, also known as Ada County Highway District Road Impact Fee Ordinance. 9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. 10. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 11. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. E. Conclusions of Law The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are satisfied. 2. ACHD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. The request for reconsideration must be supported by written documentation setting forth new facts and information not presented at the earlier meeting, or a changed situation that has developed since the taking of the earlier vote, or information establishing an error of fact or law in the earlier action. The request may also be supported by oral testimony at the meeting. d. If a motion to reconsider passes, the effect is the original matter is in the exact position it occupied the moment before it was voted on originally.
