He noted the existing house is a rental property and that long-term residential use is not feasible. • A "no objection" letter was submitted by A. John and Neta E. Gaige, dated 11-22-03. they are • Key issue of discussion and questioning by Commission included: 1. The proposed private street vs. a public street. 2. Appropriateness of a Development Agreement being required on the C-G lots that don't have proposed uses at this time. 3. Appropriateness of the commercial rezone with a Medium Density Residential designation in the Comprehensive Plan. Key Commission Additions to Staff Recommendation: The Commission added a requirement for a vehicular cross-access easement between Lots 2 and 3 and between Lots 4 and 5. The property is approximately 2.8 acres in size and is generally located east of the southeast corner of Overland Road and SH69/Meridian Road, Meridian. The property is designated as Medium Density Residential in the 2002 Comprehensive Plan. 2. The owners of record of the subject property are Patrick and Judi Thacker. 3. Applicant is The Land Group, Inc. 4. The subject property is currently zoned R-6 and consists of a single family residence and six (6) out-buildings. The Applicant requests the property be zoned as L-O (3 building lots) and C-G (2 building lots). 6. The subject property is bordered to the north by an ACHD drainage lot and a single family residence; to the south by Country Terrace and Running Brook Estates Subdivisions; to the east by Country Terrace Subdivision; and to the west by Southern Springs No. 1 (zoned C-G). The property which is the subject of this applicafion is within the Area of Impact of the City of Meridian. 8. The entire parcel of the property is included within the Meridian Urban Service Planning Area as defined in the Meridian Comprehensive Plan. 9. The Applicant proposes to develop the subject property in the following manner: a five (5) lot commercial subdivision. 10. The Applicant requests zoning of the subject real property as L-O and C-G which is consistent with the Meridian Comprehensive Plan policies, as noted in the accompanying staff report. The Future Land Use Map designates the subject property as Medium Density Residential. RECOMMENDATION TO CITY COUNCIL FOR APPROVAL OF ANNEXATION AND REZONE FOR SOUTHERN SPRINGS N0.2 BY THE LAND GROUP, INC - AZ-03-030 -Page 1 11. The Ten Mile Drain is a scenic features of major importance that affects the consideration of this application. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested Annexation and Zoning as requested by the applicant for the property described in the application, subject to the following: A. Adopt the Recommendations of the Meridian Planning & Zoning Department as follows: 1. The legal description submitted with the application meets the requirements of the City of Meridian and State Tax Commission and places the parcel contiguous to existing city limits. 2. The subject property is within the Urban Service Planning Area. Essential City services can be made available to the subject property. 3. All future development on said property shall comply with the City of Meridian ordinances in effect at the time of application. 4. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service, per City Ordinance Section 5-7-517, when services are available from the City of Meridian. Wells may be used for non- domesticpurposes such as landscape irrigation.
