t~ Mod~ication to Legal Description for Ruwe Property (Fde f11o. AZ-03-018)
At the 11-5-03 public hearing for the subject application, staff and the applicant, BRS
Architects, presented an amendment to the origir~l annexation application. The
amendment inGuded two parts:
a Addition of a sl'nr~ of property between the Ruwe parcel and Carol
Subdivision, and
b. Withdrawal of #s3 three parcels owned by Eagy from the application legal
description (approx. 12 acres).
The hearing was continued to allow the applicant time to amend their application
and submit the following items to stafF.
a. A revised legal description that removes the Eagy parcels and
incorporates the sliver of land on the west boundary;
b. A revised master concept plan for the Kennevick/CobbslRuwe parcels;
and
c. Evidence that the sliver parcel was legally split through Ada County.
To date, items "a" and "b" have been submitted to the City. However, the applicant's
surveyor, Marks Land Surveying, is still working with Ada County Development
Services Department to process their parcel split and boundary adjustment. Since
the City of Meridian has no mecthenism in the Subdivision Ordinance to allow a one-
time parcel split, this must ocxur arior to annexation. Therefore, staff is
recommending the City Council leave the public hearing open to allow this parcel
split to be finalized and submitted into the public record. At that point, staff can
confirm the Ruwe parcel is corteiguous to existing aty limits and, if approved, the
annexation ordinance and development agreement can be prepared.
Altematively,rf the City Councl elects th not annex the properly at this time, the
public hearing could be closed as no additional information would be necessary.
There was also discussion at the 11-5.03 hearing regarding a potential re-notice of
property owners within 300 feet Specifically, Mr. David Thurston, resident of Carol
Subdivisan, raised a concern about the residents on the west side of Leslie Way
being noticed. On 9-92-04, Staff prepared a new 300-foot radius using the new
sliver property that was added to the Ruwe legal description. -The property list is
identical to the original mailing list The four (4) lots south of Ustick Road on the west
side of Leslie Way were all noticed by mail for the 1-20-04 public hearing (and the
'03 hearings as well).
