"CC & R's" L1 .ADOPTION These rules and regulations were adopted by the Board of Directors of Meridian Acres. 2.1 GENERAL RULES AND REGULATIONS All homeowners and residents are requested to assist in the enforcement of all regulations. In cases where the rules are not understood, please take time to explain them courteously to fellow homeowners, visitors, or tenants. Each owner has a vested interest in the common areas and should therefore afford these areas the same pride of ownership and care as given their unit. The following rules should be observed to protect your investment. 1.1 GENERAL USE ADOPTION No individual unit shall be ,occupied and used except for residential purposes by the owner, their tenants and social quests, and no trade or business shall be conducted to therein. No tent, shack, trailer, basement, garage, out building or structure of a temporary character shall be used at any time as a residence, either temporarily or permanently. The use of any part of the common area for commercial or related purposes is prohibited. 2.1 UNIT RIGHTS AND RESPONSIBILITIES No exterior clotheslines shall be erected or maintained and there shall be no outside laundering or drying of clothes. Further, no clothes washer, clothes dryer, water heaters,-refrigerators or freezers may be kept stored or operated on any exterior area. No power equipment, hobby shops or car maintenance (other than emergency work) shall be permitted on the property except with prior written approval of the Board. ,No garbage cans, bottles, mats, newspapers, boxes, or other articles shall be placed in the common area. No linens, cloths, clothing, curtains, rugs, or mops shall be shaken or rung from or on any windows, doors, railings or fence. The sidewalks, side~Nalks, entrances, driveways, stairways, and landings shall not be obstructed or used for any other purpose than fettering and leaving the units or restricted common areas. 2.2 NUISANCES No noxious, illegal, or offensive activities shall be carried on upon any unit or in any part of the property, nor shall anything be done thereon which may be or may become an annoyance or nuisance to or which may in any way interfere with the quiet enjoyment of each of the owners of his respective unit, or which shall in any way . • • increase the rate of insurance for the project, or cause any insurance policy to be canceled or to cause a refusal to renew he same, or which will impair the structural integrity of any building. No person shall pla}~ upon or allow to be played any musical instrument, or operate or permit to be operated or operate or permit to be operated any phonograph stereo, radio, television set, or other amplified sound system in any outdoor area between the hours of 10:00 p.m. and 9:00 a.m. No persons shall permit any party or other activity in the common area or his unit which makes or causes to make noises which might tend to unreasonably interfere with the peace and quiet of the other owners or occupants. No radio or other sound system shall be operated in any outdoor area of the subdivision except at a low sound level. No offensive noise, language or behavior is allowed. Department, 2.4 SIGNS Unless written approval is first obtained from the Board of Directors, no sign of any kind shall be displayed to public view on the building or building site on said property except one professional sign if not more than five square feet advertising the property for sale or rent. 2.5 ROOF AREA Walking or climbing on roofs, cement walls and fences is not permitted under any circumstances. No one is to go onto the roof, without the consent of the Board of Directors. 2.6 LIABILITY The Board will have no liability for damage, loss, or theft of any personal property stored on any property. Owners will beheld liable for any reasonable costs incurred by the association for the repair or replacement, due to negligent or willful damage or destruction, to structures, fences, gates, landscaping, and recreational areas caused by said owner, tenant or guests. Such cost, plus possible penalty assessments will be charged back to the owners. 2.7 RECREATIONAL VEHICLES.,[PARHING No boats, campers, recreational vehicles, trucks, trailers and no vans in excess of eighteen feet long and or six feet, eight inches wide shall be parked or maintained within property (except for temporary loading and unloading without inconvenience to resident access). Recreational vehicles, including vans, may not be used as temporary living or sleeping quarters for residents or visitors at any time. Boats and other nonwheeled mounted vehicles may not be parked in the subdivision at any.. time. The maximum speed limit is 10 mph on any subdivision driveway. Owners of illegally parked vehicles are subject to penalty assessments and possible tow away at the owners expense for repeated violations. Vehicles cited for any violation are automatically checked through the Department of Motor Vehicles for ownership and address. To assure maximum use of,the limited parking, residents must park their vehicles in a manner that does not waste a"possible parking space for another vehicle. No vehicle shall be parked in such a manner as to impede or prevent ready access to any entrance to or exit from a building.;. ` Offensive vehicular noise such as loud radios, undue use- of horn, squealing tires or"brakes, etc., is strictly prohibited. Vehicles should be equipped with mufflers in a good working' order to prevent excessive noise and annoying exhaust fumes. 2.8 PETS ~. No animals, birds, insects or livestock shall be kept on said property except domesticated dogs, cats or other common household pets which do not unreasonably bother or constitute a nuisance to others and on such portion of roads and other public ways or easements as may be~desigriated or permitted. for such use from time to time. No dogs"or cats in excess of two shall be kept by any residential household within said subdivision, and no animals of any kind shall be bred or kept for commercial purposes. All dogs must be leashed when outside a dwelling unit, and shall not be allowed in the common area or kenneled outside the ,.dwelling units. , 3.0 COMMON AREAS __ ~ 3.1 PATIOS The hanging of~laundry, towels,~rugs, ladders or other unsightly items over balcony railings or patios is prohibited. ;Placing any: items ` as to extend beyond a, balcony or patio is prohibited and any .hanging plants or other decorations from patios must be securely fastened. ;The storage,. of .,gasoline and other flammable fluids, explosives, fireworks, etc., anywhere on the property is prohibited..No wire screening, plastic, wood or other material may be placed on exterior of units for the retention of any pets. Debris of any kind is not to be discarded on the landscape. Any debris must be swept or picked up and disposed., of properly. No articles of any type are permitted to be thrown from any balcony or patio area. ` 4.0 COMPLAINT AND RULE ENFORCEMENT PROCEDURE ° A complaint or grievance is' an alleged violation, misunderstanding, misinterpretation or inequitable application of these documents ar~d 'or rules and regulations guidelines. A violation is a failure of an individual to observe these documents and the subdivision Board. Thi's can range in severity from the inconsiderate act of individual, to acts which endanger the health and safety of the ~ community. ~ Any violation disrupts the harmony of the community and must be addressed with wisdom, patience, and determination. The complaint procedure may~~be employed after attempts made to resolve a deemed violation have been unsuccessful. "Neighborhood complaints" i.e., undue noise, barking dogs, etc., should be settled between the parties involved. All efforts should be exercised to resolve the .difficulty at this.level. If the complaint cannot be resolved in this- manner it may then be referred to local enforcement agencies. Any resident should report a violation or infraction to member of the Board by a written report of the facts. A signed and dated letter should be submitted which comprehensively lays out the basis of the complaint and provides the information of when, where, who, what, and how the violation occurred. No enforcement procedure will be initiated without a signed written complaint. An owner is strictly liable for violations of these rules by his or her quests or tenants. Where a tenant or occupant is in violation of a rule the owner will be served notice and have the responsibility per subsequent action as outlined hereafter. When the complaint is valid a formal complaint letter will be sent to the offending owner of record at his or her last known address. This letter will state the nature of the offense, the deadline for correction and date of the Board meeting at which the complaint will be heard. iAll complaints will be heard at the next regularly scheduled Board meeting if the offending owner has received at least ten (10) days prior notice of the hearing, if the offending owner has not received ten (10) days prior notice, the complaint will be heard at the second Board meeting following the date of the notice letter. Upon written request of either party to the grievance, the Board may conduct a special hearing to review and act upon the complaint... If the offending owner has corrected the violation, the Board will impose no penalty and will close that complaint. If the violation has continued, the Board will determine a sanction that is appropriate for the.violation. Should the offending owner not appear at the hearing, the Board may make a determination on the matter in his or her absence. Any such determination would be binding. The decision of the Board will be final except in any manner when an applicable State Code allows recourse by another authority. Notice of the Board action will be sent to the owner of record or their designated agent at his or her last known address. Tenants and guests are bound by the documents and rules and regulations of this association. Owners and tenants are held responsible and liable at all times for the action and conduct of their family and guests while on community property. All tenants and guest violations will be cited against the homeowner. A copy of the violation will be sent to the tenant also. The owner will be held liable for payment of any penalty assessment levied for his tenant or guest violation, as well as reasonable costs, if applicable, incurred by the association for the repair or replacement of any damage caused to community. The Board of Directors has at its disposal, several enforcement alternatives ranging from a simple oral warning to legal action. In general, the alternatives fall into the following categories, but are not limited to: a. Oral and or written warning. b. Suspension of a member right to vote. c. Penalty assessment. d. Late charges on assessments. e. Lien and foreclosure against an owners unit. f. Court injunctions g. Notification of violation of City, County and State Codes and/or laws to the appropriate police and or regulatory agency. In cases of damage to subdivision property, a penalty assessment will be levied against an owner in addition to recovery of reasonable costs incurred by the Board for the repair or replacement of damage caused to other owner's property by said owner, tenant or guest. If there is a violation of architectural standards, a penalty assessment maya be levied, or a court injunction instituted, against any owner who undertakes improvement or alterations or a unit which might effect the architectural integrity or accepted standards of the community without prior Board approval. If the violation endangers the health or safety of the community, the Board can take immediate action to ensure the health and or safety of the community, including making a report with the Police Department or seeking court injunctions as legal restraint. I do remember that the ordinance is much more strict on requirements for alternatives than what the previous Council had required in terms of what Shari had mentioned actually providing a well for the City or materials for a well, a domestic well for the City which is a substantial investment and so I think the well development fees was a spin off from the requirements of the ordinance and much more lenient than the actual requirements of the ordinance at that time, but it was an alternative at one time for final plats. Anderson: Mr. Mayor, I guess in light of that information, if Gary feels that confident that it wasn't part of it then the only- choice would be a variance so I guess I would be leaning towards instructing that come back for a variance at the`next meeting. Stiles: Mr. Mayor. and Council, this is for a subdivision that was also known as Meridian Acres at one time. I hate to bring up the issue of pressurized irrigation. We do have evidence from them that they do not have surface water supply available and they've °agreed to pay the well development fees in lieu of that pressurized irrigation. !don't `- know if that's an ordinahce or where that came -from. The Public Works Department analyzed it and based on the amount of the square footage of the land they will have in landscaping and maybe Gary can clarify, since it is below the half acre - I don't know if ~ ~ Meridian City Council Meeting June 15, 1999 Page 51 that's ordinance or what but there would be less than a half acre irrigated and so in that case they would allow city water to be used but I'm not sure where we are on that. Corrie: Gary? Smith: Mr. Mayor and Council members, our recent water rights that we obtained from the Idaho Department of Water Resources restricts us to the amount of water that we can place on land for irrigation and we therefore have to follow those requirements and we are limited to a half acre of sprinkling, common lot area of sprinkling, with domestic water and as I understand it this is less than that so we don't have a problem in allowing them to sprinkle the common area with city water as far as the requirements of our water rights are concerned. Bird: Gary, what about our ordinance? Our ordinance is pretty definite that says that you will either -and there's no well fee or whatever you want to call it, it says that you either put in a well or you pay to have a well put in, no ifs and's or bat's about it or you hook up to pressurized irrigation and that's the same thing we're just talking about earlier, are we going to change every situation that comes or are we going to live by the ordinance? Smith: Welt "i don't think we have a choice, .that the ordinance requires it, unless. a variance is granted as I understand it. Bird: Okay, Gary. I don't know what awell -- Shari said a well development fee is a - a well costs us three to four hundred thousand dollars, is that what they're going to give us or what? Smith: No. Bird: i don't think so. I mean that definitely isn't what the receipt we saw was for. Smith: No, that well development fee was based on the number of homes that a wel! costing three hundred thousand would serve proportioned out on that basis. Bird: But our ordinance doesn't state that. Smith: Right. I think there are some cases where there are extraordinary circumstances that - Stipa: Can I comment on that?~ Corrie: 1t's not a public hearing. e i Meridian City Council Meeting June 15, 1999 Page 52 Stipa: I was just going to clarify what Bruce Freckleton wanted. Corrie: Gary, are you done? Smith: I guess so. Stipa: I'm Mike Stipa, the owner of the property and 1've been working with Bruce Freckleton on this and we redesigned our landscaping to a certain extent to accommodate the footages that he said that the guidelines would fall in for the area, the minimum required, and I think my footage came out around 19,500 feet and the minimums are over 20,000. He did make a request of me to put in a meter, there's six lots all together, a meter for each lot dedicated totally to the irrigation that would be separate from the rest of the buildings so basically I've tried to follow along with what he recommended and in terms of the fee I don't know if he called it a well development fee, I don't think he called it that, there was some fee per building and 1 frankly don't remember Shari what he referred to it as. Corrie: Gary, you don't know your comment on that one (inaudible} Smith: I don't. Corrie: Okay, thank you. Thank you Mike. Rountree:. Mr. Mayor, the sentence in the ordinance, one of the outs, says that if you can't do the pressurized irrigation system the requirement can be waived if they deed land for a well, drill wells, put wells on line, etc., etc., or to the subdivider deposits gives and grants sufficient #unds with the City to purchase all necessary equipment to put the well on line with the City water system. 1 suppose one could construe that direction as identifying a cost for putting a well on line or a system on line that would accommodate those number of lots and that might have been the genesis of a well development fee. I don't have a problem stretching it that way but (think we -again, we see this issue not frequently, but enough that we ought to get asub-ordinance or a clariftcation statement that what we've been doing as a result of maybe that sentence and what we've been doing is based on a formula created by Public Works and it's related to the current cost of providing domestic water. I don't have a problem with doing the well development fee but I just think that we"re kind of on thin ice in some of these things at times and I don't think the Developers do either, if they can't provide water I -what can you do? Bird: We're being so inconsistent though. I mean one time we're doing well development, next time you've got to put it in and stuff like that, the poor Developer out there he doesn't know what he's supposed to do. Bentley: I agree. • r Meridian City Council Meeting June 15, 1999 Page 53 Bird: I think we need to go through with a variance'on anything that don't go word for word with our ordinance and I have. no problem with it. Corrie: Gary? Smith: Mr. Mayor, Council members, I think there are instances where extraordinary circumstances exist and i think in those instances this so called well development fee could be and should be utilized. The impact of the pressurized irrigation is to utilize waters that are available and not let those waters pass through Meridian for downstream use but to keep them here, use them, maintain the water rights and that was the reason for the pressurized irrigation. Every once in a while we're going to run into pieces of property for one reason or another that don`t have adequate water available to them that are of such a size that it's not feasible to provide a pump system and in that case then I think this well development fee could be an alternative and I don't know if you construe the language that Councilman. Rountree read to be the well development fee, if that's an allowance without a variance I don't know -- but I think that we need to keep in our back pocket this alternative for instances where water is not available, surface water is not available, the size of the project is such that the installation of a subsurface gathering device may not be economically feasible, but again I think that needs to be proven to us by the Developer that those avenues are not available and I can remember a small subdivision off of Cherry'I_ane, I don't remember the name of it, it was a long straight street and they went out there and dug a shallow well and they put in an irrigation system because they didn't have surface water that was available on a regular basis and that was included as part of their development, so it's always possible, nothing is impossible, some of these systems may be very small, there have been individual lots in the City of Meridian that have just dug a shallow well, 10-feet or so in depth, plenty of water for sprinkling of their lot, so alternatives are available, the fee is an altemative but I think first and foremost we need. to try and utilize the waters that are available for sprinkling. and not utilize domestic drinking water for irrigation. Bird: I agree with you Gary 100% but I think we need to be very consistent on what we do. i mean, if the Developer proves he can't then we have a well development fee or whatever you want to call it. t mean, for a four or five lot subdivision it isn't feasible for him to put in a big well but I think we've just got to either _ if they can't put in pressurized irrigation or pay for a new well like our ordinance says then I think they have to go for a variance and if'one does, all does. Gigray: Mr. Mayor, point of information to the Mayor and the Council, it would be my opinion that in the variance process you're given certain flexibility but what you can grant variances and you can grant them subject to conditions and i think you've got a lot more leeway through the variance process than you do with the language of this ordinance without making the requirement of final plat the condition of the ordinance as ~ ~ Meridian City Council Meeting June~15, 1999 Page 54 b it's stated. Now we can change this ordinance if we come up with some rational to change it but you also have the variance process in there so if they need relief and they can make the basic proof would follow right in line with what Gary just mentioned then they can make that case and then you can deal-with the variance. Corrie: Any further comments? Rountree: I'm not sure you want to hear what (have to say. Corrie: Let's take a look at it. Rountree: Mr. Mayor, I think we all recognize the potential problem and possible error in our ways but it seems to me that this. particular development has gone through the process and we've all been aware of the inability to provide surface water, I'm sure by record you could see discussions from the Council as well as-the applicant as well as staff discussing well development fees or whatever those fees might be. 1 hate to see them sit yet another couple weeks to a month waiting for a subdivision final plat approval because we're learning. a lesson here. Having said that 1 would hope that we can resolve this water issue hat we've got tonight but I would recommend that based on what the applicant said tonight and the willingness to move forward with the fee that we approve the final plat and tet them move forward. In cases where the rules are not understood, please take time to explain them courteously to fellow homeowners, visitors or tenants. Each owner and resident has a vested interest in the subdivision and should, therefore, afford all areas the same pride of ownership and care as given their unit. The following rules should be observed to protect your investment. 2.1 GENERAL USE No individual unit shall be occupied and used except for residential purposes by the owners, their tenants and social guests, and no trade or business shall be conducted to therein. No tent, shack, trailer, basement, garage, out building or structure of a temporary character shall be used at any time as a residence, either temporarily or permanently. The use of any part of the property for commercial or related purposes is prohibited. 2.2 UNIT RIGHTS AND REPSON5IBII.ITIES No exterior clothes lines shall be erected or maintained and there shall be no outside laundering or drying of clothes. Further, no clothes washers, clothes dryers, water heaters, refrigerators or freezers may be kept, stored or operated on any exterior area. No power equipment, hobby shops `or car maintenance (other than emergency work) shall be permitted on the property except with prior written approval of the Board. No garbage cans, bottles, newspapers, boxes or other articles shall be placed outside for longer than 24 hours. No linens, cloths, clothing, curtains, rugs or mops shall be shaken or rung from or on any windows, doors, railings or fence. The sidewalks, entrances, driveways, stairways, and landings shall not be obstructed or used for any other purpose than entering and leaving the units. 2.3 NUISANCES No noxious, illegal, or offensive activities shall be carried on upon any unit or in any part of the property, nor shall anything be done thereon which may be or may become an annoyance or nuisance to or which may in any way interfere with the quiet enjoyment of each of the owners or his respective unit, or which shall be in any way increase the rate of • insurance for the property, or cause any insurance policy to be canceled or to cause a refusal to renew the same, or which will impair the structural integrity of any building. No person shall play upon or allow to be played any musical instrument, or operate or permit to be operated any phonograph stereo, radio, television set, or other amplified sound system in any outdoor area between the hours of 10:00 p.m. and 9:00 a.m.. No persons shall permit any party or other activity in his unit which makes or causes to make noises which might tend to unreasonably interfere with the peace and quiet of the other owners or occupants. No radio or other sound system shall be operated in any outdoor area of the subdivision except at a low sound level. No offensive noise, language or behavior is allowed. The use of fireworks, firecrackers and any type of firearms in the subdivision is strictly prohibited and is subject to formal complaint to the Police Department. 2.4 SIGNS Unless written approval is first obtained from the Board of Directors, no sign of any kind shall be displayed to public view on the building or building site on said property except one professional sign if not more than five square feet advertising the property for sale or rent. 2.5 ROOF AREA Walking or climbing on roofs, cement walls and fences is not permitted under any circumstances. No one is to go onto the roof, without the consent of the Board of Directors. 2.6 LIABILITY The Board will have no liability for damage, loss, or theft of any personal property stored on any property. Owners will be held liable for any reasonable costs incurred by the association for the repair or replacement, due to negligent or willful damage or destruction, to structures, fences, gates, landscaping, and recreational areas caused by said owner, tenant or guests. Such cost, plus possible penalty assessments will be charged back to the owners. 2.7 RECREATIONAL VEHICLES~PARKING No boats, campers, recreational vehicles, trucks, trailers and no vans in excess of eighteen feet long and or six feet, eight inches wide shall be parked or maintained within property (except for temporary loading and unloading without inconvenience to resident access). Recreational vehicles, including vans, may not be used as temporary living or sleeping quarters for residents or visitors at any time. Boats and other nonwheeled mounted vehicles may not be parked in the subdivision at any time. The maximum speed limit is 10 mph on any subdivision driveway. Owners of illegally parked vehicles are subject to penalty assessments and possible tow away at the owners expense for repeated violations. Vehicles cited for any violation are ~~1 ~~ automatically checked through the Department of Motor Vehicles for ownership and address. To assure maximum use of the limited parking, residents must park their vehicles in a manner that does not waste a. possible parking space for another vehicle. No vehicle shall be parked in such a manner as to impede or prevent ready access to any entrance to or exit from a building. Offensive vehicular noise such as loud radios, undue use of horn, squealing tires or brakes, etc., is strictly prohibited. Vehicles should be equipped with mufflers in a good working order to prevent excessive noise and annoying exhaust fumes. 2.8 PETS No animals, birds, insects or livestock shall be kept on said property except domesticated dogs, cats or other common household pets which do not unreasonably bother or constitute a nuisance to others and on such portion of roads and other public ways or easements as may be designated or permitted for such use from time to time. No dogs or cats in excess of two shall be kept by any residential household within said subdivision, and no animals of any kind shall be bred or kept for commercial purposes. All dogs must be leashed when outside a dwelling unit, and shall not be allowed in the common area or kenneled outside the dwelling units. .0 COMMON AREAS 3.1 PATIOS The hanging of laundry, towels, rugs, ladders or other unsightly items over balcony railings or patios is prohibited. Placing any items as to extend beyond a balcony or patio is prohibited and any hanging plants or other decorations from patios must be securely fastened. The storage of gasoline and other flammable fluids, explosives, fireworks, etc., anywhere on the property is prohibited. No wire screening, plastic, wood or other material may be placed on exterior of units -for the retention of any pets. Debris of any kind is not to be discarded on the landscape. Any debris must be swept or picked up and disposed of properly. No articles of any type are permitted to be thrown from any balcony or patio area. 4 0 COMPLAINT AND RULE ENFORCEMENT PROCEDURE A complaint or grievance is an alleged violation, misunderstanding, misinterpretation or inequitable application of these documents and or rules and regulations guidelines. A violation is a failure of an individual to observe these documents and the subdivision Board. This can range in severity from the inconsiderate act of individual, to acts which endanger the health and safety of the community. Any violation disrupts the harmony of the community and must be addressed with wisdom, patience, and determination. The complaint procedure may be employed after attempts made to resolve a deemed violation have been unsuccessful. "Neighborhood complaints" i.e., undue noise, barking dogs, etc., should be settled between the parties involved. All efforts should be exercised to resolve the difficulty at this level. If the complaint cannot be resolved in this manner it • may then be referred to local enforcement agencies. Any resident should report a violation or infraction to member of the Board by a written report of the facts. A signed and dated letter should be submitted which comprehensively lays out the basis of the complaint and provides the information of when, where, who, what, and how the violation occurred. No enforcement procedure will be initiated without a signed written complaint. An owner is strictly liable for violations of these rules by his or her quests or tenants. Where a tenant or occupant is in violation of a rule the owner will be served notice and have the responsibility ger subsequent action as outlined hereafter. When the complaint is valid a formal complaint letter will be sent to the offending owner of record at his or her last known address. This letter will state the nature of the offense, the deadline for correction and date of the Board meeting at which the complaint will be heard. All complaints will be heard at the next regularly scheduled Board meeting if the offending owner has received at least ten (10} days prior notice of the hearing, if the offending owner has not received ten (10) days prior notice, the complaint will be heard at the second Board meeting following the date of the notice letter. Upon written request of either party to the grievance, the Board may conduct a special hearing to review and act upon the complaint. If the offending owner has corrected the violation, the Board will impose no penalty and will close that complaint. If the violation has continued, the Board will determine a sanction that is appropriate for the violation. Should the offending owner not appear at the hearing, the Board may make a determination on the matter in his or her absence. Any such determination would be binding. The decision of the Board will be final except in any manner when an applicable State Code allows recourse by another authority. Notice of the Board action will be sent to the owner of record or their designated agent at his or her last known address. Tenants and guests are bound by the documents and rules and regulations of this association. Owners and tenants are held responsible and liable at all times for the action and conduct of their family and guests while on community property. All tenants and guest violations will be cited against the homeowner. A copy of the violation will be sent to the tenant also. The owner will be held liable for payment of any penalty assessment levied for his tenant or guest violation, as well as reasonable costs, if applicable, incurred by the association for the repair or replacement of any damage caused to community. The Board of Directors has at its disposal, several enforcement alternatives ranging from a simple oral warning to legal action. In general, the alternatives fall into the following categories, but are not limited to: a. Oral and or written warning. b. Suspension of a member right to vote. c. Penalty assessment. • d. Late charges on assessments. e. Lien and foreclosure against an owners unit. f. Court injunctions g. Notification of violation of City, County and State Codes and/or laws to the appropriate police and or regulatory agency. In cases of damage to subdivision property, a penalty assessment will be levied against an owner in addition to recovery of reasonable costs incurred by the Board for the repair or replacement of damage caused to other owner's property by said owner, tenant or guest. If there is a violation of architectural standards, a penalty assessment maya be levied, or a court injunction instituted, against any owner who undertakes improvement or alterations or a unit which might effect the architectural integrity or accepted standards of the community without prior Board approval. If the violation endangers the health or safety of the community, the Board can take immediate action to ensure the health and or safety of the community, including making a report with the Police Department or seeking court injunctions as legal restraint. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: GENERAL REQUIREMENTS 1. Any existing irrigation/drainage ditches crossing the property to be included in this project shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 11-9-606.B. 4. Coordinate .fire hydrant placement with the City of Meridian's Water Works Superintendent. SITE SPECIFIC REQUIREMENTS 1. Applicant is to meet all terms of the approved preliminary plat and conditional use permit. 2. Sanitary sewer service to this site is proposed to be extended into the subject site from W. Minimum cover over sanitary sewer mainlines is three feet (finish grade to top of pipe.) In all cases where there is less than three feet of cover from sub-grade to top of pipe, ASTM D-2241, Class 200 pipe will be required. Applicant will be responsible to construct the sewer main through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. 3. Applicant will be responsible to construct the water system improvements to and through this proposed development. Subdivision designer to coordinate sizing and routing with the Public Works Department. 4. Provide letter from Meridian Fire Department approving turnaround configuration prior to signature on the final plat. 5. Developer has supplied evidence that adequate surface water supply is not available to this site. Permanent perimeter fencing is required to be in place along the exterior subdivision boundary prior to obtaining building permits, unless expressly waived in writing by the Planning & Zoning Administrator.
