APPROVAL OF FINAL PLAT
IN THE AREA OF IMPACT
This matter coming before the City Council of the City of Meridian on the
1" day of December, 1998, pursuant to the above referenced application for Final Plat
approval and the Council having received the report of the Planning and Zoning
Administrator, and having reviewed the proposed Final Plat finds:
IT IS HEREBY ORDERED THAT:
1.) The real property which is the subject of this application is outside of
the boundaries of the City of Meridian but within the City of Meridian Area of City
Impact as provided by Ada County Code § 9-4-1 Al and this application being a land use
application which is referred to the City Council as provided in Ada County Code § 9-4-4
C; and
2.) This application is governed and determined for approval pursuant to
the subdivision ordinance of the City of Meridian codified at § 11-9-601 et. Seq.
Municipal Code of the City of Meridian; and
ORDER OF CONDITIONAL APPROVAL OF
FINAL PLAT FOR 'STETSON-ESTATES-SUBDIVISIONT- 1
3.) The City Council has authority to approve and accept a plat within
the Impact Area pursuant to I.C. H 67-6526 and 50-1306; and
4.) That the proposed plat herein specifically identified is in compliance
with the City's subdivision ordinance and the proposed use is in compliance with the
City's Comprehensive Plan.
NOW, THEREFORE, IT IS HEREBY ORDERED AND THIS DOES
ORDER THAT:
1.) The Plat showing "STETSON ESTATES SUBDIVISION" as
evidenced in Plat bearing the job reference "Pinnacle Engineers, Inc., consisting of 3 sheets
designated as DRAWING -NO. 8663_PLT.DWG, is approved;
2.) The City Cleric and City Engineer are hereby authorized to sign on
behalf of the City this acceptance and approval; and
3.) The City Cleric is to provide a copy of this Order of Approval to the
applicant and the Ada County Development Services Department Director, and the City
of Meridian Planning and Zoning Administrator and the Public Works Director.

The City of Meridian is not requesting a resubdivision plan or installation of dry line sewers
for this development. The project appears to otherwise comply with the Meridian
Comprehensive Plan if all lots are a minimum of five acres. An exception to our Subdivision
Ordinance would be the excessive culdesac length. The Applicant will need to coordinate with
the Meridian City -Rural Volunteer Fire Department to ensure that Uniform Fire Code and all
Fire Department policies are met.

"District") took action on the Preliminary Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for acceptance, the Developer shall
cause the following applicable standard conditions to be satisfied prior to District certification
and endorsement:
Drainage plans shall be submitted and subject to review and approval by the
District.
2. If public street improvements are required: Prior to any construction within the
existing or proposed public right-of-way, the following shall be submitted and
subject to review and approval by the District:
a. Three complete sets of detailed street construction drawings prepared by
an Idaho Registered Professional Engineer, together with payment of plan

B. Utility street cuts in new pavement less than five years old are not allowed unless approved in

C. In accordance with District policy (that is based upon the density of development having lot
sizes between 7.5 -acres and 12.5 -acres), Victory Road should be improved with a minimum
of 28 -feet of pavement abutting this site. Victory Road is improved with 30 -feet of pavement
abutting this site. The applicant -will have a sufficient pavement width on Victory Road. No
additional pavement on Victory Road willbe required.
D. The applicant is proposing to construct a public road to access the lots. The public road,
Wrangler Street, is proposed to have 30 -feet of pavement and 3 -foot wide graveled shoulders
within 50 -feet of right-of-way. This street section meets District policy for the proposed
density of development. The applicant is'proposing to construct Wrangler Street to intersect
with Victory Road adjacent to the west property line.
There are two private roads on the north side of Victory Road which conflict with the
proposed driveway location:

White Pointe Lane is located approximately 150 -feet west of the site's west property
line.
White Mountain Lane is located approximately 390 -feet east of the site's west
property line.

District policy requires a minimum of 230 -feet of separation between the :proposed Wrangler
Street and the private roads on the north side of Victory Road: The location of the pfoposed
road does not meet District policy. The applicant should be required to locate Wrangler
Street ,85 -feet east of the site's west property line or in alignment with White Mountain Lane.
A public road at this location will meet the required 230 -feet of separation -between the
proposed Wrangler Street and the private roads on the north side of Victory Road.
The applicant should be required to provide an ACHD approved turnaround abutting Lot 5,
Block 1, of the proposed subdivision. Submit a design of the turnaround for review and
approval by District staff.
E. In accordance with District policy, stub streets to the undeveloped parcels abutting this site
may be required upon review of a future application for this site.
F. The existing transportation system will be adequate to accommodate the additional traffic
generated `by this proposed development with the requirements outlined within this report.
The following Site Specific Requirements and Standard Requirements must.,be met or provided
for prior to ACRD approval of the final plat:
Site Specific Requirements:
1. Dedicate 30 -feet of right-of-way from the section line of Victory Road abutting the parcel by
means of recordation of a final subdivision plat or execution of a warranty deed prior to
issuance of a building permit (or other required permits), whichever occurs first. The owner
will be compensated for this additional right-of-way from available impact fee revenues in
this benefit zone. If the owner wishes to be paid for the additional right-of-way, the owner,
must submit a letter of application -to the impact fee administrator prior to breaking ground,
in accordance with Section 15 of ACHD Ordinance #188.
2. Construct Wrangler Street with 30 -feet of pavement and 3 -foot wide graveled shoulders
within 50 -feet of right-of-way (The District's Policy Manual allows the deletion of the
graveled shoulders if adjacent landscaping will accommodate the drainage. Coordinate the
design of the landscaping with District staff). Locate the roadway 85 -feet east of the site's
west property line (as measured from property line to near edge of roadway). Provide an
ACHD approved turnaround abutting Lot 5, Block 1. The 50 -feet of right-of-way for
Wrangler Street shall abut Lot 5, Block 1. Coordinate the design of the turnaround with
District staff.

In accordance with District policy, stub streets to the undeveloped parcels abutting this site
may be required upon review of a future application for this site.
4. Other than the public road, Wrangler Street,` specifically approved with this application,
direct lot or parcel access to Victory Road is prohibited. Lot access restrictions, as required
with this application, shall be stated on the final plat.
Standard Requirements:
A request for modification, variance or waiver of any requirement or policy outlined herein
- shali be made in writing to the ACHD Development Services Supervisor. The request shall
specifically identify each requirement to be reconsidered and include a written explanation of
why such a requirement would result in a substantial hardship or inequity. The written
request shall be submitted to the District no later than 9.00 a m on the day scheduled for
ACHD Commission action. Those items shall be rescheduled for discussion with the
Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission
action do not provide sufficient time for District staff to remove the item from the consent
agenda and report to the Commission regarding the requested modification, variance or
waiver. Those items will be acted on by the Commission unless removed from the agenda by
the Commission.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Development Services Supervisor within two days of the
action and.shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation
of data that was not available to the Commission at the time of its original decision. The
request for reconsideration will be heard by the District Commission at the next regular
meeting of the Commission. If the Commission agrees to reconsider the action, the applicant
will be notified of the date and time of the Commission meeting at which the reconsideration
will be heard. 41
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, .prior to issuance of building
permit (or other required permits), which incorporates any required design changes.

6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District, approval for occupancy.
7. No change in the terms and conditions of this approval shall be valid unless they are in
writing and signed by the applicant or the ' applicant's authorized representative and an
authorized representative of the Ada County Highway District. The burden shall be upon the
applicant to obtain written confirmation of any change from the Ada County Highway
District.
8. Any change by the applicant in the planned use of the property which is the subject,of this
_ application, shall require the applicant to comply with all rules, regulations, ordinances,
plans, or other regulatory and legal restrictions in force at the time the applicant or its
successors in interest advises the Highway District of its intent to change the planned use of
the subject property unless a waiver/variance of said requirements or other legal relief is
granted pursuant to the law in effect at�the time the change in use is sought.
Conclusion'of Law:
1. ACED requirements are intended to assure that the proposed use/development will not place
an undue burden on, the existing vehicular and pedestrian transportation system`within the
vicinity impacted by the proposed development.
