We have reviewed the aforementioned applications and now offer the following comments, as conditions of the Applicant. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATIONS SUMMARY The Applicant, Mary Ballantyne, C/O Troutner Business Park Development Corporation, has requested Preliminary Plat (PP) approval to subdivide 17.26 acres of C -G zoned property into 6 buildable lots and 1 common lot. The site is located approximately 200 feet south of Franklin Road and approximately 500 feet west of Meridian Road within Township 3 North, Range 1 West, Section 13. The site lies within a Commercial area of the 2002 Comprehensive Plan Future Land Use Map and is currently vacant. The submitted preliminary plat application proposes to re -subdivide Lots 4, 5, 10-15, Block 2, Lot 4, Block 3, and Lot 3, Block 5, Troutner Park Subdivision No. 1, which was recorded in 1997. With the plat of Troutner Park Subdivision #1, the Applicant dedicated 60 feet of right-of-way for Pennwood Street and 3'a Avenue. The Applicant is concurrently proposing to vacate a portion of the platted right- of-way for Pennwood Street and all of 3'a Avenue (VAC -03-007). The area proposed for vacation is included within the proposed lots of the subject plat. Staff is recommending approval of VAC -03-007, with the exception of the 3d Avenue right-of-way stub to the south. See Special Consideration "A" below. Staff is recommending approval of the preliminary plat application, with the conditions outlined in this report. CURRENT OWNERS OF RECORD Troutner Business Park Development Corporation, Mary Ballantyne, President, is the current property owner and has submitted the subject application. PP -03-034 Troutner 2.1`P-doc Mayor, Council, and P&Z Commission Hearing Date: December 4, 2003 Page 2 North: Vacant, zoned C -G; Tavern, zoned C -G South: Vacant, zoned C -G East: Multi -family, zoned R-15; Vacant/Automotive Shop/Commercial Tire Subdivision, zoned C -G West: Troutner Office Park, zoned C -G PRELIMINARY PLAT ANALYSIS Sections 12-3-312 and 12-3-5.D of Meridian City Code read as follows: In determining the acceptance of a proposed subdivision, the Commission/Council shall consider the objectives of this title and at least the following: A. The conformance of the subdivision with the Comprehensive Development Plan; Staff finds that the lot configuration and overall design of the proposed subdivision are in general conformance with the City of Meridian Comprehensive Plan. See Special Considerations below for further analysis. B. The availability of public services to accommodate the proposed development; The developer will be responsible for financing the extension of sewer, water, utilities and irrigation services needed to serve the project. The primary public costs to serve the future tenants will be fire and police services. Staff finds that public services can be made available to accommodate the proposed development. The Commission and Council should reference any written and/or verbal testimony submitted by the Meridian Police and Fire Departments regarding their ability to adequately service this project. C. The continuity of the proposed development with the capital improvement program; Because the developer is responsible for installing sewer, water, utilities and irrigation, for the development at their cost, staff finds that the subdivision will not conflict with the capital improvement program. D. The public financial capability of supporting services for the proposed development; Staff finds that the City and its related services are capable of servicing the proposed development. The development will not require major expenditures for providing supporting services. Staff recommends that the Commission and Council reference any written and/or verbal testimony submitted by the Meridian Police and Fire Departments with regard to their capability to serve the proposed development. The other health, safety or environmental problems that may be brought to the Commission's attention. Staff finds that there are not any health, safety or environmental problems associated with this subdivision that should be brought to the Council or Commission's attention. Staff has not identified any environmental problems that may be associated with the development of this site. ACHD considers road safety issues in their analysis, and ACHD staff has recommended, with conditions, approval of the subject subdivision. This project is scheduled to be on the ACHD Board of Commissioners agenda on December 3, 2003. Staff finds the Commission and Council should rely on any public testimony that may be presented to determine whether or not the proposed subdivision may cause health, safety or environmental problems of which staff is unaware. SPECIAL CONSIDERATIONS A. Third Avenue: In conjunction with the subject preliminary plat, the Applicant is requesting to vacate all of the right-of-way for 3rd Avenue that was platted with Troutner Park Subdivision No. 1. The 3rd Avenue right-of-way is currently un -opened. The Applicant claims that extending 3rd Avenue as platted will interfere with the adjacent property owner to the south because Corporate Drive is also planned for extension adjacent to that site (see Applicant's Letter and Attached map). Depending on the future use(s) on the property to the south, staff believes that a stub street could allow that parcel(s) to develop more efficiently and provide better traffic circulation in the area. Staff is not convinced that vacating 3'd Street, south of Pennwood Street, would be in the public's best interest (see VAC -03-007). Staff believes that a stub street to the south, whether it be in the existing location, or further to the east, should be provided with the subject preliminary plat. To provide for better traffic circulation in the area, street from the subject property to the south. See Site Specific Condition #1 below. B. Street Buffers: Meridian City Code 12-13-10-4 requires a 10 -foot wide landscape buffer along local roads, excluding residential areas. On the north side of Pennwood Street, a local/commercial road, the Applicant is proposing to construct a 5 -foot wide attached sidewalk with the required 10 -foot wide landscape buffer being outside of the right-of-way (12 -feet wide from back of sidewalk). On the south side of Pennwood Street, the Applicant is proposing to construct a 5 -foot wide detached sidewalk with a 5 -foot wide landscape buffer between the curbing and the sidewalk, and another 5 feet of landscaping on the south side of the sidewalk. The Applicant should be required to install landscaping along Pennwood Street (and any other local street), in accordance with Meridian City Code 12-13-10-6, as proposed. The landscape buffer between sidewalk and the curb lies within the jurisdiction of ACHD and the Applicant should be required to obtain a license agreement from ACHD for the proposed landscaping in the right-of-way. See Site Specific Condition #2 below. C. Driveways/Sight Triangles: Meridian City Code 12-13-9-3 requires a clear -vision sight triangle at the intersection of a road and a driveway. The submitted landscape plan shows shared driveways between Lots 4 and 5 and between Lots 6 and 7. Staff is supportive of combined/shared access points along Pennwood Street. Prior to final plat approval, the PP -03.034 Troutn" UP-doc Mayor, Council, and P&Z Commission Hearing Date: December 4, 2003 Page 4 Applicant should submit a copy of a recorded cross access agreement for any lots sharing driveways. In order to limit vision obstructions at intersections, provide a clear -vision sight triangle where the proposed driveways intersect Pennwood Street (MCC 12-13-9-5). See Site Specific Condition #3 below. D. Turnarounds: As part ofthe approval for Commercial Tire Subdivision (PP -01-018), Pennwood Street was to be constructed from Meridian Road to the subject site's east boundary. The Commercial Tire plat expires in January of 2004, and Pennwood Street has not been constructed. If Pennwood Street is not constructed east of the site, from Meridian Road to the eastern property line, construct a temporary turnaround at the eastern terminus of Pennwood Street that meets the design and construction standards of the Meridian Fire Department and the ACHD. See Site Specific Condition #4 below. E. Land Use Buffers: Meridian City Code 12-13-12-4 requires landscape buffers between different classes of land uses. The Applicant is proposing a 20 -foot wide landscape buffer between the existing multi -family land use to the east and any future use on the proposed Lot 18, Block 2. There is a good probability that a higher intensity land use will be constructed adjacent to the multi -family development to the east. Therefore, staff is supportive of the Applicant depicting a 20 -foot wide landscape buffer along the east boundary of Lot 18, Block 2. If a higher intensity use is proposed for Lot 18, Block 2, in the future, landscaping in the proposed 20 -foot wide buffer shall be installed prior to occupancy. 1. Provide a stub street from Pennwood Street to the south property line. 2. Sanitary sewer and water service to this site will be from main line extensions from the phase one and from the future connection of Pennwood Street to the east. The applicant will be responsible to construct lateral sewer and water mains to and through this proposed development, thereby making them available to adjacent properties. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Provide landscaping along Pennwood Street (and any other local/commercial street) in accordance with MCC 12-13-10. Obtain a license agreement from ACHD for any landscaping proposed in the right-of-way. 4. Where driveways intersect Pennwood Street, provide a clear -vision sight triangle in accordance with MCC 12-13-9-5. If Pennwood Street is not constructed from Meridian Road to the eastern boundary of the plat, construct a temporary, Meridian Fire Department approved, vehicular turnaround for Pennwood Street. 6. Building setbacks for structures and dimensional standards for the proposed lots shall be in accordance with the applicable zoning regulations of the City of Meridian. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. Applicant shall be required to utilize any existing surface or well water for the primary source. If a surface or well source is not available, a single -point connection to the culinary water system shall be required. If a single -point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. 8. Any tree over 4" in caliper that is removed from the property shall be replaced by installing additional trees, being the equivalent number of caliper inches of trees that were removed. Required landscaping trees will not be considered as replacement trees for those trees that have to be removed. Coordinate the proposed tree mitigation plan with Elroy Huff in the Meridian Parks Department (888-3579). 9. Please submit any updated groundwater/soils monitoring data to the Public Works Department for review. Any drainage areas (detention/retention basins) must be designed to ensure that water will percolate or discharge within a period of time not to exceed 24 hours for all storms up to and including a 100 -year storm event. Side slopes within drainage areas shall not exceed 3:1. The project engineer should pay close attention to the results of field studies determining the groundwater, soil type & and characteristics during the design and construction phases. Submit a copy of the Ada County Street Name Committee's final approval letter for the subdivision name, including lot and block numbering. Make any corrections necessary to conform. 2. Coordinate fire hydrant placement with the City of Meridian Public Works Department. 3. A letter of credit or cash surety in the amount of 110% will be required for all landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature of the final plat. 4. Streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at the subdivider's expense. Typical locations are at street intersections and/or fire hydrants. 5. A detailed landscape plan for the common areas, including pathways and types of construction, shall be submitted for review and approval with the submittal of the final plat applications. The plan must include sizes and species of trees, shrubs, berming/swale details, and all proposed ground cover/treatment. A letter of credit or cash surety in the amount of 1101/0 will be required for all fencing, landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the Final Plat. 6. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per MCC 12-4-13. The ditches to be piped should be shown on the site plans. Plans will need to be approved by PP -03.034 Troutna 2TRAoc Mayor, Council, and P&Z Commission Hearing Date: December 4, 2003 Page 6 the appropriate inigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 7. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per MCC 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 8. Developer shall coordinate mailbox locations with the Meridian Post Office. 9. Compaction test results must be submitted to the Meridian Building Department for all building pads receiving engineered backfill, where footing would sit atop fill material. STAFF RECOMMENDATION Staff recommends approval of the submitted preliminary plat application with the conditions listed above. This easement must be protected and any encroachment without a signed License Agreement and approved plan, before any construction is started, is unacceptable. All municipal surface drainage must be retained on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation District must review drainage plans. The developer must comply with Idaho Code 31-3805. It is recommended that irrigation water be made available to all developments within the Nampa & Meridian Irrigation District. Commercial and office occupancies will require a fire -flow consistent with the International Fire Code to service the proposed project. Fire hydrants shall be placed an average of 400' apart. 2. Acceptance of the water supply for fire protection will be by the Meridian Water Department. 3. Final Approval of the fire hydrant locations shall be by the Meridian Fire Department thru the Public Works Department. 4. All roads shall have a turning radius of 28' inside and 48' outside. 5. Operational fire hydrants and temporary or permanent street signs are required before combustible construction begins. 6. The phasing plan may require that any roadway greater than 150' in length that is not provided with an outlet shall be required to have a turn around. Provide a approved tum -around on the East end of Pennwood. 7. The fire department requests that any future signalization installed as the result of the development of this project be equipped with Opticom Sensors to ensure a safe and efficient response by fire and emergency medical service vehicles.
