ordinance. The ordinance pertains to a rezone of the Midtown Square development, fly located
on the south side of Cherry Ln. and Crestmont Dr. befinreen Meridian and Linder. The applicant, Steven
Ricks, submitted an application to rezone three (3) frontage Tots in the development (approx. 2.89
acres) from R-4 to L-0 and to rezone the remaining residential lots (approx. 13.5 acres) from R-4 to R
8.
The attach Firx#rrgs of Fae~ and Corrdusiovas o~ Law prepped for the July 20, 1993 City Courra`t
meeting recaYxnend approval for Math the R-8 and L-0 rezone requests. IYe highlighted and tagged
these pertinent sections. However, the approved ordinance only references the R-4 to R-8 rezone and
includes no language regarding the R-4 to L-0 rezone for the frontage piece. There is nothing in the
minutes from the Council meeting to infer that the Courx;il did not want the L-0 lots approved; it
appears to simply have been a clerical oversight when tying up the ordinance.
The zoning map has, since the passage of this ordnance, irxJorrecUy identified the front, 2.89 acre
section of the Midtown plat as R~4, no# L-0. I've already requested that APA rrrake the c~rr~ection to the
zoning map, but WII suggested I also inform you of the discrepancy.
Let me known if there's arrything else you need in order to make the correction.

We have reviewed this submittal and offer the following comments, as conditions of the final plat.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
SITE SPECIFIC COMMENTS
1. Please submit a copy of the Ada County Street Name Committee's final approval letter for
the Subdivision name, lot and block numbering, and street names. Make any corrections
necessary to conform.
2. Please address, in written form, all items contained in this memorandum (both General and
Site Specific) and submit to the City Clerk's office by 5:00 PM, Friday, June 5, 1998.
3. Sanitary sewer and domestic water service to these lots will be via existing mains installed in
previous phases of this development.
4. Please add or revise the following notes:

We recommend that stormwater be pretreated through a grassy Swale prior to
discharge to the subsurface to prevent impact to groundwater and surface water

design a stormwater management system that is preventing groundwater and

The Nampa & Meridian Irrigation District requires that a Land Use Change/Site Development
application be filed for review prior to , final platting. Contact Donna Moore at 466-7861 for
further information.
All laterals and wasteways must be protected. All municipal surface drainage must be retained
on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation District must
review drainage plans. The developer must comply with Idaho Code 31-3805. It is
recommended that irrigation water be made available to all developments within the Nampa &
Meridian Irrigation District.

Facts and Findings:

A. The Ada County Highway District (ACHD) staff has reviewed the above referenced application
requesting preliminary plat approval for atwo-lot commercial subdivision. The 2.67-acre site is
located at the southeast corner of Cherry Lane and Crestmont Drive. This development is
estimated to generate less than 100 additional vehicle trips per day based on the Institute of
Transportation Engineers Trip Generation manual.
The site is already developed. The current application is a resubdivision of Lot 1, Block 1, of an
existing one-lot development. The original subdivision, Midtown Square was approved in 1994.
B. The applicant is not proposing any new driveways on Cherry Lane or Crestmont Drive with this
application. The site has an existing driveway on Crestmont Drive located 215-feet south of
Cherry Lane. The driveway aligns with McFadden Drive on the west side of Crestmont Drive.
The location of the driveway meets District policy. ~~,
C. The application and site plan stamped as received by the City of Meridian on May 29; 1 y~8, and
submitted to the District on June 1, 1998, have been reviewed by the ACHD Planni_r~g and
Development staff and conforms to applicable District standards/policy, or can he made to
conform with the change(s) to the plan described in the requirements stated below.
This is a staff level approval and will not be heard by the ACHD Commission unless the site plan
is changed in such a manner as to not conform with District standards/policy or an appeal of the
Development Services staff decision is submitted as described within the Standard Requirements
outlined below.

The following requirements are provided as conditions of approval to the City of Meridian:
Site Specific Requirements:
Provide a recorded cross access easement between the proposed lots for access to the public
streets prior to issuance of a building permit (or other required permits).
2. The existing driveway on Crestmont Drive, located approximately 215-feet south of Cherry
Lane, is approved with this application.
Utility street cuts in new pavement less than five years old are not allowed unless approved in
writing by the District. Contact Construction Services at 387-6280 (with file number) for details.
4. As required by District policy, restrictions on the width, number and locations of driveways,
shall be placed on future development of this parcel.
5. No driveways are proposed on Cherry Lane and none are approved with this application. Direct
lot or parcel access to Cherry Lane is prohibited. Lot access restrictions, as required with this
application, shall be stated on the final plat.
Standard Requirements:
1. This decision of the Planning and Development Supervisor maybe appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar days from
the date of this report. The regl~e~t Ghall Specifically id n i each re4uirement to be
rPronSidered and include a ~=~ritten explanation of why such a re4uirement would result in a
substantial hardshi op r ine4uity. The request will be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. The re~»PSt for reconsideration shall
~necifically identi y each re4uirement to be reconsidered and include written documentation of
data that waS not available to the Commission at the time of it's original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified of
the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in accordance
with Ordinance #188, also known as Ada County Highway District Road Impact Fee Ordinance.

4. All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACRD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or
other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless awaiver/variance of said requirements or other legal relief is granted pursuant to
the law in effect at the time the change in use is sought.
8. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Conclusion of Law:
ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.
