=NOTICE OF HEARING
n NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 p.m. on November 3, 1999, for the purpose of reviewing artd considering
the application of Food Services of America for a variance for I-R Zoning-has 40 foot
maximum height--requesting 43 feet at the ridgeline. The property is generally located
at Fairview Avenue and Hickory Avenue.
A more particular description of the above property is on fife in the Ciiy Clerk's
ofFce at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony.

NOTICE OF HEARING

application for a variance is submitted to the Administrator and the Council. Provide a written narrative
containing, where applicable, the following outlined information:

12. Characteristics of subject property which prevent compliance with the requirements of this
Ordinance.
Current zoning only allows 40 ft.-max. building height.
13. Difficulty or hardship which would result if requirements of this Ordinance were applied to
subject property. ,
Current Zoning for this property allows for 40 feet max. building height. Requesting 43 feet be
allowed for future additions to this property.
14. Difficulty or hardship which would result if requirements of this Ordinance were applied to
subject property.
The loss in racking height would mean to have the same amount of storage space at this
facility, FSA would have to build a bigger building. This costs more money, is less efficient to
run, and will have a larger impact on the built environment than building the structure 3 feet
higher. Also the technologies and equipment used at all their other facilities would not be able
to be used at the Boise warehouse.
15. Unusual or peculiar circumstances which indicate that regulations of this Ordinance should not be
strictly complied with.
If this higher racking technology was available to FSA back when they built the original
building they would not have built on a property which limits the height to less than what they
needed.
16. Statement that special conditions and circumstances exist which are peculiar to the land, structure
or buildings involved which are not applicable to other lands, structures or buildings in the same
district.
In warehouse construction the most important design items are the racking in which product is
stored and the forklifts which access this racking. Selections of these two items set the height
and area of the proposed building or additions. FSA needs to stay current with the
technologies available to them at all their facilities. This requires a 43 foot-high building from
now on for them, in lieu of the 40 foot used in the past.
17. Statement that a literal interpretation of the provisions of this Ordinance shall deprive the
applicant of rights commonly enjoyed by other properties in the same district under terms of this
Ordinance.

action.
New technology has provided for forklift access to higher racks in the racking system FSA
uses at all their facilities. Thirty-two feet clear inside building height was required for the old
type forklifts used by FSA at the time the current building was constructed Now 35 feet clear
inside building height is required for the new forklifts. With the slopes of the roof and the
structure required to support the roofs the ridge height of the proposed additions would be 43
feet.

GRANTING A VARIANCE
The above entitled matter coming on regularly for public hearing before the City
Council on the November 3, 1999, an'd Shari Stiles, Planning and Zoning Administrator,
appeared and commented at the hearing, and Gene Avery, who represents Food Services
of America, a Delaware Corporation, appeared and testified on behalf of the applicant at
the Bearing, and no one appeared in opposition, and the City Council having received the
transmittal to agencies and having received the variance application, having heard the
testimony presented, being fully advised in the premises does hereby make the following
Findings of Fact and Conclusions of Law and Order of Decision, as follows to-wit:
FINDINGS OF FACT
1. The City Council takes judicial notice of its Zoning, Subdivisions and
Development Ordinances codified at Title 11 Municipal Code of the City of Meridian
and• all current zoning maps thereof and the Comprehensive Plan of the City of

Meridian adopted December`21, 1993 Ordinance #629 -January 4, 1994 and Maps.
2. The notice requirements of Idaho Code §§ 67-6509, 6516 and.§§ 11-2-
416 E and 419 D as evidenced in the record of this matter have been met.
3. The Applicant is Food Services of America, a Delaware Corporation, by
and through Development Services of America, 4025 Delridge Way, Suite 100, Seattle,
Washington 98106-1272.
4. The location of the subject real property is 1495 N. Hickory Ave.,
Meridian, Idaho.
5. The legal description of the property appertains to the real~property that
is included within the Vicinity Map as appears in the record of proceeds of this matter,
and is described as follows:
Lots 4 and 5 in Block 2 of TREASURE'VALLEYBDSINESS CENTER -
PHASE I, according to the Official Plat thereof, filed•in Book 53 of Plats at
Page(s) 4790-4792, records of Ada County, Idaho:
6. The present land "use of subject property is presently zoned as (I-L) Light.
Industrial.
7. The proposed land use of subject property is to develop the subject
property in the following manner: The Applicant intends,to build a 14,895 sq. ft.
addition to the freezer on the north and a 7,114 sq. ft. addition to dry storage on the
south end of the present facility, which is depicted in the Floor Plan, Site Plan and

Vicinity Map, prepared by The SCHEMMERASSOCIATES as referenced in the Floor
Plan, Site Plan and in particular the Applicant proposes to construct as depicted on
"The Schemmer Associates Exterior Building Elevations, Job No. 409401, Sheet A2-1 ".
8. The Applicant seeks a variance of the following provision of the Revised and
Compiled Ordinances of the City of Meridian, Section 11-2-410 A, Zoning Schedule of
Bullc and Coverage Controls for I-L zone, which provides fora "Maximum Building Height
of 40'."
9. The characteristics of the subject property which prevent compliance with
the requirements of the Ordinance are that the current,zoning only allows a 40 foot
maximum building height.
10. The difficulty or hardship which would result if requirements of the

Ordinance were applied to the subject property are that the current zoning for this
property allows for 40 feet maximum building heights. The Applicant requests 43 feet be
' allowed for future additions to the property.
1'1. The difficulty or hardship which would result if requirements of the
Ordinance were applied to the subject property are that the loss in racking height would
mean to have the same amount of storage space at this facility, and Applicant would have
to build a bigger building. This would cost more "money, and would be less efficient to
run, and would have a larger impact on the built environment than building the structure

3 feet higher. Also, the`technologies and equipment used at the other facilities would not
be able to be used at the Meridian warehouse. "
12. The unusual or peculiar circumstances which indicatethat regulations of this
Ordinance should not be strictly compiled with, is that, if the higher racking technology
was available to Applicant bacl~ when the original building was built, Applicant would not
have built on property which limits the height to less than what Applicant needed.
13. Special conditions and circumstances exist which, are peculiar to the land,
structure or buildings involved which are not applicable to other lands, structures or
buildings in the same district pertains to the warehouse construction, and that the most
important design items are the racking in which product is stored and the forldifts which
access the racking. Selections of these two items set the height and area of the proposed
building or additions. Applicant needs to stay current with the technologies available to
Applicant's facilities. This requires a 43-foot-high building and not the 40-foot height
from the past.
14. ~ A literal interpretation of the provisions of the Ordinance shall deprive the
Applicant of rights commonly enjoyed by other properties in the same district under terms
of the Ordinance is that the loss in racking height would mean to have the same amount
of storage space at this facility. Applicant would have to build a bigger building. The cost
would be more money and less efficient to~run, and would have a larger impact on the

built environment than building the structure 3 feet higher. Also, the technologies and
equipment used at all the other facilities would not be able to be used at the Meridian
warehouse.
15. The special conditions or circumstances exist that were not a result of the
Applicant's action are that the new technology has provided for forl~lift access to higher
racks. in the racking system that are used at all other facilities. Thirty-two feet clear inside
building height was required for the old type forklifts used by the warehouses at the time
the current building was constructed. Now 35 feet clear inside building height is required
for the new forklifts. With the slopes of the roof and the structure required to support the
roofs the ridge height of the proposed additions would be 43 feet.
16. The variance requested is not out of convenience but from necessity. The '
configuration of the parcel was determined by prior developments (i.e., sewer and water
previously installed). The variance is not profit- oriented, it is due to practicality.
17. The granting of the requested variance will not be detrimental to the public's
welfare or injurious to other property in the area of the proposed plat, and, ~in fact, the

development of the plat in accordance with the conditions of approval and the
' requirements of the Subdivision Ordinance will prevent the conditions which are the
source of the complaints raised in the public hearing of this matter.
18. The granting of this variance will not have an effect of altering the interest

and ~` purpose of the Subdivision or Development Ordinance and or the City's
Comprehensive Plan.
19. The applicant paid the fee established by the City Council for application
variance.
CONCLUSIONS OF LAW
1. The City of Meridian has authority pursuant to the enactment of the Local
PLand Use PlanningAct of 1975 codified at Chapter 65, Title 67, and in particular, by the
provisions of Idaho Code § 67-6516 to provide as part of its zoning ordinance for the
process of applications for variance: permits.
2. The City of Meridian has exercised its authority of Idaho Code § 67-6516
by the enactment as a ,part of its Zoning and Development Ordinance variances, as set
forth in § 11-2-41.9 of the Municipal Code of the City of Meridian.

3. That -the requirements for the processing of a variance request are set forth
in Idaho Code §§ 67-6509, 6516 and §§ 11-2-416E and 418E Municipal Code of the City
of Meridian.
4. Application and standards for variances are set forth in § 11-2-419B
Municipal Code of the City of Meridian, and the findings which are required are set forth
in §' 11-2-419C, include required findings that there are special circumstances or
conditions affecting the property that strict application of the provisions of Zoning and

Development Ordinance would clearly be impracticable and unreasonable, and a finding
that strict compliance with the requirements of the Zoning and Development Ordinance
would°'result in extraordinary hardship?to the owner, subdivider or developer because
unusual topography, the nature or condition of adjacent development, or other physical
conditions or other conditions that make strict compliance with the ordinance
unreasonable under the circumstances, or that-the conditions and requirements of said
ordinance will result in inhibiting the achievements or the objectives of the ordinance, and
that the granting of a specified variance will not be detrimental to the public's welfare or
injurious to other property in the area in which the property is situated, and that such
variance will not have the effect of altering the interest and purposes of the Zoning and
Development Ordinance and the Meridian Comprehensive Plan.
5. The provisions of the Revised and Compiled Ordinances of the City of
Meridian, Section 11-2-410 A, Zoning Schedule of Bulk and Coverage Controls for I-L
zone provide fora "Maximum Building Height of 40'."
DECISION AND ORDER
NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING

Avery:• Mr, Mayor, Council; may name is Gene Avery, A-V-E-R-Y. I represent
Food Services of America. Currently, our warehouses are at 40 feet. We're
requesting athree-foot variance. This will allow us to have`50 percent more
storage space with the advanced technology that we've had in the last few years.
It will avail us to have 50, percent more storage. Rather than spreading the
warehouse up for three feet extra, we have a 50 percent more storage area.
That's why we are requesting the variance. Any questions?

The Ada County Highway District (ACRD) staff has received and reviewed the application
and site plan for the item referenced above. ACRD does not have any site improvement
requirements-at this time. This item will not be heard by the ACRD Commission unless
the site plan is changed in such a manner as to require Commission review.
All future design plans and construction shall be in accordance with the Ada County
Highway District Policy Manual, ISPWC Standards and approved supplements.
Construction Services procedures and atl applicable ACRD Ordinances unless specifically
waived in writing by the District.
Contact Ms. Joyce Newton for payment of possible road impact fees prior to building
construction in accordance with Ordinance #188, also known as Ada County Highway
