At our request, revised plans were submitted on April 9, .1998, by the Applicant's representative. The application submitted is also confusing because of references to a subdivision plat, when, in fact, a subdivision is not being proposed at this time. Due to the short time frame allowed for review of the revised plan, we respectfully request that this item be continued to the May P&Z Commission meeting. The Applicant could continue with the public hearing in order to hear any input that might be forthcoming, but we believe that the surrounding property owners need to be re -noticed and publicized due to the significant change. We also find that this development is located in census tract 103.12 and in the attendance zone for Merdian Elementary School, Meridian Middle School and Meridian High School. Using the above information we can predict that these homes, when completed, will house 6 elementary aged children, 6 middle school aged children, and 4 senior high aged students. This development will cause additional overcrowding in all three schools. The cost per student for newly constructed schools, excluding site purchase price and offsite improvements, exceeds $5,000 per elementary student and $10,000 per middle or high school student. Even though, we are in a difficult position and need your help in dealing with the impact of growth on schools, we will approve this subdivision. Other than the access point specifically approved with this application, direct lot or parcel access to Pine Avenue is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. Standard Requirements: A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the ACHD Planning and Development Supervisor. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The project has been revised to allow for future right-of-way extension of Idaho Street, which will run along the south end of the townhouse project. Idaho Street improvements will be trusted with the A.CH.D., and no improvements will be done until the entire roadway alignment can be constructed through numerous parcels of land lying to the east, west, and south. In the meantime, access to the project will be off of Pine Street, and an approved emergency turn -around will be incorporated at the south end. Once Idaho Street is improved, then access to the townhouses will be by way of Idaho Street and the Pine Street entrance will be closed to vehicular traffic. Bollards will be placed at the entrance so that pedestrian and bicycle traffic will still be encouraged. Again, emergency turn -around capabilities will be provided for at the north end of the project when the Pine Street entrance is closed. It is intention that Oliason Lane be and continue to be a private road, and the A.C.H.D. is in support of this concept. Also, this application is being submitted as a C.U.P., with no preliminary plat application at this time. The developer simply wants to make his intentions known right up front that he is proposing a townhouse development. The owner will be compensated for any additional right-of-way from available impact fee revenues in this benefit zone. If the owner wishes to be paid for the additional right-of-way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance #188. 2. Dedicate 25 -feet of right-of-way from the extended centerline of Idaho Avenue abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. The owner will not be compensated for this additional right-of-way. 3. Provide an $8,000.00 deposit to the Public Rights -of -Way Trust Fund for the cost of constructing curb, gutter and 5 -foot wide concrete sidewalk and pavement widening to one half of a 37 -foot street section on Idaho Avenue extended abutting south property line of the parcel (approximately 222 -feet) prior to issuance of any required permits or District approval of a final plat, whichever occurs first. 4. Construct a 5 -foot wide concrete sidewalk located 2 -feet within the new right-of-way on Pine Avenue abutting the parcel (approximately 222 -feet). 5. Construct a 24 to 36 -foot wide approach for the private road located as proposed 100 -feet west of the east property line. Pave the roadway its full width to at least 30 -feet beyond the edge of pavement of Pine Avenue and install pavement tapers with 15 -foot radii abutting the existing roadway edge. The applicant should provide a plan showing how the private road grade meets the public road. District Policy requires a design approach speed of 20 MPH and a maximum intersection approach grade of 2 % for at least 40 -feet. Street name and stop signs are required for the private road. The signs may be ordered through the District at the cost of $115. Verification of the correct approved name of the road is required 6. ACHD does not make any assurances that the private road which is a part of this application will be accepted as a public road if such a request is made in the future. Substantial redesign and reconstruction costs may be necessary in order to qualify this road for public ownership and maintenance. 7.
