Characteristics of the property which prevent compliance with the ordinance: Two blocks (Block 4 & 1) exceed the maximum block length of 1,000 feet. The unusual configuration of the parcel the Eight Mile Lateral and golf course along exterior boundaries limits the lot layout alternatives and creates longer block lengths. The block lengths are excessive due to the inability to break blocks with a public street. A dog -leg area intrudes into the golf course. This area can only be developed with a cul- de-sac which exceeds the 450' maximum length by 70 feet. 13. Section 9-605B(6) "No street which ends in a cul-de-sac or a dead-end shall be longer than four hundred fifty feet (450'). 981016\variance-app Section 9-605E Blocks: " Every block shall be designed... no more than one thousand feet (1,000') in length." 14, 15 & 16 Hardship: It would be impossible to break up the block lengths or reduce the cul- de-sac length. The unusual configuration of the property inhibits compliance with the maximum block length. The adjoining lateral and configuration of the parcel creates a natural hindrance for compliance. The addition of stub streets for block length reduction would serve no purpose with the Canal and golf course along the exterior. 17. Development of the property would be prohibited if no flexibility on block length or cul- de-sac length was allowed. 18. The existing canal and configuration of the property are not a result of actions by the applicant. 19. The granting of these variances does no imply special privilege to the applicant since similar variances have been granted on other projects with the similar restrictive topographic characteristics. 20. The Variance request is confined to standards within the Zoning Ordinance and not addressed in the Comprehensive Plan. 21. Fee attached. 22. The present land use of subject property is presently zoned as (R-4) Low Density Residential District, and contains 14.78 acres, more or less. 6. The proposed land use of subject property is to develop the subject property in the following manner: 44 lot single family residential development. 7. The proposed site of the subject property is bordered on the east side by Ashford Greens and west of the Lake at Cherry Lane #4 of the property site. 8. That a vicinity map of the proposed scale approved by the City Council showing property lines, existing streets, proposed district and such other items as required have been furnished. 9. That the vicinity map, of which is attached to these findings marked Exhibit "A" has been supplied. 10. Single family dwellings are proposed and the variance requested is unrelated to the building pads or setbacks. 11. The Applicant seeks a variance of the following provision of the Revised and Compiled Ordinances of the City of Meridian, Section 11-9-605(B)(6), CUL-DE-SACS, which provides: FINDINGS OF FACT AND CONCLUSIONS OF LAW AND -- Page 5 of 11 ORDER OF DECISION GRANTING A VARIANCE / STEINER DEVELOPMENT Cul -De -Sacs: No street which ends in a cul-de-sac or a dead-end shall be longer than four hundred fifty feet (450'). And Section 11-9-605E, BLOCKS, which provides: Blocks: Every block shall be so designed as to provide two (2) tiers of lots, except where lots back onto an arterial street, natural feature or subdivision boundary; blocks shall not be less than five hundred feet (500') nor more than one thousand feet (1,000) in length. 12. The existence of special circumstances or conditions affecting the property and the characteristics of the property which prevent compliance with the ordinance: Two blocks (Block 4 SL 1) exceed the maximum block length of 1,000 feet. The unusual configuration of the parcel the Eight Mile Lateral and golf course along exterior boundaries limits the lot layout alternatives and creates longer block lengths. The block lengths are excessive due to the inability to break blocks with a public street. A dog -leg area intrudes into the golf course. This area can only be developed with a cul-de-sac which exceeds the 450' maximum length by 70 feet. 13. Strict compliance with the requirements of § 11-9-605(B)(6) and 11-9- 605E of the Revised and Compiled Ordinances of the City of Meridian would result in extraordinary hardship to the owner, and developer, because the conditions and requirements of the ordinance would result and be impossible to break up the block lengths or reduce the cul-de-sac length. The unusual configuration of the property inhibits compliance with the maximum block length. The adjoining lateral and configuration of the parcel creates a natural hindrance for compliance. The addition of stub streets for FINDINGS OF FACT AND CONCLUSIONS OF LAW AND -- Page 6 of 11 ORDER OF DECISION GRANTING A VARIANCE / STEINER DEVELOPMENT 0 block length reduction would serve no purpose with the Canal and golf course along the exterior. 14. The variances requested are not out of convenience but from necessity. The configuration of the parcel was determined by prior developments (i.e., sewer and water previously installed in Moon Lake Drive.), and the golf course. The variance is not profit oriented, it is due to practicality. 15. The granting of the requested variance will not be detrimental to the public's welfare or injurious to other property in the area of the proposed plat, and, in fact, the development of the plat in accordance with the conditions of approval and the requirements of the Subdivision Ordinance will prevent the conditions which are the source of the complaints raised in the public hearing of this matter. 16. The granting of this variance will not have an effect of altering the interest and purpose of the Subdivision or Development Ordinance and or the City's Comprehensive Plan. 17. The applicant paid the fee established by the City Council for application variance. CONCLUSIONS OF LAW 1. The City of Meridian has authority pursuant to the enactment of the Local Land Use Planning Act of 1975 codified at Chapter 65, Title 67, and in particular, by the FINDINGS OF FACT AND CONCLUSIONS OF LAW AND -- Page 7 of 11 ORDER OF DECISION GRANTING A VARIANCE / STEINER DEVELOPMENT provisions of Idaho Code § 67-6516 to provide as part of its zoning ordinance for the process of applications for variance permits. 2. The City of Meridian has exercised its authority of Idaho Code § 67-6516 by the enactment as a part of its Zoning and Development Ordinance variances, as set forth in § 11-2-419 of the Municipal Code of the City of Meridian. 3. That the requirements for the processing of a variance request are set forth in Idaho Code §§ 67-6509, 6516 and §§ 11-2-416E and 418E Municipal Code of the City of Meridian. 4. Application and standards for variances are set forth in § 11-2-419B Municipal Code of the City of Meridian, and the findings which are required are set forth in § 11-2-419C, include required findings that there are special circumstances or conditions affecting the property that strict application of the provisions of Zoning and Development Ordinance would clearly be impracticable and unreasonable, and a finding that strict compliance with the requirements of the Zoning and Development Ordinance would result in extraordinary hardship to the owner, subdivider or developer because unusual topography, the nature or condition of adjacent development, or other physical conditions or other conditions that make strict compliance with the ordinance unreasonable under the circumstances, or that the conditions and requirements of said ordinance will result in inhibiting the achievements or the objectives of the ordinance, and FINDINGS OF FACT AND CONCLUSIONS OF LAW AND -- Page 8 of 11 ORDER OF DECISION GRANTING A VARIANCE / STEINER DEVELOPMENT 0 0 that the granting of a specified variance will not be detrimental to the public's welfare or injurious to other property in the area in which the property is situated, and that such variance will not have the effect of altering the interest and purposes of the Zoning and Development Ordinance and the Meridian Comprehensive Plan. 5. Section 11-9-605(B)(6), CUL-DE-SACS, and Section 11-9-605E, BLOCKS, of the Revised and Compiled Ordinances of the City of Meridian provides for an R-4 zone that states in part as follows: Cul -De -Sacs: No street which ends in a cul-de-sac or a dead-end shall be longer than four hundred fifty feet (450'). The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship r inequity. The written request shall be submitted to the District no later than 9.00 a.m. on the d1, scheduled for LAKESAT9.CNINI _ -Page 3 ACHD Commission action Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within six days of the action and shall include a minimum fee o f $110.00. The request for reconsideration shall specifically identify each regLiirement to he reconsidered and include written documentation of data that was not available to the Commission at the time of its original derision The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance m188, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Stiles: Mr. Mayor and Council, this is for a property that you previously reviewed for a plat. It's located on the golf course. It's in between Ashford Greens and other phases of the Lakes at Cherry Lane. With the design that they have, this would be where a proposed Wilkins Ranch Subdivision once came before you that was denied. They have this block length that exceeds our 1,000 -foot block length. They do have a proposed stub street that would come in this area and also the cul-de-sac length, I believe, exceeds our maximum. They are requesting a variance for the cul-de-sac and block length requirements. This is also the Eight Mile Lateral running along here. If they did stub into this property, they would need to build a bridge, and that's all the information I have. Corrie: Okay. I'll entertain the developer to testify first, and if we have any questions as referenced to the Findings of the Planning and Zoning director. Becky. This cul-de-sac exceeds the 450 by approximately 70 feet, so it's 520 feet and then we've got this continuation of a block here and the block here that exceeds the 1,000 -foot maximum block length. This particular variance application does meet the requirements for a variance. Stiles: Mr. Mayor and Council, this is for approximately 40 -acre parcel at the southeast corner of Black Cat and Cherry Lane. It's bisected by the Ten Mile drain. They're proposing this to be a common area here. I don't have the latest version of the plat. Hopefully you have that in your packets. I didn't have a reduced version of that to present tonight. Ada County Highway District requested them to cul-de-sac this area here and to bring this road through. They do currently show that this is a storage lot, and we've discussed with them that storage is not a permitted use in the R-4 zone and they would have to make that into building lots. This would be a drainage lot here, and they also have a large lot here that would be for single-family residential only unless they submitted some kind of a rezone application for that. They have made some modifications to the roadway system based on Ada County Highway District's request. This road would go straight through, and then they have brought this through with a knuckle that would come on down here. They also proposed a pathway system. It is shown on their plat for a greenbelt along the Ten Mile. They also have on their notes that would need to be revised that they are showing access from this storage – proposed storage lot and the drainage lot directly to Black Cat and no access would be approved except for the public road systems that are approved by Ada County Highway District. Gary has worked with them on some sewering of the property, and he may want to address those items.
