A notice of a public hearing on the conditional use permit vas published for two (2) consecutive weeks prior to the said public hearing scheduled for October 5, 1999, before the City Council, the first publication appearing and written notice having been mailed to property owners or purchasers of record within three hundred (300') feet of the external boundaries of the property under consideration more than fifteen (15) days prior to said hearing and with the notice of public hearings having been posted upon the property under consideration more than one week before said hearing and the copies of all notices were made available to newspaper, radio and television stations as public service announcements; and the matter having been duly considered by the City Council at the said October 5, 1999, public hearing; and the Applicant, affected property owners, and government subdivisions providing services within the planning jurisdiction of the City of Meridian, having been given full opportunity to express comments and submit evidence. 2. There has been compliance with all notice and hearing requirements set forth in Idaho Code §§67-6509 and 67-6512; and §§11-2-416E and 11-2-418E as evidenced by the Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with the staff report. Council takes judicial notice of its Zoning, Subdivision and Development Ordinances codified at Title 11 Municipal Code of the City of Meridian and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian adopted December 21, 1993 Ordinance #629 -January 4, 1994 and Maps and the Ordinance establishing the Impact Area Boundary Ordinance and Map. The property is located on the corner of Gentry Way and Allen Street, Meridian, Idaho. 4. The property is located at Lot 15 of Magic Eye Subdivision, Meridian, Idaho. 5. The owners of record of the subject property are John R. Sonntag and Alberta Sonntag, husband and wife, of 3373 N. Tumbleweed, Boise, Idaho. 6. The General Retail and Service Commercial (C-G) zoning designation within-the City of Meridian Zoning and Development Ordinance requires a conditional use permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-2-409B). 9. That the Applicant, Sonntag Eye Associates or Assigns, and John R. Giving due consideration to the comments received from the governmental subdivisions providing services in the City of Meridian planning jurisdiction,; public facilities and services required by the proposed development will not impose expense upon the public if the following conditions of development are imposed and the following is also found to be required to mitigate the effects of the proposed use and development upon services delivered by political subdivisions providing services to the subject real property within the planning jurisdiction of the City of Meridian. 11.A Conditions requested by the City of Meridian Planning and Zoning Administrator and Assistant City Engineer within their Memorandum dated August 30, 1999, be required as follows: Adopt the Meridian Fire Department's Recommendations as follows: FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS SONNTAG EYE ASSOCIATES /MEDICAL OFFICE BUILDING AND OUTPATIENT SURGERY FACILITY - 6 • 11.1 Applicant shall satisfy all fire code requirements including those pertaining to water flow and fire hydrants. Adopt the Central District Health Department's Recommendations as follows: 11.2 Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 11.3 The Engineers and architects involved with the design of the subject project shall obtain current best management practices for stormwater disposal and design a storm~vater management system that prevents groundwater and surface water degradation. Adopt the Nampa & Meridian Irrigation District Recommendations as follows: 11.4 Applicant shall submit a Land Use ChangeJSite Development application for review prior to final platting. 11.5 Requires all laterals and wasteways be protected. 11.6 All municipal surface drainage shall be retained on site. If any surface drainage leaves the site, the Nampa Si Meridian Irrigation District must review drainage plans. 11.7 Applicant must comply with Idaho Code 31-3805. Adopt the Planning and Zoning Administrator and Assistant City Engineer Recommendations as follows: 11.8 Off-street parking shall be provided in .accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance and/or as detailed in site-specific requirements. 11.9 Paving and striping shall be in accordance with the standards set forth in Sections 11-2-414.D.4 and 11-2-414.D.5 of the City of Meridian FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS SONNTAG EYE ASSOCIATES /MEDICAL OFFICE BUILDING AND OUTPATIENT SURGERY FACILITY - 7 • • Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 11.10 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 11.11 Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-414.D.3. 11.12 All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. 11.13 Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil conditions as prepared by a soil scientist with the design of site drainage plan. 11.14 Provide sidewalks in accordance with City Ordinance Section 11-9- 606.B. 11.15 All construction shall conform to the requirements of the Americans with Disabilities Act. 11.16 Applicant will be responsible for construction of the water mains to and through this proposed development. Project designer to coordinate main sizing and routing with the Public Works Department. Applicant shall provide the Public Works Department with information on anticipated fire flow and domestic water requirements for the proposed site. Water service to this development is contingent upon positive results from a hydraulic analysis by our computer model. Flow and pressure from the existing mains should be monitored with the Meridian Water Department. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS SONNTAG EYE ASSOCIATES /MEDICAL OFFICE BUILDING AND OUTPATIENT SURGERY FACILITY - 8 • 11.17 Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. In addition to these assessments, water and sewer "Late Comers" fees will also be charged against this parcel to help reimburse the parties responsible for installing the water and sewer mains to their current points. 11.18 Underground pressurized irrigation must be provided to all landscape areas on site. Applicant shall submit hook-up and design details based on the proposed landscaping. Due to the landscape area, primary water supply connection to the City's mains will not be allowed. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 11.19 Applicant is proposing a six (6) foot landscape strip adjacent to Freeway Drive. 1-84 is identified as an entryway corridor in the Comprehensive Plan, which requires athirty-five foot (35') landscape strip beyond the required right-of-way. While this parcel does not have direct frontage on 1-84, it is highly visible from the Eagle Road off-ramp and 1-84 west-bound traffic and functions as an entryway for Meridian. Staff recommend the applicant approach ITD to investigate the potential for a license agreement to landscape within the 1-84 right-of-way between Freeway Drive and the north 1-84 boundary to meet the 35-foot buffer requirement. 11.20 Applicant shall install aten-foot (10') landscape strip along the Allen Street frontage. 11.21 Applicant shall coordinate screened trash enclosure locations and construction requirements with Sanitary Service Company and provide a letter of approval from their office prior to applying for building permits. All trash areas are to be enclosed by a screening fence on three (3) sides. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS SONNTAG EYE ASSOCIATES /MEDICAL OFFICE BUILDING AND OUTPATIENT SURGERY FACILITY - 9 • r 11.22 Handicap parking, associated signage and building construction shall meet the requirements of the Americans with Disabilities Act. A total of six (6)handicap-accessible stalls are required and six (6) are shown. However, given the medical office use and anticipated clientele, staff encourages the addition of at least- three (3) handicap parking stalls. 11.23 No signage has been proposed and none is approved with this application. All signage will be subject to design review and requires separate permits. 11.24 Six-foot-high, permanent perimeter fencing shall be provided adjacent to the existing residential and agricultural use along the west boundary line. 11.25 This conditional use permit shall be subject to review upon ten (10) days notice to the applicant. Transfer of-the conditional use permit will need to be submitted and approved by the Zoning Administrator for any new owners/tenants. 11.26 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 1 1-9- 605.M. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 11.27 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. Additionally, the Planning and Zoning Commission requires: 11.28 No building permit will issue until all sewer and water are operational and approved by the appropriate authorities. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS SONNTAG EYE ASSOCIATES /MEDICAL OFFICE BUILDING AND OUTPATIENT SURGERY FACILITY - 10 • • 11.29 A minimum 19-foot landscape buffer is required along future Freeway Drive with extra planning for additional buffering. 11.30 The applicant shall switch from alift station/sewer ejector to a gravity fed sewer system when the lines become available. Further the applicant shall coordinate with Meridian City staff on placement of future lines. (The Meridian Planning and Zoning Commission's approval of this application is based on the new updated site plan submitted for the public hearing on August 31, 1999 and not the original submission to the City of Meridian on June 30, 1999.) 12. The proposed uses within the subject application will be harmonious with and in accordance with the Meridian Comprehensive Plan and the City of Meridian Zoning and Development Ordinance. 13. The uses proposed within the subject application will be subject to the conditions set forth in Finding of Fact no. 11 and will be designed, constructed, operated and maintained to be harmonious and appropriate in appearance or intended character of the general vicinity and that such uses will not change the intended essential character of the same area. 14. The uses proposed within the subject application will not be hazardous or disturbing to existing or future neighboring uses. 15. The applicant has agreed to pay any additional sewer, water or trash fees or charges, if any associated with the use. 17. The uses proposed within the subject application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors. 18. The development will not result in the destruction, loss or damage of natural or scenic feature of major importance relating to the property. CONCLUSIONS OF LAW 1. Idaho Code § 67-6512 provides in part that: (A) As part of a zoning ordinance the City Council may provide for the processing of applications for special or conditional use permits; and (B) That a special use permit may be granted to an applicant if the proposed use is otherwise prohibited by the terms of the zoning ordinance, but may be allowed with conditions under specific provisions of the zoning ordinance, subject to the ability of political subdivisions, including school districts, to provide services for the proposed use, and when it is not in conflict with the plan; and FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER GRANTING CONDITIONAL USE PERMIT SUBJECT TO CONDITIONS SONNTAG EYE ASSOCIATES /MEDICAL OFFICE BUILDING AND OUTPATIENT SURGERY FACILITY - 12 • • (C) That upon the granting of a special use permit, conditions may be attached to a special use permit, including, but not limited to, those: 1) Minimizing adverse impact on other development; 2) Controlling the sequence and timing of development; 3) Controlling the duration of development; 4) Assuring that development is maintained properly; 5) Designating the exact location and nature of development; requiring the provision for on-site or off-site public facilities or services; requiring more restrictive standards than those generally required in an ordinance; requiring mitigation of effects of the proposed development upon service delivery by any political subdivision, including school districts, providing services within the planning jurisdiction. 2. The City of Meridian has exercised its authority to provide for the processing of applications for Conditional Use Permits by the enactment of § 11-2-418 Municipal Code. 3. Idaho Code § 67-6504 provides that the City Council may exercise all of the powers required and authorized by Chapter 65 of Title 67 Idaho Code which Act is known as the "Local Land Use Planning Act of 1975." 4. The City of Meridian has enacted the Comprehensive Plan City of Meridian adopted December 21, 1993, Ordinance No. 629, January 4, 1994. All construction shall conform to the requirements of the Americans with Disabilities Act. 2.16 Applicant will be responsible for construction of the water mains to and through this proposed development. Project designer to coordinate main sizing and routing with the Public Works Department. Applicant shall provide the Public Works Department with information on anticipated fire flow and domestic water requirements for the proposed site. Water service to this development is contingent upon positive results from a hydraulic analysis by our computer model. Flow and pressure from the existing mains should be monitored with the Meridian Water Department. In addition to these assessments, water and sewer "Late Comers" fees will also be charged against this parcel to help reimburse the parties responsible for installing the water and sewer mains to their current points. 2.18 Underground pressurized irrigation must be provided to all landscape areas on site. Applicant shall submit hook-up and design details based on the proposed landscaping. Due to the landscape area, primary water. supply connection to the City's mains will not be ,allowed. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 2.19 Applicant is proposing a six (6) foot landscape strip adjacent to Freeway Drive. 1-84 is identified as an entryway corridor in the Comprehensive Plan, which requires athirty-five foot (35') landscape strip beyond the required right-of--way. While this parcel does not have direct frontage on 1- 84, it is highly visible from the Eagle Road off-ramp and 1-84 west-bound traffic and functions as an entryway for Meridian. The applicant shall approach ITD to investigate the potential for a license agreement to landscape within the 1-84 right-of-way between Freeway Drive and the north 1-84 boundary to meet the 35-foot buffer requirement, and will install a 35 foot strip if an agreement with ITD can be met. 2.20 Applicant shall install aten-foot (10') landscape strip along the Allen Street frontage. 2.21 Applicant shall coordinate screened trash enclosure locations and construction requirements with Sanitary Service Company and provide a letter of approval from their office prior to applying for building permits. All trash areas are to be enclosed by a screening fence on three (3) sides. 2.22 Handicap parking, associated signage and building construction shall meet the requirements of the Americans with Disabilities Act. A total of six (6) handicap-accessible stalls are required and six (6) are shown. Transfer of the conditional use permit will need to be submitted and approved by the Zoning Administrator for any new owners/tenants. 2.26 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 1 1-9-605.M. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. 2.27 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. We agree with the Facts and Findings as far as I know. The question of phasing which came up, it was my understanding that we were going to be required to develop the perimeter ~ • Meridian City Council Meeting October 5, 1999 Page 40 landscaping and along the street and also the landscaping that would be adjacent to Phase I. We were planning on doing the rest of the landscape and curb improvements in the interior of the site later on during Phase II, and that would include the landscape which is associated with the Phase II and III portions of the building. This probably is a moot point; it's looking more and more like this entire project is going to be completed as one phase. I guess the only other thing that I need to address came up in an earlier item, and that's the development of the water and sewer lines on Allen Street. We are certainly not opposed to agreeing in a similar way to holding off on a building permit until those items are resolved. And from what I heard, what it sounds like, the City can go ahead and take ownership of those lines and testing will be happening in the dear future; am I correct? Or am I assuming too much? Corrie: That's a big assumption. We'll have Gary answer that one when you're through. Freeman: Okay. Unless there are questions of me, I don't think there's anything else that I need to say. Staff has selected the following sections that most directly apply to the proposed project for the Council and Commission's consideration during the hearing process. The subject property is located in an area designated asMixed/Planned Use Development in the Meridian Comprehensive Plan. Eagle Road from the St. Luke's West site, and south of the recently approved Midvalley Business Park (Hubble Engineering). The legal description for annexation (revised copy submitted August 5, 1999 by PLS, doesn't appear to place the subject site contiguous to the Corporate City Limits of Meridian (Ordinance 661 & 665). Please subnut a revised legal description prepared by a Registered Land Surveyor, Licensed by the State of Idaho, and conforming to all the provisions of the City of Meridian Resolution No. 158. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non- domestic purposes such as landscape irrigation. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. SITE SPECIFIC COMMENTS: 1. Applicant shall be required to dedicate all right-of--way along Allen Street and Freeway Drive as required by ACRD prior to any building permits being issued for this property. 2. Applicant shall be required to enter into a Development Agreement with the City as a condition of annexation. The Development Agreement shall specify minimum required landscape strip widths (as negotiated between applicant and City of Meridian) along the west, south and east boundaries of property. Paving and striping shall be in accordance with the standards set forth in Sections 11-2-414.D.4 and 11-2-414.D.5 of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 3. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. 4. Outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-414.D.3. All signage shall be in accordance with the standards set forth in Section 11-2-415 of the City of Meridian Zoning and Development Ordinance. 6. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil conditions as prepared by a soil scientist with the design of site drainage plan. 7. Provide sidewalks in accordance with City Ordinance Section 11-9-606.B. All construction shall conform to the requirements of the Americans with Disabilities Act. SITE SPECIFIC COMMENTS: 1. The developer of the Holiday Inn Express on the east side of the subject site, has installed sewer and water mains in Allen Street as part of his project. These mains have not received final inspection, nor have they been approved by the Public Works Department for ownership and maintenance. It is unclear when or whether these mains will be accepted by the City. This is very important to the serviceability of this project. 2. Water service to the proposed site could be to the existing water line mentioned above. Applicant will be responsible to construct the water mains to and through this proposed development. Project designer to coordinate main sizing and routing with the Public Works Department. Please provide the Public works department with information on anticipated fire flow and domestic water requirements for the proposed site. Flow and pressure from the existing mains should be monitored with the Meridian Water Department. 3. Applicants azchitect has indicated on the site plans that the sanitary sewer service shall be accommodated via a pressure line. Further design investigation needs to be performed to determine the serviceability of the site via gravity sewer mains.. 4. Assessment fees for water and sewer service are determined during the building plan review process. Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. In addition to these assessments, water and sewer "Late Comers" fees will also be charged against this parcel to help reimburse the parties responsible for installing the water and sewer mains to their current points. 5. Underground pressurized irrigation must be provided to all landscape areas on site. Please submit hook-up and design details based on the proposed landscaping. Due to the landscape azea, primary water supply connection to the City's mains will not be allowed. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 6. The southwest drive entrance width off Freeway Drive is currently shown as twenty feet (20'). City ordinance requires minimum of twenty-five foot (25') drive aisles. Plan must be modified. 7. Applicant is proposing a six (6) foot landscape strip adjacent to Freeway Drive. I-84 is identified as an entryway corridor in the Comprehensive Plan, which requires athirty-five foot (35') landscape strip beyond the required right-of--way. While this parcel does not have direct frontage on I-84, it is highly visible from the Eagle Road off-ramp and I-84 west-bound traffic and functions as an entryway for Meridian. Staffrecommend the applicant approach ITD to investigate the potential for a license agreement to landscape within the I-84 right-of--way between Freeway Drive and the north I-84 boundary to meet the 35-foot buffer requirement. 8. Applicant is proposing a four (4) foot landscape strip adjacent to Allen Street. As the primary entrance to the facility, staff consider this width to be inadequate. Midvalley Business Pazk/Hubble Engineering is immediately adjacent to the north and is providing a tapered landscape strip -ranging from 8 feet on the north to 16-feet on the south immediately abutting Sontag's property. Staff recommend a minimum ten-foot (10') landscape strip along the Allen Street frontage. 9. The north boundary line of subject property and the south boundary of Midvalley Business Pazk are common. While this parcel does not have direct frontage on 1-84, it is highly visible from the Eagle Road off-ramp and 1-84 west- boundtraffic and functions as an entryway for Meridian. Now I know why Tom is here. Okay. I'll open the public hearing. Mr. Bentley. Bentley: Would we want to open both public hearings? Corrie: Well, let's just do one at a time, we got annexation and then we can go to the conditional use permit. Or we can open both of them if you want. Okay. We can open them both since we're all - Bentley: We usually wind up with testimony going both ways. Corrie: I'll open the public hearing on both 18 and 19 (inaudible) Sonntag Eye Association. Number 18 is annexation and zoning and the 19 is a request for conditional use permit. So is your testimony on both of those, that would be fine. Staff comments? Stiles: Mr. Mayor and Council, this is for the property on Allen Street that was discussed earlier. It's located south of Hubble Engineers' property, just west of the Holiday Inn Express and kitty-corner from the Eagle Road Professional Center. We'd ask that our comments be incorporated into your approval. We've asked for additional landscaping along what would be a frontage road, it's called Freeway Drive, I guess, tentatively, that would extend somewhere in this area. The site plan didn't show up very well. This is the site plan. They had proposed phasing some of the improvements, and we'd ask that if they phased the buildings that they include all of the landscaping and • • Meridian City Council Meeting October 5, 1999 Page 2 any of the associated parking and other on-site improvements, on- and off-site improvements prior to the occupancy of the initial phase. This is a public hearing, and I'll invite the applicant or representative there to talk: Would you please state your name and address, please. Freeman: My name is Scott Freeman. I live at 3625 Barry ,Drive in Boise. Although I don't believe I have a copy of the latest Facts and Findings, I assume that they're substantially the same as those that I saw prior to the previous hearing. We agree with the Facts and Findings as far as I know. The question of phasing which came up, it was my understanding that we were going to be required to develop the perimeter landscaping and along the street and also the landscaping that would be adjacent to Phase I. We were planning on doing the rest of the landscape and curb improvements in the interior of the site later on during Phase II, and that would include the landscape which is associated with the Phase II and III portions of the building. This probably is a moot point; it's looking more and more like this entire project is going to be completed as one phase. I guess the only other thing that I need to address came up ih~ an earlier item, and that's the development of the water and sewer lines on Allen Street. We are certainly not opposed to agreeing in a similar way to holding. off on a building permit until those items are resolved. And from what I heard, what it sounds like, the City can go ahead and take ownership of those lines and testing will be happening in the near future; am I correct? Or am I assuming too much? Corrie: That's a big assumption. We'll have Gary answer that one when you're through. Freeman: Okay. Unless there are questions of me, I don't think there's anything else that I need to say. Corrie: Gary. Smith: Mr. Mayor, Council members, as I understand, what Eric Rossmar~ has. said earlier is that we wouldn't have a problontractor to clomehback and f n sh the jobenNow been filed. Freeman: And that is something, if I can address that, that is something that we and the other adjacent property owners are working on at this time. Staff would request that all of our comments dated in our memo of August 30, 1999 be incorporated into those findings. Corrie: Do the applicants have this - Bird: Mr. Mayor, does the applicants have this - Corrie: I don't think they do. Do you not? Bird: Of the August 30, 1999? Stiles: Yes. Bird: You don't have that? The staff comments? Freeman: We received staff comments prior to the P & Z hearing. If there have - I know there were going to be additional comments incorporated, but I haven't seen the final version. Bird: Have you seen these? The way you were talking, I didn't think you probably had. Corrie: I have a fax sheet that was sent over the 8/30/99. Did you get - Bird: You have not received this? What's this fax sheet then? I can't - I looked at that fax sheet. Was it -City of Meridian? Corrie: There's six sheets. Bird: -- Freeman. It could be it happened, it just never crossed my desk. Freeman: I think I can make this really brief. There are a couple of items on here that were discussed during the P & Z hearing, and I did not see any additional comments that addressed them as we discussed them. Item No. 3 which has to do with the sanitary sewer service. We had demonstrated during the P & Z hearing that due to topography, a lift station was, in fact, necessary; however, we did agree to stub out a sewer line from our building southward so, in the event in the future a sewer main was brought up to future Freeway Drive on the south side of our property, we could ~~~en use • • Meridian City Council Meeting October 5, 1999 Page 5 that for our sewer and eliminate the lift station. One other comment has to do with Item No. 7 which is requires 35-foot landscaping buffer along future Freeway Drive. That also relates to the recommendation to City Council, Page 5, Item 1.4 in the recommendations which says that we will negotiate with the City of Meridian for a certain width along future Freeway Drive. What we had agreed to, I believe, in our discussions at the P & Z hearing was that we would provide - I need this back, don't I - we would provide a minimum 19-foot wide landscape strip along future Freeway Drive. I didn't see that specifically addressed in these comments. And that's all. Corrie: Okay. What was the first one, sir? Freeman: The first one had to do with the sewer line. They were asking that we look further into agravity-feed sewer line to the street. We had demonstrated during that hearing that that was not possible at this time because of the topography of the site. Corrie: Okay. Staff comments? Stiles: I wasn't clear on the 19-foot -was that going to be south of Freeway Drive or north of Freeway Drive? Freeman: That's north of Freeway Drive along our property. Stiles: So where this existing landscape is here, that would be increased to 19 feet? Freeman: Correct. I had submitted a revised site plan at the time of the last hearing that had taken that corner access out per ACHD's recommendations and added landscape buffer to that south side. That was going to be included, I believe, in the recommendations, but I see that the original site plan is attached here right now. Stiles: I don't have a copy of a revised site plan in my file. Does anybody up there have one? Freeman: I had distributed one to all of the members of the P & Z Council. No? Bentley: We're not (inaudible) P & Z. Rossman: Mr. Mayor, I would assume that if it was passed out at the P & Z hearing that it would have been made a part of the record, so there should be some indication in the Clerk's record of a revised site plan. Freeman: I could attempt to describe those changes. It's relatively simple on the map on the screen if that helps. • • Meridian City Council Meeting October 5, 1999 Page 6 Corrie: Shari, is that going to help you if he does that, or will we still need that revised plan? We don't have it. Do you have it? Stiles: I would like to have a plan to know what we're approving when we see a site plan come in. Corrie: Is that it, Will? Is that the one? Freeman: That appears to be it. You'll know if the elimination of the access on the corner there between Allen Street and future Freeway Drive and also the increased landscape width. And what we had discussed, and what was going to become, according to my understanding, part of the recommendations was that we provide minimum 19 feet along future Freeway Drive. (inaudible discussion) Corrie: We better send it over and let Shari look at it. Bentley: Shari -show her that. Bird: We got it. Isn't it on the back of that packet? Bentley: It's on the back page. Nineteen. Bird: I knew I'd seen that when I seen it. Bentley: Dated August (inaudible). Bird: Don't I have it on mine? Corrie: August 31St date - Stiles: Has a scaled copy been provided to anybody? That's not scaled. Bird: It's on our conditional use, yeah. Corrie: But it's not to scale. I just need to turn it in. Corrie: Would that suffice or do you still want to hold it? Stiles: Steve has told me that the 19-foot requirement was placed on the project after that site plan was submitted, so we haven't seen a revised site plan that shows that. I would like to see one that we can put a scale to and make sure that the driveways meet ordinance requirements and the parking stalls meet ordinance requirements after that 19-foot is taken out. It's pretty tight the way it is right now, so I don't know - Freeman: Well, we discovered that we actually - supposedly ACHD is going to take the right-of--way off of the center line of what the paved portion of future Freeway Drive is. We discovered that we actually had more land on our property than we originally had thought. So we were able to provide 19 more feet along the south side. Stiles: If they can meet all the conditions of approval, I don't have a particular problem. I would like them to submit a plan so we can guarantee that. Freeman: Yeah. It's not a problem. Freeman: No. I do have some drawings available of the elevations and some renderings if you are interested in viewing those, but I don't have any additional comments unless there questions I can answer. Meridian Planning an~ning Commission Special Meeting August 31, 1999 Page 35 Borup: I think we've got copies of those. Would you like to incorporate your previous comments and testimony into this item. Freeman: Yes. Borup: Commissioner's, any questions for Mr. Freeman? We do have the elevations and I think we have covered the landscaping aspect. Don't know if there is any comments or questions on the building itself. De Weerd: Is this a phased in project. Freeman: Yes. We are planning to phase the construction. De Weerd: In what manner. Freeman: I'll describe that to you. The first phase of construction will include the one story wing in this area. Phase 2 which will be a separate construction package will include the remainder --the two story portion to the south. Hatcher: The approximate time frame between Phase 1 and 2. Freeman: It could be that the Phases will be transparent when you visit the site. That is our hope at this time. Ron do you have any comments on what the maximum length might be? Any where from zero to 4 months. Most likely it is going to continue right on. Barbeiro: So, based upon your discussion on the schedule, the entire project would still be completed within 12 months. Freeman: Yes. De Weerd: This is a entry way corridor and the 35 feet of landscape along the entry there I guess is of particular interest to me and I wondered why, when you went back to the drawing board you could only get 19 feet. Freeman: Well, most of that has to do with the required parking. We do have some additional parking over what would be required for a facility of this size. We need some parking along that south property line in order to meet the minimum. That is the reason for not increasing it the full 35 because we would effectively eliminated the entire line of parking. Borup: Do you know what the distance is from your property to the freeway. Freeman: No, I don't. Meridian Planning an~ning Commission Special Meeting August 31, 1999 Page 36 Hatcher: Mr. Chairman, can we get further clarification from staff on a earlier discussion about landscaping between future Freeway Drive and ITD land. I was kind of unclear as to what you were talking about there. Siddoway: Commissioner Hatcher, that the references if you view along the south boundary this project they if their property line Freeway Drive and then continuing south is 184's right of way and there is a strip. Unfortunately we don't have a rendering of it or a map, but there is a strip of land. I don't know the width, between the off ramp from Eagle Road onto 184, which actually 184-this project immediately to the south is not 184 itself. It is the off ramp. That strip of land there again that was simply a suggestion. I don't believe it has been done before in the city. There are agreements with ACHD to landscape and their right of way through license agreements and that was simple a suggestion there. I think probably if you view the elevations, it is a very attractive building. Certainly the goal is not to hinder view of the building itself. I think one of the issues is sound. Of course one thing that has not been talked about is a berm. 19 feet. Our landscape architect would have to answer. You probably could not get that tall of a berm in 19 feet, but some kind of a berm may provide some of that esthetic effect that would be lost if the full 35 feel wasn't granted. Borup: (inaudible) concern-a lot of concern just that the on going weed patch along the off ramp-or on ramp. Is that a lot of what you are trying to address. Siddoway: Mainly trying to address consistency in projects along entry way corridors. That is what the Comprehensive Plan calls for is 35 feet and there is little bit of a judgement call as to whether this would fall into entry way. 184 is -but that is really the goal to get consistency from project to project in terms of the width. De Weerd: Mr. Chairman I have a question for Steve. Can they get the same visual effects with 19 feet with a berm defect. Siddoway: Yes, if it was the-if the amount of landscaping was increased in terms of the shrubbery and trees. I know that there is an easement 10 feet along future Freeway Drive that would restrict any planting within that first 10 feet. But now that they have increased that to 19 feet, there would be room beyond that initial 10 feet to plant trees. A 19 foot easement with a 3 to 1 maximum slope-you could not get any higher than 3 feet with a berm. A 3 foot berm with trees and additional landscaping could be very nice. De Weerd: Now clarify that. As far as the right of way and the additional 10 feet-I'm sorry, you lost me on that one. Siddoway: It is my understanding that a long future Freeway Drive the first 10 feet into the property is covered by a utility easement that they could not plant trees in. So if this is 19 feet, they now have an additional 9 feet beyond that 10 foot easement that they could plant trees in. They could berm with a 3 foot high berm and a 3 to 1 slope within Meridian Planning an~ning Commission Special Meeting August 31, 1999 Page 37 the 19 feet and provide trees that were planted at least 10 foot back from the property line. De Weerd: And your suggestion would be that they could add some additional plantings in there? Siddoway: Certainly. Trees, if I were making a recommendation I'd say trees, at least 35 feet on center with the addition of shrubbery on the ground plane would really dress that up. Borup: Steve, does anyone-you or maybe Mr. Freeman elevation differs between that strip and the off ramp on ramp. Siddoway: I do not know. Borup: If there is an elevation difference in my mind I wonder how much more a berm would add if your all ready looking at it anyway. Siddoway: I am getting an indication from the audience that it is lower on the ramp then along that drive there. Borup: So in that situation would a berm add as much as the planting themselves would? Siddoway: I would say yes because you could actually see some of the landscaping that is there. You will see more of it with the berm. Borup: Any other questions? Thank you Mr. Freeman. Did you have any other comments. Freeman: It seems to be that a low berm would be more in line with what we were intending to do anyway. It is not a building that we intend to hide from the freeway entirely. We did make an attempt to make it an attractive building an addition to the community. It doesn't sound like the intent here with the landscape berm is to hide the building. I think a 3 foot landscape berm might actually help hide some vehicles along that first front row but it doesn't sound like it would block views of the building. Nor is the recommended tree planting if there indeed going to be 35 feet on center. De Weerd: No and I don't think that is the intention. It is just the visual effect with a landscape strip and the softening-not to hide your building. It is a nice looking building. Borup: Anyone else wish to address the Commission this evening? Come on up. Willis: Thora Willis, 3555 Montvue Drive. I have some questions that probably all of you know, but since we don't have that information-I would like to see the site map for Meridian Planning an~ning Commission Special Meeting August 31, 1999 Page 38 a few minutes-that has the streets and how it fits on the streets just for a few minutes and - Borup: You mean the other lots around it? Willis: Yeah. The other lots. Do we know how many marking spaces are for physicians or staff. What is reserved for staff, what is reserved for physicians and what is reserved for patients. How many out patient suites are there-either operating suites-how many doctors are we talking about in this building. The neighbors-from 184 to Magic View-is that the 10 feet or is it at the RT going toward Allen. Are they building it up to 10 feet. Are those neighbors going to be looking at a mountain of dirt and building. Borup: Well, it is not going to built up 10 feet. They said if they gravity feed they would have to. They are trying to accommodate the site. Willis: It is a sloped site. Okay. Can somebody answer those other questions forme. Borup: Okay Mr. Freeman or is there someone else that would answer that better. I think the first question was on parking. You made mention that you had additional beyond requirement, but could you explain. Freeman: I going to put this overhead back up to help explain. As you can see the building configurations separates the parking into 3 sections. This section back here in the northwest corner is really what we intend to designate as employee and staff parking. I don't have the numbers on this one. I think staff may have a copy that does have the numbers on it. That is probably 70 spaces back there, approximate)}~. The comment about building up the site, as was explained by the Commissioner, we do not intend to build up the site at all. We are actually going to recess this building somewhat down from street level along the east property line. Most of the building is going to be medical office space. The exact number of tenants that are going to be in there, I can't tell precisely but I can explain what I do know. This single story wing will have one medical tenant in it with a couple of operating rooms. The two story section there are to pods of 2 stories. The ground floor on the western pod will be dedicated to an operating room facility and the remaining 3 floors, both the upper here on the west and both floors on the east, will be given to doctor's offices. The number of doctors in there could range from 1 or 2 to 10. We have not determined yet who exactly is going to be in there. Borup: Okay, thank you. Anyone else wish to address the Commission? Mr. Freeman is there any summary comments you'd like to make. Freeman: No, I think I've said enough. Borup: Thank you. Commissioner's. Does staff have any final- Meridian Planning ar~ning Commission Special Meetin~ August 31, 1999 Page 39 Siddoway: Bruce and I were discussing this 10 foot easement along future Freeway Drive and apparently the city has no utility's within such an easement, so we would simply state that if that easement is vacant of utilities, then we would allow and encourage the landscaping-the trees to be centered, even if it encroaches into that easement. If there are utilities within that easement then the trees ought to be outside of it. If it is a vacant easement-they could plant in it. Borup: (Inaudible) sewer or water. Siddoway: All city services (inaudible) utilities would be within **"`*END OF SIDE 3***** Siddoway: Freeway Drive. Borup: Mr. Freeman. You aware of any other- Freeman: Well (inaudible) as a irrigation and utility easement and I do think there is an irrigation line that runs along that south property line. It is unclear when or whether these mains will be accepted by the City. This is very important to the serviceability of this project. 2. Water service to the proposed site could be to the existing water line mentioned above. Applicant will be responsible to construct the water mains to and through this proposed development. Project designer to coordinate main sizing and routing with the Public Works Department. Please provide the Public works department with information on anticipated fire flow and domestic water requirements for the proposed site. Assessment fees for water and sewer service are determined during the building plan review process. Applicant shall be required to enter into an Assessment Agreement with the City of Meridian. In addition to these assessments, water and sewer "Late Comers" fees will also be charged against this parcel to help reimburse the parties responsible for installing the water and sewer mains to their current points. 5. Underground pressurized irrigation must be provided to all landscape areas on site. Please submit hook-up and design details based on the proposed landscaping. Due to the landscape area, primary water supply connection to the City's mains will not be allowed. Applicant shall be required to utilize any existing surface or well water for the primary source. The southwest drive entrance width offFreeway Drive is currently shown as twenty feet (20'). City ordinance requires minimum of twenty-five foot (25') drive aisles. Plan must be modified. '1. Applicant is proposing a six (6) foot landscape strip adjacent to Freeway Drive. I-84 is identified as an entryway corridor in the Comprehensive Plan, which requires athirty-five foot (35') landscape strip beyond the required right-of--way. While this parcel does not have direct frontage on I-84, it is highly visible from the Eagle Road off-ramp and I-84 west-bound traffic and functions as an entryway for Meridian. Staffrecommend the applicant approach ITD to investigate the potential for a license agreement to landscape within the I-84 right-of--way between Freeway Drive arnd the north I-84 boundary to meet the 35-foot buffer requirement. g. Applicant is proposing a four (4) foot landscape strip adjacent to Allen Street. As the primary entrance to the facility, staff consider this width to be inadequate. Midvalley Business Park/Hubble Engineering is immediately adjacent to the north and is providing a tapered landscape strip -ranging from 8 feet on the north to 16-feet on the south immediately abutting Sontag's property. Staffrecommend a minimum ten-foot (10') landscape strip along the Allen Street frontage. 9. The north boundary line of subject property and the south boundary of Midvalley Business Park are common. Applicant shall submit hook-up and design details based on the proposed landscaping. Due to the landscape area, primary water supply connection to the City's mains will not be allowed. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 1.18 Applicant is proposing a six (6) foot landscape strip adjacent to Freeway Drive. 1-84 is identified as an entryway corridor in the Comprehensive Plan, which requires athirty-five foot (35') landscape strip beyond the required right-of-way. While this parcel does not have direct frontage on 1-84, it is highly visible from the Eagle Road off-ramp and 1-84 west- boundtraffic and functions as an entryway for Meridian. Staff recommend the applicant approach ITD to investigate the potential for a license agreement to landscape within the 1-84 right-of-way between Freeway Drive and the north 1-84 boundary to meet the 35-foot buffer requirement. 1.19 Applicant shall install aten-foot (10') landscape strip along the Allen Street frontage. 1.20 Applicant shall coordinate screened trash enclosure locations and construction requirements with Sanitary Service Company and provide a letter of approval from their office prior to applying for building permits. All trash areas are to be enclosed by a screening fence on three (3) sides. 1.21 Handicap parking, associated signage and building construction shall meet the requirements of the Americans with Disabilities Act. A total of six (6) handicap-accessible stalls are required and six (6) are shown. However, given the medical office use and anticipated clientele, staff require the addition of at least three (3) handicap parking stalls. All signage will be subject to design review and requires separate permits. 1.23 Six-foot-high, permanent perimeter fencing shall be provided adjacent to the existing residential and agricultural use along the west boundary line. 1.24 This conditional use permit shall be subject to review upon ten (10) days notice to the applicant. Transfer of the conditional use permit will need to be submitted ,and approved by the Zoning Administrator for any new owners/tenants. 1.25 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 1 1-9-605.M. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Worlcs Department. No variances have been requested for tiling of any ditches crossing this project. 1.26 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. Additionally, the Planning and Zoning Commission requires: 1.27 No building permit will issue until all sewer and water are operational and approved by the appropriate authorities. 1.28 A minimum 19-foot landscape buffer is required along future Freeway Drive with extra planning for additional buffering. 1.29 The applicant shall switch from a lift station/sewer ejector to a gravity fed sewer system when the lines become available. Further the applicant shall coordinate with Meridian City staff on placement of future lines.
