and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 p.m. on November 16, 1999, for the purpose of reviewing and considering
the application of W. H. Moore Company for a partial easement vacation of two 10 foot
wide public utility easements, in present zoning I-L, which is generally located at lots 5
and 6 of block 1 of Meridian Business Park.
A more particular description of the above property is on file in the City Clerk's

Winston H Moore as General Partner of The Meridian Industrial Park, an Idaho General Partnership, is submitting a
completed application, processing check, legal descriptions, proof of ownership and vicinity map for the vacation of
two 10-foot wide public utility easements, as noted on the attached site plan. Although The Meridian Industrial
Park is not the owner of Parcel A, the City has asked that, with the consent of the Parcel A land owner (Gary Price),
we combine the two vacations in one application. A consent letter from Mr. Price is included.
As background information, the vacations are required to allow construction of buildings over the easements. All
utilities are located in the street and can service the projects without having to utilize these easements. Accordingly,
both Messrs. Moore and Price are requesting the City approve the vacation.

This matter coming on regularly before the City Council at its regular meeting
on the 16`'' day of November, 1999, at the hour of 7:00 p.m., and Gary Smith, City
Engineer, appeared and the Council having received the record from the Planning and
Zoning Commission and its recommendations to the City Council, and no objection
having been received makes the following Findings of Fact and Decision and Order.

STATEMENT OF LEGAL AUTHORITY AND JURISDICTION
CONCLUSIONS OF LAW
1. Easements shall be vacated in the same manner as streets. {I.C. § 50-
1325}.
2. The vacation of an easement which was accepted as part of a platted
subdivision shall be vacated pursuant to the provision of Chapter 13,
Title 50 Idaho Code {I.C. § 40-203 (6)}.
3. Any person, firm, association, corporation or other legally recognized
form of business desiring to vacate a part of a plat which is inside the
boundaries of any City must petition the City Council to vacate. Any
person, persons, firm, association, corporation or other legally
recognized form of business desiring to vacate a plat or any part thereof
which is inside or within one (1) mile of the boundaries of any city must
petition the city council to vacate. Such petition shall set forth
particular circumstances of the requests to vacate; contain a legal
description of the platted area or property to be vacated; the names of
the persons affected thereby, and said petition shall be filed with the
city clerk. Written notice of public hearing on said petition shall be
given, by certified mail with return receipt, at least ten (10) days prior
to the date of public hearing to all property owners within three
hundred (300) feet of the boundaries of the area described in the
petition. Such notice of public hearing shall also be published once a
week for two (2) successive weeks in the official newspaper of the city,
the last of which shall be not less than seven (7) days prior to the date
of said hearing; provided, however, that in a proceeding as to the
vacation of all or a portion of a cemetery plat where there has been no
interment, or in the case of a cemetery being within three hundred
(300) feet of another plat for which a vacation is sought, publication of
the notice of hearing shall be the orgy required notice as to the property
owners in the cemetery. When the procedures set forth herein have
been fulfilled, the city council may grant the request to vacate with such
restrictions as they deem necessary in the public interest. In the case of
easements granted for gas, sewer, water, telephone, cable television,

power, drainage, and slope purposes, public notice of intent to vacate is
not required. Vacation of these easements shall occur upon the
recording of the new or amended plat, provided that all affected
easement holders have been notified by certified mail, return receipt
requested, of the proposed vacation and have agreed to the same in
writing. {I.C. § 50-1306A (1), (2), (3) and (5)}
4. Pursuant to § 9-611 A 2. a. and b. 1. of the Meridian Zoning and
Development Ordinance it provides as follows:
Commission Recommendation: The Commission shall review the
request and all agency response and make a recommendation to the
Council for either approval, conditional approval, or denial.
Council Action -When considering an application for the vacation
procedures, the Council shall establish a date for a public hearing and
give such public notice as required by law. The Council may approve,
deny or modify the application. Whenever public rights-of-way or lands
are vacated, the Council shall provide adjacent property owners with a
quit-claim deed for the vacated rights-of-way in such proportions as are
prescribed by law.

recognized form of business in the State of Idaho. {see Chapter 6 of

vacation of two 10 foot wide public utility easements in the SE 1/4 of
the SW 1/4 of Section 7, Township 3 North, Range 1 East of the Boise

4. The particular circumstances of the requested vacation is:
The vacations are required to allow construction of buildings over the
easements. All utilities are located in the street and can service projects
without having to utilize these easements. Additionally, the City has
requested that the consent of Parcel A land owner (Gary Price) be
combined with the two vacations in one application. A consent letter
from Mr. Price is attached within Exhibit "A".
5. The names and, Relinquishment of Easements attached as Exhibit "A",
of the affected by the petition to vacate include:
5.1 The applicant/owner of the property is W. H. Moore Company,
Boise, Idaho.
5.2 Ada County Highway District of Boise, Idaho.
5.3 Intermountain Gas, US West Communications, Inc., City of
Meridian, TCI Cablevision and Idaho Power, attached within
Exhibit "A" are the Relinquishment of Easements releases.
5.4 Gary Price, consent letter.
6. Written notice of the public hearing of this petition was given by
certified mail with return receipt at least ten (10) days prior to the date
of the public hearing to all property owners within three hundred (300)
feet of the boundaries of the area described in the petition, and such
notice was also published once a week for two (2) successive weeks in
the Idaho Statesman with the last publication which was not less than
seven (7) days prior to the hearing.

NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING
STATEMENT OF LEGAL AUTHORITY AND JURISDICTION AND
STATEMENT OF FACTS RELATIVE TO LEGAL AUTHORITY AND
JURISDICTION, the City Council does hereby ORDER and this does ORDER
that:
1. Those certain utility easements as depicted on the Record of Survey of
Meridian Business Parlc, are hereby vacated.
Easement One (Legal description of a portion of an existing easement to
be released Lots 5 and 6 of Block 1, MERIDIAN B USINESS PARK):
A 10.00 foot wide strip of land being 5.00 feet wide on each side of
centerline and located in Lots 5 and 6 of Bloclc 1 of MERIDIAN
BUSINESS PARK SUBDIVISION situate in the SW 1/4 of the SE 1/4
of Section 7, Township 3 North, Range 1 East of the Boise Meridian,
Ada County, Idaho, the centerline of said strip of land being more
particularly described as follows:
BEGINNING at the most easterly Lot corner common to said Lots 5
and 6; thence South 89°20'30" West a distance of 235.05 feet along the
line common to said Lots 5 and 6 to the POINT OF TERMINUS, said
point bears North 89°20'30" East a distance of 25.00 feet from the most
westerly corner common to said Lots 5 and 6.
Said strip of land contains 2,350.5 square feet more or less.

with the Ada County Recorders office.

Please take notice that this is a final action of the governing body of the City
of Meridian, pursuant to Idaho Code § 67-6521 an affected person being a person
who has an interest in real property which may be adversely affected by the issuance
or denial of the vacation may within twenty-eight (28) days after the date of this
decision and order seek a judicial review as provided by Chapter 52, Title 67, Idaho
Code.

WHEREAS, by platted subdivision easement recorded as Instrument 95059609 in Book 70 of Plats at
Pages 7158 and 7159 in the records of Ada County, State of Idaho, Meridian Business Park, granted to IDAHO
POWER COMPANY an easement (the "Easement") for the construction, operation and maintenance of certain
power line facilities upon. the following premises located in Ada County, State of Idaho, to-wit:
Meridian Business Park a resubdivision of Block 1, 2 and 3 Meridian Business and Industrial Park a
portion of the SW % SE % and SE % SW %, Section 7, Township 3 North, Range 1 East, B.M. ,

AND, WHEREAS, it is no longer necessary or desirable that a certain portion of the Easement
be retained

public utility easements by W.H. Moore Company, Lots 5 and 6 of Block 1,

Stiles: Mr. Mayor and Council, this is for vacation of those easements. They
would be located south of -west of East 5th and south of Bower Street on -
actuafly, it would involve four lots instead of just the two that are shown there.
Corrie: Shari, we can't see what you're -
Stiles: I believe those easements - there's a five-foot public utility easement on
the south side of these two lots, and then another five-foot easement here, and
then another five-foot easement on each side of this property line. And they're
requesting vacation of those easements so that they can construct a single
building using these three lots.

Smith: Yes, Mr. Mayor and Council members. It's a similar situation. I do have
the relinquishment of easements from the affected utility companies in
possession.

In essence, we just have two ten-foot public utilities through there. We're
ultimately buildings will be situated. We're asking that they be vacated. All the
utilities are in the street. As Gary said, we've gotten relinquishment from all the
utilities on these. Other than that, I'd be glad to answer any questions. It's pretty
straight-forward.

Overland Mini-Storage of 7.25 acres from single-family residential from acreage
to commercial lots and mini-storage facility by Overland Mini-Storage, LLC, 1230

Stiles: Mr. Mayor and Council, this is for the property on Overland Road
immediately north of the Sportsman Pointe Subdivision. Nine Mile Creek comes
down on the boundary here. This is where the Treasure Valley Baptist Church is.
This area here has recently been annexed and is proposed as a roofing
contractor's office and storage area. They have also submitted in the next two
applications preliminary plat and a request for conditional use permit. The only
use they have shown now is for storage units. We have asked for a
Development Agreement to be entered into and would recommend approval with
Staff and agency comments.

I'm with Pinnacle Engineers. Our address is 870 North Linder Road, Suite B,
Meridian, Idaho 83642. We represent the Overland Storage, LLC in this project.
Shari, do you have the plat itself on here? There you go. Thank you. What we
are proposing is a four-lot, or actually, four-lot subdivision. We have one, two,
three, four lots in here. There's currently an existing house on this lot right here.
We're asking that that house be allowed to continue to be there until such time as
some sort of development could occur on it or a conditional use to modify the use

that we just spoke about. And, incorporating all staff and other reg. agency comments
as described earlier.

Borup: Miss Stiles do you have a presentation?
Stiles: Mr. Chairman, Commissioner's I'm not sure if they have a representative here.
Okay, Jonathan. I just wanted to make sure that the application was a sketchy and it
was a little hard to follow. I wanted to make sure it was understood where those
easements are. I believe what they are asking for if you can see this, this would be lot 6
and lot 7 and 8. Although the notice went out to say lots 5 and 6 for a five foot
easement on either side of lots 5 and 6. I believe they are also requesting the five foot
easement on the north side of lot 6 and the south sides of lot 7 and 8 to be vacated.
This would not include the Hunter Lateral Vacation. I think they may be able to address
that if that has been relocated. I also wanted to make sure that they understood that we
would want the lot lines to be adjusted if there was going to be a building on those.
Other then that, I just wanted to clarify that because it was a little unclear from the
application.

Seel: My name is Jonathan Seel with the W.H. Moore Co., 600 North Steelhead, Boise,
Idaho. Shari is correct. It is a 2 easements there. Ten foot easements. The one that
is the southerly on is a little hard to read on this. We have a lot line adjustment though,
so the next one down that one. We have a lot line adjustment but we don't want to up a
little bit. Right there. We do have a lot line adjustment but we have been told not to
submit that until after this has been vacated. Anyway, it is that one where the arrow is
and the one to the north. Those are the two that we are asking for Vacation of and as
they say, as soon the vacation of the southerly easement is completed, we will submit
the lot line adjustment for that. We have been told not to do that. We read the staff
report. We have not problems with it. On the northerly one they plan to build a building
on it as well as on the southerly one too, so that is the reason for the vacation of the
easements. Utilities are on the street and the balance of the project as we done in the
future, we have not put utilities or easements between the lots on the plat just because
of this reason because you end of having to come back and vacate them later.
Borup: Any questions from the Commissioner's. Commissioner Brown.
Seel: The Hunter Lateral has all ready been moved. You can again kind of see that
dotted line. It is an "L" shaped one. It borders right there along that property line and
heads directly up there. That easement as it is shown there has all ready been vacated.
The Hunter Lateral (inaudible) through the project. I am not sure why that is showing on
there.
Brown: Have you got your relinquishments of your easements all ready?
Seel: We are in the process of doing that right now. We have given one to the city,
which we were asked to do. TCI Cable, Idaho Power, U.S. West and Intermountain
Gas. We will have those before the City Council meeting. I am getting some of those
all ready. They have been done and we've asked them to acknowledge and notarize
those.

Borup: Miss Stiles.
Siddoway: I am not Miss Stiles but I'll go ahead and handle this one. Commissioner's
this application is for a day care which is 5 kids or less. An Accessory Use Permit
because there was an objection filed with the city. We are required to send this to you.
The highlighted there is the request. We would ask that all of our comments that are on
the October 6th memo be included. I don't think there are any other outstanding issues
related to the application. You should have a copy of the objection in your packets.
Borup: Okay. Is the applicant here?
Lovett: Sandra Lovett. 1835 S. Swan Avenue in Meridian. I am the applicant. I guess
my situation in a nut shell, I have applied for the permit and have started going through
the licensing process through the state as any full time child care would, or home day
care, even though I am only just a part time half day morning play group program
planned. Just being that I have been in the early childhood profession for about 14
years I just thought it was necessary to go through all the necessary steps to prove my
commitment to the professional aspect I guess to the parents who are interested in my
program. Just kind of hit the snag when one of my neighbors did oppose the idea
because it is stated in neighborhood covenants that there are to be no businesses run
out of homes. However, before we purchased the home back in May, I spoke with the
president of the neighborhood association. He told me that they do make exceptions for
family home day cares, being there is such a high need for them in our area as welt as
other areas. He had no problem with it, the neighborhood association had no problem
with it, so we went ahead and purchased the house and went through with the plans to
do this but as I stated before, one of the neighbors did object. According to the
neighbor, from what I understand from the neighborhood association who has kept in
good contact with me just to update me how things were going from their end, the main
objection was not the traffic. It wasn't the additional children because there is so many
children in our neighborhood anyway. It was just the fact that it was going to be okay to
let a business be run out of the neighborhood. He did not feel comfortable with that. He
wanted to stick to the original agreement in the neighborhood covenants that said no
businesses. The neighborhood association does not care to take a stand because they
have made exceptions for other full time day cares.

We have reviewed this submittal and offer the following comments as conditions of the application.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
GENERAL COMMENTS
This property is located on the west side of E. 5th Avenue on the north side of Franklin in the
Meridian Industrial Pazk. The lots are contiguous and contain utility easements along the side lot lines
designated on the recorded plat for the Meridian Business Park Subdivision. The lots aze currently
vacant. In order for the Applicant to utilize these lots for future construction, he must vacate the
existing easements. Neither of the utility easements is being used for utilities nor will they ever be -
they were designated as such on the plat but utilities were constructed in E. 5th Avenue instead.
The Subdivision and Development Ordinance (Title 9), section 9-611, does not require the
Commission to determine findings or to find evidence for decisions on Vacation applications.
However, the Commission must review and make a recommendation on all vacation requests.
SITE REQUIREMENTS
Prior to the issuance of any building permits on the subject lots, applicant must submit relinquishment
of easement letters from all applicable utility companies to the City of Meridian.
RECOMMENDATION
Staff recommends approval.
