The zoning district of Light Industrial (I-L) is defined within the City of Meridian Zoning and Development Ordinance, Section 11-2-408(14). 7. The proposed application requests a conditional use permit for construction and development of multiple buildings on a single lot. The Light Industrial (I-L) zoning designation within the City of Meridian Zoning and Development Ordinance requires that the proposed use be treated as a planned unit development. Meridian City Zoning and Development Ordinance Section 11-2-409(B) requires a conditional use permit be obtained for the proposed use. 8. Prior to granting a conditional use permit in a Light Industrial District (I- L), a public hearing shall be conducted with notice to be published and provided to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the land under consideration for the conditional use permit all in accordance with the provisions of Section 11-2-418E City of Meridian Zoning and Development Ordinance, which provides as follows: "Prior to approving a Conditional Use Permit, the applicant and the Commission and Council shall follow notice and hearing procedures provided in Section 11-2-416, Zoning Amendment Procedures, of this Ordinance. Provided; however, that Conditional Use applications for land in Old Town and in Industrial and Commercial Districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission and after the recommendation of the Commission is made the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 7. It's pretty a straight forward project just to advise you, they are coming in with a condominium project for this that you will be seeing later, but we had no problems with this as it's already in a developed industrial subdivision. Stiles: Mr. Mayor and Council, the only comment I had would be on page 4. This would also require Findings of Fact and Conclusions of Law. Item 1.18 be changed to read 17 foot long parking spaces shall be allowed due to overhang area provided. I would also like to request since there are findings required for this -- Findings of Fact and Conclusions of Law required for this project, they would like, to be able to submit their building permit and if Findings are required it's going to take a little bit longer for it to be officially approved. I would like to start processing the building permit application so they could get going. Corrie: Okay, Shari, I have another question for you. On page 4, 1.14, it says landscaping of 20 foot wide strip adjacent to Meridian Road shall be provided south of the proposed property line as part of this development. Have they agreed to that? Stiles: I haven't had a direct objection to it. They did mention it in the Planning and Zoning pubic hearing. They're proposing for their access to the property to be quite a bit south of where they propose to split the properly. Ralston Street in Railside Parlc, Meridian, Idaho. 4. The owner of record of the subject property is Railside Development Inc. of PO Box 5405, 4414 S. Gelder Lane, Boise, Idaho. 5. Applicant is Wes Worcester dba Santee Construction of 10065 Westview, Boise Idaho. 6. The subject property is currently zoned Light Industrial (I-L). The zoning district of Light Industrial (I-L) is defined within the City of Meridian Zoning and Development Ordinance, Section 11-2-408(14). 7. The proposed application requests a conditional use permit for construction and development of multiple buildings on a single lot. The Light Industrial (I-L) zoning designation within the City of Meridian Zoning and Development Ordinance requires that the proposed use be treated as a planned unit development. Meridian City Zoning and Development Ordinance Section 11-2-409(B) requires a conditional use permit be obtained for the proposed use. 8. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. 9. The Meridian City Council takes judicial notice of its Zoning, FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS WES WORCESTER, dba SANTEE CONSTRUCTION - 3 • Subdivision and Development Ordinances codified at Title 11, Municipal Code of the City of Meridian and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian, adopted December 21, 1993, Ord. No. 629-Jan. 4, 1994 and Maps and the Ordinance establishing the Impact Area Boundary. 10. Giving due consideration to the comment received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian: Adopt the Planning and Zoning Administrator and Assistant City Engineer Recommendations as follows: 10.1 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. Plans shall be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Worlcs Department. No variances have been requested for tiling of any ditches crossing this project. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS WES WORCESTER, dba SANTEE CONSTRUCTION - 4 ~ ~ 10.2 Any existing domestic wells and/or septic systems within this project shall be removed from their domestic service per City Ordinance Section 5-7- 517. Wells may be used for non-domestic purposes such as landscape irrigation. 10.3 Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 10.4 Paving and striping shall be in accordance with the standards set forth in Sections 11-2-414.D.4 and 11-2-414.D.5 of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 10.5 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 10.6 Outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-14.D.3. 10.7 All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. No temporary signage or flashing signs will be permitted. 10.8 Applicants shall provide five-foot-wide sidewalks in accordance with City Ordinance Section 11-9-606.B. 10.9 All construction shall conform to the requirements of the Americans with Disabilities Act. 10.10 Applicant shall provide a revised site plan detailing all existing and proposed utilities for review by the Meridian Public Worlcs Department. Designer shall coordinate sizing and routing of sanitary sewer and water within the development with the Public Worlcs Department. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS WES WORCESTER, dba SANTEE CONSTRUCTION - 5 10.11 Applicant shall provide the Public Worlcs Department with information on anticipated fire flow and domestic water requirements for the proposed site. Flow and pressure from the existing mains shall be monitored with the Meridian Water Department to determine whether adequate fire protection exists. 10.12 Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. In addition to these assessments, "Late Comers" fees may also be charged against this parcel to help reimburse the parties responsible for installing mains. Applicant may participate in the cost of the sewer trunk line extension at time of its construction. 10.13 An appropriate number of three-inch (3") caliper trees are shown on the site plan. Landscape plan is not to be revised without prior written approval of the Planning and Zoning Department. 10.14 Signage shall be limited to one low-profile monument type sign. Sign shall be placed outside of sight triangle. Detailed signage plans will be subject to design review. 10.15 Applicant shall coordinate the location and sizing requirements of the trash enclosure with Sanitary Services, Inc. and obtain written approval of the plans prior to applying for building permits. 10.16 Application shall provide a letter of approval from Ada County Highway District with submittal of site plan prior to issuance of Certificate of Zoning Compliance. 10.17 All outdoor storage of equipment and material must be enclosed with a screening fence. 10.18 Handicap parking, associated signage and building construction shall meet the requirements of the Americans with Disabilities Act. Adopt the Meridian Fire Department's Recommendations as follows: 10.19 Applicants shall satisfy all fire code requirements. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS WES WORCESTER, dba SANTEE CONSTRUCTION - 6 10.20 A fire hydrant shall be added unless it is determined by the Fire Department there is not enough water for fire flow in which case the applicant shall add a fire sprinkler system. Adopt the Ada County Highway District's Recommendations as follows: 10.21 Driveways shall be located a minimum of SO-feet from any intersection, as measured near edge of driveway to back of curb. 10.22 Driveways shall be a minimum of 30-feet wide and a maximum of 40-feet wide, paved a minimum of 30-feet beyond the back of sidewalk. Shared driveways are encouraged. 10.23 Restrictions on the width, number and locations of driveways, shall be placed on future development of this parcel. 10.24 Direct lot or parcel access to Locust Grove Road and Pine Avenue is prohibited. 11. To maintain compliance with the Comprehensive Plan, the project should be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing and intended character of the general vicinity and that such intended conditional use will not change the essential character of the requests. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS WES WORCESTER, dba SANTEE CONSTRUCTION - 7 CONCLUSIONS OF LAW The City Council adopts as its Conclusions of Law the Recommendations 10.1 through 10.24 of the Recommendations to City Council made in the above entitled matter by the Planning and Zoning Commission which are incorporated herein by reference as if set forth at length. 2. The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the "Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503). 3. The Meridian Planning and Zoning Commission may exercise all the powers required and authorized under the "Act" except the power to adopt ordinances by the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho Code Section 67-6504 which the City Council of the City of Meridian has established by the passage of the "City of Meridian Zoning and Development Ordinance" at Title XI, Chapter 1, Municipal Code of the City of Meridian. 4. As part of a zoning ordinance the City Council can, subject to hearing and notice provision required, provide for the process of special and/or conditional use permits which a proposed use is otherwise prohibited by the terms of the ordinance but allowed with conditions under the specific provisions of the ordinance which the City of Meridian has done in the adoption of its zoning ordinances. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS WES WORCESTER, dba SANTEE CONSTRUCTION - 8 5. The City Council has the duty and responsibility to review the facts and circumstances of each application for conditional use permit to determine prior to granting the same that the evidential showing supports the finding that the following standards are met and that the proposed development: (Section 11-2-418, City of Meridian Zoning and Development Ord.): a. Will, in fact, constitute a conditional use as determined by City policy; b. Will be harmonious with and in accordance with the Comprehensive Plan and this Ordinance; c. Will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance with the existing or intended character of the general vicinity and that such use will not change the essential character of the same area; d. Will not be hazardous or disturbing to existing or future neighboring uses; e. Will be served adequately by essential public facilities and services such as highways, streets, police and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; f. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS WES WORCESTER, dba SANTEE CONSTRUCTION - 9 persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; h. Will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; and Will not result in the destruction, loss or damage of a natural or scenic feature of major importance. b. Prior to granting a conditional use permit in a Light Industrial District (I- L), a public hearing shall be conducted with notice to be published and provided to property owners or purchasers of record within three hundred feet (300') of the external boundaries of the land under consideration for the conditional use permit all in accordance with the provisions of Section 11-2-418E City of Meridian Zoning and Development Ordinance, which provides as follows: "Prior to approving a Conditional Use Permit, the applicant and the Commission and Council shall follow notice and hearing procedures provided in Section 11-2-416, Zoning Amendment Procedures, of this Ordinance. Provided; however, that Conditional Use applications for land in Old Town and in Industrial and Commercial Districts shall only be required to have one public hearing which shall be held before the Planning and Zoning Commission and after the recommendation of the Commission is made the application shall go before the City Council without a public hearing and the Council may approve, deny, or modify the recommendation of the Commission." 7. Following the public hearing and within 45 days after the conclusion of the public hearing the Commission shall, transmit its recommendations to the Meridian City Council with supportive reasons. The Commission shall recommend FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS WES WORCESTER, dba SANTEE CONSTRUCTION - 10 ~J that the application be approved, approved with conditions or denied. The Commission shall ensure that any approval or approval with conditions of an application shall be in accordance with Meridian Comprehensive Plan, City of Meridian Zoning and Development Ordinance, and Idaho State law. (Section 11-2- 418(f), City of Meridian Zoning and Development Ordinance.) 8. When the City Council approves a conditional use permit it may impose conditions of that approval that reasonably: 8.1 Minimize adverse impact on other development; 8.2 Control the sequence and timing of development; 8.3 Control the duration of development; 8.4 Assure that the development is maintained property; 8.5 Designate the exact location and nature of the development; 8.6 Require the provision for on-site public facilities or services; and 8.7 Require more restrictive standards than those generally required, in this Ordinance. 9. The City of Meridian has, by ordinance, established the Impact Area and the Comprehensive Plan of the City of Meridian, which was adopted December 21, 1993, Ord. 629, January 4, 1994 and Maps. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS WES WORCESTER, dba SANTEE CONSTRUCTION - 11 • DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING FINDINGS OF FACT AND CONCLUSIONS OF LAW, the City Council does hereby ORDER and this does Order that: 1. That the above named applicant is granted a conditional use permit to use the property for the construction and development of an approximate 8,000 sq. ft. commercial/general building, subject. to the following conditions of use and development: 1.1 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9- 605.M. No variances have been requested for tiling of any ditches crossing this project. 2.2 Any existing domestic wells and/or septic systems within this project shall be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. 2.3 Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 2.4 Paving and striping shall be in accordance with the standards set forth in Sections 11-2-414.D.4 and 11-2-414.D.5 of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 2.5 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 2.6 Outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-14.D.3. 2.7 All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. No temporary signage or flashing signs will be permitted. 2.8 Applicants shall provide five-foot-wide sidewalks in accordance with City Ordinance Section 11-9-606.6. 2.9 All construction shall conform to the requirements of the Americans with Disabilities Act. Designer shall coordinate sizing and routing of sanitary sewer and water within the development with the Public Works Department. 2.11 Applicant shall provide the Public Works Department with information on anticipated fire flow and domestic water requirements for the proposed site. Flow and pressure from the existing mains shall be monitored with the Meridian Water Department to determine whether adequate fire protection exists. 2.12 Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. In addition to these assessments, "Late Comers" fees may also be charged against this parcel to help reimburse the parties responsible for installing mains. Applicant may participate in the cost of the sewer trunk line extension at time of its construction. 2.13 An appropriate number of three-inch (3") caliper trees are shown on the site plan. Landscape plan is not to be revised without prior written approval of the Planning and Zoning Department. 2.14 Signage shall be limited to one low-profile monument type sign. Sign shall be placed outside of sight triangle. Us? Stiles: Mr. Chairman, commissioners, we have reviewed this application and you have our comments dated May 7, 1999. Had no major problems with it, I think most of it could be (Inaudible) in the building permit review process because we will be watching him really closely. Worcester: We concur with all of staffs comments. 1 have had the site plan redrawn for the fifth time trying to incorporate some of those items. I've got that (Inaudible) look at it as I comment on the items that we've already addressed if you want to. MacCoy: Is yours different from ours? We had a... Worcester: This one's got all those clarified. I'll go over what we've got so far. I'll address those items. (Inaudible) No utilities are shown on the site plan details indicate how building three will be served. We've had the architect extend the main lines to the third building that is on the end there. They are not designated on the plans you've got there. We don't have a detail for signage, because we are not going to have any. The only thing we will have is numbers on the buildings for each individual space and wall signs. Pinnacle is doing the civil engineering and he is going to be addressing all the other comments from staff. We did have a problem with landscaping and the existing irrigation drainage easement to the-rear of the property. What we did to ease that a little bit is we are proposing to move that building number three to the north and to the east and line it up with that 20 foot planting easement. Two reasons for doing that is that the architect in my opinion have put that building too close to that easement and he also put some trees in that easement. So we are going to loose the trees and I would like to move that building to enhance that planting area for the use of the entire complex and also give us a wider driveway on the south side. On that particular first site plan we listed 33 three inch caliber trees. I'll work with Shari on that. We don't want to have the trees in that easement for that irrigation district. All right now, I think on the revised site plan they are down to 28. I think we are still within the ratio. If we are not, we will put more trees in. On the-when we were moving that one little building around, we also are suggesting that we move the one trash enclosure into the rear of the- property line and that would give us better access to it and better utilization for building number three. If we do that then we are going to loose the sidewalks bordering on that one side which have no utility what so ever to the project. We better service for the vehicles. On the screening fence we concur, in fact that is what we wanted initially and the architect was overzealous with the tress, arborvitae trees. That's not a very effective screen nor security for the folks that are going to be occupying that. We would propose to replace the arborvitae screen with a fence with slats. I think by doing so, with more Maples going up over the screen fence that would break up the profile of the building a little bit better. Barbeiro: Where are we talking? ~ ~ Meridian Planning and Zoning Commission May 11, 1999 Page 108 Worcester: We're on to the arborvitae trees and the-originally the architect was going to screen the project with arborvitae trees and more Maples and there was no fence there at the time. Barbeiro: So we are on the south side of the property? Worcester: Yes. We are going to go entirely around the project with a fence with slats in it for screening purposes and for security purposes. Barbeiro: A six foot chain link with slats. Worcester: Yes. The arborvitae's wouldn't give us very good security. There is also a maintenance factor there. We are going to loose quite a few of those and then we are going to be continually replanting them. We elected to do away with the arborvitae trees and put the fence with the slats around the project. The more Maple trees we are hoping will be larger, well they will be large enough to go up over the screen so that will break up the profiles of the buildings a little bit more. Barbeiro: Is that compatible with the existing city's landscaping requirements? Worcester: That was staff's recommendation No. 8 on general-I'm sorry, site specific comments. MacCoy: Do you have clients for this already? Worcester: Oh yeah, on building number three that is fully occupied. It's not occupied yet, but it will be once it's built. MacCoy: What type of people are going in here? Worcester: The ones that are going in the back is a heating company, heating and cooling. De Weerd: Are they nice? Worcester: Sure. De Weerd: I'm sorry, it's getting late. Malcolm asked what type of people. (Inaudible) Meridian Planning and Zoning Commission May 11, 1999 Page 109 Worcester: The other thing I note was that the architect was (Inaudible) was the 26 foot driveway ingress/egress and the property. is going to have to be changed to 30 feet. That's an ACHD requirement. We will concur. De Weerd: Shari is that what you wanted with the chain link fence with slats? Stiles: You mean did I request that? De Weerd: Yeah. Stiles: No, the landscaping requirement is met with the trees that they are proposing. Sure would be nice to see the landscaping, the sod and trees. I think what he is worrying about is security of the building. I'm not sure he needs that kind of security in the... Worcester: We don't need the slats, but I think I would prefer to have the fence around it yes. Stiles: Does the Plumbers Union already have some fencing already in place there on the property line? Worcester: I think it's the Plumbers Union, there is chain link fence in the area. That's what we were going to go along with. As I recall, there is also chain link fence on the property to the south too. I don't think they have slats in theirs. I think it's just chain link fence. Stiles: Our requirement is just to have screening fence around areas where they have outdoor storage of equipment and materials. I don't think they will have any outdoor storage of equipment and materials. They don't have room to put any back there. Worcester: You've got a ten foot easement back in there and I was frightened for that, but I want to go to property line, but architect suggested not to do that because of the property line walls that would be required. We know how to get around that, but he convinced me to have that little ten foot space back in there with a man door for utilization for the folks that are going to be in the spaces for break rooms or whatever the case may be. I concurred with that, but as far as I'm concerned I could just go right up to the property line and the opening is allowed and have a tight (Inaudible) building, but I don't think that's what we want to do. I don't think that would enhance the project to do that. I think it would better enhance to have a screening fence surrounding the project for two purposes, one for the screen of course and then the other is for security. ~ ~ Meridian Planning and Zoning Commission May 11, 1999 Page 110 Stiles: It's actually a pretty nice design I think for an industrial area, it's an industrial " subdivision. Worcester: We want to do a split face block which you folks have discussed earlier and then I want to put a regular gable roof, truss assembly on it. I've chosen green color, there is one over in Nampa, it's really striking, the green really offsets the split face block and by having a four, twelve slope that accentuates the roofline and green is pretty good color. MacCoy: You've got a what green asphalt roof? Worcester: Yeah, it would be a green architecture shingles, (Inaudible). Then on the gable ends I'm going to put a green metal. De Weerd: Then you should have your green trees. Worcester: Then we'll have green trees. We've got more Maples that will only be green in the summer time I guess. Freckleton: Mr. Chairman, I did have some questions of Mr. Wes. What color is the installation going to be? Worcester: It's going to be pink. Freckleton: Wes used to be a building inspector for the City of Meridian. MacCoy: Is that right? Freckleton: Yeah, so we've got to dig at him a little bit. Seriously I did have a question, type of construction. I'm sure you've considered your occupancy types with what kind of a water main you've got going in there (inaudible) too much water line going in. Worcester: That six inch-I think you've got a six inch main there for a fire hydrant and a two inch main for water usage. We are going to go with a type 3 N or a type 3-1 hour depending on what type of flow Skip tells me I've got out there. If that doesn't work, then what we will do is sprinkle the building. As far as water mains are concerned, the fixture counts can be pretty minimum. Each space is only going to have a his and hers restroom. So you are going to have only two fixtures per space. Two fixture count. Freckleton: He's only got, unless I'm just not seeing it. He's only got a one two inch line shown going in here. As part of a conditional use permit, the City of Meridian may impose additional restrictions/conditions. 3. The property is located at N. Ralston Street in Railside Park, Meridian, Idaho. 2. The owner of record of the subject property is Railside Development Inc. of PO Box 5405, 4414 S. Gekler Lane, Boise, Idaho. 3. Applicant is Wes Worcester dba Santee Construction of 10065 Westview, Boise Idaho. 4. The subject property is currently zoned Light Industrial (I-L). The zoning district of Light Industrial (I-L) is defined within the City of Meridian Zoning and Development Ordinance, Section 11-2-408(14). 5. The proposed application requests a conditional use permit for construction and development of multiple buildings on a single lot. Meridian City Zoning and Development Ordinance Section 11-2- 409(B) requires a conditional use permit be obtained for the proposed use. 6. The use proposed within the subject application will in fact, constitute a conditional use as determined by City Policy. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the conditional use permit as requested by the applicant, subject to the following: Adopt the Planning and Zoning Administrator and Assistant City Engineer Recommendations as follows: 1.1. C. Locust Grove Road is planned to be extended south of Pine Street to Franklin Road in a straight alignment along the east side of this site. The applicant is not proposing access to the planned extension of Locust Grove Road. All of the lots in the subdivision can be accessed by the internal streets. When Locust Grove Road is improved in the future, Commercial Avenue will intersect Locust Grove Road. In the meantime, the subdivision can operate with the internal streets connecting to Pine Avenue. A temporary paved turnaround with a temporary easement to the District will be required at the east end of Commercial Avenue until Locust Grove Road is improved. RAILSIDE.WPD Page 2 • In accordance with District policy, staff recommends that the applicant be required to provide a $5,850.00 deposit to the Public Rights-of--Way Trust Fund for the cost of constructing a 5- foot wide concrete sidewalk on Locust Grove Road abutting the parcel (approximately 1,170- feet) prior to issuance of any required permits or District approval of a final plat, whichever occurs first. D. Pine Avenue abutting this site is not listed in the District's current Five Year Work Program. The Pine/Executive Corridor Report states that 90-feet of right-of-way is needed for this segment of Pine Avenue. The north right-of-way line has already been established with the platting of Maws Addition No.l (a single-family residential development). The City of Meridian will require a 20-foot wide buffer strip along Pine Avenue. Because of the constriction caused by the earlier development of Maw's Addition and the resulting 30-feet of dedicated right-of--way, staff recommends that the applicant dedicate 52-feet of right-of-way south of the section line (to total 82-feet) on Pine Street and construct the sidewalk in an easement in the 20-foot wide buffer strip. E. The applicant is proposing to stub Commercial Avenue to the site's west boundary. Staff supports this stub street. A temporary paved turnaround with a temporary easement to the District will be required at the west end of Commercial Avenue. The north-south road, Ralstin Street is proposed to intersect Pine Avenue aligned with Ralstin Street in Maws Addition No. l Subdivision. F. In accordance with District policy, staff recommends that the applicant be required to construct the streets within the subdivision with standard vertical curb, gutter, 5-foot wide concrete sidewalk, and a 41-foot street section within a 58-foot right-of--way prior to issuance of any required permits or District approval of a final plat, whichever occurs first. Staff recommends a waiver of policy that sidewalk be required on only one side of the internal streets, because the pedestrian traffic in industrial subdivisions is lower than in commercial or residential developments and can adequately be served on one side of the street. G. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. If the driveway is not to be paved on site, staff recommends that the applicant pave the driveway its full required width of 30 to 40-feet to at least 30-feet beyond the sidewalk. H. The transportation system will be adequate to accommodate the additional traffic generated by this proposed development. I. This application is scheduled for a public hearing by the Meridian Planning and Zoning Commission on April 9, 1996. The following requirements are provided as conditions for approval: RAILSIDE.WPD Page 3 Site Specific Requirements: Dedicate 52-feet of right-of-way from the section line, or a total of 82-feet from the existing north right-of-way line, of Pine Avenue abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. The owner will be compensated for this additional right-of--way (that which is in excess of 30-feet from the section line) from available impact fee revenues in this benefit zone. If the owner wishes to be paid for the additional right-of-way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance, with Section 15 of ACRD Ordinance #188. 2. Dedicate 48-feet of right-of-way from the ultimate street centerline of Locust Grove Road extended abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. A 70-foot street section as measured from the existing back of curb on the north side of Pine Avenue will be constructed by the District at a future date. 4. Provide a $5,850.00 deposit to the Public Rights-of-Way Trust Fund for the cost of constructing a 5-foot wide concrete sidewalk on Locust Grove Road abutting the parcel (approximately 1,170-feet) prior to issuance of any required permits or District approval of a final plat, whichever occurs first. 5. Ralstin Street shall align with Ralstin Street in Maws Addition No.l Subdivision. 6. Commercial Avenue extend from the right-of-way for Locust Grove Road to the west boundary of the site with a temporary easement for a paved turnarounds at the site's east and west boundaries. 7. All internal public streets shall be constructed with standard vertical curb, gutter, 5-foot wide concrete sidewalk on one side and a 41-foot street section within 58-foot right-of--way. A 5- foot wide concrete sidewalk shall be constructed on the north side of Commercial Avenue and the west side of Ralstin Street. 8. Driveways shall be located a minimum of 50-feet from any intersection, as measured near edge of driveway to back of curb. RAILSIDE. WPD Page 4 • 9. Driveways shall be a rrTfnimum of 30-feet wide and a maximum of 40-feet wide, paved a minimum of 30-feet beyond the back of sidewalk. Shared driveways are encouraged. 10. Restrictions on the width, number and locations of driveways, as required by District policy, shall be placed on future development of this parcel. 11. Direct lot or parcel access to Locust Grove Road and Pine Avenue is prohibited. Lot access restrictions shall be stated on the final plat. Standard Requirements: A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the Development Services Supervisor. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardship or inequity. The written reauest shall be submitted to the District no later than 9:00 a.m. on thew schedulesLf~c r ion action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Development Services Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall sp ' ically id nti each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of its origins decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance # 188, also known as, Ada County Highway District Road Impact Fee Ordinance. 4. Aright-of--way permit must be obtained from ACHD for any street or utility construction within the public right-of--way. Submit site drainage pl'~ns and calculations for review and appropriate action by ACRD prior to District approval of the final plat or issuance of building permit (or other required permits), whichever occurs first. The proposed drainage system shall retain all storm water on-site and shall conform to the requirements of the city or county having jurisdiction. Public street drainage facilities shall be located in the public right-of--way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 6. Locate driveways a minimum of 5-feet from the side lot property lines when driveways are not to be shared with the adjacent property. 7. If sidewalk is to be constructed or is currently abutting the site, construct pedestrian ramps on the corner of all street intersection in compliance with Idaho Code, Section 40-1335. 8. Dedicate up to a 20-foot x 20-foot right-of--way triangle (or appropriate curve) to keep street improvements within the public right-of-way at all intersections abutting and/or within the development by means recordation of the final plat or prior to issuance of a building permit (or other required permits), whichever occurs first. 9. Continue existing irrigation and drainage systems across parcel. 10. Continue borrow ditch drainage abutting parcel (culvert may be required). 11. Provide written approval from the appropriate irrigation/drainage district authorizing storm runoff into their system. 12. If street improvements are required, locate obstructions (utility facilities, irrigation and drainage ditches and appurtenances, etc.) outside of the public right-of--way. Authorization for relocations shall be obtained from the appropriate entity. If determined by the District, existing irrigation facilities may remain in the right-of--way with District review and approval of easements recorded for future relocation at a later date. 13. Locate proposed sign(s) out of the public right-of--way and out of the clear-vision sight- triangle of all street and driveway intersections. 14. Install a stop sign on every unsignalized approach of a project street to an intersection involving a collector or arterial as the cross-street. The stop sign shall be installed when the project street is first accessible to the motoring public. 15. The developer is required to install street name signs at the locations approved by the Ada County Highway District. Purchase street name signs, sign poles, and mounting hardware from ACHD's Traffic Operations Department or an approved outside supplier. The District will not manufacture street signs until a copy of the recorded plat showing the recording data has been provided to Development Services staff. RAILSIDE.WPD Page 6 • 16. Any portion of a stree~hich is required by the District to be designated as "no parking" shall be posted by the installation of standard "no parking" signs. A signing plan shall be sealed, signed and dated by a Registered Professional Engineer and submitted to ACRD Traffic Services staff for their review and approval prior to final plat approval by the District. If a final plat is not required, the signing plan approval shall be completed prior to issuance of a building permit (or other required permit). 17. Provide a clear vision sight triangle at all driveway and street intersections. Within this triangle no obstruction higher than 36-inches above the top of pavement will be allowed, including but not limited to landscaping, berms, fences, walls or shrubs. The triangle shall be defined with the long leg measured 200-feet to 540-feet (depending on speed limit) along the centerline of any road; and the short leg measured from the curb line of the road 20-feet along the centerline of the intersecting driveway or street (see District Policy Figure F7). Provide notes of these restrictions on the plat/site plan and street construction plans. 18. Submit three sets of street construction plans to the District for review and appropriate action. 19. Provide design data for proposed access to public streets for review and appropriate action by ACHD. 20. All public streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 21. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACRD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 22. The applicant shall submit revised plans for staff approval, prior to issuance of building .permit (or other required permits), which incorporates any required design changes. 23. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 24. The connection of driveways to the public street system is not allowed without approval of the District. To obtain approval, anyone proposing to construct a driveway is required to contact the Construction Services Division of the District to obtain a proper permit prior to commencing construction per District Policy 7207.9. 25. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District.
