• Request for Conditional Use Permit for an indoor soccer center. Located at East
Piper Court in the Medimont Subdivision, in an I -L (Light Industrial) Zone, by
Meridian Soccer Property, LLC (File No. CUP -03-056).
We have reviewed this submittal and offer the following comments, as conditions of the
applicant. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
APPLICATION SUMMARY & BACKGROUND
The applicant, Meridian Soccer Property, LLC, has requested approval ofa conditional use permit for
an indoor soccer center which will consist of a 20,000 square foot soccer field and 3,000 square feet
which will include an office, restrooms, and a small pro shop which will sell soccer merchandise. The
applicant estimates that on a typical evening there will be approximately 30 patrons and two
employees within the soccer facility. The primary users of the soccer facility will be adults and the
facility will be used from noon to midnight during the week. The heaviest periods of useage for the
facility are anticipated to be evenings and weekends.
The subject property is located in an I -L (Light Industrial) zone. A conditional use permit is required
because the proposed use, an indoor recreation facility, is not listed in the Zoning Schedule of Use
Control in Meridian's City Code. When a proposed use is not listed in the schedule of uses a
Conditional Use Permit application must be submitted.
The subject property is located on East Piper Court in the Medimont Business Park (marketed as
Stonebridge Business Park). The Medimont Business Pak is at the southwest intersection ofFranklin
Road and Locust Grove Road.
The following uses surround the subject property: (Anna- I'll run out to the site and checkon

The subject property is surrounded to the north, south, and east by properties zoned I -L located in
the Medimont Business Park. The property to the west of the subject property is zoned R-40 and is
currently vacant.
Standards for Conditional Uses
The Commission and Council shall review the particular facts and circumstances of each proposed
conditional use in terms of the following and may approve a conditional use permit and planned
development if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this Ordinance;
Staff finds that the site is large enough to accommodate all required landscaping. The
applicant's proposed landscaping plan meets all Meridian City Code landscaping
requirements.
The MCC's parking standards (12-13-5) do not specifically list indoor soccer centers.
The applicant estimates that the indoor soccer center will have two employees at the
facility and twenty soccer players using the facility at a time. The applicant's site plan
proposes 35 parking spaces to allow parking for each of the players (games consist of
two, ten player teams) employees, and spectators. Additionally, staff is requesting that the
applicant obtain a shared parking agreement with neighboring businesses to accommodate
any potential overflow parking.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The Comprehensive Plan Land Use Map designates the property as "Industrial". Staff finds
the proposed use is harmonious with the Comprehensive Plan. Staff finds further that the
proposed use is in compliance with the Meridian City Code.
Staff finds that the proposed indoor soccer center is compatible with the existing light
industrial uses found in the Medimont business park. The proposed structure will consist of a
large, open enclosed space which is similar to other structures found in business parks with I-
L zoning. The design of the structure makes it both aesthetically compatible with
surrounding uses and makes the structure a good candidate for reuse if the Meridian Soccer
Center ceases operation.
The uses immediately surrounding the proposed indoor soccer center are all light industrial in
nature (the surrounding uses include an office for a construction company, an office for the
Intermountain Foods Corporation, and a training center for Mary Kay cosmetics ) and are
compatible with the proposed indoor soccer center. The City ofMeridian recently approved

a dance studio in the I -L zone, finding that the dance studio was compatible with surrounding
I -L uses.
Staff has classified the proposed use as an "indoor recreation facility" because the active
nature of the activity at the proposed soccer center is substantially different from the more
passive activities at a movie theater or video arcade found in what is classified as an "indoor
entertainment facility in the MCC."
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
of the same area;
The adjacent industrial and office uses are compatible with the proposed indoor soccer center.
The applicant has stated in their application that the heaviest periods of usage for the soccer
facility will be evenings and weekends. The usage times of the facility will help to make the
proposed use compatible with the existing industrial uses in the business park.
The Council and Commission should consider public testimony when determining if the
proposed use will change the essential character of the area.
D. That the proposed use, if it complies with all conditions of the approval imposed, will
not adversely affect other property in the vicinity;
Staff does not anticipate that the proposed use will have an adverse affect on the other
property in the vicinity. See Finding C.
The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.
E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establishment of proposed
conditional use shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above. The proposed indoor soccer center will be constructed in
a preexisting business park which is currently served by public facilities.
F. That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;

Staff finds that the proposed use would not create additional requirements at public cost for
public facilities and service and will not be detrimental to the economic welfare of the
community. The proposed soccer center will be located in a preexisting business park which is
already served by urban services.
G. That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors;
Staff anticipates that the proposed use will not be detrimental to any persons, property, or the
general welfare.
H. That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create interference with traffic on the surrounding
public streets. Unlike youth soccer leagues, the applicant's proposed indoor soccer center
will cater to adult soccer leagues which typically have much lower spectator attendance. The
proposed use will not generate the volume of traffic seen at youth soccer games.
I. That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic features exist on the subject property and subsequently
will not be lost, damaged or destroyed by issuance of this conditional use.
SITE SPECIFIC REQUIREMENTS
All exterior lighting, whether attached to the building or located within the parking lot, shall
be down -shielded or otherwise altered so that the light does not spill over onto adjacent
properties or right-of-way. All parking lot fighting shall be in accordance with Ordinance 11-
13-4C.
2. All signage shall be in accordance with the standards set forth in Section 11-14 of the City
Zoning and Development Ordinance. All new signage is subject to design review and shall
require separate permits. Temporary or portable signs shall be prohibited, and shall be
removed upon 3 days notice to the applicant.
3. All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act.
4. As part of a conditional use permit, the City of Meridian may impose additional

restrictions/conditions.
5. Any conditions added by the Planning & Zoning Commission or City Council pertaining to
the parking lot shall be complied with prior to occupancy.
6. Enter into a shared parking agreement with neighboring businesses in the Medimont Business
Park to accommodate any potential parking overflows.
As part of a conditional use permit, the City of Meridian may impose additional
restrictions/conditions.
8. Sanitary sewer and water service shall be from existing service lines on the property.
9. A drainage plan designed by a State of Idaho licensed architect or engineer is required and
shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas.
Storm water treatment and disposal must be designed in accordance with Department of
Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices
for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal
into a surface water is prohibited unless the jurisdiction which has authority over the receiving
stream provides written authorization prior to development plan approval. The applicant is
responsible for filing all necessary applications with the Idaho Department of Water
Resources regarding Shallow Injection Wells.
RECOMMENDATION
Staff recommends approval of the proposed Conditional Use Application with Conditions of
Approval.

The following will be the requirements and/or concerns to provide minimum levels of fire
protection for the proposed project:
1. Commercial occupancies will require a fire -flow consistent with the Uniform Fire
Code to service the proposed project. Fire hydrants shall be placed an average of
400' apart.
2. Acceptance of the water supply for fire protection will be by the Meridian
Water Department.
3. Final Approval of the fire hydrant locations shall be by the Meridian Fire
Department. The proposed fire hydrant locations will be submitted to the Public
Works for plan review.
4. All roads and fire lanes shall have a turning radius of 28' inside and 48' outside.
5. All access roads within the project shall have a clear driving surface with a minimum
width of 20' available at all times.
6. All interior revocations shall comply with the 2000 International Fire Code.

Medimont Subdivision is an 18 -lot industrial subdivision on 26.11 -acres. The applicant is also

F. The applicant is proposing to stub S. Medimont Street at the south property line. District
staff supports the location of the stub street. The applicant should provide a paved temporary
turnaround at the south end of the stub with a temporary easement. Coordinate the
turnaround with District staff.
G. The applicant is proposing to stub E. Kalispell Street at the west property line. District staff
supports the location of the stub street. The applicant should provide a paved temporary
turnaround at the west end of the stub with a temporary easement. Coordinate the
turnaround with District staff.
H. The applicant is proposing a turnaround at the west end of E. Piper Court. District policy
requires a minimum 45 -foot radius for a standard turnaround. The applicant is proposing a
hammerhead type turnaround instead of a standard turnaround. The District will consider
alternatives to the standard turnaround on a case-by-case basis. This will be based on
available space, drainage, maintenance considerations and the written approval of the agency
providing emergency fire service for the area where the development is located. Submit
plans to the District for review and approval.
I. The proposed main project entrance off Franklin Road should be designed with two 21 -foot
street sections with curb, gutter and 5 -foot wide sidewalk separated by a center median and
located approximately 280 -feet west of the east property line. The median should be
constructed to a minimum of 4 -feet wide to total a minimum 100 -square foot area. The
applicant will be required to dedicate 54 -feet of right-of-way plus the additional width of the
median.
J. There is a proposed development across Franklin Road north of this site that has been
pn:aiously approved through MCU -18-96 which has an approved driveway on Franklin Road
that is in conflict with this site's main project entrance. District policy requires a minimum
of 150 -foot offset for driveways on Franklin Road. The subject site is proposing the main
project entrance in conflict with the District's offset requirements from an approved driveway
for MCU -18-96. District staff has spoken with the applicant (Doug Tamura at 343-2931) for
MCU -18-96 and he has agreed to relocate his driveway currently at the west property line of
MCU -18-96, a minimum of 150 -feet from the subject site's main entrance. This applicant
should provide to the District a letter from the representative of MCU -18-96, stating that
they have agreed to relocate their driveway a minimum of 150 -feet east of this project
entrance.

The applicant should relocate or align their main project to be a minimum of 150 -feet from
MCU -18-96's westerly driveway.
K. Due to the expected traffic volumes from this site the applicant should construct an eastbound
right -turn deceleration lane on Franklin Road for the main project entrance. Widen Franklin

entrance to the went side of the main site entrance (Medimont Way). Submit the design to
District staff for review and approval.
The applicant should also construct a westbound left -tum lane on Franklin Road for the main
project entrance (Mediniont Way). Submit the design to District staff for review and
approval. The added turn lane should have the following design elements:
• A design lane width of 14 -feet with a minimum loo -foot of storage east of the
project entrance.
• A painted taper island extending east from the east end of the storage lane for 200 -feet
on Franklin Road.
• A 14 -foot wide shadow taper on the west side of the project entrance, tapering from
14 -feet at the main site entrance to a point 200 -feet to the west.
• See Ada County Highway District's Development Policy Manual, figure 72-178
L. Street name and stop signs are required for Medimont Way, E. Kalispell Street, and E. Piper
Court. The signs may be ordered through the District at the cost of $115. Verification of

M. As required by District policy, restrictions on the width, number and locatiopa of driveways,
may be placed on future development of this parcel.
N. The existing transportation system will be adequate to accommodate the additional traffic
generated by this proposed development with the requirements outlined within this report.
The following requirements are provided as conditions for approval:
Site Specific Requirements:
1. Dedicate 45 -Feet of right-of-way from the centerline of Franklin Road abutting .the parcel (20
additional feet) by means of recordation of a final subdivision plat or execution of a warranty
deed prior to issuance of a building permit (or other required permits), whichever occurs
fnst. The owner will be compensated for this additional right-of-way from available impact
fee revenues in this benefit zone. If the owner wishes to be paid for the additional right-of-
way, the owner must submit a letter of application to the impact fee administrator prior to
breaking ground, in accordance with Section 15 of ACHD Ordinance #188.
2. Provide a $7,225.00 deposit to the Public Rights -of -Way Trust Fund for the cost of
constructing a 5 -foot wide concrete sidewalk on Franklin Road abutting the parcel
(approximately 850 -feet) prior to issuance of any required permits or District approval of a
final plat, whichever occurs first.

Policy Manual, ISPWC Standards and approved supplements, Construction services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building
permit (or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. No change in the terms and.conditions of this approval shall be valid unless they are in
writing and signed by the applicant or the applicant's authorized representative and an
authorized representative of the Ada County Highway District. The burden shall be upon the
applicant to obtain written confirmation of any change from the Ada County Highway
District.
8. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require :he applicant to comply with all rules, regulations, ordinances,
plans, or other regulatory and legal restrictions in force at the time the applicant or its
successors in interest advises the Highway District of its intent to change the planned use of
the subject property unless a waiverlvariancc of said requirements or other legal relief is
granted pursuant to the law in effect at the time the change in use is sought.
Conclusion of Law:
ACHD requirements are intended to assure that the proposed use/development will not place
an undue burden on the existing vehicular and pedestrian transportation system within the

STORM WATER MANAGEMENT RECOMMENDATIONS

Thank you for your review regarding the proposed Meridian Soccer Center in the
Stonebridge Business Park. After some investigation myself, I discovered that a
privately owned pressurized irrigation system currently exists within the Stonebridge
Business Park. Attached is a letter from the property owner attesting that the system
exists and who manages the irrigation.
Currently, the owner for the proposed Meridian Soccer Center has applied for a
Conditional Use Permit with the City of Meridian. The proposed project will occupy an
existing lot within an existing business park. As stated above, a pressurized irrigation
system exists and is accessible for the Meridian Soccer Center's use. Therefore, I do not
believe the Land Use Change Application, Construction Contract for the Pressurized
Urban Irrigation System, and Change of Land Use or Site Development are applicable to
the owner of the Meridian Soccer Center. The proposed Soccer Center will be a new
structure within an existing development with a pressurized irrigation system already in
place.

Conditional Use Permit with the City of Meridian. The proposed Soccer Center will be
