Re: Starbuck's Coffee Shop City Clerk Office Request for Conditional Use Permit for the Construction of a 1,400 square-foot coffee shop with adrive-thru in a C-G zone, by Wenco, Inc. (File No. CUP-03-O.il ). We have reviewed this submittal and offer the following comments, as conditions of the Applicant. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY/SITE HISTORY The Applicant, Wenco Inc., has requested approval of a Conditional Use Permit (CUP) for the construction of a new Starbuck' s Coffee Shop with adrive-thru located on the northeast corner of Meridian Street and Corporate Drive. The proposed coffee shop is proposed on Lot 2, Bloclc 1, Wenco Subdivision and is located west of Wendy' s Restaurant and north of a Taco Bell Restaurant. The Applicant is required to apply far a CUP because drive-thru establishments are a Conditional Use in the C-G zone. This site has been the subject of two development applications in the recent past. On February 19, 2002, the City Council approved a Conditional Use Permit (CUP-01-028) for a Wendy' s Restaurant, which at that time was on the same parcel as the proposed establishment As part of the approval of CUP-O1-028, the parking lot, perimeter landscaping and an overall, conceptual. site plan were reviewed and approved by the City. On March 1, 2002, the City Council approved a two-lot subdivision (Wenco, PFP-O1-007) that separated the Wendy' s pad site from the subject Starbuck' s pad site. Except for the four proposed parking stalls directly east of the proposed building, the parking lot and the majority of the perimeter landscaping improvements shown on the submitted site and landscape plans currently exist on the subject lot. Staff recommends approval of the subject conditional use application with the recommended changes to the submitted site plan and Site Specific Conditions listed below. Starbuck's.CUP.doc CUI'-U3-Oil Planning & Zoning Commission/Mayor & City Council P&Z Hearing Date: November 6, 2003 Page 2 LOCATION & SURROUNDING USES The subject property is located on the northeast comer of Meridian Road and Corporate Drive, j ust west of Main Street. The following uses surround the subject property: North -Vacant pad sites and parking for Blimpie's and Round Table restaurants, zoned C-G South -Taco Bell and Bolo's restaurants, zoned C-G East- Wendy's Restaurant, zoned C-G. West- Vacant, zoned C-G. STANDARDS FOR CONDITIONAL USES The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms of the following and may approve a conditional use permit and planned development if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3): A: That the site is large enough to accommodate the proposed use and all yards, open spaces, parking, landscaping and other features as may be required by this Ordinance; As part of the approval for CUP-O1-028 (Wendy's), parking spaces with alternative dimensions have been constructed on this site. The applicant requested, and the City approved, 17-foot long standard parking spaces and 13-foot long compact stalls for this site. Because the City previously reviewed and approved the existine parkins ]ot layout and stal l dimensions staff recommends that the Applicant be able to urihze the existmQ facthhes and construct four (4) additional stalls as proposed (see Stte Specific Requirement #2). On the submitted site plan the applicant is showing a substandard landscape buffer along Meridian Road, a defined Entryway Corridor. A 35-foot wide buffer is required by Meridian City Code (MCC) 12-13-10-4 along Entryway Corridors. A 25-foot wide landscape buffer was previously approved for this site along Meridian Road by the City through the CUP process for the Wendy's drive-thru. MCC 12-13-10-2 states that all required (street) buffers shall be located beyond any street right-of--way. Since the approval of the CUP for the Wendy's, an additional 10 feet of right-of--way (40 feet total from centerline) has been dedicated to ACHD. On the submitted site and landscape plans, a 25-foot wide buffer is depicted. However, l 0 feet of the proposed buffer are off-site and lie within th,e j urisdiction of ACHD. Staff anticipates that Meridian Road will be widened in the fume, significantly reducing or removing a large portion of the Applicant's proposed street buffer. When Meridian Road is widened the buffer between Che drive-thru and the street would be 15 feet wide (measured from the current right-of--way line to the edge of the drive-that lane); the MCC r equires a 3 5-foot 1 andscape b offer. In accordance w ith the p revrously approved subdivision conditions for Wenco staff recommends that the applicant provide a 25-foot wide landscape buffer along Meridian Road measured from the ex~stmQ Wahl-of-wa ~ hne to the edge of the drive thru lane and/or building (see Special Cons~deraCions below). It appears that the applicant could meet the previously approved 25-foot wide landscape buffer for Meridian Road and provide the required parking spaces by removing approximately 6 stalls and modifying the drive aisle on the west side of the parking lot. Staff finds that the site is large enough to accommodate the proposed use and all yards, open spaces, parking and landscaping required by this Ordinance except as noted above. B. That the proposed use and development plan will be harmonious with the Meridian Comprehensive Plan and in accordance with the requirements of this Ordinance; The Comprehensive Plan Future Land Use Map designates the property as "Commercial". The purpose of the commercial designation, as defined in Chapter 7 of the Meridian Comprehensive Plan, is to "provide a full range of commercial and retail to serve area residents and visitors. Uses may include retail, wholesale, service and office uses, multi- family residential, as well as appropriate public uses such as government offices." Staff finds that the proposed coffee shop use is consistent with the Comprehensive Plan. Ftu-ther, staff finds that the proposed use is in compliance with Title 11 of the Meridian City Code. C. That the design, construction, operation, and maintenance will be compatible with other uses in the general neighborhood and with the existing or intended character of the general vicinity and that such use will not adversely change the essential character of the same area; Stafffinds that the proposed use, design, construction, operation and maintenance should be compatible with the other restaurant type uses found in the general vicinity, i ncluding KFC/A&W, Taco Bell, Wendy's, Round Table Pizza and Bolo's. The Taco BelPdirectly to the south and the Wendy's directly to the east also have drive-tlu-us. Staff finds that the design of the Starbuck's drive-thru is compatible with the other drive thrus and uses in the general vicinity. Staff recommends that the Council and Commission also consider public testimony when determining if the proposed use will adversely change the essential character of the area. D. That the proposed use, if it complies with all conditions of the approval imposed, will not adversely affect other property in the vicinity; Staff finds that the proposed uses should not have an adverse affect on the other property rn the vicinity. That the proposed use will be served adequately by essential public facilities and services such as highways, street, police, and fire protection, drainage structu res, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; The subject site has frontage on Meridian Road (120-feet) and Corporate Drive (121-feet) but does not have any approved access points to either street. It appears that access to Meridian Road, Main Street and Corporate Drive are provided to the site via shared driveways that were previously approved by ACRD. However, staff does not have copies of any recorded documents that grant access to the ,public street system to the subject Lot 2, ,Block 1, Wenco Subdivision. Staff recommends that the applicant provide staff with a recorded copy of a cross-access ingress/egress easement and parkin,; agreement for the subject site to use the existing drive aisles and parking on Lot 1 Block 1 Wenco Subdivision (see Site Specific Requirement #31. The Commission and Council will need to reference any written and'or verbal testimony submitted by the Meridian Police and Fire Departments regarding their ability to adequately service this project. Water and sanitary sewer service to the proj ect is readily available to the site. F. That the proposed use will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; If approved, the developer will be required to finance the extension of sewer, water, utilities and pressurized irrigation to serve the project. The primary public costs to serve the site will be fire and police services. Staff finds there will not be excessive additional requirements at public cost and that the proposed use will not be detrimental to the community's economic welfare. G. That the proposed use will not involve activities or processes, materials, equipment, and conditions of operation that will be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; According to the ACHD traffic count taken on 2-7-01 there were 14,939 vehicle trips on Meridian Road, north of Corporate Drive, and 841 vehicle nips on Corporate Drive, east of Meridian Road. On 5-23-02 there were 27,696 vehicle trips on Main Street, south of Watertower Lane. Staff finds that the proposed use will create additional traffic on adjacent arterial r oads. B ased on the ITE manual, this use (fast food restaurant) is estimated to generate 694 additional vehicle trips per day. Although this is a sizeable amount of traffic, staff does not believe that it is excessive and will not be detrimental. Staff does not anticipate the proposed use will create excessive noise, smoke, fumes, glare, or odors. That the proposed use will have vehicular approaches to the property which shall be so designed as not to a-eate an interference with traffic on surrounding public streets; Staff finds that ACHD has previously approved the driveway locations and acquired additional tight-of-way when the Wendy's CUP and Wenco Subdivision were reviewed. Traffic interference should have been taken into account for said driveways when they were previously approved. NOTE: There was a note placed on the approved driveway to Meridian Road that notifies the applicant that the driveway maybe restricted byACHD toright-in/right-out only movements in the future. The driveway is currently striped for right-in/right-out and left-in movements only. I. That the proposed use will not result in the destruction, loss or damage of a natural, scenic or historic feature considered to be of major importance. Staff is not aware of any natural or scenic feature(s) that would be lost, damaged or destroyed by issuance of this conditional use. SPECIAL CONSIDERATIONS 1. Street Buffers: The Comprehensive Plan designates both Meridian Road and Main Street as Entryway Corridors for the City. MCC 12-13-10-4 requires a 35-foot buffer along all Entryway Corridors. MCC 12-13-10-2 states that all required (street) b offers s hall b e located beyond any street right-of--way. A 25-foot wide landscape buffer was previously approved for this site along Meridian Road through the CUP process for the Wendy's drive-thru. Since the approval o f the CUP for the Wendy's, an additional 10_feet of right-of--way (40-feet total from centerline) has been dedicated to ACHD. On the submitted site and landscape plans, a 25-foot wide buffer is depicted. However, 10 feet of the proposed buffer are off-site and lie within the jurisdiction of ACHD. Staff anticipates that Meridian Road will be widened in the future, significanCly reducing or removing a large portion of the street buffer. When Meridian Road is widened, the buffer between the drive-thru and the street would be approximately 15_feet wide (measured from the current right-of--way line to the edge o f t he drive-thru 1 ane). S taff recommends that the anplicant provide a 25-foot wide landscape buffer along Meridian Road measured from the existing right-of-way line to the edge of the drive-thru lane and/or building (see Site Syecific Requirement #1). NOTE: There have been other requests in this area for reduced landscape buffers along Main Street and Meridian Road. With the development of the KFC Restaurant, at the corner of Main Street and Meridian Road, a 10-foot wide (approximate) landscape buffer was approved. Recently an application was submitted for a Carl's Jr. Restaurant, just south ofthe CUP-U3-O51 SCUrbuclcs.CUf'.doc Planning & Zoning Commission/Mayor & City Council P&Z Hearing Date: November 6, 2003 Page 6 subject site. With that application (CUP-03-042), the applicant requested a ] 0-foot wide buffer along Meridian Road. Further, staff has had preliminary discussions regarding potential development of the currently vacant parcels just to the north of this site, between Gem Avenue and the north property line. Staff will analyze future applications on acase-by- case basis. However, staff anticipates that depending on the outcome of this application, a similar (reduced) landscape buffer maybe proposed for the development of the two parcels directly to the north of the subject site in the near future. Therefore, staff recommends that the Commission and Council consider whether the proposed landscaping along Meridian Road, ultimately 15-feet wide from property line, or the landscape buffer width previously approved with Wenco Subdivision/Wendy'sRwtaurant, 25-feet wide, alon~MeridianRcad is appropriate and in harmony with the intent of the Landscape Ordinance and other (existing and future) buffers in the area. SITE SPECIFIC REQUIREMENTS 1. Landscapingi Street Buffers: Provide a 25-foot wide landscape buffer along Meridian Road, measured from the existing r fight-of--way 1 fine t o t he e dge o f t he d rive-tl3ru 1 ape a nd/or building. Other than the above-mentioned change, the landscape plan prepared b}~ BRS Architects, Sheet L-I, dated 9-03-03 is approved. The Applicant shall submit 15 copies of a revised landscape and site plan to the City Clerk at least 10 days prior to the next public hearing on this project. 2. Parking: All parking and areas of circulation shall be improved with a hard surface, and striped in accordance with ADA, as previously approved with CUP-O1-028 and as shown on the submitted site plan, prepared by BRS Architects on 8-20-03. If modifications are needed to accommodate the street buffer on Meridian Road, the applicant shall submit a revised site plan to P & Z staff showing said modifications at least 10 days prior to the next public hearing. The required parking for Lot 1 & 2, Block 1, Wenco Subdivision shall not drop below the required 33 stalls. Cross-Access: The submitted site plan shows off-site vehicular access points to Meridian Road, and Corporate Drive. Across-access easement has not been submitted to P & Z staff for this lot to use the approved off-site access points. Therefore, the Applicant shall submit a copy of a recorded cross-access ingress/egress easement and parking agreement for the subject lot to utilize the access points and parking on Lot 1, Block 2, Wenco Subdivision prior to issuance of a Certificate of Zoning Compliance (CZC). 4. Signs: All signage shall be in accordance with the standards set forth in MCC 11-14. All signage is subject to design review and shall require separate permits. 5. Lighting: All exterior lighting, whether attached to the building or located within the parking lot, shall be down-shielded or otherwise altered so that the light does not spill over onto adjacent properties or right-of--way. Accessibility: All construction and site improvements shall conform to the requirements of the Americans with Disabilities Act. Stonnwater: A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 70-1-91) for all off-street parking areas. Storm water treatment and disposal must be designed i^ accordance with Department of Environmental Quality 1997 publication Catalog of Stonn Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into surface water is prohibited unless thejurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. Trash: The trash enclosure shall be enclosed on at least 3 sides by a solid wall or sight obscuring fence at least four feet in height in accordance with MCC 11-12-1C. Coordinate location and constniction requirements with. Sanitary Services, Inc. 9. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy for the proposed development. A temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of creditor cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for temporary occupancy. Any temporary occupancy will not exceed 60 days to complete the required improvements. 10. A Certificate ofZoning Compliance (CZC) and a Building Permit shall be obtained prior to the start of construction. The Ada County Highway District (ACRD) staff has received the above referenced application requesting preliminary plat approval fora 2-lot commercial subdivision. The 1.46-acre site is located at the northwest corner of Corporate Drive and First Street. This development is estimated to generate 2,342 vehicle trips per day based on the Institute of Transportation Engineers Trip Generation Manual. B. On January 2, 2002, the ACRD Commission approved MCUP01-0028, a conditional use application for a drive-thru restaurant. This application is to plat two lots: one for the drive-thru restaurant, and the other as an "unidentified° pad site. The conditions of MCUP01-0028 apply to this application. The following Site Specific Requirements and Standard Requirements must be met or provided for prior to ACRD approval of the final plat: Site Specific Requirements: Dedicate 775-square feet of right-of-way on the northwest corner of East 1~` Street and Corporate Drive. The dimensions should provide a 775-square foot triangle. The triangle should be a right triangle with right-of way from the southeast corner of the property on East 15~ extending 31-feet north of Corporate Drive. The right triangle on Corporate Drive should be from the southeast corner of the property extending 25-feet west of East 1s` Street. The right-of-way abutting the parcel should be dedicated by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will be paid the fair market value of the right-of--way dedicated which is an addition to existing ACRD right-of-way if the owner submits a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACRD Ordinance #193. The right-of-way purchase agreement must be completed and signed by the applicant prior to scheduling the final plat for signature by the ACRD Commission. _~ 2. Dedicate 40-feet of right-of-way from the centerline of Meridian Road abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will be paid the fair market value of the right-of-way dedicated which is an addition to existing ACHD right-of-way if the owner submits a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACRD Ordinance #193. Per the action of the ACHD Commission on 01-02-02, construct aright-in/right-out, left-in driveway located approximately 140-feet north of Corporate Drive. Left-turns out of the site are not permitted. Install an on-site sign that states "LEFT TURNS PROHIBITED". This driveway may be restricted to all left turning movements in the future. ACHD may install a concrete median in Meridian Road when warranted. 4. The driveway that is proposed on Corporate Drive located approximately 180-feet west of East 1S1 Street is approved as a full access driveway. 5. The proposed internal driveway to be shared with the property directly to the north is approved with this application. The applicant shall provide a recorded cross access easement for the parcels to the north to use this parcel for access to the public roadway network. 6. Construct a 5-foot wide detached concrete sidewalk on Meridian Road and East 15' Street located 2- feet within the new right-of-way. Coordinate the location and elevation of the sidewalk with District staff. If the sidewalk meanders outside of the right-of-way, provide an easement for the sidewalk. 7. Replace unused curb cuts on Corporate Drive, Meridian Road and East 1st Street with standard curb, gutter and concrete sidewalk to match existing improvements. 8. Replace any damaged curb, gutter and/or sidewalk on Corporate Drive, Meridian Road and East 1st Street with new curb, gutter and/or concrete sidewalk to match existing improvements. Segments to be replaced shall be determined by ACHD Construction Services staff. Contact Construction Services at 387-6280 (with file number) for details. 9. Pave the driveway its full width of 30- to 40 feet and at least 30-feet into the site beyond the edge of pavement of Meridian Road with 15-foot curb radii. 10. Provide a minimum of 100-feet of stacking distance from the drive-thru window to the public roadway system. 11. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact Construction Services at 387-6280 (with file numbers) for details. 12. Any existing irrigation facilities should be relocated outside of the right-of-way. 13. All utility relocation costs associated with improving street frontages abutting the site should be borne by the developer. 14. Other than the access points specifically approved with this application, direct lot or parcel access to Corporate Drive, East 15' Street and Meridian Road is prohibited. ~1 Standard Requirements: The Commission shall hear and decide appeals by an applicant of the final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this section 7101.6, did. not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of the ACHD Policy Manual. a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs. b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten (10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection. c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply, and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal. d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the delivery to the appellant of the ROWDS Manager's reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. e. Action by Commission: Following the hearing, the Commission shall either affirm or reverse, in whole or part, or otherwise modify, amend or supplement the decision being appealed, as such action is adequately supported by the law and evidence presented at the hearing. 2. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance. 3. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 4. The applicant shall submit revised plans for staff approval; prior to issuance of building permit (or other required permits), which incorporates any required design changes. 5. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 6. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. Conclusion of Law: ACRD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. Future right of way widths will be, A: 120 feet each side of centerline (240 feet total) for building setbacks and to include a frontage road, or B: 70 feet each side of centerline (140 feet total) if the developer provides an internal frontage road type system to feeder roads. Access to a Principal Arterial Type IV will be intersections only, and spaced at one mile intervals in rural areas and one-half mile intervals in urban azeas. Approaches (other than intersections) may be permitted in special cases and on a temporary basis as follows: (1) Allowed until state highway system is improved by a construction project at which time an access will be provided to the property, which may not directly access the state highway system, but may be via a frontage or backage road. (2) Shall be recorded at the County Recorders Office. (3) Temporary access restrictions will be noted on the permit. Noise abatement (berms, fences, etc.) will be the responsibility of the developer and will be constructed off of the State Right of Way, see enclosed Noise Abatement Measures. The applicant shall perform a Traffic Noise Screen in accordance with the Environmental Process Manual (EPM) Section 1350.02. a. The design year shall be the date of the proposed development plus 20 yeazs. b. The traffic volume considered for 20 yeaz future build-out shall be: S/o0 ADT (Average Daily Traffic). c. The highway configuration considered for 20 year fixture build-out shall be per the attached typical section. d. Use the existing highway centerline for the 20 yeaz future build-out. 2. If the results of the Traffic Noise Screen so warrant, then [he applicant shall perform a Traffic Noise Impact Analysis in accordance with EPM Section 1350.03. 3. The applicant shall submit a noise report to the Planning & Zoning authority with a copy to TfD. This report shall include: a. Results of the Traffic Noise Screen, including supporting assumptions, documentation, and conclusion as to whether a Traffic Noise Impact Analysis is warranted. b. Results of Traffic Noise Impact Analysis (if warranted), including supporting assumptions, documentation, and discussion of different types of abatement considered. c. A recommenda[ion of the type of abatement to be used for the proposed development. 4. The Planning & Zoning authority will review the noise report, solicit and consider comments from ITD, and determine which (if any) abatement methods will be made as a condition of the proposed development.
