1 have confinned with my client that the window on the rear gable over the attic space on
the mouse on Lot 20 has been removed. We have now fully complied with the demands of the
City of Meridian. While 1 recognize that the Mayor is out of town, I am concerned that my client
continues to be faced with further interminable delays with no clear resolution of the matter.
As removal of the window has occurred as requested by the City, there is no need to
delay this matter further. My client is entitled to the immediate issuance of a certificate of
occupancy. Thank you for your attention to this matter.

Re: Overflow Drainage Swell
We are homeowners in the Thousand Springs Subdivision located off South Eagle Road
in Meridian. We have a serious concern regarding the common area lot located next to
our home. This common area lot (Phase 2, Lot 7, Block 10, we believe) is located near
the intersection of E. Indian Creek Dr. and Three Bars. It contains a hole designed for
overflow drainage of the storm sewer system, commonly called a 'swell'. We moved into
our home on May 31, 2000. A few months before we moved in we were told this swell
would be landscaped shortly. It has not been landscaped to this date. It is currently
home to various weeds etc. The purpose of this letter, however, is not the aesthetic look
of this lot. Our worry lies with the fact that this swell is not draining.
As you know, the Treasure Valley has had little precipitation this summer. Regardless of
this fact, this swell contains at least two feet of stagnant water. The water is filled with
slime, algae, trash, debris, and is home to hundreds of thousands of mosquitoes and
other insects. Because the water is not draining, it has now become not only a health
hazard, but a dangerous safety issue as well. It could even be fatal. Our greatest fear is
that one of the numerous small children or toddlers, who reside in our subdivision, could
wander over to this swell (it is not gated off) and could fall down the steep sides of the
hole and into the water located at the bottom. If this unthinkable situation were to occur,
the child could/would drown.
As concerned residents of Thousand Springs Subdivision, we have tried to contact the
developer, Marty Goldsmith with Farwest LLC, numerous times via email. We were
told, by Brad Minasian with John L. Scott Realty, that the email address he gave us was
the only way to contact the developer and/or the temporary homeowners association.
Our emails have gone either unread or ignored. We do not know whom to turn to at this
point. We are hoping one of you can help us with this frightening matter by having the
drainage system repaired.
We have listed our phone number and address below. If you have any questions,

Re: 1000 Springs Subdivision —License Agreement with Nampa & Meridian
Irrigation District
Mayor: The developer for this subdivision recently brought this License Agreement
to me for review and approval by the City of Meridian. The City is party to this
agreement because the proposed fence is located on, property controlled/owned by
us.
I would appreciate it if you could place this License Agreement Proposal on the
August 1 City Council meeting agenda for their action. Approval of the agreement
would allow the developer to proceed with construction of the fence. This fence is
perceived to eliminate a safety concern that presently eiasts for the children in the
subdivisions adjacent to this crossing of the Ridenbaugh Canal.

Enclosed for review and signature are duplicate originals of the above -referenced License
Agreement which you requested on behalf of City of Meridian.
Both originals of the Agreement must be signed and notarized as indicated. Do not date the
agreement. If both originals are executed and returned to me by July 12, 2000, I will be able to
submit the agreement to the District's Board of Directors for approval and.signature at the Board's
next meeting on July 18, 2000. The District will then have its original recorded and return your
original to you with a bill for the recording fee, and for our services in preparing the agreement.

LICENSE AGREEMENT
LICENSE AGREEMENT, made and entered into this day of , 2000, by and
among NAMPA & MERIDIAN IRRIGATION DISTRICT, an irrigation district organized and existing under
and by virtue of the laws of the State of Idaho, party of the first part, hereinafter referred to as the "District",
and
CITY OF MERIDIAN,

party or parties of the second part, hereinafter collectively referred to as the "Licensee",
WITNESSETH:
WHEREAS, Licensee is the owner of real property (burdened with the easement of the District
hereinafter mentioned) particularly described in the "Legal Description" attached hereto as Exhibit A and by
this reference made a part hereof: and,
WHEREAS, the District owns the irrigation ditch or canal known as RIDENBAUGH CANAL
(hereinafter referred to as "ditch or canal"), an integral part of the District's irrigation works and system,
together with the easement therefor to convey irrigation water, operate, clean, maintain, and repair the ditch
or canal, and access the ditch or canal for those purposes; and,
WHEREAS, said ditch or canal and easement crosses and intersects Licensee's real property as shown
on Exhibit B attached hereto and by this reference made a part hereof, and,
WHEREAS, the Licensee desires a license to engage in construction or activity affecting said ditch
or canal or the District's easement in its course across the lands of the Licensee in the manner and under the
terms and conditions hereinafter set forth: and,
WHEREAS, it is necessary that the District protect absolutely its right to control any modification or
alteration of its watercourses and its right of way along its watercourses;
NOW, THEREFORE, for and in consideration of the premises and of the covenants, agreements and
conditions hereinafter set forth, the parties agree as follows;
1. The Licensee shall have the right to modify the said ditch or canal or encroach upon the
District's easement along said ditch or canal in the manner generally described in the "Purpose of License"
attached hereto as Exhibit C and by this reference made a part hereof. Any modification of said ditch or canal
by the Licensee or encroachment upon the District's easement along said ditch or canal shalt be performed and
maintained in accordance with the "Special Conditions" stated in Exhibit D, attached hereto and by this
reference made a part hereof.
2. This a�zreement pertains only to the Licensee's modification of said ditch or canal or
encroachment to the District's easement for the purposes and in the manner described herein. The Licensee
shall not change the location of the ditch or canal, bury the ditch or canal in pipe, or otherwise alter the ditch
or canal in any manner not described in this agreement without first obtaining the written permission of the
District.
3. Each facility ("facility" as used in this agreement means any object or thing of any nature
installed in or on the District's easement by the Licensee or the Licensee's predecessor in interest) shall be
constructed, installed, operated, maintained, and repaired at all times by the Licensee at the cost and expense
of the Licensee.
4. Licensee agrees to construct, install, operate, maintain and repair each facility and conduct
its activities within or affecting the District's easement so as not to constitute or cause:
a. a hazard to any person or property;
b. an interruption or interference with the flow of irrigation water in the ditch or canal
or the delivery of irrigation water by the District;
C. an increase in seepage or any other increase in the loss of water from the ditch or
canal;
d. the subsidence of soil within or adjacent to the easement;
e. any other damage to the District's easement and irrigation works.
5. The Licensee agrees to indemnify, hold harmless, and defend the District from all claims for
damages arising out of any of the Licensee's construction or activity which constitutes or causes any of the
circumstances enumerated in the preceding paragraph, 4.a. through 4.e., or any other damage to the easement
and irrigation works which may be caused by the construction, installation, operation, maintenance, repair, and
any use or condition of any facility.
6. Licensee agrees that the work performed and the materials used in such construction shall at
all tirnes be subject to inspection by the District and the District's engineers, and that final acceptance of the
such work shall not be made until all such work and materials shall have been expressly approved by the
District. Such.approval by the District shall not be unreasonably withheld.
7. Tile District reserves the right, at the District's option, to remove any facility installed by the
Licensee and to repair any alteration by the Licensee of said ditch or canal and the easement therefor which
does not comply with the terms of this agreement, and to remove any impediment to the flow of water in said
ditch or canal and any unsafe condition or hazard caused by the Licensee. at any time, and the Licensee agrees
to pay to the District, on demand. the costs which shall be reasonably expended by the District for such
purposes. If the Licensee shall fail in any respect to properly maintain and repair such facility, then the
District. at its option, and without impairing or in anywise affecting its other rights and remedies hereunder,
shall have the right to perform the necessary maintenance and repairs and the Licensee agrees to pay to the
District, on demand, the cost or expense which shall be reasonably expended or incurred by the District for
such purposes. The District shall give reasonable notice to the Licensee prior to the District's performing such
maintenance. repair or other work except that in cases of emergency the District shall attempt to give such
notice as reasonable under the circumstances. Nothing in this paragraph shall create or support any claim of

any kind by Licensee or any third party against the District for failure to exercise the options stated in this
paragraph, and Licensee shall indemnify, hold harmless and defend the District from any claims made against
the District arising out of or relating to the terms of this paragraph except for claims arising solely out of the
nesligenee of the District.
8. Neither the terns of this agreement, the permission granted by the District to the Licensee,
the Licensee's activity which is the subject of this agreement, nor the parties exercise of any rights or
performance of any obligations of this agreement, shall be construed or asserted to extend the application of
anv statute, rule, regulation, directive or other requirement, or the jurisdiction of any federal, state, or other
agencv or official to the District's ownership, operation, and maintenance of its ditches, canals, drains,
irrigation works and facilities which did not apply to the District's operations and activities prior to and without
execution ofthis agreement. In the event the District is required to comply with any such requirements or is
subject to the jurisdiction of any such agency as a result of execution of this agreement or the Licensee's
activity authorized hereunder, Licensee shall indemnify, hold harmless and defend the District from all costs
and liabilities associated with the application of such laws or the assertion of such jurisdiction or, at the option
of the District, this agreement shall be of no force and effect and the Licensee shall cease all activity and
remove any facility authorized by this agreement.
9. In addition to all "other indemnification provisions herein, Licensee further agrees to
indemnify, hold harmless and defend the District from any injury, damages, claim, lien, cost and/or expense
(including reasonable attorney's fees) incurred by, or asserted against, the District by reason of the negligent
acts or omissions of Licensee or its agents, contractors or subcontractors in performing the construction and
activities authorized by this agreement.
10. The Licensee agrees that the District shall not be liable for any damages which shall occur to
anv facility, structure, plant, or any other improvement of any kind or nature whatsoever which the Licensee
shall install on the said easement area of the District in the reasonable exercise of the rights of the District in
the course of performance of maintenance or repair of said ditch or canal. The Licensee further agrees to
suspend its use of the said easement area when the use of the easement area is required by the District for
maintenance or repair under this or any other paragraph of this agreement.
11. Licensee shall place no structures or landscaping of any kind above within the District's
easement area except as referred to in this agreement or exhibits hereto without the prior written consent of
the District.
12. Should either party incur costs or attorney fees in connection with efforts to enforce the
provisions of this agreement, whether by institution of suit or not, the party rightfully enforcing or rightfully
resisting enforcement of the provisions of this agreement, or the prevailing party in case suit is instituted, shall
be entitled to reimbursement for its costs and reasonable attorney fees from the other party.
13. The parties hereto understand and agree that the District has no right in any respect to impair
the uses and purposes of the irrigation works and system of the District by this agreement, nor to grant an
rights in its irrigation works and system incompatible with the uses to which such irrigation works and system
are devoted and dedicated and that this contract shall be at all times construed according to such principles.

14. Nothing herein contained shall be construed to impair the right of way of the District in the
said ditch or canal and all uses of said ditch or canal by the Licensee and the license herein provided therefor
shall remain inferior and subservient to the rights of the District to the use of said ditch or canal for the
transmission and delivery of irrigation water.
15. In the event of the failure, refusal or neglect of the Licensee to comply with all of the terms
and conditions of this agreement,`the license of the Licensee under the terms hereof may be terminated by the
District, and any facility, structure, plant, or any other improvement in or over said ditch or canal, and the right
of way therefor, which may impede or restrict the maintenance and operation of such ditch or canal by the
District with its equipment for the maintenance of its said ditch or canal may be removed by the District.
16. The Licensee agrees to pay attorney fees or engineering fees charged by the attorney for the
District or by the engineers for the District in connection with the preparation of this License Agreement or
in connection with negotiations covering the terms and conditions of this License Agreement.
17. Nothing in this agreement shall create or support a claim of estoppel, waiver, prescription or
adverse possession by the Licensee or any third party against District.
18. This agreement is not intended for the benefit of any third party and is not enforceable by any
third party.
19. If any provision of this agreement is determined by a court of competent jurisdiction to be
invalid or otherwise unenforceable, all remaining provisions of this agreement shall remain in full force and
effect.
20. The word "Licensee", if used in the neuter in this agreement, includes the masculine and
feminine genders, the singular number includes the plural, and the plural number includes the singular.
The covenants. conditions and agreements herein contained shall constitute covenants to run with, and
running with, all of the lands of the Licensee described in said Exhibit A. and shall be binding on each of the
parties hereto and on all parties and all persons claiming under them or either of them, and the advantages
hereof shall inure to the benefit of each of the parties hereto and their respective successors and assigns.

Purpose of License
The purpose of this License Agreement is to permit Licensee to:
construct and install a fence within the District's easement for the Ridenbaugh Canal; and
construct and install a 16 foot gate with locks within the District's easement for the
Ridenbaugh Canal,
all within Licensee's property described in Exhibit A, located northwest of the intersection of Victory Road
and Eagle Road in Meridian, Ada County, Idaho.
EXHIBIT D
Special Conditions
a. Construction shall be in accordance with Exhibit D-1, attached hereto and by this reference
made a part hereof. The fence and gates which shall be constructed on each side of E. Three Bars Drive shall
be set back 20 feet from E. Three Bars Drive so as to allow the District to open the gate while not being parked
in the public street. Said gates shall be locked and the District shall have its own set of keys for access,
maintenance and operation of the Ridenbaugh Canal.
b. Licensee shall notify the water superintendent of the District prior to and immediately after
construction so that he or the District's engineer's may inspect and approve the construction.
C. The Licensee recognizes and acknowledges that the license granted in this agreement by the
District pertains only to the rights of the District as owner of an easement. The District has no right or power
to create rights in the Licensee affecting the holder of title to the property subject to the District's easement.
Any such rights affecting fee title must be acquired by the Licensee from the holder of title to the property.
Should Licensee fail to obtain such rights from the holder of title to the property or should the rights obtained
prove legally ineffectual, Licensee shall hold harmless, indemnify and defend the District from any claim by
any party arising out of or related to such failure of rights and at the option of the District this agreement shall
be of no force and effect.
d. The fence and gates shall be constructed of chain link. The following shall apply for that
portion of the fence or gates which erected is now or in the future in whole or in part constructed of wood:
Because of the location of the fence and the fact that the fence will be constructed wholly or partly of wood,
the District shall not be responsible for weed control in the area of the fence. Without affecting the foregoing
exemption of the District from weed control obligations, Licensee hereby indemnifies, holds harmless and shall
defend the District from any claims for damages to said fence because of weed -burning except where the
District intentionally burns the fence or isguilty of gross negligence in burning the fence.
e. Licensee shall not excavate, discharge, place any structures , nor plant any trees, shrubs or
landscaping within We District's easement, nor perform any construction or activity within the District's
easement for the Ridenbaugh Canal except as referred to in this agreement or exhibits thereto without the prior
written consent of the District. The District's easement for the Ridenbaugh Canal is 100 feet, 50 feet to either

Will: Shah and 1 visited this pond site two days ago, after receiving the letter from
Mr. and Mrs. Leffler. I then contacted Justin Mart n,.who works with Marty'Goldsmith,
by telephone to ask about the letter we received and about corrective action. Justin
informed `me that they have and or are taking the following actions to resolve the,
problem:
1. They have been in contactwiththe Ada County Mosquito Abatement District and
the pond area is being sprayed every other day.-- They have determined that the
mosquitoes are "pasture", type, which apparently relates to the amount of grass
sod that is being' installed in the subdivision. On a weekly basis, they are testing
the water at the bottom of the pond for mosquito larvae. To date, these tests are
negative.
2. Their general contractor, Lurre' Construction, will `be at the pond site today or
tomorrow to pump the water out and do some exploratory digging to see why the
water is there and not, draining away.
3:. 1 told Justin that it might be a groundwater problem. Justin ,said they had a
monitoring 'pipe in this area before "development to determine depth to
groundwater and they do not think it is groundwater. He thought maybe there
was surface irrigation water runoff coming into the pond, although when Shari
and I looked at the pond the banks did not show any

-:whatever was necessary to resolve the problem. It may require a redesign of this
storm drainage retention basin along with some piping revisions.

and Justin Martin will follow through and get it resolved.

We are homeowners in the Thousand Springs Subdivision located off South •Eagle Road
in Meridian. We have a serious concern regarding the common area lot located next to
our home. This common area lot (Phase 2, Lot 7, Block 10, we believe) is located near
the intersection of E. Indian Creek Dr. and Three Bars. It contains a hole designed for
overflow drainage of the storm sewer system, commonly called a 'swell'. We moved into
our home on May 31, 2000. A few months before we moved in we were told this swell
would be landscaped shortly. It has not been landscaped to this date. It is currently
home to various weeds etc. The purpose of this letter, however, is not the aesthetic look
of this lot. Our worry lies with the fact that this swell is not draining.
As you know, the Treasure Valley has had little precipitation this summer. Regardless of
this fact, this swell contains at least two feet of stagnant water. The water is filled with
slime, algae, trash, debris, and is home to hundreds of thousands of mosquitoes and
other insects. Because the water is not draining, it has now become not only a health
hazard, but a dangerous safety issue as well. It could even be fatal. Our greatest fear is
that one of the numerous small children or toddlers, who reside in our subdivision, could
wander over to this swell (it is not gated off) and could fall down the steep sides of the
hole and into the water located at the bottom. If this unthinkable situation were to occur,
the child could/would drown.
As concerned residents of Thousand Springs Subdivision, we have tried to contact the
developer, Marty Goldsmith with Farwest LLC, numerous times via email. We were
told, by Brad Minasian with John L. Scott Realty, that the email address he gave us was
the only way to contact the developer and/or the temporary homeowners association.

Our emails have gone either unread or ignored. We do not know whom to turn to at this
point. We are hoping one of you can help us with this frightening matter by having the
drainage system repaired.

This matter coming before the City Council for Final Plat approval
pursuant to § 11-9-604 H Municipal Code of the City of Meridian the 2°d day of
February, 1999, and the Council finding that the Administrative Review is complete
which has included certain comments and conditions as stated in a letter to the Mayor
and Council from Bruce Freckleton, Assistant to the City Engineer, and Shari Stiles,
Planning and Zoning Administrator, listed 6 General Comments and 12 Site Specific
Comments, which are herein found fair and reasonable, and that Shari Stiles, Planning
and Zoning Administrator, and Gary Smith, City Engineer, commented at the hearing,
and the Council having considered the requirements of the preliminary plat the Council
takes the following action:
IT IS HEREBY ORDERED THAT:

ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR HOUSAND i`

Consulting Engineers, FARWEST L.L.C., Developer, is Conditionally
Approved subject to those conditions of Staff comments as set forth in the
Memorandum to the Mayor and City Council from Bruce Freckleton,
Assistant to the City Engineer, and Shari Stiles, Planning and Zoning
Administrator, dated January 28, 1999, listing 6 General Comments and 12
Site Specific Comments, a true and correct copy of which is attached hereto
marked Exhibit "A" and by this reference incorporated herein, with the
additional requirements that:
1.1 Fire Chief, Kenny Bowers, requires that all codes be met; that street
name signs need to be installed before building is started; that all
common lots will need to be kept clear of trash and weeds; and that
roads need to be constructed before any construction is started.
1.2 The Central District Health Department requires after written
approval from the appropriate entities are submitted, they can
approve this proposal for central sewage and central water; that plans
must be submitted to and approved by the Idaho Department of
Health and Welfare, Division of Environmental Quality for central
sewage and central water; that run-off is not to create a mosquito
breeding problem; and that stormwater be pretreated through a
grassy swale prior to discharge to the subsurface to prevent impact to

groundwater and surface water quality; that engineers and architects
should obtain current best management practices for stormwater
disposal and design a stormwater management system that is
preventing groundwater and surface water degradation. Manuals for
guidance:
1.2.1 State of Idaho Catalog Of Stormwater Best Management
Practices For Idaho Cities And Counties. Prepared by the
Idaho Division Of Environmental Quality, July 1997.
1.2.2 Stormwater Best Management Practices Guidebook. Prepared
by City of Boise Public Works Department, January 1997.
1.3 Nampa &. Meridian Irrigation District noted that their District's
Ridenbaugh Canal courses along the north and west boundary of the
project. The final plat indicates the correct easement of 50 feet from
the center each way; and if all encroachments are covered under a
license agreement then the final plat will be acceptable to the
District.
2. The final plat upon which there is contained the Certification and signature
of the City Cleric and the City Engineer verifying that the plat meets the
City's requirements shall be signed only at such time as:
a. The Plat dimensions are approved by the City Engineer; and

b. The City Engineer has verified that all off-site improvements are
completed and/or the appropriate performance bond has been issued

by motion of the Meridian City Council:
GENERAL COMMENTS
1. Any existing irrigation/drainage ditches crossing the property to be included in this
project, shall,be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by
the appropriate irrigation/drainage district, with written confirmation of said approval
submitted to the Public Works' Department.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape irrigation.
3. Indicate on the final plat map any FEMA Flood Plains affecting the area being platted,
and detail plans for reducing or eliminating the boundary.
4. Coordinate fire hydrant placement with the City of Meridian Public Works Department.
5. Please submit a copy of the Ada County Street Name Committee's final approval letter
for the Subdivision name, lot and block numbering, and street names. Make any
corrections necessary to conform.

SITE SPECIFIC COMMENTS
This final plat generally conforms to the approved preliminary plat.
2. Six -foot -high, permanent perimeter fencing is required to be in place prior to obtaining
building permits unless specifically waived in writing by the City P&Z Administrator. A
letter of credit or cash will be required for this fence prior to signature on the final plat.
3. Submit detailed landscaping plans, including sizes and species of vegetation and details
of walkways, for approval prior to signature on the final plat. A letter of credit or cash
will be required for these improvements prior to signature on the final plat. All
landscaping is to be completed prior to obtaining certificates of occupancy.
4. Provide five -foot -wide sidewalks in accordance with City Ordinance Section 11-9-606.B.
5. Sanitary sewer service to this site will be via an extension of the existing main located in
the Los Alamitos Subdivision. Applicant will be responsible to construct the sewer mains
to and through this proposed development. Subdivision designer to coordinate main
sizing and routing with the Public Works Department. Sewer manholes are to be provided
to keep the sewer lines on the south and west sides of centerline.
6. Water service to this site will be via an extension of the existing main located in the Los
Alamitos Subdivision. Applicant will be responsible to construct the water mains to and
through this proposed development. Subdivision designer to coordinate main sizing and
routing with the Public Works Department.
7. All street signs, road base, street lights, pressurized irrigation system, domestic water
system (activated fire hydrants), and fencing are to be installed prior to obtaining bdilding
permits.
8. Please add or revise the following plat notes:
(12.) Lot 19, Block 7, Lot 1, Block 8, aad Lot 2, Block 10, and Lot 30, Block 1 are non -
buildable lots to be owned and maintained by the Thousand Springs
Homeowner's Association, or it's assigns, and shall be used as landscape/drainage

(16.) Lot 24, Block I is a non -buildable lot to be owned and maintained by the

a pedestrian access corridor.

9. One -hundred -watt, high-pressure sodium streetlights will be required at locations
designated by the Public Works Department. All streetlights shall be installed at
subdivider's expense. Typical locations are at street intersections and/or fire hydrants.
10. Please add the notation for "1/16 Corner" to the southwest corner of Lot 25, Block 1, and
add the CP&F No to each of the fractional section comers shown.
11. The S 40039'16"W and S 54019'48" W bearings along the southeasterly boundary of Lot
5, Block 10 don't match the corresponding calls in the legal description of the Certificate
of Owners.
12. This plat submittal was very well prepared. Briggs Engineering should be commended
for their ability to carry forward with what is asked for in previous phases of
development. It is a refreshing experience not having to restate comments over and over
again.

STOR.MWATER MANAGEMENT RECOMMENDATIONS
We recommend that stormwater be pretreated through a grassy swale prior to
discharge to the subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of this project
should obtain current best management practices for stormwater disposal and
design a stormwater management system that is preventing groundwater and
surface water degradation. Manuals that could be used for guidance are:

Idaho Cities And Counties. Prepared by the Idaho Division. Of

1. Streets, curbs, gutters and sidewalks are to be constructed to standards as
required by Ada County Highway District and Meridian Ordinance. Dimensions will
be determined by the City Engineer. All sidewalks will be five (5) feet in width.
2. Proposed use is in conformance with the City of Meridian Comprehensive Plan.
3. Development will connect to City services.
4. Development will comply with City Ordinances.
5. Preliminary Plat will include all appropriate easements.
6. Street names must not conflict with City grid system.

STATEMENTS OF COMPLIANCE
THOUSAND SPRINGS SUBDIVISION NO.2
1. All proposed streets will be public and constructed to Ada County Highway District
Standards. All right-of-ways will be 50 feet with a 36 -foot improved section and offset 5 -
foot sidewalks on both sides. The proposed streets.will meet the improvement standards
set forth in the Meridian Zoning Ordinance or as specifically approved by the' City
Council.
2. The proposed residential development is in compliance with the Meridian
Comprehensive Plan. The plan designates the property as single family residential
development.
3. The development is subject to the dimensional standards of the R-4 zone. All proposed
residential lots meet or exceed the 8,000 square foot minimum lot size. All lot frontages
meet the�80-foot requirement with exception of the cul-de-sac lots and lots on a 90 -degree
bend in a street. These lots fall within the 40 -foot frontage requirement.
The development complies with the provisions of the Meridian Zoning Ordinance with
the exception of Section 9-605(E) Blocks. A variance on block length has been approved
by the Meridian City Council.
4. The final plat reflects existing easements associated with the Ridenbaugh Canal and
applicable utility, irrigation and drainage easements.
5. The street names on the final plat comply with the Ada County Street Name Committee
review on the preliminary plat. The final plat for Phase 2 has been submitted to the Street
Name Committee for a second review.
6. The final plat is in conformance with the approved preliminary plat and the conditions
setforth by the City Council. A minor deviation from the preliminary plat is reflected on
S. Lava Way. The street originally abutted the south boundary for future extension into
the Harris parcel. We submitted a preliminary plat on the Harris parcel (Thousand,
Springs Village) and realized this stub street connection was too close to the easterly stub
street. We therefore recommend a micro -path connection to the south.

7. The final plat is in conformance with the acceptable engineering, architectural and
surveying practices and focal standards.
