Exhibit A that is referenced on page 1 ~has~ included in the development agreement is for
0.456 acres. _That,was the parcel that~was annexed in addition.to what was originally
annexed. I assume that the development agreement should be for the complete
subdivision rather than just that .45 acres, so I think the Exhibit A needs to be revised to
included~the entire subdivision.

Corrie: Comments from staff on the request?
Stiles: Mr. Mayor and Council, on page six of the recommendation item 1.34, the
development agreement I believe reduced the planting strip beyond required right-of-
way to 15 feet. If that could be revised the second sentence provide planting strip
beyond required right-of--way per terms of development agreement. Also I would like to
note that theaapplicant or his representative I don't know is here tonight, just to inform
you that the plan that we have. received does not comply with ordinance requirements
°and just make sure that that the plan that we get for a building permit does comply with
all the terms and conditions of our comments.
Corrie: Also Shari, I believe we got a letter from Bill and Pat-Geyer about item number
1.42 no-city water should be eliminated per conversation understanding with Mr. Bruce
Freckleton.

Stiles:. Bruce took~that out because~~of the size of the landscaped area. 1s that - ~
Corrie: Do you ,want that one removed? , .

Smith: I don't know anything about the letter that they've sent, Mayor Corrie. Typically
that restriction for city water is if the area to be irrigated exceeds a half acre. I can't
imagine that's the case here, so that's probably why the request is being made to delete
that item. I would assume that that's a valid request.
Corrie: Any other discussion from Council to staff or yourselves?
Bentley: I have none.
Bird: I have none.
Corrie: I'll entertain a motion on item number 11 request for conditional use permit for
Bill and Pat Geyer.
Bentley: Mr. Mayor I move we approve the conditional use permit for 8,000 square foot
building by Biil and Pat Geyer with the recommended changes on page six that the 15
foot instead of 20 foot planting strip be required beyond the required right-of=way per
terms of the development agreement and that we strike on page 7 provision 1.42 no city
water will be allowed for landscape irrigation.
Rountree: Second.
Corrie: Motion is made and seconded that we approve the request for conditional use
permit with the corrections and- deletions of item 1.34 and item 1.42. Any further
discussion? Hearing none, roll call vote.

Berg: Just a clarification, this maybe directed to the attorney, do we need to approve
the Findings of Fact and Conclusions of Law officially from the P & Z and then approve
a conditional use permit or authorize the -whatever document that is for the conditional
use? In the past we have approved individually the Planning and Zoning's Findings.
Just a question.
Rutherford: Mayor and members of the Council, it was understanding that we would - if
you approved this that we would come up with the Order and Decision and go from
there.
Rountree: Mr. Mayor I think the question is do we need Findings of Fact and
Conclusions of Law prepared? We don't have them. We have a recommendation from

Planning and Zoning. Do we need that,for a conditional use permit before we can take
action on the conditional use permit?
Rutherford: It's my understanding, yes.

Corrie: Okay, I'll entertain a motion for Findings of Fact and Conclusions of Law
preparation.
Rountree: Mr. Mayor I move that we have Findings of Fact and Conclusions of Law and
Decision and Order prepared for this requested conditional use permit and that that
Findings of Fact and Conclusions of Law incorporate the recommendations from
Planning and Zoning that have been modified by Planning Administrator, Shari Stiles.
Page 6 item 1.34 the planting would be 15 feet and that item 1.42 be deleted and that
the Findings of Fact and Conclusions of Law reflect positively on the requested
conditional use permit.
Bentley: Second.
Corrie: Motion made that we direct the city attorney to draw up the Findings of Fact and
Conclusions of Law with the recommended changes and also approve the
recommended changes on the conditional use permit for the Council. Any further

and Conclusions of Law. It's pretty a straight forward project just to advise you, they are
coming in with a condominium project for this that you will be seeing later, but we had
no problems with this as it's already in a developed industrial subdivision.
Corrie: Is there any question on the number of trees or anything like that Shari?
Stiles: No, they'll meet our requirements.

The above entitled conditional use permit application having come before
the City Council on the 1st day of June, 1999, and Shari Stiles, Planning and Zoning
Administrator, having appeared and testified, and the Applicant, Bill Geyer, did not
appear but had previously submitted a letter to City Hall on June 1, 1999, and no one
appeared in opposition of the application, and the City Council having received the staff
report and the record made before the Planning and Zoning Commission, and' being fully
advised in the premises, the Council finds and concludes as follows:

FINDINGS OF FACT
l . A notice of a public hearing on the conditional use permit was
published for two (2) consecutive weeks prior to the said public hearing scheduled for
June 1, 1999, before the City Council, the first publication appearing and written
notice having been mailed to property owners or purchasers of record within three
hundred (300') feet of the external boundaries of the property under consideration
more than fifteen (15) days prior to said hearing and with the notice of public hearings
having been posted upon the property under consideration more than one week before
said hearing and the copies of all notices were made available to newspaper, radio and
television stations as public service announcements; and the matter having been duly
considered by the City Council at the June 1, 1999, said public hearing; and the
Applicant, affected property owners, and government subdivisions providing services
within the planning jurisdiction of the City of Meridian, having been given full
opportunity to express comments and submit evidence.
2. There has been compliance with all notice and hearing
requirements. set forth in Idaho Code §§67-6509 and 67-6512; and §§11-2-416E and
11-2-418E as evidenced by the Affidavit of Mailing, and the Affidavit of Publication
and- Proof of Posting filed with the staff report.

4. The owners of record of the subject property are Bill and Pat Geyer
of 967 E. Parlccenter, #282, Boise, Idaho. 83706.
5. Applicants are the owners of record. '
6. The subject property is currently zoned General Retail and Service
Commercial (C-G). The zoning district of General Retail and Service Commercial (C-
G) is defined within the City of Meridian Zoning and Development Ordinance,
Section 11-2-408(11).
7. The proposed application requests a conditional use permit for
construction and development of an approximate 8,000 sq. ft. commercial/general
building. The General Retail and Service Commercial (C-G) zoning designation within
the City of Meridian Zoning and Development Ordinance does not ordinarily require a
conditional use permit. A requirement of the original annexation of this parcel was
that all uses,. be developed as Planned Uriit Developments under a conditional use
permit process. (Meridian City Zoning and Development Ordinance, Section 11-2-
409(B).)
8. As a planned unit development the use proposed within the subject
application will in fact, constitute a conditional use as determined by City Policy.
9. The Meridian City Council takes judicial notice of its Zoning,

Subdivision and Development Ordinances codified at Title 1 1, Municipal Code of the
City of Meridian and all current zoning maps thereof and the Comprehensive Plan of
"the City of Meridian, adopted December 21, 1993, Ord. No. 629-Jan. 4, 1994 and
Maps and the Ordinance establishing the Impact Area Boundary.
10. Giving due consideration to the comment received from the
governmental subdivisions providing services in the City of Meridian planning
.~
jurisdiction public facilities and services required by the proposed development will not
impose expense upon the public if the following conditions of development are
imposed and the following is also found to be required to mitigate the effects of the
proposed use and development upon services delivered by political subdivisions
providing services to the subject real property within the planning jurisdiction of the
City of Meridian:
Adopt the Ada County Highway District's Recommendations as follows:
10.1 Utility street cuts in the new pavement are not allowed
unless approved in writing by the District.
10.2 Provide a recorded cross access easement for the parcels to
the north and east to use this parcel for access to the public
streets prior to issuance of a building permit (or other
required permits).
10.3 Construct a 5-foot wide detached concrete sidewalk on
Locust Grove Road abutting the site. Locate the sidewalk
one-foot within the right-of-way of Locust Grove Road.

10.4 Construct curb, gutter and 5-foot wide concrete sidewalk
and match paving on Wilson Street abutting the developed
.portion of the site. Construct improvements to one-half of a
41-foot street section. Coordinate the location, elevation
- and grade of the sidewalk with District staff.
10.5 Construct a 24 to 30-foot wide curb return drivewayaocated
100-feet east of.Locust Grove on Wilson Street, as
proposed. Pave the driveway its full required width and at
least 30-feet beyond the edge of pavement of Wilson Street
and install pavement tapers with 15-foot radii abutting the
existing roadway edge.
10.6 Construct a 24 to 30-foot wide curb return driveway located
' 20-feet west of the east property line on Wilson Street, as
proposed. Pave the driveway its full required width and at
least 30-feet beyond the edge of pavement of Wilson Street
and install pavement tapers,with 15-foot.radii abutting the
existing roadway edge.
10.7 The el~cisting`driveway at the. site's north property line shall
be approved for full access until such time as the
intersection is reconstructed, the site redevelops to the east,
or if a hazardous situation develops with regard to the
operation of the driveway. At which time the District will
construct asix-inch raised median in the center of Locust
Grove Road, from a point 10-feet south of the stop bar at
the intersection of Fairview Avenue to a point 310-feet
south of the intersection.
10.8 As required by District policy, restrictions on the width,
number and locations of driveways, shall be placed on future
development of this parcel.
10.9 No new access to Locust Grove Road has been proposed and
none is approved-with~ths application..

10.10 Other than the access points specifically approved with this
application, direct lot or parcel access to Wilson Street is
prohibited.
Adopt the Meridian Fire Department's` Recommendations as follows:
10.11 Applicants shall satisfy all fire code requirements.
Adopt the Central District Health Department's Recommendations as follows:
10.12 The Applicant's central sewage and central water plans must
be submitted to and approved by the Idaho Department of
Health Sz Welfare, Division of Environmental Quality.
10.13 Run-off is not to create a mosquito breeding problem.
10.14 stormwater shall be pretreated through a grassy Swale prior
to discharge to the subsurface to prevent impact to
groundwater and surface water quality.
10.1 S The Engineers and architects involved with the design of the
subject project shall obtain current best management
practices for stormwater disposal and design a stormwater
management system that prevents groundwater and surface
water degradation.
Adopt the Nampa & Meridian Irrigation District Recommendations as follows:
10.16 Applicant shall submit a Land Use Change/Site
Development application for review prior to final platting.
10.17 All laterals and wasteways shall be protected.
10.18 All municipal surface drainage shall be retained on site. If
any surface drainage leaves the site, the Nampa & Meridian
Irrigation District must review drainage plans.

10.19 The developer must comply with Idaho Code § 31-3805.
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
10.20 Any existing irrigation/drainage ditches crossing or adjacent
to the property shall be tiled per City Ordinance 1 1-9-
605.M. The ditches to be piped should be shown on the site
plans. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users' association, with
written confirmation of said approval submitted to the
Public Worlcs Department. No variances have been
requested for tiling of any ditches crossing this project.
10.21 Any existing domestic wells and/or septic systems within
this project shall be removed from their domestic service per
City Ordinance Section 5-7-5 17. Wells may be used for
non-domestic purposes such as landscape irrigation.
10:22 Off-street parking shall be provided in accordance with
Section 11-2-414 of the City of Meridian Zoning and
Development Ordinance and/or as detailed in site-specific
requirements
10.23 Paving and striping shall be in accordance with the
standards set forth in Sections 11-2-414.D.4 and 11-2-
414.D.5 of the City of Meridian Zoning and Development
Ordinance and in accordance with Americans with
Disabilities Act (ADA) requirements.
10.24 A drainage plan designed by a State of Idaho licensed
architect or engineer is required and shall be submitted to
the City Engineer (Ord. 557, 10-1-91) for all off-street
parking areas. All site drainage shall be contained and
disposed of on-site.

10.25 Outside lighting shall be designed- and placed so as not to
direct illumination on any nearby residential areas and in
accordance with City Ordinance Section 11-2-14.D.3.
10.26 All signage shall be in accordance with the standards set
forth in Section 11-2-4I5 of the City of Meridian Zoning
and Development Ordinance. No temporary signage or
flashing signs will be permitted.
10.27,: Applicants shall provide five-foot-wide sidewalks in
accordance with City Ordinance Section 11-9-606.B.
10.28 All construction shall conform to the requirements of the
Americans with Disabilities Act:
10.29 Applicant shall provide a revised site plan detailing all
existing-and proposed utilities for review by the Meridian
Public Worlcs Department: Designer is to coordinate sizing
and routing.. of sanitary sewer and water within the
development with the Public Works Department.
10.30 Applicant shall provide the Public Worlcs Department with
- information on 'anticipated fire flow and domestic water
requirements for the proposed site. Flow and pressure from
the existing mains shall be monitored with the Meridian
Water Department to determine whether adequate fire
protection exists.
10.31 Applicant shall be required to enter into an Assessment
Agreement with the City of Meridian. In addition to these
assessments, "Late Comers" fees may also be charged against
this parcel to help reimburse the parties responsible for
installing mains to their current points.
10.32 The total area of all common open space shall equal or
exceed ten percent (10%) of the gross land area of a planned
development.

10.33 Applicant shall provide calculation of paved area. A
minimum of one (1) three-inch (3 ") caliper tree is required
for every 1,500 square feet of asphalt.
10.34 Applicant shall provide detailed landscape plan for review
and approval. Per terms of development agreement-for this
property, a minimum 15-foot-wide planting strip shall be
provided beyond the required right-of--way per terms of the
development agreement.
10.35 Lighting plans shall be submitted for review to ensure
adjacent residential property and the traveling public is not
impacted by glare,. as determined by the City of Meridian.
10.36 Signage should be limited to one low-profile monument type
sign near the intersection of Locust Grove Road and the
private drive. Detailed signage plans shall be reviewed as
part of this .,application.
10.37 Applicant shall construct five-foot-wide sidewalks along the
entire frontages of Locust Grove Road and Wilson Lane.
10.38 Applicant shall coordinate screened trash enclosure locations:
and construction requirements with Sanitary Service
Company and.. provide a letter of approval from their office
prior to applying for building permits.
10.39 Handicapped accessible parking spaces shall be provided in
accordance with the Americans with Disabilities Act. All
building and parking lot construction shall meet the
requirements of the Americans with Disabilities Act.
10.40 Applicant shall install wheel blocks or other suitable devices
to prevent any part of a parked vehicle from extending
beyond the property line.

10.41 Drainage swales may not be within the landscape setbacks
along Locust Grove.
10.42 Applicant shall provide detail of southern elevation. Design
must consider street appeal from Wilson Lane.
10.43 Applicant shall meet all other terms and conditions of
recorded development agreement.
Additional Recommendations of the Planning and Zoning Commission
10.44 The Applicants' monument sign shall not exceed 65 sq.ft.
11. To maintain compliance with the Comprehensive Plan,. the project
should be designed, constructed, operated and maintained to be harmonious and
appropriate in± appearance with the existing and intended character of the general
vicinity and that such intended conditional use will not change the essential character
of the requests.
CONCLUSIONS OF LAW
1. The City Council adopts as its Conclusions of Law the Recommendations
10.1 through 10.44 of the Recommendations to City Council made in the above
entitled matter by the Planning and Zoning Commission which are incorporated herein
by reference as if set forth at length.

2. The City of Meridian shall exercise the powers conferred upon it by the
"Local. Land Use Planning Act of 1975" hereinafter referred to for convenience as the
"Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503).
3. The Meridian Planning and Zoning Commission may exercise all the
powers required and authorized under the "Act" except the power to adopt ordinances
by the establishment of a Planning and Zoning Commission by ordinance pursuant to ..
Idaho Code Section 67-6504 which the City Council of the City of Meridian has
established by the passage of the "City of Meridian Zoning and Development
Ordinance" at Title XI, Chapter 1, Municipal Code of the City of Meridian.
4. As part of a zoning ordinance the City Council can, subject to hearing
and notice provision required, provide for the process of special and/or conditional use
p"ermits which a proposed' use is otherwise prohibited by the terms of the ordinance but
allo~~ved with conditions under the specific provisions of the ordinance which the City
of Meridian has done in the adoption of its zoning ordinances.
5. The City Council has the duty and responsibility to review the facts and

6. Prior to granting a conditional use permit in a General Retail and Service
Commercial District (C-G), a public hearing shall be conducted with notice to be
published and provided to property owners or purchasers of record within three
hundred feet (300') of the external boundaries of the land under consideration for the
conditional use permit all in accordance with the provisions of Section 11-2-418E City
of Meridian Zoning and Development Ordinance, which provides as follows:
"Prior to approving a Conditional Use Permit, the applicant and the
Commission and Council shall follotiv notice and hearing procedures provided in
Section 11-2-416, Zoning Amendment Procedures, of this Ordinance. Provided,
however, that Conditional Use applications for land in Old Town and in
Industrial .and Commercial Districts shall only be required to have one public
hearing which shall be held before the Planning and Zoning Commission and
after the recommendation of the Commission is made the application shall go
before the City Council without a public hearing and the Council may approve,
deny, or modify the recommendation of the Commission."
7. Following the public hearing and within 45 days after the conclusion of
the public hearing the Commission shall, transmit its recommendations to the
Meridian City Council with supportive reasons. The Commission shall recommend

1.2 Provide a recorded cross access easement for the parcels to the north and
east to use this parcel for access to the public streets prior to issuance of a
building permit (or other required permits).
1.3 Construct a 5-foot wide detached concrete sidewalk on Locust Grove
Road abutting the site. Locate the sidewalk one-foot within the right-of-
way of Locust Grove Road.
1.4 Construct curb, gutter and 5-foot wide concrete sidewalk and match
paving on Wilson Street abutting the developed portion of the site.

1.6 Construct a 24 to 30-foot wide curb return driveway located 20-feet west
of the east property line on Wilson Street, as proposed. Pave the driveway

redevelops to the east, or if a hazardous situation develops with regard to
the operation of the driveway. At which time the District will construct a
six-inch raised median in the center of Locust Grove Road, from a point
10-feet south of ahe stop bar at the intersection of Fairview Avenue to a
point 310-feet south of the intersection.
1.8 As required by District policy, restrictions on the width, number and
locations of driveways, shall be placed on future development of this
parcel.
1.9 No ne~v access to Locust Grove Road has been proposed~and none is
approved with this application.
1.10 Other than the access points specifically approved with this application,
direct lot or parcel access to Wilson Street is prohibited.
1.1 l Applicants shall satisfy all fire code requirements.

disposal and design a stormwater management system that prevents
groundwater and surface water degradation.
1.16 Applicant shall submit a Land Use Change/Site Development application

1.18 All municipal surface drainage shall be retained on site. If any surface
drainage leaves the site, the Nampa & Meridian Irrigation District must
review drainage plans.
1.19 The developer must comply with Idaho Code § 31-3805.
1.20 Any existing irrigation/drainage ditches crossing or adjacent to the
property shall be tiled per City Ordinance 1 1-9-605.M. The ditches to be
piped should be shown on the site plans. Plans will need to be approved
by the appropriate irrigation/drainage district, or lateral users' association,
with written confirmation of said approval submitted to the Public Worlcs
Department. No variances have been requested for tiling of any ditches
crossing this project.
1.21 Any`existing domestic wells and/or septic systems within this project shall
be removed from their domestic service per City Ordinance Section 5-7-5
I7. Welis may be used for non-domestic purposes such as landscape
irrigation.
1.22 Off-street parking shall be provided in accordance with Section 11-2-414
of the City of Meridian Zoning and Development Ordinance and/or`"as

' No temporary signage or flashing signs will be permitted.
1.27 Applicants shall provide five-foot-wide sidewalks in accordance with City
Ordinance Section 11-9-606.B.
1.28 All construction shall conform to the requirements of the Americans with
Disabilities Act.
1.29 Applicant shall provide a revised site plan detailing all existing and
proposed utilities -for review by the Meridian Public Works Department.
Designer is to coordinate sizing and routing of sanitary sewer and water
~u~ithin the development with the Public Worl<s Department.
1.30: Applicant shall provide the Public Worlcs Department with information
on anticipated fire flow and domestic water requirements for the proposed
site. Flow and pressure from the existing mains shall be monitored with
the Meridian Water Department to determine whether adequate fire
protection exists.
1.31 Applicant shall be required to enter into an Assessment Agreement with
the City of Meridian. In addition to these assessments, "Late Comers"
fees may also be charged against this parcel to help reimburse the parties
responsible for installing mains to their current points.
1.32 The total area of all common open space shall equal or exceed ten percent
(10%) of the gross land area of a planned development.
1.33 Applicant shall provide calculation of paved area. A minimum of one (1)
three-inch (3") caliper tree is required for'every 1,500 square feet of.

1.34 Applicant shall provide detailed landscape plan for review and approval.
Per terms of development agreement for this property, a minimum 15-
foot-wide planting strip shall be provided beyond the required right-of-
way per terms of the development agreement.
1.35 Lighting plans shall be submitted for review to ensure adjacent residential
property and the traveling public is not impacted by glare, as determined
by the' City of Meridian.
1.36 Signage should be limited to one low-profile monument type sign near the
intersection of Locust Grove Road and the private drive. Detailed signage
.plans shall be reviewed as part of this application.
1.37 Applicant shall construct five-foot-wide sidewalks along the entire
frontages of Locust Grove Road and Wilson Lane.
1.38 Applicant shall coordinate screened trash enclosure locations and
construction requirements with Sanitary Service Company and provide a
letter of approval from their office prior to applying for building permits.
1.39 Handicapped°accessible parking spaces shall be provided in accordance
with the Americans with Disabilities Act. All building and parking lot
construction shall meet the requirements of the Americans with

1.40 Applicant shall install wheel blocks or other suitable devices to prevent
any part of a parked vehicle from extending beyond the property line.

1'.42 Applicant shall provide detail of southern elevation. Design must consider

Meridian Water Department to determine whether adequate fire protection
exists.
2.31 Applicant shall be required to enter into an Assessment Agreement with the
City of Meridian. In addition to these assessments, "Late Comers" fees may
also be charged against this parcel to whelp reimburse the parties
responsible for installing mains to their current points.
2.32 The total area of all common open space shall equal or exceed ten percent
(10%) of the gross land area of a planned development.
2.33 Applicant shall provide calculation of paved area. A minimum of one (1)
three-inch (3") caliper tree is required for every 1,500 square feet of asphalt.
2.34 Applicant shall provide detailed landscape plan for review and approval. Per
terms of development agreement for this property, a minimum 15-foot-wide
planting strip shall be provided beyond the required right-of-way per terms
of the development agreement.
2.35 Lighting plans shall be submitted for review to ensure adjacent residential
property and the traveling public is not impacted by glare, as determined by
the City of Meridian.
2.36 Signage should be limited to one low-profile monument type sign near the
intersection,of Locust Grove Road and the private drive. Detailed signage
plans shall be reviewed as part of this application.
2.37 Applicant shall construct five-foot-wide sidewalks along the entire frontages
of Locust Grove Road and Wilson Lane.
2.38. Applicant` shall coordinate screened trash enclosure locations and
construction requirements with Sanitary Service Company and provide a
letter of approval from their office prior to applying for building permits.
2.39 Handicapped accessible parking spaces shall be provided in accordance
with the Americans with Disabilities Act. All building and parking lot
construction shall meet the requirements of the Americans with Disabilities
Act.
2.40 Applicant shall install-wheel blocks or.other suitable devices to prevent any
part of a parked vehicle from extending beyond the property line.

Administrator, having appeared and testified, and the Applicant, Bill Geyer, did not
appear but had previously submitted a letter to City Hall on June 1, 1999, and no one
appeared in opposition of the application, and the City Council having received the staff
report and the record made before the Planning and Zoning Commission, and-being fully
advised in the premises, the Council finds and concludes as follows:

1. A notice of a public hearing on the conditional use permit was
published for two (2) consecutive weeks prior to the said public hearing scheduled for
June 1, 1999, before the City Council, the first publication appearing and written
notice having been mailed to property owners or purchasers of record within three
hundred (300') feet of the external boundaries of the property under consideration
more than fifteen (15) days prior to said hearing and with the notice of public hearings
having been posted upon the property under consideration more than one week before
said hearing and the copies of all notices were made available to newspaper, radio and
television stations as public service announcements; and' the matter having been duly
considered by the City Council at the June 1, 1999, said public hearing; and the
Applicant, affected property owners, and government subdivisions providing services
within the planning jurisdiction of the City of Meridian, having been given full
opportunity to express comments and submit evidence.
' 2. There has been compliance with all notice and hearing
requirements set forth in Idaho Code §§67-6509 and 67-6512; and §§11-2-416E and
11-2-418E as evidenced by the Affidavit of Mailing, and the Affidavit of Publication
and Proof of Posting filed with the staff report.

' 4. The owners of record of the subject property are Bill and Pat Geyer
of 967 E. Parl<center, #282, Boise, Idaho 83706.
S. Applicants are the owners of record.
6. The subject property is currently zoned General Retail and Service
Commercial (C-G). The zoning district of General Retail and Service Commercial (C-
G) is defined within the City of Meridian Zoning and Development Ordinance,
Section 11-2-408 (1 l }.
7. The proposed application requests a conditional use permit for
construction and development of an approximate 8,000 sq. ft. commercial/general
building. The General Retail and Service Commercial (C-G) zoning designation within
the City of Meridian Zoning and Development Ordinance does not ordinarily require a
conditional use permit. A requirement of the original annexation of this parcel was
that all uses be developed as Planned Unit Developments under a conditional use
permit process. (Meridian City Zoning and Development Ordinance, Section 11-2-
409(B).}
8. As a planned unit development the use proposed within the subject
application will in fact, constitute a conditional use as determined by City Policy.

~ City of Meridian and all current zoning maps thereof and the ,Comprehensive Plan of
the City of Meridian, adopted December 21, 1993, Ord. No. 629-Jan. 4, 1994 and
Maps and the Ordinance establishing the Impact Area Boundary.
10. Giving due consideration to the comment received from the
governmental subdivisions providing services in the City of Meridian planning
jurisdiction public facilities and services required by the proposed development will not
impose expense upon the public if the following conditions of development are
imposed and the following is also found to be required to mitigate the- effects of the
proposed use and development upon services delivered by political subdivisions
providing services to the subject real property within the planning jurisdiction of the
City of Meridian:
Adopt the Ada County Highway District's Recommendations as follows:
10.1 Utility street cuts in the new pavement are not allowed
unless approved in writing by the District.
10.2 Provide a recorded cross access easement for the parcels to
the north and east to use this parcel for access to the public
streets prior to issuance of a building permit (or other
required permits).
10.3 Construct a 5-foot wide detached concrete sidewalk on
Locust Grove Road abutting the site. Locate the sidewalk
one-foot within the right-of-way of Locust Grove Road.

10.4 Construct curb, gutter and 5-foot wide concrete sidewalk
and match paving on Wilson Street abutting the developed
portion of the site. Construct improvements to one-half of a
41-foot street section. Coordinate the location, elevation
and grade of the sidewalk with District staff.
10.5 Construct a 24 to 30-foot wide curb return driveway located
100-feet east of Locust Grove on Wilson Street, as
proposed. Pave the driveway its full required width and at
least 30-feet beyond the edge of pavement of Wilson Street
and install pavement tapers with 15-foot radii abutting the
existing roadway edge.
10.6 Construct a 24 to 30-foot wide curb return driveway located
20-feet west of the east property line on Wilson Street, as
proposed. Pave the driveway its full required width and at
least 30-feet beyond the edge of pavement of Wilson Street
and install pavement tapers with 15-foot radii abutting the
existing roadway edge.
10.7 The existing driveway at the site's north property line shall
be approved for full access until such time as the
intersection is reconstructed, the site redevelops to the east,
or if a hazardous situation develops with regard to the
operation of the driveway. At which time the District will
construct asix-inch raised median in .the center of Locust
Grove Road, from a point 10-feet south of the stop bar at
the intersection of Fairview Avenue to a point 310-feet
. south of the intersection.
10.8 As required by District policy, restrictions on the width,
number and locations of driveways, shall be placed on future
development of this parcel. -
10.9 No new access to Locust Grove Road has been proposed and
none is approved with this application.

Adopt the Meridian Fire Department's Recommendations as follows:
10.11 Applicants shall satisfy all fire code requirements.
Adopt the Central District Health Department's Recommendations as follows:
10.12 The Applicant's central sewage and central water plans must "~`~'
be submitted to and approved by the Idaho Department of
Health Sz Welfare, Division of Environmental Quality.
10.13 Run-off is not to create a mosquito breeding problem.
10.14 stormwater shall be pretreated through a grassy swale prior
to discharge to the subsurface to prevent impact to
groundwater and surface water quality.
10.15 The Engineers and architects involved with the design of the
subject project shall obtain current best management
practices for stormwater disposal and design a stormwater
management system that prevents groundwater and surface
water degradation.
Adopt the Nampa &. Meridian Irrigation District Recommendations as follows:
10.16 Applicant shall submit a Land Use Change/Site
Development application for review prior to final platting.
10.17 All laterals and wasteways shall be protected.
10.18 All municipal surface drainage shall be retained on site. If
any surface drainage leaves the site, the Nampa SL Meridian
Irrigation District must review drainage plans.

10.19 The developer must comply with Idaho Code § 31-3805.
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
10.20 Any existing irrigation/drainage ditches crossing or adjacent
to the property shall be tiled per City Ordinance 1 1-9-
605.M. The ditches to be piped should be shown on the site
plans. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users' association, with
written confirmation of said approval submitted to the
Public Worlcs Department. No variances have been
requested for tiling of any ditches crossing this project.
10.21 Any existing domestic wells and/or septic systems within
this project shall be removed from their domestic service per
City Ordinance Section 5-7-5 17. Wells may be used for
non-domestic purposes such as landscape irrigation.
10.22 Off-street parking shall be provided in accordance with
Section 11-2-414 of the City of Meridian Zoning and
Development Ordinance and/or as detailed in site-specific
requirements
10.23 Paving and striping shall be in accordance with the
standards set forth in Sections 11-2-414.D.4 and 11-2-
414.D.5 of the City of Meridian Zoning and Development
Ordinance and in accordance with Americans with
Disabilities Act (ADA) requirements.
10.24 A drainage plan designed~by a State of Idaho licensed
architect or engineer is required and shall be submitted to
the City Engineer (Ord. 557, 10-1-91) for all off-street
parking areas. All site drainage shall be contained and
disposed of on-site.

2. The City of Meridian shall exercise the' powers conferred upon it by the
"Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the
"Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503).
3. The Meridian Planning and Zoning Commission may exercise all the
powers required and authorized under the "Act" except .the power to adopt ordinances
by the establishment of a Planning and Zoning Commission by ordinance pursuant to
Idaho Code Section 67-6504 which the City Council of the City of Meridian has
established by the passage of the "City of Meridian Zoning and Development
Ordinance" at Title XI,.Chapter I, Municipal Code of the City of Meridian.
4. As part of a zoning ordinance the City Council ean, subject to hearing
and notice provision required, provide for the process of,special and/or conditional use
permits which a proposed use is otherwise prohibited by the terms of the ordinance but
allowed with conditions under the specific provisions of the ordinance which the City
of Meridian has done in the adoption of its zoning ordinances.
5. The City Council has the duty and responsibility to review the facts and
circumstances of each application for conditional use permit to determine prior to
granting the same that the evidential showing supports the finding that the following
standards are met and that the proposed development:

harmonious and appropriate in appearance with the existing or
intended character of the general vicinity and that such use will not
change the essential character of the same area;
d. Will not be hazardous or disturbing to existing or future
neighboring uses;
e. Wili be served adequately by essential public facilities and services
such as highways, streets, police and fire protection, drainage
structures, refuse disposal, water, sewer or that the person
responsible for the establishment of proposed conditional use shall
be able to provide adequately any such services;
` f. Will not create excessive additional requirements at public cost for
public facilities: and services and will not be detrimental to the
economic welfare of the community;
g. Will not involve uses, activities, processes, materials, equipment
and conditions of operation that will be detrimental to any
persons, property or the general welfare by reason of excessive
production of traffic, noise, smoke, fumes, glare or odors;
h. Will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on
surrounding public streets; and
i. Will not result in the destruction, loss or damage of a natural or
scenic feature of major importance.

6. Prior to granting a conditional use permit in a General Retail and Service
Commercial District (C-G), a public hearing shall be conducted with notice to be
published and provided to property owners or purchasers of record within three
hundred feet (300') of the external boundaries of the land under consideration for the
conditional use permit all in accordance with the provisions of Section 11-2-418E City
of Meridian Zoning and Development Ordinance, which provides as follows:
"Prior to approving a-Conditional Use Permit, the applicant and the
Commission and Council shall follow notice and hearing procedures provided in
Section 11-2-416, Zoning Amendment Procedures, of this Ordinance. Provided,
however, that Conditional Use applications for land in Old Town and in
Industrial and Commercial Districts shall only be required to have one public
hearing which shall be -held before the Planning and Zoning Commission and
after the recommendation of the Commission is made the application shall go
before the City Council without a public hearing and the Council may approve,
deny, or modify the recommendation of the Commission."
7. Following the public hearing and within 45 days after the conclusion of
the public hearing the Commission shall, transmit its recommendations to the
Meridian City Council with supportive reasons. The Commission shall recommend
that the application be approved, approved with conditions or denied. The
Commission shall ensure that any approval or approval with conditions of an
application shall be in accordance with Meridian Comprehensive Plan, City of
Meridian Zoning and Development Ordinance, and Idaho State law. (Section 11-2-
418(f),° City of Meridian Zoning and Development Ordinance.)

8.5 Designate the exact location and nature of the development;
8.6 Require the. provision for on-site public facilities or services; and
8.7 Require more restrictive standards than those generally required, in
this Ordinance.
9. The City of Meridian has, by ordinance, established the Impact Area and
the Comprehensive Plan of the City of Meridian, which was adopted December 21,
1993, Ord. 629, January 4, 1994 and Maps.

redevelops to the east, or if a hazardous situation develops with regard to

six-inch raised median in the center of Locust Grove Road, from a point
10-feet south of the stop bar at the intersection of Fairview Avenue to a
point 310-feet south of the intersection.
1.8 As required by District policy, restrictions on the width, number and
locations of driveways, shall be placed on future development of this
parcel.
1.9 No new access to Locust Grove Road has been proposed and none is

1.18 All municipal surface drainage shall be retained on site. If any surface
drainage leaves the site, the Nampa SL Meridian Irrigation. District must
review drainage plans.
1.19 The developer must comply with Idaho Code § 31-3805.
1.20 Any existing irrigationidrainage ditches crossing or adjacent to the
property shall be tiled per City Ordinance 1 1-9-605.M. The ditches to be
piped should be shown on the site plans. Plans will need to be approved
by the appropriate irrigation/drainage district, or lateral. users' association,
with written confirmation of said approval submitted to the Public Worlcs
Department. No variances have been requested for tiling of any ditches
crossing this project.
1.21 Any existing domestic wells and/or septic systems within this project shall
be removed from their domestic service per City Ordinance Section 5-7-5
17. Wells may be used for non-domestic purposes such as landscape

fees may also be charged against this parcel to help reimburse the parties

(10%) of the gross land area of a planned development.
1.33 Applicant shall provide calculation of paved area. A minimum of one (1)
three-inch (3") caliper tree is required for every 1,500 square feet of

1.36 Signage should be limited to one low-profile monument type sign near the

APPROXIMATELY 8,000 SQUARE FOOT BUILDING BY BILL & PAT GEYER-NE
CORNER OF WILSON & LOCUST GROVE:
MacCoy: Staff what do you have on this one?
Stiles: Mr. Chairman, commissioners, again we have received some additional
information on this project as well. The site plan although not conforming to our
ordinance requirements I don't think it's impossible for it to conform, however, the main
issues that I'm concerned about here are some kind of-we need to really pin
something down on what kind of signage we are going to have there and what is going
to be approved by this commission for recommendation to the City Council. We are
concerned about the driveway widths. They are not providing the driveway widths that
are in accordance with ordinance and with such an expanse of a building, continuous
building, it's going to be very important that that access be provided with garbage
trucks, delivery trucks, a lot of service area in the rear of the building here. Most of our
other requirements were met.
MacCoy: Is that it? Okay, Bruce do you have anything? Is the applicant here? Right
in front of us, will you sign in please.

Geyer: I guess as you see, it's a continued item, subsequent to the continuation of the
last meeting, myself and my contractor, and the architect met with Mr. Freckleton and
Brad of Shari's staff and we went through- the comments, which was like a bad term
paper. A whole bunch of red. Anyway, we've gone through each and every line item
and I believe that we have covered just about every base. I did want to draw your
attention to the fact, just to make sure you know, I discussed it with (Inaudible) prior to
the hearing. This is clearly a two phase project. The first phase being the one closest to
Locust Grove, we just don't have the economic fire power to do both in one shot. IN
fact, the first phase is being done specifically for a tenant that is Interstate (Inaudible)
Corporation, who will operate an Eddy's Thrift Bakery Store on the 6,000 feet closest to
Locust Grove. That's kind of the (Inaudible) genesis for this project. As far as the-I
think the three outstanding issues, the sign, unfortunately I had to rely on someone else
to come up with that sign design and they were not able to finish in time for the hearing
tonight. I'm well aware of the kind of pet peeves of the City of Meridian. I've been
involved in this thing, the D & B Supply going back five years. I was also involved in the
Hollywood Video and Wingers. I've gotten a real good idea of what works and what
doesn't work...

MacCoy: I would say so.
Geyer: You will see in the top, not really the top, but the left hand corner of the site plan
we have, I don't know why he calls it a monumental sign, it's not meant to be
monumental, it's just a monument sign. Scouts honor it won't be more than 65 square
feet total, which isn't that big, it's about the same size of the Wingers sign, which will
have individual spots for the tenants to have their names so they can have some
visibility hopefully from Fairview. Then we also plan to put some size restrictions on the
actual size that they would have over their front doors. I don't want to commit to an
actual square footage now, because I would want to measure the actual space in front
of the front doors, it's like 24 foot widths, but you know there are going to be maybe a
couple feet high by four or five feet long and they will be back lit or fit with down lighting
from the front. That's something that I intended to have here for you, but Ijust-I was
relying on somebody else that didn't get their job done. So that's a sign issue. We
have an issue with the trash enclosures not being in the area that may be as accessible
for the trash hauler as Shari would like to see. Although I will tell you that the (Inaudible)
that we have designed now, has been designed around and improved by the major user
which is going to be Eddy's. They wilt be bringing in a step van, their main loading truck
is a tractor trailer rig that I think is about 40 feet long. They have looked at this and they
have determined that it is no problem for them to get in there, unload the racks of bread
and get out again, but again, we're willing to work with staff to try and stretch that out a
little bit without compromising the overall size of the (Inaudible) of the building too much.
Then thirdly, Shari what was the last one?
Stiles: The width of the driveway?
Geyer: The drive isle, the width. That kind of goes hat in hand with the (Inaudible}.
Borup: That's the service drive on the south of the building that you are referring to?
Geyer: Yes. So I guess at this point we've been continued once and rightly so, I guess
we just flat weren't prepared, but we think we are now and we respectfully request that
you approve this so we can move on to the City Council. I've got a very tight timeline
for handing keys to these guys if they are going to open for business. Any questions?
MacCoy: Any questions commissioners? Well, while they are thinking. Shari has
something? Shari do you want to say something?
Stiles: I was wondering if Bill brought up his proposal for phasing this project. Although
you have a full building before you, he is proposing to only make the improvements on
the property... "

Borup: West half?
MacCoy: Yeah, the west half.
Stiles: He explained that to you? And is phasing the improvements as well, as far as
sidewalk, landscaping.
MacCoy: We haven't asked him that question yet, but he might as well answer it now.
Geyer: My intention is to my sidewalk and the landscaping, that will all line up with what
is existing already been improved to the north at the Hollywood Video and to the east at
D & B. I need to stop at phase one with the improvements. The additional-it's a
legitimate a argument, you know, is it cost effective to not do it now when you are doing
all the rest of the stuff. I think you could argue both sides of the fence. It is an
approximate $18,000 additional expense to-not only do I have to build the sidewalk for
you guys, but then I've got my buddies over in Garden City at ACHD they are saying by
the way you can finish the street there too Bill. It just gets to be vary expensive and I
have a budget that I've already submitted to my lender and these guys don't like
changes. The only person whose pocket that is going to come out of would be mine. I
just-I know that I've got-I'm going to have some other surprises somewhere along the
line, that's the way these projects go, I need to leave myself a little cushion and that's
one area where I'm looking for some help from you folks to give me a little cushion so I
can make this an economically viable project, because you know I'm not doing it for my
health. I want to be successful here.
MacCoy: Let me ask you something on that. You own the whole property. (Inaudible)
You do have, I would think by the way you've drawn it up here, you have the intent of
completing'the project down the road. Do you have any idea how soon that would be?
Geyer: You know, I can't, Commissioner MacCoy I would be blowing smoke if I said I
will do it in a year or two years, I don't know.
MacCoy: All I'm asking for is a stance...
Geyer: Honestly, I don't know, it will be when the next guy that comes along and says
Bill we love that location and we are willing to pay you to be there. I don't know that I
would take on this as just speculative development unless I had something else going
on with one of the other properties that okay, it's a good time to build that and I'll just go
ahead and roll the dice. We don't have a specific...
MacCoy: I'll accept that. In fact I understand why you don't want to continue on with a
lot of amenities that we are asking for having been in that business, a lot of this stuff
damaged when they try to do the construction and then you've got to go back and repair

it, that's additional cost. I would like to ask you about the building, what type of-you
told me what type of business is going in this part anyway, but what type of building are
you going to put up there? What's the...
Geyer: Face block along all the major view corridors and then a plain (Inaudible) on the
back of the building.
MacCoy: What's the color going to be?
Geyer: Like a brown.
MacCoy: Reddish Brown?
Geyer: Like ared-brown and then some accent ribbons going through the panels on
the side along with some additional landscaping to soften the massive building on the
Locust Grove side.
MacCoy: Okay, what about the roofing, what do you want to do for a roof?
Geyer: It's a flat roof.
MacCoy: A regular flat roof?
Geyer: Slope roof, slopes to the back.

MacCoy: Where are you going to put it?
Geyer: 1 think it's going to be (Inaudible) I would have to defer to (Inaudible) for that
one, because I'm not sure exactly (Inaudible).
MacCoy: Okay. Wondered. The signage you say, I don't see a picture and you say it's
not available to us yet. 1 would like to see that before we approve your signage. For the
time being I'm going to pass, commissioners, anything else?
Barbeiro: Mr. Geyer, there appears to be a built up roof for the plan here.
Geyer: I'm assuming, I'm not real familiar with the specific roof types.
Barbeiro: Then you are going to have a metal standing (Inaudible) room with split face
to the sides, standard block to the- rear aluminum store front in the front and then will
that be Ethus highlights? Kind of a stucco highlight?

Geyer: Correct. What I call a Drivot.
Barbeiro: It's very similar to what Hollywood Video has right now, which is...
Geyer: The colors will match and coordinate. There won't be an eye sore there.
MacCoy: You are not going to use stucco, you are going to use Drivot?
Geyer: I don't know if it will be Ethus or....
Stiles: We prefer it not match Hollywood Video.
MacCoy: It makes it's own statement. A lot of times you get stuck with the Drivot that
it's a maintenance situation as far as I'm looking at and Stucco at least if you were, a
colored Stucco in there that'll last you a lot longer than Drivot will.
Geyer: Our intention is to own the property for some time to come.
MacCoy: Yes, you should look for maintenance and that I just have had past
experience with Drivot and...
Geyer: It doesn't work?
MacCoy: No, you've got problems within a couple of years. You are going to end up
painting it or repairing it.
Geyer: That's bad, especially after two years.
MacCoy: I can't help it, I tell you from the standpoint of construction. I wouldn't allow it
on the new firehouse.
De Weerd: I just had one other question and do you now conform to the 10% open
space that is required?
Geyer: Right now the land of course is vacant, but 10%open space being open you
mean like landscaping?
De Weerd: Yes.
Geyer: Oh yeah, in fact I think we exceed it. Yeah your-the open space required is
2,944 square feet on the first phase, we are providing 3,399 square feet.

De Weerd: Did you change that? Is that why, Shari is that why this was a staff
comment? Has that been revised?
Stiles: They were only at the six percent before. The required amount would be of the
gross land area. That would include half of the driveway, but according to their
calculations, it would still, the 3,233 they would exceed that. We would not include
walkways as part of the common area, landscape. Those -are a separate requirement
and don't are not counted towards common open space.
De Weerd: So where are we at? Are we at 10°/a?
Stiles: They still meet, according to their calculations, if you will look at the gross
ground area which is the first line and then on site planter, they would exceed the
minimum of 10% slightly.
De Weerd: In their landscaping, a number of trees, has that been fixed too?
Stiles: I believe so, we will have our landscape architect review this to make sure it's
what we want. We are not, we wouldn't indicate it this time that we are approving this
landscape plan that has been submitted, but we will work with that during the building
permit.
De Weerd: So your concerns for not conforming to the ordinances were the driveway
width and what else?
Stiles: There is an ordinance requirement that no part of the parking area can be closer
than four feet to an established street or alley right-of-way. They don't meet that on
Wilson Lane, they do however show-I'm not sure how big that is-here is an
architectural scale, I don't have that. I think it's about five or six feet.
Geyer: Five.
Stiles: If this is correct that they would have that, they would have to get a license
agreement with Ada County Highway District in order to be able to landscape that, we
would have to have proof of that before we process the building permit application. We
could probably live with it in this case, because that area if they end up with six feet,
could support 3 inch caliber trees, however we can't relax on the driveway requirement.
The fire district does require a minimum of 20 feet clear distance the entire way around
this building. So it will require some kind of shifting to accommodate those driveway
requirements.
Borup: The plan is showing 19-10, is that correct? 19 feet, 10 inches.

Stiles: Yeah. The zoning ordinance requires driveways be 25 feet. -
Borup: Oh, 25 feet, okay, I thought you said 20.
Stiles: The fire, the fire department Uniform Fire Code requires 20 feet.
Borup: So that was your concern on~the driveway with that back service you say needs
to be 25?
Stiles: Twenty gets. pretty skinny as far as service trucks, garbage trucks. Probably
most critical location would be right there at that corner, where the trash enclosure is.
Borup: That was the spot that I thought was going to be a concern was on the corner.
I'm sorry, Shari still going?
Stiles: No.
Borup: Mr. Geyer, what does that do to your plans if you need another five feet on your
service driveway.
Geyer: I think we can make the adjustment. I don't know if we are going to be able to
get the whole five feet, but we certainly can get to 20. It's not...
Borup: Well yeah, that's only two inches.
Geyer: Every inch counts-I don't know that we are going to get to the 25 feet. The 20
feet that's kind of the no brainer. We will fool with the walkway in front of the building.
We think we can probably take a little of that out, that's an excess of 10 feet and just
slide the building forward a little bit.
Borup: You say Eddy's felt they could get a semi back there on that service drive?
They can pull in and out, but they wouldn't be able to pull around the corner would they?
Geyer: They don't plan to. They are going to back and then right back out again. This
plan has been circulated from here to Phoenix, to-I think they are in Omaha is where
their headquarters are.
Borup: But how about a vehicle that needed to drive clear around the building such as
fire trucks?
Geyer: Well, we have to meet the requirement, if that's 20 feet, we will get there.

Borup: I guess that would be up to staff. From my standpoint, if you can get a semi~in
the 20 feet, that would probably be adequate for most other delivery trucks. I would still
have the same concern as Shari is the corners. Being able to get something around
those corners. It may just take some revising of that area rather than the whole way.
Geyer: We are more than willing to work with staff to get that issue resolved to
everybody's satisfaction.
Borup: I don't think I have anything else.
MacCoy: Okay, anything else? You can sit down now I guess is what it amounts to. Is
anyone here who would like to speak in favor of this project? All right, seeing nobody
answering, anybody care to speak against this project. Looks like you've got a good
house today. All right, commissioners, what is your direction?
Borup: Question for staff, you feel-Shari, you felt (Inaudible) working out any other
details with the applicant on this as far-you said most would be taken care of in the
building application stage, etc.
Stiles: Some of the items could be-I'm not going to, I mean all I can tell him is what
the ordinance requires. If he wants to do something different than the ordinance
requires, of course he is going to have to get a variance from that ordinance.
Borup: That was specifically the service drive?
Stiles: Yes.
Borup: The variance would be request through what body?
Stites: City Council. I just had another question, sorry for the applicant, did you close it
already?
De Weerd: No.
Stiles: Where are they going to keep their service vehicles? Are they going to have,
there is no on site area for parking vehicles, are they going to park inside the
warehouse?
Geyer: Yes, their little step van delivery vans that they use to make the deliveries to the
stores, their vendors, their customers, excuse me, their customers not vendors. There
will be-I think there is room for, I think they determined they can fit four or five of those
things in the warehouse.

Stiles: So would they be willing to make that a part of their conditional use permit that
they are not having these bread trucks parked out on the street.
Geyer: You know I can't speak for them. Isn't Wilson Lane a public street, can't they,
couldn't they park out there if they needed 'to?
MacCoy: It's not a very big street. You park on that you've got one lane traffic going
one direction.
Geyer: But is it a no parking street?
MacCoy: Not yet.
Geyer: I would say that I'm not going to speak for Eddy's, we've had so many other
troubles working through ACHD that I'm just in no position to do that. However,
obviously you reserve the right as you have just indicated that anytime in the future that
that parking on the street became a problem, mark it no parking, then I'm not the bad
guy.
MacCoy: With your client.
De Weerd: But there would be no parking in the service drive.
Geyer: There is-no, absolutely not. They get towed if they do that. I don't mind doing
that.
De Weerd: So Shari, our ordinance states 25 feet then?
Stiles: For driveways.
(Inaudible).
Barbeiro: I would like to ask Mr. Geyer, it appears to me the way that you have your
driveway set up it might be to your advantage to move the exit on Wilson Lane to be in
line with the doors for your warehouse...
Geyer: No can do, it's too close to the corner. We've got that as close as we can get it.
Borup: The other choice would be to change the floor plan of the building.

De Weerd: Well, so how does that effect the service drive then? That it would be the

De Weerd: They would have to apply for the variance if they want it different.

Borup: Mr. Chairman, I think Shari may have had a comment concerning that motion.

Stiles: Since the applicant has volunteered that he will go with 65 square feet or less as
a monument sign and the. remainder of the signage would be only wall signs, could you
make that part of your recommendation?
MacCoy: Well, I haven't seen a sign yet, so I don't know what he is going to put up.
De Weerd: Just that he mentioned you are talking about?
Stiles: I would hate to get to the point where just because you said your going to review
the signs, you haven't put any conditions on the signage. If they come in with a 100 foot
pylon sign, we are back to another project.
MacCoy: Put the fact that we maintain the sign...
Borup: Do you want to add that a 65 square foot monument sign, maximum 65 foot
monument sign?
Barbeiro: Then I would amend my motion to include a 65 foot square foot monument
sign as a maximum allowable size.

ITEM NO. 5: CONTINUED PUBLIC HEARING: REQUEST FOR ANNEXATION &
ZONING OF 6.15 ACRES (FOR R-40 ZONING) FOR PROPOSED COBBLESTONE
VILLAGE BY STAMAS CORPORATION /IONIC ENTERPRISE INC. -SOUTHWEST
CORNER OF LOCUST GROVE & FRANKLIN:
Stiles: Mr. Chairman, commissioners we did also receive a revised site plan I believe
Friday on this project. It appears most of our comments were addressed. We did get a
letter from Ada County Highway District today stating that they were not asking for the
60 foot right-of-way on Franklin, they were going to stick with their 48 foot requirement.
The applicant has indicated his desire to use that portion of the Five Mile Creek
incorporated into his project as an amenity. There are-they have incorporated some
trash enclosures, they do show two on the site. They've indicated that number is based
on their desire to limit the trash areas because of the aesthetics of those areas. They
would need to coordinate that with sanitary service and see if that was going to be
adequate for the project. The other major issue that I see remaining and that I'm sure
the applicant will address tonight is the buffering of the adjacent residential use.
(Inaudible) Parking clear to the property line and with the two story structures within five
feet of the property line which would not meet fire code requirements or building code
requirements, I guess. With those remaining issues, we would like you to consider the
rest of our comments and include those as conditions of the applicant or this
development.
MacCoy: Bruce do you have anything?
Freckleton: Mr. Chairman, members of the commission. Just looking at the utilities as
proposed, the applicant will be required to comply with the to and through requirements
along Franklin Road and Locust Grove Road, that meaning that water mains would
have to be extended along the entire frontage of the project in those two roads and the
sewer would also be extended up Locust Grove, their entire frontage. That was-Shari
had one other thing.
Stiles: One other thing that I've noticed on this plan is the sign is shown in the future
right-of-way, that would need to be relocated onto the property and we would need to
review the details of that signage as well.
MacCoy: Is that it? Is the applicant here? Would you come forward please?

Request for Conditional Use Permit for an 16,548 square-foot Commercial Building
on 1.49 Acres by Bill and Pat Geyer
We have reviewed this submittal and offer the following comments, as conditions of the
applicant. These conditions shalt be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
GENERAL COMMENTS
1. The property included in this application is located in an area designated as Mixed/Planned
Use Development in the Meridian Comprehensive Plan. Located at the northeast corner of
Locust Grove Road and Wilson Lane, the property is directly south of Hollywood Video and
Wingers Restaurant. A parcel zoned RT in Ada County, with one residence, is adjacent to
the southern boundary; and C-3 property is located west of Locust Grove Road.
2. As this property is designated in the Meridian Comprehensive Plan as a mixed planned use
development area, a requirement of the annexation was that all uses be developed as a
planned unit development under the conditional use permit process. A development
agreement is also in place for this development.
3. Ten percent (10%) of the gross land area of a planned unit development is required to be open
space. Only six percent (6%) is shown.
4. Landscaping and number of trees is deficient.
5. As part of a conditional use permit, the City of Meridian may impose additional
restrictionslconditions.
6. No utilities are shown on the site plan with details to indicate how the individual buildings will
be served.
7. Assessment fees for water and sewer service are determined during the building plan review
process.

8. No signage details were submitted.
9. No drainage areas are shown within the development. State agencies recommend that
drainage swales be used for pretreatment of stormwater.
10. Ada County Highway District's preliminary comments require that the entrance on Locust
Grove Road be signed as a right-in/right-out only access. Previous approvals for this area
required that a median be constructed in Locust Grove Road at such time as the property
south of the existing driveway developed. m

GENERAL REQUIREMENTS `
1. Any existing irrigation(drainage ditches crossing the property to be included in this project;
shall be tiled per City Ordinance 11-9-605.M. The ditches to be piped should be shown on
the site plans. Plans will need to be approved by the appropriate~irrigation/drainage district,
or lateral users association, with written confirmation of said approval submitted to the Public
Works Department.

2. Any existing domestic wells and/or septic systems within this project will have to be removed
from their domestic service per City Ordinance Section 5-7-517. Wells maybe used for non
domestic purposes such as landscape irrigation.. $ ~ ,~
3. Off-street parking shall be provided in accordance with Section 11-2-414 of the City of
Meridian Zoning .and Development Ordinance and/or as detailed in site-specific requirements.
4. Paving and striping shall be in accordance with the standards set forth in Sections
11-2-414.D.4 and 11-2-414.D.5 of the City of Meridian Zoning and Development Ordinance
and in accordance with Americans with Disabilities Act (ADA) requirements.
5. A drainage plan designed by a State of Idaho licensed architect or engineer is required and
shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all oil street parking areas.
All site drainage shall be contained and disposed of on-site. ,
6. Outside lighting shall be designed and placed so as not to direct illumination on any nearby
residential areas and in accordance with City Ordinance Section 11-2-414.D.3.
7. All signage shall be iri accordance with the standards .set forth in Section ~ 1-2-415 of the City_

water requirements for the proposed site. Flow and pressure from the existing mains should
be monitored with the Meridian Water Department to determine whether adequate fire

3. Applicant shall be required to enter into an Assessment Agreement with the City of Meridian.
1n addition to these assessments, "Late Comers" fees may also be charged against this parcel

1.49-acre site is located on the east"side of Locust Grove approximately 500-feet south of Fairview
Avenue. This development is estimated•to generate 240 additional vehicle trips per day based on

B. :The application and site plan stamped as received liy the City~of Meridian on February 26,..1999,'arid
submitted to the District on March 1, 1999, have been"reviewed by the ACHD Planning and
Development staff and conforms to applicable District standards/policy, or can be made to conform

C. On August 20, 1997, application MCU-21-97 was approved by the Commission as a staff level

A. The Ada County Highway District (ACHD) staff has received the above referenced application
requesting conditional use approval. to construct an 8,000-square foot commercial building. The
1.49-acre site is located on the east side of Locust Grove approximately 500-feet south of
Fairview Avenue. This development is estimated to generate 240 additional vehicle trips per
~ day based on the Institute of Transportation Engineers Trip Generation manual.
B. The application and site plan stamped as received by the City of Meridian on February 26, 1999,
~~ and submitted to the District on March 1, 1999, have been reviewed by the ACRD Planning and
CCU Development staff and conforms to applicable District standards/policy, or can be made to
~~~ conform with the change(s) to the plan described in the requirements stated below.
This is a staff level approval and will not be heard by the ACHD Commission unless the site
plan is changed in such a manner as to not conform with District standards/policy or an appeal
of the Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.
~~ C. On August 20, 1997, application MCU-21-97 was approved by the Commission as a staff level
C~ report. This application requested conditional use approval to construct a video rental store at
~,~ the southeast corner of Fairview Avenue and Locust Grove. As a requirement for approval, the
applicant was instructed to, and did, provide a letter of agreement to the District agreeing to
install a center median in Locust Grove Road when Lots 3 and 4 are developed. The owners of
Lots 3 and 4 agreed to post a Median Construction Fee of $3,600 when either of the Lots 3 or 4
~ were developed.- The current application is for the development of these two parcels, Lots 3
and 4. `

The following requirements are provided as conditions for approval:
Site Specific Requirements:
1. Utility street cuts in the new pavement are not allowed unless approved in writing by the District.
Contact Constriction Services at 387-6280 (with file number) for details.

~2. Provide a recorded cross access easement for the parcels to the north and east to use this parcel
~,~ for access to the public streets prior to issuance of a building permit (or other required permits).
The District acquired a similar agreement of the owners of the parcels to the north and east when
they were the subject of a past development application.
~ 3. Construct a 5-foot wide detached concrete sidewalk on Locust Grove Road abutting the site.
Locate the sidewalk one-foot within the right-of--way of Locust Grove Road.
_~~4. Construct curb, gutter and 5-foot wide concrete sidewalk and match paving on Wilson Street
abutting the site. Construct improvements to one-half of a 41-foot street section. Coordinate the
~ location, elevation and grade of the sidewalk with District staff.

~5. Construct_a 24 to 30-foot wide curb return driveway located 100-feet east of Locust Grove as
proposed. Pave the driveway its full required width and at least 30-feet beyond the edge of
~ pavement of Wilson Street and install pavement tapers with 15-foot radii abutting the existing
roadway edge.
_,~ ~6. Construct a 24 to 30-foot wide curb return driveway located 20-feet west of the east property line
~-F--~ as proposed. Pave the driveway its full required width and at least 30-feet beyond the edge of
CCU pavement of Wilson Street and install pavement tapers with 15-foot radii abutting the existing
'`~ roadway edge.

7. Construct asix-inch raised median in the center of Locust Grove Road, from a point 10-feet
south of the stop bar at the intersection of Fairview Avenue to a point 310-feet south of the
~ intersection. Coordinate the design and location of the median with District staff. Submit a
design of the median to the District's Traffic Service's Supervisor for review and a letter of
approval

C~$ Note:. When the median is constnicted,~s 1L op sed by District staff~it will restrict a driveway
r--+ on the east side of Locust Grove Road. However, that driveway is within 440-feet of Fairview
Avenue. The driveway does not conform with current District polic,L
8. As required by District policy, restrictions on the width, number and locations of driveways,
shall be placed on future development of this parcel.
9. No new access to Locust Grove Road has been proposed and none is approved with this

10. Other than the access points specifically approved with this application, direct lot or parcel
access toWilson Street is prohibited.
Standard Requirements:
~~1. This decision of the Planning and Development Supervisor maybe appealed to the Ada County
~~ Highway District Commission by the applicant or by another party within 15 calendar days from
~~ the date of this report. The request shall specifically id n ify each requirement to be
reconsidered and include a written explanation of why such a requirement would result in a
substantial hardshi or in 4 it itv. The request will be heard by the District Commission at an
evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
~ appellant will be notified of the date and time of the Commission meeting.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
~.,,_,~ shall be made in writing to the Planning and Development Supervisor within two days of the
C~'C'j action and shall include a minimum fee of $110.00. The reghest for reconsideration shall
~ specifically~d n ify each requirement to he r'e~nnSidererl a„rl include written documentation of
~~ data that was not available to the Commission at the time of it's original de~iSi~n_ The request
for reconsideration will be heard by-the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified of
the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in accordance
~~' with Ordinance #188, also known as Ada County Highway District Road Impact Fee Ordinance.
~~~
~~4. All design and construction shall be in accordance with the Ada County Highway District Policy
~"~"'~ Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
~ (or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
C~ requirements of the Ada County Highway District prior to District approval for occupancy:

~~~7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all Hiles, regulations, ordinances, plans, or
other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
~ property unless awaiver/variance of said requirements or other legal relief is granted pursuant to
the law in effect at the time the change in use is sought.

8. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.

~ undue burden on the existing vehicular and pedestrian transportation system within the vicinity

Gigray: I would ask the Clerk whether they have one. We certainly will supply one if
they don't have one. We're suppose to send one along with each development
agreement. I would think there would be one in the packet because there's been one
prepared and then there was a problem with the legal description and that was revised.
If there isn't I'll just put a note on here and we'll supply one.
