Total square footage of the mini storage buildings is 164,904.

12. The property lies next to the Meridian Sewer Treatment Plant. Development adjacent to the plant
has the ability to coexist with the negative attributes of the plant. The mini storage facility would
be a perfect neighbor for the treatment plant. Since the IL zone does not specifically list a storage
facility, I believe it necessary to submit a conditional use permit. This application would also
provide the City with detail review of the project.

14. The applicant agrees to pay any additional sewer, water or trash services associated with the
industrial development of the subject property.

Permit. Please note, pursuant to the City Council action of November 3, 1999, that
2.17 has been deleted and all sections re-numbered thereafter and that at 2.35 it has
been changed to say, "Drainage swales shall not be required," which is now the new
2.34. I have also added the legal under the Decision and Order, and additionally,
made the above changes in the Decision and Order. The changes have also been
made in the ORDER.
Also, this matter has been continued until December 7, 1999, to allow

The above entitled conditional use permit application having come before
the City Council on October 19, 1999, and Shari Stiles, Planning and Zoning
Administrator, appeared and testified at the hearing, and Beclcy Bowcutt of Briggs
Engineering appeared and testified on behalf of the Applicant, and no one appearing in
opposition, and the City Council having received the staff report and the record made
before the Planning and Zoning Commission, and being fully advised in the premises, the
Council finds and concludes as follows:

1. A notice of a public hearing on the conditional use permit was
published for two (2) consecutive weeks prior to the said public hearing scheduled for

more than fifteen (15) days prior to said hearing and with the notice of public hearings
having been posted upon the property under consideration more than one week before
said hearing and the copies of all notices were made available to newspaper, radio and
television stations as public service announcements; and the matter having been duly
considered by the City Council at the said October 19, 1999, public hearing; and the
Applicant, affected property owners, and government subdivisions providing services
within the planning jurisdiction of the City of Meridian, having been given full
opportunity to express comments and submit evidence.
2. There has been compliance with all notice and hearing
requirements set forth in Idaho Code §§67-6509 and 67-6512; and §§11-2-416E and

the west side of Ten Mile Road, approximately 1,000 ft. north of Ustick Road.
5. The owner of record of the subject property is Mike I<i.ng of 3735
N. Ten Mile Road, Meridian.
6. Applicant is Ed Bews of 5204 Sorrento, Boise.
7. The subject property is currently zoned Ada County Rural
Transitional (R-T). There is a pending application for annexation and zoning to Light
Industrial (I-L) which is defined within the City of Meridian Zoning and Development
Ordinance, Section 11-2-408(B14).
8. The proposed application requests a conditional use permit for
construction and development of a mini storage facility consisting of 9 storage
buildings with a total square footage of 164,904 and one single family dwellin~office.
City of Meridian Zoning and Development Ordinance requires a conditional use
permit be obtained for multiple buildings on one lot [Section 11-2-408(B14)].
9. The Applicant and owner of the property, Ed Bews, seeks to be
granted a conditional use permit for construction and development of a mini storage
facility consisting of 9 storage buildings with a total square footage of 164,904 and one

10. The use proposed within the subject application will in fact,
constitute a conditional use as determined by City Ordinance.
I I . Giving due consideration to the comments received from the
governmental subdivisions providing services in the City of Meridian planning
jurisdiction, public facilities and services required by the proposed development will not
impose expense upon the public if the following conditions of development are
imposed and the following is also found to be required to mitigate the effects of the
proposed use and development upon services delivered by political subdivisions
providing services to the subject real property within the planning jurisdiction of the
City of Meridian.
11.A Conditions requested by the City of Meridian Planning and
Zoning Administrator and Assistant City Engineer within their
Memorandum dated September 14, 1999, be required as follows:
Adopt the Ada County Highway District's Recommendations as follows:
11.1 Developer shall dedicate 48-feet of right-of-way from the centerline
of Ten Mile Road abutting the parcel by means of recordation of a
final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits),
whichever occurs first.
11.2 Developer shall construct a 5-foot wide concrete sidewalk on Ten
Mile Road abutting the parcel within 2-feet of the new right-of-
way. Location, elevation and grade of the sidewalk shall be
coordinated with District staff.

11.3 Developer shall locate a 24 to 30-foot wide driveway as proposed,
approximately 200-feet north of the south property line. The
driveway shall be paved its full required width and at least 30-feet
beyond the edge of pavement of Ten Mile Road and pavement
tapers installed with 15-foot radii abutting the existing roadway
edge.
11.4 Any proposed gated entry shall be located a minimum of 50-feet
from a public road and shall be coordinated with District staff.
11.5 Utility pole relocation will be the responsibility of the developer if
relocation is necessary to accommodate a 5-foot wide sidewalk.
11.6 Utility street cuts in the new pavement are not allowed unless
approved in writing by the District.
11.7 As required by District policy, restrictions on the width, number
and locations of driveways, shall be placed on future development
of this parcel.
11.8 Other than the access point specifically approved with this
application, direct lot or parcel access to Ten Mile Road is
prohibited.
Adopt the Central District Health Department's Recommendations as follows:
11.9 The Applicant's central sewage and central water plans must be
submitted to and approved by the Idaho Department of Health SL
Welfare, Division of Environmental Quality.
11.10 Run-off is not to create a mosquito breeding problem.
11.11 It is recommended that stormwater shall be pretreated through a
grassy swale prior to discharge to the subsurface to prevent impact
to groundwater and surface water quality.

11.12 The Engineers and architects involved with the design of the
subject project shall obtain current best management practices for
stormwater disposal and design a stormwater management system
that prevents groundwater and surface water degradation.
Adopt the Nampa SL Meridian Irrigation District Recommendations as follows:
11.13 Requires all laterals and wasteways be protected.
11.14 All municipal surface drainage shall be retained on site.
11.15 If any surface drainage leaves the site, the Nampa & Meridian
Irrigation District must review drainage plans.
11.16 The Developer must contact the Nampa & Meridian Irrigation
District for approval before any encroachment or change of right-
of-way occurs. Developer must comply with Idaho Code § 31-
3805.
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
11.17 Any existing irrigation/drainage ditches crossing the property to be
included in this project, shall be tiled per City Ordinance 11-9-
605.M. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association; with written
confirmation of said approval submitted to the Public Works
Department. No variances have been requested for tiling of any
ditches crossing this project. Staff could support leaving the ditch
open and fencing at the easement line provided the area between
the Creason Lateral and proposed buildings is made a lawn area.
11.18 Any existing domestic wells and/or septic systems within this
project will have to be removed from their domestic service per
City Ordinance Section 5-7-517. Wells may be used for non-
domestic purposes such as landscape irrigation.

11.19 Off-street parking shall be provided in accordance with Section 11-
2-414 of the City of Meridian Zoning and Development Ordinance
and/or as detailed in site-specific requirements.
11.20 Paving and striping shall be in accordance with the standards set
forth in Sections 11-2-414.D.4 and 11-2-414.D.5 of the City of
Meridian Zoning and Development Ordinance and in accordance
with Americans with Disabilities Act (ADA) requirements.
11.21 A drainage plan designed by a State of Idaho licensed architect or
engineer is required and shall be submitted to the City Engineer
(Ord. 557, 10-1-91) for all off-street parking areas. All site drainage
shall be contained and disposed of on-site.
11.22 Outside lighting shall be designed and placed so as not to direct
illumination on any nearby residential areas and in accordance
with City Ordinance Section 11-2-14.D.3.
11.23 All signage shall be in accordance with the standards set forth in
Section 11-2-415 of the City of Meridian Zoning and
Development Ordinance. No temporary signage or flashing signs
will be permitted.
11.24 Applicants shall provide five-foot-wide sidewalks in accordance
with City Ordinance Section 11-9-606.B.
11.25 All construction shall conform to the requirements of the
Americans with Disabilities Act.
11.26 A new 30-inch diameter sanitary sewer trunk line is to be installed
along the northerly boundary of the proposed mini storage site.
The proposed location would be 16.5 feet south of the north
boundary line. This location would locate the trunk line
approximately 10 feet south of the landscape planter and more
center of the driveway. Developer shall provide the City with a
permanent 20-foot-wide easement, centered on the pipe for this
line.

11.27 Sanitary sewer service to this site will be via an extension to the
new trunk line as shown on the site plan. Applicant will be
responsible to construct the sewer mains to and through this
proposed development. Project designer to coordinate sizing and
routing with the Public Worlcs Department.
11.28 Water service to this site will be via extensions of existing mains
installed adjacent to subject site. Applicant will be responsible to
construct the water mains to and through this proposed
development. Project designer to coordinate main sizing and
routing with the Public Works Department.
11.29 Applicant shall provide detailed signage plans for review and
approval. Signage will be limited to one 4' x 8' monument sign in
the location shown on the approved site plan. Detailed signage
plans will be subject to design review and separate permits.
11.30 Office area of single-family dwelling unit shall meet all current
Codes and comply with the Americans with Disabilities Act.
11.31 Underground pressurized irrigation must be provided to all
landscape areas on site. Developer shall submit hook-up and design
details based on the proposed landscaping. Primary water supply
connection to the City's mains will not be allowed. Developer shall
be required to utilize any existing surface or well water for the
primary source. If City water is proposed as a secondary source,
developer shall be responsible to pay water assessments for the
entire common open area.
11.32 Non-combustible fencing will be required for the boundary
adjacent to Creason Lateral. Developer shall submit details,
considering public safety and aesthetics in the design.
11.33 Assessment fees for water and sewer service to the office/residence
shall be determined during the building plan review process.

11.34 Applicant shall be required to enter into a Re-Assessment
Agreement with the City of Meridian.
11.35 State agencies recommend that drainage swales be used for
pretreatment of stormwater. Drainage swales shall be approved
within the 20-foot-wide planting strip adjacent to Ten Mile Road.
11.36 Developer shall provide the Public Worlcs Department with
information on anticipated fire flow and domestic water
requirements for the proposed site. Flow and pressure from the
existing mains should be monitored with the Meridian Water
Department to determine whether adequate fire protection exists.
11.37 All driveways and parking areas are to be paved.
11.38 Developer shall provide detailed landscape plan for review and
approval, including sizes and species of trees, bushes, and all
proposed ground cover/treatment.
11.39 Solid walls of storage buildings are not aesthetically pleasing and
need to be broken up by landscaping. Staff recommends that trees
be placed at a minimum of 40 feet on center instead of the 70 feet
shown on the northern boundary. The planting strip shall not be
reduced below the 6.5 feet shown and may not encroach upon the
20-foot-wide sewer easement requested.
11.40 Developer shall provide a minimum 20-foot-wide planting strip
beyond required right-of--way of 48 feet from centerline of Ten
Mile Road.
11.41 Applicant shall coordinate trash receptacle locations and
construction requirements with Meridian Sanitary Service
Company and provide a letter of approval from their office prior to
applying for building permits.

I3. The uses proposed within the subject application will be subject to
the conditions set forth in Finding of Fact no. 11 and will be designed, constructed,
operated and maintained to be harmonious and appropriate in appearance or intended
character of the general vicinity and that such uses will not change the intended
essential character of the same area.
14. The uses proposed within the subject application will not be
hazardous or disturbing to existing or future neighboring uses.
15. The uses proposed within the subject application will be served
adequately by central public facilities and services such as highways, streets, police and
fire protection, drainage structures, refuse disposal, water, and sewer.
16. The applicant has agreed to pay any additional sewer, water or
trash fees or charges, if any associated with the use.
17. The uses proposed within the subject application will not involve
uses, activities, processes, materials, equipment and conditions of operation that will be
detrimental to any persons, property or the general welfare by reason of excessive
production of traffic, noise, smoke, fumes, glare or odors.

CONCLUSIONS OF LAW
Idaho Code § 67-6512 provides in part that:
(A) As part of a zoning ordinance the City Council may provide for the
processing of applications for special or conditional use permits;
and
(B) That a special use permit may be granted to an applicant if the
proposed use is otherwise prohibited by the terms of the zoning
ordinance, but may be allowed with conditions under specific
provisions of the zoning ordinance, subject to the ability of
political subdivisions, including school districts, to provide services
for the proposed use, and when it is not in conflict with the plan;
and
(C) That upon the granting of a special use permit, conditions may be
attached to a special use permit, including, but not limited to,
those:
1) Minimizing adverse impact on other development;
2) Controlling the sequence and timing of development;
3) Controlling the duration of development;
4) Assuring that development is maintained properly;
5) Designating the exact location and nature of development;
requiring the provision for on-site or off-site public facilities
or services; requiring more restrictive standards than those
generally required in an ordinance; requiring mitigation of
effects of the proposed development upon service delivery
by any political subdivision, including school districts,
providing services within the planning jurisdiction.

2.13 Requires all laterals and wasteways be protected.
2.14 All municipal surface drainage shall be retained on site.
2.15 If any surface drainage leaves the site, the Nampa SL Meridian Irrigation
District must review drainage plans.
2.16 The Developer must contact the Nampa & Meridian Irrigation District for
approval before any encroachment or change of right-of-way occurs.
Developer must comply with Idaho Code § 31-3805.
2.17 Any existing domestic wells and/or septic systems within this project will
have to be removed from their domestic service per City Ordinance Section
5-7-517. Wells may be used for non-domestic purposes such as landscape
irrigation.
2.18 Off-street parking shall be provided in accordance with Section 11-2-414 of
the City of Meridian Zoning and Development Ordinance and/or as
detailed in site-specific requirements.
2.19 Paving and striping shall be in accordance with the standards set forth in

Signage will be limited to one 4' x 8' monument sign in the location shown

2.31 Non-combustible fencing will be required for the boundary adjacent to
Creason Lateral. Developer shall submit details, considering public safety
and aesthetics in the design.
2.32 Assessment fees for water and sewer service to the office/residence shall be
determined during the building plan review process.
2.33 Applicant shall be required to enter into a Re Assessment Agreement with
the City of Meridian.
2.34 Drainage swales shall not be required.
2.35 Developer shall provide the Public Works Department with information on
anticipated fire flow and domestic water requirements for the proposed site.
Flow and pressure from the existing mains should be monitored with the
Meridian Water Department to determine whether adequate fire protection

construction and development of a mini storage facility consisting of 9 storage
buildings with a total square footage of 164,904 and one single family dwelling/office
located at 3735 N. Ten Mile Road, Meridian, Idaho, subject to the following
conditions of use and development:
2.1 Developer shall dedicate 48-feet of right-of-way from the centerline of
Ten Mile Road abutting the parcel by means of recordation of a final
subdivision plat or execution of a warranty deed prior to issuance of a
building permit (or other required permits), whichever occurs first.
2.2 Developer shall construct a 5-foot wide concrete sidewalk on Ten Mile
Road abutting the parcel within 2-feet of the new right-of-way.
Location, elevation and grade of the sidewalk shall be coordinated with
District staff.
2.3 Developer shall locate a 24 to 30-foot wide driveway as proposed,
approximately 200-feet north of the south property line. The driveway
shall be paved its full required width and at least 30-feet beyond the
edge of pavement of Ten Mile Road and pavement tapers installed with
15-foot radii abutting the existing roadway edge.
2.4 Any proposed gated entry shall be located a minimum of 50-feet from a
public road and shall be coordinated with District staff.
2.5 Utility pole relocation will be the responsibility of the developer if
relocation is necessary to accommodate a 5-foot wide sidewalk.
2.6 Utility street cuts in the new pavement are not allowed unless approved
in writing by the District.

2.9 The Applicant's .central sewage and central water plans must be
submitted to and approved by the Idaho Department of Health ~
Welfare, Division of Environmental Quality.

Stiles: The request for annexation and zoning to I-L with the conditional use
permit for the mini-storage, Items 8 and 9. On the Findings for the annexation
and zoning, Page 5, Item 16.2, it was left out part of our comments, so that's why
it's an incomplete sentence there. We had asked that so it would read due to the
numerous uses that are currently permitted in the I-L zone, a development
agreement should be required as a condition of annexation. We also went on to
say that there could be an outright restriction of certain uses, and, Mr. Gigray, if
what we're approving as a condition -since we're doing it as an annexation and
zoning with a conditional use permit, does that restrict that only to the storage
unit proposal?
Gigray: The conditional use permit should - I don't have the file in front of me -
should specify the use which is granted by that permit.
Stiles: But part of the development agreement, can we state that it is approved
to be rezoned I-L but only for the use as they have proposed? And that will be
the only use permitted?
Gigray: Mr. Mayor, we do have a provision in our development agreement which
describes approved uses in the development agreement, and, yes, we can
include restrictions. You bet. And we do often.
Stiles: That's what we would like to make sure that - I mean, either not planned
residential development would be -could possibly be submitted through a
conditional use permit if it's zoned I-L, there would be no restrictions on the use.
The Item 16.2, it was taken from our comments on Page 2 of our comments
dated September 14, 1999.

Stiles: It is also on Page 12, Item 3.1. And then for the conditional use permit,
Item, let's see -the conditional use permit, Findings of Fact, Page 21, Item 2.35,
the second sentence should read drainage swale shall not be approved within
the 20-foot wide planting strip adjacent to Ten Mile Road. So there should be a
"not" added.
Rountree: What Item are we on?

adjacent to a body of water. They have to control the weeds by City Ordinance.

agreement it'd have to be signed before we moved forward, so we probably
would - if we tabled this, it would have to be until the first meeting in December
which would be the 7th. Mr. Mayor.

Rountree: I move that we table Item No. 9 until December 7th and while on table,
instruct the city attorney to make those necessary changes on Page 19 and Page
21 and get the appropriate information that would correct the legal description.

3. Applicant is Ed Bews of 5204 Sorrento, Boise.
4. The subject property is currently zoned Ada County Rural Transitional
(R T). There is a pending application for annexation and zoning to Light Industrial
(I-L) which is defined within the City of Meridian Zoning and Development
Ordinance, Section 11-2-408(B14).
5. The proposed application requests a conditional use permit for
construction and development of a mini storage facility consisting of 9 storage
buildings with a total square footage of 164,904 and one single family dwelling/office.

City of Meridian Zoning and Development Ordinance requires a conditional use
permit be obtained for multiple buildings on one lot [Section 11-2-408(B14)].
RECOMMENDATION
l . The Meridian Planning and Zoning Commission hereby recommends to
the City Council of the City of Meridian that they approve the conditional use
permit as requested by the applicant, subject to the following:
Adopt the Ada County Highway District's Recommendations as follows:
1.1 Developer shall dedicate 48-feet of right-of-way from the centerline of
Ten Mile Road abutting the parcel by means of recordation of a final
subdivision plat or execution of a warranty deed prior to issuance of a
building permit (or other required permits), whichever occurs first.
1.2 Developer shall construct a 5-foot wide concrete sidewalk on Ten Mile
Road abutting the parcel within 2-feet of the new right-of--way.
Location, elevation and grade of the sidewalk shall be coordinated with
District staff.
1.3 Developer shall locate a 24 to 30-foot wide driveway as proposed,
approximately 200-feet north of the south property line. The driveway
shall be paved its full required width and at least 30-feet beyond the
edge of pavement of Ten Mile Road and pavement tapers installed with
15-foot radii abutting the existing roadway edge.
1.4 Any proposed gated entry shall be located a minimum of 50-feet from a
public road and shall be coordinated with District staff.
1.5 Utility pole relocation will be the responsibility of the developer if
relocation is necessary to accommodate a 5-foot wide sidewakc.
1.6 Utility street cuts in the new pavement are not allowed unless approved

in writing by the District.
i . 7 As required by District policy, restrictions on the width, number and
locations of driveways, shall be placed on future development of this
parcel.
1.8 Other than the access point specifically approved with this application,
direct lot or parcel access to Ten Mile Road is prohibited.
Adopt the Central District Health Department's Recommendations as follows:
1.9 The Applicant's central sewage and central water plans must be
submitted to and approved by the Idaho Department of Health ~
Welfare, Division of Environmental Quality.
I.10 Run-off is not to create a mosquito breeding problem.
1.11 It is recommended that stormwater shall be pretreated through a grassy
swale prior to discharge to the subsurface to prevent impact to
groundwater and surface water quality.
1.12 The Engineers and architects involved with the design o£ the subject
project shall obtain current best management practices for stormwater
disposal and design a stormwater management system that prevents
groundwater and surface water degradation.
Adopt the Nampa Si Meridian Irrigation District Recommendations as follows:
1.13 Requires all laterals and wasteways be protected.
i .14 All municipal surface drainage shall be retained on site.
1.15 If any surface drainage leaves the site, the Nampa ~ Meridian Irrigation
District must review drainage plans.
1.16 The Developer must contact the Nampa St Meridian Irrigation District
for approval before any encroachment or change of right-of-way occurs.
Developer must comply with Idaho Code § 31-3805.

Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
1.17 Any existing irrigation/drainage ditches crossing the property to be
included in this project, shall be tiled per City Ordinance 11-9-605.M.
Plans will need to be approved by the appropriate irrigation/drainage
district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department. No variances have
been requested for tiling of any ditches crossing this project. Staff could
support leaving the ditch open and fencing at the easement line
provided the area between the Creason Lateral and proposed buildings is
made a lawn area.
1.18 Any existing domestic wells and/or septic systems within this project will
have to be removed from their domestic service per City Ordinance
Section 5-7-517. Wells may be used for non-domestic purposes such as
landscape irrigation.
1.19 Off street parking shall be provided in accordance with Section 11-2-
414 of the City of Meridian Zoning and Development Ordinance and/or
as detailed in site-specific requirements.
1.20 Paving and striping shall be in accordance with the standards set forth in
Sections 11-2-414.D.4 and 11-2-414.D.5 of the City of Meridian
Zoning and Development Ordinance and in accordance with Americans
with Disabilities Act (ADA) requirements.
1.21 A drainage plan designed by a State of Idaho licensed architect or
engineer is required and shall be submitted to the City Engineer (Ord.
557, 10-1-91) for all off-street parking areas. All site drainage shall be
contained and disposed of on-site.
1.22 Outside lighting shall be designed and placed so as not to direct
illumination on any nearby residential areas and in accordance with City
Ordinance Section 11-2-14.D.3.
1.23 All signage shall be in accordance with the standards set forth in Section
11-2-415 of the City of Meridian Zoning and Development Ordinance.
No temporary signage or flashing signs will be permitted.

1.24 Applicants shall provide five-foot-wide sidewalks in accordance with City
Ordinance Section 11-9-606.B.
1.25 All construction shall conform to the requirements of the Americans
with Disabilities Act.
1.26 Anew 30-inch diameter sanitary sewer trunk line is to be installed along
the northerly boundary of the proposed mini storage site. The proposed
location would be 16.5 feet south of the north boundary line. This
location would locate the trunk line approximately 10 feet south of the
landscape planter and more center of the driveway. Developer shall
provide the City with a permanent ZO-foot-wide easement, centered on
the pipe for this line.
1.27 Sanitary sewer service to this site will be via an extension to the new
trunk line as shown on the site plan. Applicant will be responsible to
construct the sewer mains to and through this proposed development.
Project designer to coordinate sizing and routing with the Public Works
Department.
1.28 Water service to this site will be via extensions of existing mains
installed adjacent to subject site. Applicant will be responsible to
construct the water mains to and through this proposed development.
Project designer to coordinate main sizing and routing with the Public
Works Department.
1.29 Applicant shall provide detailed signage plans for review and approval.
Signage will be limited to one 4' x 8' monument sign in the location
shown on the approved site plan. Detailed signage plans will be subject
to design review and separate permits.
1.30 Office area of single-family dwelling unit shall meet all current Codes
and comply with the Americans with Disabilities Act.
1.3I Underground pressurized irrigation must be provided to all landscape
areas on site. Developer shall submit hook up and design details based
on the proposed landscaping. Primary water supply connection to the
City's mains will not be allowed. Developer shall be required to utilize
any existing surface or well water for the primary source. If City water is

proposed as a secondary source, developer shall be responsible to pay
water assessments for the entire common open area.
1.32 Non-combustible fencing will be required for the boundary adjacent to
Cresson Lateral. Developer shall submit details, considering public
safety and aesthetics in the design.
1.33 Assessment fees for water and sewer service to the office~residence shall
be determined during the building plan review process.
1.34 Applicant shall be required to enter into a Re-Assessment Agreement
with the City of Meridian.
1.35 State agencies recommend that drainage swales be used for pretreatment
of stormwater. Drainage swales shall be approved within the 20-foot-
wide planting strip adjacent to Ten Mile Road.
1.36 Developer shall provide the Public Works Department with information
on anticipated fire flow and domestic water requirements for the
proposed site. Flow and pressure from the existing mains should be
monitored with the Meridian Water Department to determine whether
adequate fire protection exists.
1.37 All driveways and parking areas are to be paved.
1.38 Developer shall provide detailed landscape plan for review and approval,
including sizes and species of trees, bushes, and all proposed ground
cover/treatment.
1.39 Solid walls of storage buildings are not aesthetically pleasing and need to
be broken up by landscaping. Staff recommends that trees be placed at a
minimum of 40 feet on center instead of the 70 feet shown on the
northern boundary. The planting strip shall not be reduced below the
6.5 feet shown and may not encroach upon the 20-foot-wide sewer
easement requested.
1.40 Developer shall provide a minimum 20-foot-wide planting strip beyond
required right-of-way of 48 feet from centerline of Ten Mile Road.

Corrie: Item No. 13 is a public hearing. This is a request for annexation and
rezone for Ten Mile Mini Storage by Ed Bews, west of Ten Mile and north of
Ustick Road. At this time, we'll open the public hearing and invite the staff for
first comments.
Stiles: Mr. Mayor and Council, this is for the property that's located immediately
north of the Wastewater Treatment Plant on Ten Mile Road. It is designated in
the Meridian Comprehensive Plan as being agricultural rural residential which
requires a five to ten acres lots that they are residential uses. The staff's
recommendation is that if this approved for annexation and zoning that the uses
be restricted and that there be outright restriction of certain uses or the possibility
also would be that this be the only use that's permitted on that lot. The light
industrial zone that they've requested would be compatible with the Wastewater
Treatment Plant. I talked to John Shawcraft, the Wastewater Treatment Plant
operator, and he has no particular concerns with the project. I will, if I may, I
would like to cover the conditional use permit at this time in my comments.
They're proposing storage units along this entire perimeter. Would be storage
units. They have added some landscaping and we have requested that the
landscaping on this northern boundary be approved by our staff and that trees be
planted at least 40 feet on center. They also would have the office/residence
here. Staff would support leaving the Cresson Lateral open provided that some
kind of treatment is given to the land area here either through some kind of lawn
or fescue or something of that nature. There are existing trees here as part of
the Wastewater Treatment Plant's property. There's the road for the ditch rider,
the Nampa Meridian Irrigation District is on the Wastewater Treatment side. One
thing that Mr. Shawcraft has asked just verbally tonight.in reviewing this plan,
they are currently showing all of these units here to be open.. He has requested
that they at least be enclosed on the southern boundary here because of the

construction activities that are going to take place at the treatment plant. His
concern is that there will be a lot of dust generated and the vehicles that are
parked in this area will be covered with dust and they won't be very happy. Staff
would support recommendation of this annexation and zoning and the conditional
use permit with the conditions outlined in our report. There also will be a
trunkline sewer -how big is that? I believe 30-inch trunkline sewer that wilt be
extended from the treatment plant, and it will follow this 20-foot wide corridor all
the way to Ten Mile, and that will start us on the way for the no-name trunk
sewer.
Corrie: Anything else from staff?
Stiles: Do you have anything, Gary?
Smith: I'm sorry, Mr. Mayor. No. I don't have any other comments to make.
Corrie: Okay. Thank you. Okay. Developer. Okay, Becky, the Council has
indicated that the members of the council that we might deal with the public
hearing for both the request for the conditional use permit and also for the
annexation and rezone --
Bowcutt: Yes, sir.
Corrie: -- at the same time.
Bowcutt: Yes, sir. That was my intent.
Corrie: Thank you.
Bowcutt: Becky Bowcutt, Briggs Engineering, 1800 West Overland, Boise. I'm
representing the applicant in this matter. As Shari indicated, this adjoins the
Wastewater Treatment facility. The Wastewater Treatment facility is also zoned
I-L, and that's where this property is contiguous with the city limits at this time.
Water is available in Ustick and Ten Mile intersection. It will be extended to the
north -with the project located on the northeast corner of Ten Mile and Ustick. We
have contacted your water department and have received some analysis of what
the flow rates are out there. They tell us they're 3,338 GPM at 20 PSI because
that's one of the concerns with these types of facilities because you do, under the
Uniform Building Code, are required to have firewalls at certain distances based
on the amount of fire flow available. The property's about 13.79 acres, and
based on the location, this is probably the best use that one can think of
concerning what we have next door. This project -not that it's bad.
Corrie: It's got to go somewhere.

Bowcutt: We wouldn't want to put anything in there that would conflict, let me put
it that way, with the adjoining use next door. The I-L zone, we chose that zone
because your staff indicated that's one of the few zones that does allow for mini-
storage facilities. The zone does in its purpose statement encourage clean,
quiet, free of hazardous or objectionable elements which this particular project
would be. These projects don't generate a lot of traffic. The traffic they do
generate is not associated with peak hours. We've got about 164,904 square
feet of mini-storage. The units would range in height; about the maximum would
be 14 -around 16 feet, I think it is. There would be one single-family dwelling
which would also serve as the office. If you look at this site plan here, the office
would be located right there at the entrance roadway. The gate would be inset
right here at this island, so we would have adequate room for stacking which is
one of the concerns that Ada County Highway District always has when you're
doing this type of facility with a gate. They're typically a coded pad so each
person would have an individual code to enter the facility. There will be parking
provided, handicap parking. We have allocated 20 feet of landscaping outside of
the right-of-way as staff requested, and we have landscaping, I believe, six, six
and a half feet along the northern boundary. We had one gentleman at the P &
Z, his only concern, he owns this property here, was that these trees would be
left in tact because I guess they do kind of straddle the property line. I have
talked to my clients about that, and they stated that they didn't have any intent to
remove those four existing trees; however, when that trunkline, the sewer
trunkline is extended down along that northern boundary, sometimes we find,
due to the excavation, that the trees will die. Not saying that's going to happen,
but that is a possibility. Obviously, if that were the case, the tree would then
have to be removed and we'd have to replace it with a new tree. Based on staff's
comments, there were only a couple of items that we were not in agreement with.
All the others we concurred. General requirements, Item 1, your ordinance does
require that you pipe any irrigation facility. We do adjoin the Creason Lateral. It
runs all along the southern boundary and separates this between the Treatment
Facility. Based on the fact that this is amini-storage facility, we don't have the
issue of ditch safety. It's back behind the buildings. To answer staff's question,
the rear of these buildings joining the Treatment Plant, this will be enclosed.
Only the face of these is open to the interior, so we wouldn't have any conflict
there. What we'd like to do is request a waiver of piping the Creason Lateral.
We feel that it just doesn't make a lot of sense to do so where we don't have any
residential, adjoining uses. Secondly, we don't want to put any manicured
landscaping back here behind these buildings. We have allocated some areas
where we're going to retain some of our storm drainage. We have about 300,000
square feet of hard surface area. That generates a substantial amount of storm
drainage. So outside of the easement for the Creason, which is I believe 25 feet
from the center line of the ditch, we have some pocket areas where we're going
to retain some storm drainage back in that area. Planting something like a red
fescue or something that you don't need to maintain, you still have some
problems with it. Our preference would be to sterilize it and that's typically the
preference of the irrigation district because then they don't have any

maintenance required. If we were to encroach into their easement with any type
of landscaping, even something like a red fescue or buffalo grass, we would have
to obtain a license agreement from them. There's a substantial amount of trees
along here. You know, it is a ditch. It's going to look like a ditch. Beings that it's
back behind the building, kind of situated between these two parcels, I would
hope that we could get some understanding there. As Shari indicated, the 30-
inch sewer trunkline will be coming out of the treatment facility. This is the no-
name trunk. (t'I( come into the property here and run for 2,000 feet and exit out to
Ten Mile. For the record, our intent is to construct, design and construct that
facility this winter. We'll also be doing our design and construction of our
extension of water north on Ten Mile. The other condition that we disagreed with
was Condition No. 13. Staff indicated that the ordinance reads that for every
15,000 square feet of asphalt on a site that one will plant a tree. But it doesn't
differentiate between any uses. Obviously, when you have 300,000 square feet
of hard surface area, you would have approximately 200 trees based on that
calculation. Staff has stated that their preference would be a tree every 40 feet
all along Ten Mile and then running along the northern boundary, and that would
be from center of trunk to center of trunk. When you calculate that, that would
require 68 trees based on those two dimensions. We concur with that. We do
agree. So we would like No. 13, the reference to 15,000 square feet deleted
because it just doesn't make any sense in this type of facility. I don't know where
you'd put the trees. You just have trees on top of trees. We've agreed to
detailed landscaping plan for what we show. We've also agreed to a
development agreement. We understand that this property is being approved for
a mini-storage facility only. We are not opposed to that being referenced in the
development agreement for this rezone to an I-L. Do you have any questions?

Bentley: Becky, you're going to make your new resident aware of where he's
living? It is the sewer plant behind them.

Bowcutt: So it'd be about 30 feet from the center of those trees, approximately,
back to the edge of the building.

~ Facts and Findings:

~_~ A. The Ada County Highway District (ACRD) staff has received the above referenced application
requesting conditional use approval to construct a 164,904-square foot mini storage facility.
The 13.8-acre site is located on the west side of Ten Mile Road, approximately. 1,000-feet north
~ of Ustick Road. This development is estimated to generate 280 additional (10 existing) vehicle
trips per day based on the Institute of Transportation Engineers Trip Generation manual.
~--!---~ B. The application and site plan stamped as received by the City of Meridian on July 27, 1999, and
C~ submitted to the District on August 11, 1999, have been reviewed by the ACHD Planning and
Development staff and conforms to applicable District standards/policy, or can be made to
conform with the change(s) to the plan described in the requirements stated below.
This is a staff level approval and will not be heard by the ACRD Commission unless the site
plan is changed in such a manner as to not conform with District standards/policy or an appeal
of the Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.

The following requirements are provided as conditions for approval:

~ Site Specific Requirements:
1. Dedicate 48-feet ofright-of--way from the centerline of Ten Mile Road abutting the parcel by
~ means of recordation of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits), whichever occurs first. The owner
will be compensated for all right-of--way dedicated as an addition to existing right-of--way from.
+~ available impact fee revenues in this benefit zone, if the owner submits a letter of application to
~~ the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD
Ordinance #188.

2. Construct a 5-foot wide concrete sidewalk on Ten Mile Road abutting the parcel within 2-feet of
the new right-of--way. Coordinate the location, elevation and grade of the sidewalk with District
staff. -
3. Locate a 24 to 30-foot wide driveway as proposed, approximately 200-feet north of the south
property line. Pave the driveway its full required width and at least 30-feet beyond the edge of
4~ pavement of Ten Mile Road and install pavement tapers with 15-foot radii abutting the existing
C~ roadway edge.
~4. Locate any proposed gated entry a minimum of 50-feet from a public road. Coordinate the
location of any proposed gated entry with District staff.
~ 5. Utility pole relocation will be the responsibility of the developer if relocation is necessary to
accommodate a 5-foot wide sidewalk.
~,6. Utility street cuts in the new pavement are not allowed unless approved in writing by the District.

~7. As required by District policy, restrictions on the width, number and locations of driveways,
shall be placed on future development of this parcel.
8. Other than the access point specifically approved with this application, direct lot or parcel access
~ to Ten Mile Road is prohibited.

~ 1. This decision of the Planning and Development Supervisor may be appealed to the Ada County
Highway District Commission by the applicant or by another party within 15 calendar days from
the date of this report. The request shall specifically id .n ify each requirement to be
reconsidered and include a wri en ex}~lanation of ~=shy such a re rnirement ~x~ould result in a
substantial hardship or ineq ~i v The request will be heard by the District Commission at an
~ evening meeting within 20 calendar days of the District's receipt of the appeal letter. The
appellant will be notified of the date and time of the Commission meeting.
~.~.~2. After ACRD Commission action, any request for reconsideration of the Commission's action
C~ shall be made in writing to the Planning and Development Supervisor within two days of the
~-~ action and shall include a minimum fee of $110.00. The req~,test for reconsideration shall

for reconsideration will be heard by the District Commission at the next regular meeting of the

Payment of applicable road impact fees are required prior to building construction in accordance
with Ordinance #188, also known as Ada County Highway District Road Impact Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the
~~ State of Idaho shall prepare and certify all improvement plans.
~,~5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
~~~ (or other required permits), which incorporates any required design changes.
6. Constriction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or
~-~~ other regulatory and legal restrictions in force at the time the applicant or its successors in
~~ interest advises the Highway District of its intent to change the planned use of the subject
~~ property unless awaiver/variance of said requirements or other legal relief is granted pursuant to
~~ the law in effect at the time the change in use is sought.

'~1. ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

The Nampa & Meridian Irrigation District's Creason Lateral courses along the south boundary of
the project. The right-of--way of the Cresson Lateral is 60 feet, 20 feet to the right and 40 feet to
the left facing downstream. See Idaho Code 42-1208-RIGHTS OF WAY NOT SUBJECT TO
ADVERSE POSSESSION. The developer must contact John P. Anderson or Bill Henson at 466-
0663 for approval before any encroachment or change of right-of--way occurs.
The Nampa & Meridian Irrigation District requires a land Use Change/Site Development
application be filed for review prior bo final platting. All laterals and waste ways must be
protected. All municipal surface drainage must be retained on site. If any surface drainage
leaves the site, the Nampa & Meridian Irrigation District must review drainage plans. Contact
Donna Moore at 466-7861 for further information.
The devebper must comply with Idaho Code 31-3805. It is recommended that irrigation water
be made available to all developments within the Nampa & Meridian Irrigation District.

Irrigation District for its review on the above-referenced development. If this
development is under a "rush° to be finalized, I would recommend that you submit a
cashier's check, money order or cash as payment of the fees in order to speed the
process up. If you submit a company or personal check, it must clear the bank before
processing the application.
Should this development be planning a pressure urban irrigation system that will be
owned, operated and maintained by the Irrigation District, I strongly urge you to
coordinate with John P. Anderson, Water Superintendent for the Irrigation District,
concerning the installation of the pressure system. Enclosed is a questionnaire that you
must fill out and return in order to initiate the process of contractual agreements between
the owner or developer and the Irrigation District for the ownership, operation and
maintenance of the pressure urban irrigation system.
