Idaho Code § 67-6512 provides in part that: (A) As part of a zoning ordinance the City Council may provide for the processing of applications for special or conditional use permits; and (B) That a special use permit may be granted to an applicant if the proposed use is otherwise prohibited by the terms of the zoning ordinance, but may be allowed with conditions under specific provisions of the zoning ordinance, subject to the ability of political subdivisions, including school districts, to provide services for the proposed use, and when it is not in conflict with the plan; and (C) That upon the granting of a special use permit, conditions may be attached to a special use permit, including, but not limited to, those: 1) Minimizing adverse impact on other development; 2) Controlling the sequence and timing of development; 3) Controlling the duration of development; 4) Assuring that development is maintained properly; 5) Designating the exact location and nature of development; requiring the provision for on-site or off-site public facilities or services; requiring more restrictive standards than those generally required in FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS OVERLAND MINISTORGAGE BY: OVERLAND STORAGE LLC CASE NO. Adopt the Planning and Zoning Administrator and Assistant City Engineer Recommendations as follows: 1.6 Provide detailed signage plans for review and approval. signage details need to be approved as part of this application. Detailed signage plans are subject to design review and separate permits. Temporary and A-frame signs and banners shall be prohibited and will be removed after 3 days notice to the owner. The sign location shown on the plan is not on the lot used for the mini- storage use and as such, is an off-premise sign. Off-premise signs are prohibited as per Section 11-2-415-C-6 of the Zoning SL Development Ordinance. Therefore, approval of this sign location will require a Variance application and approval from City Council. 1.7 Office area of the Caretaker's unit shall meet all current Codes and comply with the Americans with Disabilities Act for parking and access. 1.8 No fencing details were shown on the plan. Non-combustible fencing will be required for the boundary adjacent to Nine Mile Creek. Please submit details, considering public safety and aesthetics in the design. 1.9 Assessment fees for water and sewer service to the office/residence shall be determined during the building plan review process. Drainage swales shall not be approved within the 35-foot-wide planting strip adjacent to Overland Road. 1.11 All driveways, parking, and vehicle use areas are to be paved. 1.12 The site plan does not allow for any landscaping on the mini- storage lot. The site plan must be revised to incorporate landscaping and the required number of trees. One three-inch (3") caliper tree is required per 1,500 s.f of asphalt on the site. Calculations showing total asphalt area and required number of trees must be provided on face of a landscape plan. A variance application must be filed with the City if the applicant does not wish to comply with this requirement. 1.13 Provide detailed landscape plan for review and approval, including sizes and species of trees, shrubs, and all proposed ground cover/treatment. Planting areas should not be less than 6' in any dimension. 1.14 Solid walls of storage buildings are not aesthetically pleasing, will visually impact all surrounding properties, and need to be softened with landscaping. Staff recommends that trees be placed at a minimum of 35 feet on center around the perimeter of the property. 1.15 Applicant shall coordinate trash receptacle locations and construction requirements with Meridian Sanitary Service Company and provide a letter of approval from their office prior to applying for a Certificate of Zoning Compliance. Today I did receive a signed Development Agreement from Woodbridge with the suggestion of review by the attorney before we put it on the agenda, but the process is we need to have this signed Development Agreement and then approve the Meridian City Pre-Coun~eting . January 18, 2000 Page 8 annexation ordinance, and then we can deal with the CUPs. That's what both of these items involve. Bird: So we need to pull them to the 1St of February? (inaudible) Gigray: Mr. Mayor, members of the Council, I believe that, correct me, Mr. Clerk, if I'm wrong, that the Development Agreement involved Snorting Bull, was one of the parties, and Ihave -there's been, as it often happens, and this is something that I would like to see get more clarified in the public hearings, these applications where they're anticipating selling the property somebody else. We prepare these Development Agreements and then they come back and say, well, we're selling this to so-and-so, so we've got to revise this and put another party in there, and it's not really been clear in the public record that's going to happen. We've tried to facilitate that because simply unless the owner was the central part of the condition which it has not been thus far, but in this particular instance, I have reviewed that Development Agreement. Ihave reviewed the strike- thi-oughs and they deal with who the party is and their address and those sorts of things. It looks okay to me unless I'm looking at the wrong one. Will, you can correct me. I would think that would be ready to go and the Council could then move to approve the Mayor and Clerk's signature of that Development Agreement and that one could move forward at least to the best of my knowledge. Bird: How about the - Mr. Mayor, how about the Overland Mini Storage? Same thing on that? Do we have - Berg: Mr. Mayor, Councilman Bird, that's the same situation but I have not received the Development Agreement. I guess a point of clarification to the attorney, if I may, Mr. Mayor, if the Development Agreements can be approved tonight or do I need to put them on the next agenda? I wait to put them on the agenda until I have a signed Development Agreement, and some of these get lost in the process because of the back and forth of the little changes or the change of ownership. Here again, I bring this back because I think it's extremely important because of the growth of the City that we accept this grant and put these two officers on the streets as soon as we can get them out there. The costs to the citizens of Meridian is half of what it's going to be over athree-year period, and even if we don't use them or you don't think we need them this year, if we hire them next year, we can't use this grant. This grant is a continuing grant. We've already hired eight officers on the grant. I don't know how long they're going to continue funding it. It was just re-funded again for next year, so I can re-apply at that time for more officers, manpower. The need is there. I've given you in the facts sheet, some stats. Staff does recommend approval with the addition of one condition that the landscaping proposed in Nampa Meridian Irrigation District's easement which is shown on the top of the bank of Nine Mile Creek, they're also proposing to put a fence there. Staff could support this only if a copy of the landscape plan is stamped approved by Nampa Meridian Irrigation District since the landscaping and the fence is in their easement. And a copy of the executed license agreement with Nampa Meridian is received. So those two things: the copy of the revised landscape plan that shows the landscaping around the north is stamped by NMID and that they have a license agreement.
