Request for Vacation ora Portion of Penn wood Street Right-of-Way, and all of the
Platted Right-of-Way Known as Southwest 3n1 Avenue, by Troutner Business Park
Development Corporation (File No. VAC-O3-O07).
We have reviewed this submittal and offer the following comments, as conditions of the Applicant.
These conditions shall be considered in fUll, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY
The Applicant, Troutner Business Park Development Corporation, Mary BaI1antyne, President, has
requested the City's consent to vacate six parcels of right-of-way located approximately 200 feet
south ofFrank1in Road and approximately 500 feet west of Meridian Road. All of the parcels were
platted with Troutner Business Park Subdivision No.1 in 1997, and lie within Township 3 North,
Range 1 West, Section 13 of the Boise Meridian, Ada County, Idaho. Four parcels proposed for
vacation lie along the north and south boundaries of the Pennwood Street right-of-way. The
Pennwood Street parcels are aIl3-feet wide, and approximately 420-feet long (east of3n1 Avenue)
and 290-feet long (west of3n1 Avenue). The other two parcels proposed for vacation are all of the
platted right-of-way known as Southwest 3n1 Avenue. Third Avenue was platted 60-feet wide, and
approximately 980-feet long. Together, the parcels total approximately 61,610 square-feet or 1.42
acres, more or less (see Attached map).
The Applicant is requesting the vacation of six feet (three feet on each side) ofPennwood Street
because the ACHD required right-of-way for a commercial street has changed from 60-feet to 54-feet
and the 6-feet will be incorporated into a new prelinùnary plat (Troutner Busine8s Park Subdivision
No.2, PP-03-034). In addition to the Pennwood Street right-of-way, the Applicant is requesting
vacation approval for all of the platted right-of-way for 3n1 Avenue. The Applicant claims that
extending 3n1 Avenue to the south as a stub street will interfere with the adjacent property owner
because Corporate Drive is also planned for extension adjacent to that si~e (see Applicant's Letter and
Attached map). The portion of 3n1 Avenue, north of Pennwood Street, is proposed for vacation
because the two buildable lots that were platted on either side of3n1 Avenue are proposed to be one
buildable lot for an R. V. Park. The Applicant is concurrently proposing to re-plat the subject right-of-

way for Pennwood Street and 3n1 Avenue within the proposed Troutner Business Park Subdivision
No.2 (pP-03-034). Staff is recommending approval of V AC-O3-007, with the exception of the
3n1 Avenue right-of-way stub to the south. See Special Consideration 3 and Recommendation
below.

OWNER OF RECORD
The owner of record of the right-of-way to be vacated is the Ada County Highway District. The
Troutner Business Park Development Corporation, Mary Ballantyne, President, the abutting property
owner, has suboútted the request for the proposed vacations.
SPECIAL CONSIDERATIONS
1.
Process: The Subdivision and Development Ordinance (Title 12), Chapter 10, requires the
Planning & Zoning Commission to review and make a recommendation on Vacation
applications. A public hearing is then required before the City Council.
State statute requires an easement vacation be filed when an irrigation easement is involved.
2.
Utilities: The Applicant should provide verification and te8timony at the public hearing
whether or not the right-of-way contains any utilities. Staff does not anticipate that any
utilities are located within the right-of-way because it i8 unopened and has never been
developed for public access. See Condition below.
3.
Stub to South (3n1 Avenue): Staff does not believe that vacating 3n1 Street, south of
Pennwood Street, would be in the public's best interest. Depending on the future use(s) on
the property to the south, a stub street could allow that property to develop more efficiently
and provide better traffic circulation in the area. Staffbelieves that a stub street to the south,
whether it be in the existing location, or further to the east, should be provided by the
Applicant. Staff recommends that the Commission and Council consider whether
consenting to the proposed vacation of 3rd Street, south of Pennwood Street, would be
in the City's best interest.

CONDITION OF APPROVAL
1.
Prior to issuance of a building pennit, or signature of a Final Plat on the subject properties,
the Applicant shall submit evidence that the right-of-way requested for vacation, and any
public utilities, has been approved by all required agencies and authorities.
RECOMMENDATION
Staff recommends approval of the requested vacations along Pennwood Street, and JnI Avenue,
north of Penn wood Street. Unless a stub street is provided to the south in a different location,
staff recommends denial of the proposed JnI Avenue right-of-way vacation, south of Penn wood
Street.

Troutner Business Park - RJW Vacation
Dear Sir,
We understand you represent the Troutner Business Park Development Corporation as
their engineer for Phase II construction improvements, We have been contacted by you
regarding the vacation of 3rd Street right-of-way, including a slight reduction of right-of-
way on each side of Penn wood Street.
As an adjacent property to the East of the Troutner Business Park, we have no interest in
a future extension or connection to 3rd Street. Since we abut the business park on the
east, we will connect to the Pennwood Street extension, We understand the roadway
width of Pennwood will meet current ACHD standards; therefore, we have no issues or
concerns with a reduction of right-of-way width on Pennwood Street.
In summary, we concur with the right-of-way vacation effort of 3rd Street and reduction
of right-of-way on Pennwood Street.
