NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, at the hour of 7:00 p.m., on April 14, 1998, for the purpose of
reviewing and considering the application of Tony Hickey, for a conditional use permit
for 20 townhouses for Oliason Park Subdivision No. 1 of land located in the NW '/4 SE
'/4 of Section 7, T.3N., R1 E., Boise Meridian, Ada County, Idaho, and which property is
generally located east of 603 East Pine.
A more particular legal description of the above property is on file in the City
Glerk's office at Meridian City Hall, 33 East Idaho Street, and is available for inspection
during regular business hours.
A copy of the Application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony.

CONDITIONAL USE APPLICATION
Dear Commission Members,
Oliason Park has many characteristics that make the subdivision a desirable
conditional use.
Oliason Park will indeed constitute a conditional use. The property is currently
zoned R-1 and the proposed zoning is R-15. Oliason Park is a development that
fits well with the Comprehensive Plan and Ordinance 2-418 C.
Oliason Park will be designed, constructed, and maintained to be appropriate in
appearance with the character of the vicinity and surrounding homes. The
dwellings are architecturally appealing, and will be constructed in accordance
with the uniform building code using quality materials and workmanship. Each
structure will be individually owned, which will contribute to the pride of
ownership. Oliason Park will not be hazardous or disturbing to existing or future
neighborhood uses.
Oliason Park will be served adequately by all essential public facilities. Oliason
Park development will provide quality, safe housing within safe walking
distance to major shopping areas, downtown Meridian, city parks, and public
services. The development will serve a housing niche for comfortable,
affordable housing close to the city center, and Oliason Park will limit the urban
housing sprawl.

meeting held April 14, 1998. You have a copy of the minutes. Are there any
corrections, deletions, changes to the minutes that you would like to make at this time?

Dear Councilmen:
I have reviewed the plat for Oliason Park Subdivision No. 1 and find that it includes approximately 20
townhomes. We also find that this development is located in census tract 103.12 and in the attendance
zone for Merdian Elementary School, Meridian Middle School and Meridian High School.
Using the above information we can predict that these homes, when completed, will house 6 elementary
aged children, 6 middle school aged children, and 4 senior high aged students. This development will
cause additional overcrowding in all three schools. The cost per student for newly constructed schools,
excluding site purchase price and offsite improvements, exceeds $5,000 per elementary student and
$10,000 per middle or high school student.
Even though, we are in a difficult position and need your help in dealing with the impact of growth on
schools, we will approve this subdivision.

Attached are revised copies of the above captioned project pursuant to a
~ technical. review meeting with the Ada County Highway District.
o The project has been revised to allow for future right-of--way extension of
~, Idaho Street, which will run along the south end of the townhouse project.
J M Idaho Street improvements will be trusted with the A.CH.D., and no
~ improvements will be done until the entire roadway alignment can be

`~ constructed through numerous parcels of land lying to the east, west, and
south. In the meantime, access to the project will be off of Pine Street, and an
Z approved emergency turn-around will be incorporated at the south. end.
o Once Idaho Street is improved, then access to the townhouses will be by way
O ~ of Idaho Street and the Pine Street entrance will be closed to vehicular traffic.
O Bollards will be placed at the entrance so that pedestrian and bicycle traffic

The Nampa & Meridian Irrigation District requires that a Land Use Change/Site Development
application be filed for review prior to final platting. Contact Donna Moore at 466-7861 for
further information.
All laterals and wasteways must be protected. All municipal surface drainage must be retained
on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation District must
review drainage plans. The developer must comply with Idaho Code 31-3805. It is
recommended that irrigation water be made available to all developments within the Nampa &
Meridian Irrigation District.

SUBJECT: Request for Annexation and Zoning to R-15 with a Conditional Use Permit for a
Planned Development for Oliason Park - 20 Units on 1.89 Acres by Tony Hickey
Since this application was submitted, Ada County Highway District's requirements have caused a
significant change in the design of this project, calling for extension of Idaho Street and blocking off
the access to Pine Street at such time as Idaho Street will be developed. At our request, revised plans
were submitted on Apri19, ,1998, by the Applicant's representative. The application submitted is also
confusing because of references to a subdivision plat, when, in fact, a subdivision is not being
proposed at this time.
Due to the short time frame allowed for review of the revised plan, we respectfully request that this
item be continued to the May P&Z Commission meeting. The Applicant could continue with the
public hearing in order to hear any input that might be forthcoming, but we believe that the
surrounding property. owners need to be re-noticed and publicized due to the significant change. The
Applicant will be responsible for all additional charges necessitated by the re-notification and
publication.

road is in alignment with a driveway on the north side of Pine Avenue and meets District
policy's required 150-foot of separation between driveways
D. Tl~e City of Meridian staff and District staff are planning to extend Idaho Avenue from it's
current terminus at 6th Street further to the east. The applicant abuts 200-feet of the
proposed extension of Idaho Avenue. The applicant should be required to provide a deposit
to the Public Rights-of--Way Trust Fund for the cost of constructing curb, gutter and 5-foot
wide concrete sidewalk and pavement widening to one half of a 37-foot street section on
Idaho Avenue extended abutting the parcel (approximately 222-feet) prior to issuance of any
required permits or District approval of a final plat, whichever occurs first.

3. Provide a $8,000.00 deposit to the Public Rights-of--Way Trust Fund for the cost of
constructing curb, gutter and 5-foot wide concrete sidewalk and pavement widening to one
half of a 37-foot street section on Idaho Avenue extended abutting south property line of the
parcel (approximately 222-feet) prior to issuance. of any. required permits or District approval
of a final plat, whichever occurs first.
4. Construct a 5-foot wide concrete sidewalk located'2-feet within he new right-of--way on Pine
Avenue abutting the parcel (approximately 222-feet).
~5. Construct a 26-foot wide approach for the private road located as proposed 100-feet west of
the east property line. Pave the roadway its full width (24-feet minimum) at least 30-feet
beyond the edge of pavement of Pine Avenue and install pavement tapers with 15-foot radii
abutting the existing roadway edge. The applicant should provide a plan showing how the
private road grade meets the public .road. District Policy requires a design approach speed of
20 MPH and a maximum. intersection approach grade of 2 % for at least 40-feet.
Street name and stop signs. are required for the private road. The signs may be ordered
through the District at the cost of $115. Verification of the correct approved name of the
road is required.
6. ACRD does not make _any assurances that the private road which is a part of this application
will be accepted. as a public road if such a rea at is made in the future. Substantial redesign
and reconstruction costs may be necessary in order to qualify this road for public ownership
and maintenance.
7. Utility street cuts in new pavement less than five years old are not allowed unless approved in
writing by the District. Contact Construction Services at 387-6~;i (with file numbers) for
details.
8. Other than the access point specifically approved with this application, direct lot or parcel
access to Pine Avenue is prohibited. Lot access restrictions, as required with this
application, shall be stated on the final plat.
Standard Requirements:
1. A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACRD Planning and Development Supervisor. The request
shall specifically identify each requirement to be reconsidered and include a written
explanation of why such a requirement would result in a substantial hardship or inequity!
The written reauest shall be ubmitted to the District no later than 9.00 a m on the day
scheduled for ACHD Commission action Those items shall be rescheduled for discussion
with the Commission on the next available meeting agenda.

Dear Commission Members,
Oliason Park has many characteristics that make the subdivision a desirable
conditional use.
Oliason Park will indeed constitute a conditional use. The property is currently
zoned R-1 and the proposed zoning is R-15. Oliason Park is a development that
fits well with the Comprehensive Plan and Ordinance 2-418 C.
Oliason Park will be designed, constructed, and maintained to be appropriate in
appearance with the character of the vicinity and surrounding homes. The
dwellings are architecturally appealing, and will be constructed in accordance
with the uniform building code using quality materials and workmanship. Each
structure will be individually owned, which will contribute to the pride of
ownership. Oliason Park will not be hazardous or disturbing to existing or future
neighborhood uses.
Oliason Park will be served adequately by all essential public facilities. Oliason
Park development will provide quality, safe housing within safe walking
distance to major shopping areas, downtown Meridian, city parks, and public
services. The development will serve a housing niche for comfortable,
affordable housing close to the city center, and Oliason Park will limit the urban
housing sprawl.
