NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:00 p.m. on February 9, 1999, for the purpose of
reviewing and considering the application of West Pine Development for preliminary
plat approval of proposed Meridian Acres Subdivision for approximately 1.64 acres of
land which is generally located north of Broadway Avenue, south of Pine Avenue, and
west of West 4th Street.
Further the applicant requests conditional use permit approval of the parcel of
land above described for a six lot subdivision containing two duplexes and four 4-plex
units for proposed Meridian Acres.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing and the public is welcome and invited to
submit testimony.

GRANTING CONDITIONAL USE
PERMIT
The above entitled conditional use permit application having come
before the City Council on March 16, 1999, and the City Council having continued
the public hearing to April 6, 1999, at the hour of 7:30 o'clock p.m., at the Meridian
City Hall, 33 East Idaho Street, Meridian, Idaho, and Shari Stiles, Planning and
Zoning Administrator, appeared on behalf of the City of Meridian, and Mike Stipa,
the Developer, appeared and testified, and no one appeared in opposition, and the
City Council having duly considered the evidence and the record in this matter and
the Findings of Fact and Conclusions of Law and Recommendation to City Council
issued by the Planning and Zoning Commission who conducted a public hearing and
the Council having heard and taken oral and written testimony and the Applicant

appearing in person, and having duly considered the matter, the City Council hereby
makes the following Findings of Fact, Conclusions of Law and Decision and Order to -
wit:
FINDINGS OF FACT
1. A notice of a public hearing on the conditional use permit was published
for two (2) consecutive weeks prior to the first said public hearing scheduled for
March 16, 1999, and continued until April 6, 1999, before the City Council, the first
publication appearing and written notice having been mailed to property owners or
purchasers of record within three hundred (300') feet of the external boundaries of
the property under consideration more than fifteen (15) days prior to said hearing
and with the notice of public hearing having been posted upon the property under
consideration more than one week before said hearing and the copies of all notices
were made available to newspaper, radio and television stations as public service
announcements; and the matter having been duly considered by the City Council at
the March 16, 1999, and continued until April 6, 1999, public hearing; and the
applicant, affected property owners, and government subdivisions providing services
within the planning jurisdiction of the City of Meridian, having been given full
opportunity to express comments and submit evidence.

2. There has been compliance with all notice and hearing requirements set
forth in Idaho Code §67-6509, 6512, and §11-2-416E and 418E as evidenced by the
Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with
the staff report.
3. This proposed development request is in a (R-15), Medium High
Density Residential District, by reason of the provisions of § 11-2-418E of the
Municipal Code, a public hearing was required before the City Council on this
application.
4. The property is located at the end of Idaho St., north of Broadway
south of Pine Ave., and west of W. Fourth St., Meridian, Idaho.
5. The owner of record of the subject property is Mike Stipa of 9260 Cory
Lane, Boise, Idaho.
6. Applicant is the owner of record.
7. The subject property is currently zoned Medium High Density
Residential (R-15). The zoning district of Medium High Density Residential (R-15)
is defined within the City of Meridian Zoning and Development Ordinance, Section
11-2-408(5).
8. The proposed application requests a conditional use permit for a six (6)
lot subdivision containing two (2) duplex and four (4) four-plex units. The R-15

zoning designation within the City of Meridian Zoning and Development Ordinance
requires a conditional use permit be obtained for most uses including those requested
by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-2-
409).
9. The use proposed within the subject application will in fact, constitute a
conditional use as determined by City Ordinance.
10. The Meridian City Council takes judicial notice of its Zoning,
Subdivision and Development Ordinances codified at Title 11, Municipal Code of
the City of Meridian and all current zoning maps thereof and the Comprehensive
Plan of the City of Meridian, adopted December 21, 1993, Ord. No. 629 -Jan. 4,
1994 and Maps and the Ordinance establishing the Impact Area Boundary.
11. Giving due consideration to the comment received from the
governmental subdivisions providing services in the City of Meridian planning
jurisdiction public facilities and services required by the proposed development will
not impose expense upon the public if the following conditions of development are
imposed and the following is also found to be required to midegate the effects of the
proposed use and development upon services delivered by political subdivisions
providing services to the subject real property within the planning jurisdiction of the
City of Meridian:

11.1 Adopt the Planning and Zoning Administrator and Assistant to City
Engineer Recommendations as follows:
11.1.1 Any existing irrigation/drainage ditches crossing the
property to be included in this project, shall be tiled per
City Ordinance 1 1- 9-605.M. Plans will need to be
approved by the appropriate irrigation/drainage district, or
lateral users association, with written confirmation of said
approval submitted to the Public Works Department. No
variances have been requested for tiling of any ditches
crossing this project.
11.1.2 Any existing domestic wells and/or septic systems within
this project will have to be removed from their domestic
service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape
irrigation.
11.1.3 Submit letter from the Ada County Street Name
Committee, approving the subdivision and street names.
Make any corrections necessary to conform.
11.1.4 Provide five -foot -wide sidewalks in accordance with City
Ordinance Section 1 1-9-606.B.
11.1.5 Coordinate fire hydrant placement with the City of
Meridian's Water Works Superintendent.
11.1.6 Indicate any existing FEMA Flood Plain Boundaries on the
Preliminary Plat Map, and/or any plans to reduce said
boundaries.
11.1.7 Sanitary sewer services to this site is proposed to be
extended into the subject site from W. Pine Avenue.
Special attention needs to be given to the design of this
main due to the shallow depth. Minimum cover over

sanitary sewer mainlines is three feet, (finish grade to top
of pipe.) In all cases where there is less than three feet of
cover from sub -grade to top of pipe, ASTM D-2241, Class
200 pipe will be required. If the Applicant proposes for this
main to be a public main, i.e. City owned and maintained,
a twenty foot wide sanitary sewer easement, centered over
the main, must be granted to the City of Meridian over the
portion that is outside of the subdivision boundary.
Applicant shall construct the sewer main through this
proposed development. Subdivision designer to coordinate
main sizing and routing with the Public Works
Department.
11.1.8 Water services to this site is proposed to be extended into
the private lanes from W. Idaho Avenue. Applicant shall
construct the water system improvements to and through
this proposed development. Subdivision designer to
coordinate sizing and routing with the Public Works
Department.
11.1.9 Applicant shall indicate any existing ditch easements on
the preliminary plat map.
11.1.10 Applicant shall provide for temporary turnaround at the
terminus of W. Idaho Avenue.
11.1.11 Applicant shall be required to install a pressurized
irrigation system within this development per Meridian
City Ordinance 9-606-B-14. If the system is to be owned
and maintained by the homeowners association, plans and
specifications shall be reviewed by the Public Works
Department as part of the development plan review
process. A substantially complete copy of the O&M
manual shall be required prior to development plan
approval, and the final complete copy, including as -built
drawings, shall be required prior to the City's final
subdivision approval.

along the exterior subdivision boundary prior to obtaining
building permits, unless expressly waived in writing by the

or appropriate bonding will be required for this item prior
to signature on the final plat.
11.1.13 100 watt high pressure sodium street lights will be required
at locations designated by the Public Works Department.
All street lights shall be installed, at subdivider's expense.
Typical locations are at street intersections and/or fire
hydrants.
11.1.14 Street signs are to be in place, water system shall be
approved and activated, fencing installed, pressurized
irrigation system approved and activated, and road base
approved by the Ada County Highway District prior to any
building permits being issued.

11.1.19 The Applicant's central sewage and central water plans
must be submitted to and approved by the Idaho
Department of Health and Welfare, Division of
Environmental Quality.
11.1.20 Run-off is not to create a mosquito breeding problem.
11.1.21 Stormwater shall be reviewed by the Idaho Dept. of Water
Resources relative to the injection well rules and
groundwater protection.
11.1.22 Stormwater must be pretreated through a grassy swale
prior to the discharge to the subsurface to prevent impact
to groundwater and surface water quality.
11.1.23 Applicant shall obtain current best management practices
for stormwater disposal and design a stormwater
management system that prevents groundwater and surface
water degradation.
12. The proposed uses within the subject application will be
harmonious with and in accordance with the Meridian Comprehensive Plan and the
City of Meridian Zoning and Development Ordinance because:
12.1 The subject property is designated on the "Generalized Land Use
Map" as "existing urban"; and
12.2 It meets the following Goals of the Comprehensive Plan Goals 2,
4, and 8 at page 5 of the Comprehensive Plan; the Land Use Goal
Statement General Policies nos. 1, 3, and IAU at page 23; and
the Residential Policies nos. 2.1U, 2.3U, and 2.5U at page 23;
and Housing Goal Statement under Housing Policies nos. 1.1,
1.4, 1.6, 1.12, 1.13, and 1.14 at pages 67 and 68 of the Meridian
Comprehensive Plan.

13. The uses proposed within the subject application subject to the
conditions herein ordered will be designed, constructed, operated and maintained to
be harmonious and appropriate in appearance or intended character of the general
vicinity and that such uses will not change the intended essential character of the
same area.
14. The uses proposed within the subject application will not be
hazardous or disturbing to existing or future neighboring uses.
15. The uses proposed within the subject application will be served
adequately by central public facilities and services such as highways, streets, police
and fire protection, drainage structures, refuse disposal, water, and sewer.
16. The uses proposed within the subject application will not involve
uses, activities, processes, materials, equipment and conditions of operation that will
be detrimental to any persons, property or the general welfare by reason of excessive
production of traffic, noise, smoke, fumes, glare or odors.
17. Sufficient off-street parking for the property and the proposed
uses of the property will be provided.
18. The development will not result in the destruction, loss or
damage of natural or scenic feature of major importance relating to the property.

CONCLUSIONS OF LAW
1. The City of Meridian shall exercise the powers conferred upon it by
the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the
"Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503).
2. The Meridian Planning and Zoning Commission may exercise all the
powers required and authorized under the "Act" except the power to adopt ordinances by
the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho
Code Section 67-6504 which the City Council of the City of Meridian has established by
the passage of the "City of Meridian Zoning and Development Ordinance" at Title XI,
Chapter I, Municipal Code of the City of Meridian.
3. As part of a zoning ordinance the City Council can, subject to
hearing and notice provision required, provide for the process of special and/or
conditional use permits which a proposed use is otherwise prohibited by the terms of the
ordinance but allowed with conditions under the specific provisions of the ordinance
which the City of Meridian has done in the adoption of its zoning ordinances.
4. The City Council has the duty and responsibility to review the facts
and circumstances of each application for special use permit to determine prior to

granting the same that the evidential showing supports the finding that the following
standards are met and that the proposed development:
(Section 11-2-418, City of Meridian Zoning and Development Ord.):
a. Will, in fact, constitute a conditional use as determined by City
policy;
b Will be harmonious with and in accordance with the Comprehensive
Plan and this Ordinance;
c Will be designed, constructed, operated and maintained to be
harmonious and appropriate in appearance with the existing or
intended character of the general vicinity and that such use will not
change the essential character of the same area;
d. Will not be hazardous or disturbing to existing or future neighboring
uses;
e. Will be served adequately by essential public facilities and services
such as highways, streets, police and fire protection, drainage
structures, refuse disposal, water, sewer or that the person
responsible for the establishment of proposed conditional use shall
be able to provide adequately any such services;

That the above named applicant is granted a conditional use permit to use the
property for the construction and use of a six (6) lot subdivision, containing thereon
two (2) duplex and four (4) four-plex units, subject to the following conditions of use
and development:
2.1 Any existing irrigation/drainage ditches crossing the property to be
included in this project, shall be tiled per City Ordinance 1 1-9-605.M.
Plans will need to be approved by the appropriate irrigation/drainage
district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department. No variances
have been requested for tiling of any ditches crossing this project.
2.2 Any existing domestic wells and/or septic systems within this project
will have to be removed from their domestic service per City

Ordinance Section 5-7-517. Wells may be used for non-domestic
purposes such as landscape irrigation.
2.3 Submit letter from the Ada County Street Name Committee,
approving the subdivision and street names. Make any corrections
necessary to conform.
2.4 Provide five -foot -wide sidewalks in accordance with City Ordinance
Section 1 1-9-606.B.
2.5 Coordinate fire hydrant placement with the City of Meridian's Water
Works Superintendent.
2.6 Indicate any existing FEMA Flood Plain Boundaries on the
Preliminary Plat Map, and/or any plans to reduce said boundaries.
2.7 Sanitary sewer services to this site is proposed to be extended into
the subject site from W. Pine Avenue. Special attention needs to be
given to the design of this main due to the shallow depth. Minimum
cover over sanitary sewer mainlines is three feet, (finish grade to top
of pipe.) In all cases where there is less than three feet of cover from
sub -grade to top of pipe, ASTM D-2241, Class 200 pipe will be
required. If the Applicant proposes for this main to be a public main,
i.e. City owned and maintained, a twenty foot wide sanitary sewer
easement, centered over the main, must be granted to the City of
Meridian over the portion that is outside of the subdivision boundary.
Applicant shall construct the sewer main through this proposed
development. Subdivision designer to coordinate main sizing and
routing with the Public Works Department.
2.8 Water services to this site is proposed to be extended into the private
lanes from W. Idaho Avenue. Applicant shall construct the water
system improvements to and through this proposed development.

2.9 Applicant shall indicate any existing ditch easements on the
preliminary plat map.
2.10 Applicant shall provide for temporary turnaround at the terminus of
W. Idaho Avenue.

2.11 Applicant shall be required to install a pressurized irrigation system
within this development per Meridian City Ordinance 9-606-B-14. If
the system is to be owned and maintained by the homeowners
association, plans and specifications shall be reviewed by the Public
Works Department as part of the development plan review process.
A substantially complete copy of the O&M manual shall be required
prior to development plan approval, and the final complete copy,
including as -built drawings, shall be required prior to the City's final
subdivision approval.
2.12 Permanent perimeter fencing is required to be in place along the
exterior subdivision boundary prior to obtaining building permits,
unless expressly waived in writing by the Planning & Zoning
Administrator. A letter of credit, cash, or appropriate bonding will be
required for this item prior to signature on the final plat.
2.13 100 watt high pressure sodium street lights will be required at
locations designated by the Public Works Department. All street
lights shall be installed, at subdivider's expense. Typical locations
are at street intersections and/or fire hydrants.
2.14 Street signs are to be in place, water system shall be approved and
activated, fencing installed, pressurized irrigation system approved
and activated, and road base approved by the Ada County Highway
District prior to any building permits being issued.
2.15 All fire codes must be met.
2.16 Hydrant and water supply requirements must be met.
2.17 The two water mains must be tied together as designated on the map
submitted by the Water Dept. on Jan. 22, 1999.
2.18 The Applicant obtain written approval for the central sewage and
central water prior to approval of the conditional use permit.
2.19 The Applicant's central sewage and central water plans must be
submitted to and approved by the Idaho Department of Health and
Welfare, Division of Environmental Quality.
2.20 Run-off is not to create a mosquito breeding problem.

2.21 Stormwater shall be reviewed by the Idaho Dept. of Water Resources
relative to the injection well rules and groundwater protection.
2.22 Stormwater must be pretreated through a grassy swale prior to the
discharge to the subsurface to prevent impact to groundwater and
surface water quality.
2.23 Applicant shall obtain current best management practices for
stormwater disposal and design a stormwater management system
that prevents groundwater and surface water degradation.
3. The conditions shall be reviewable by the Council pursuant to Section 1-2-418(K) of
the City of Meridian Planning and Zoning Ordinance.
4. The above conditions are concluded to be reasonable and the applicant shall meet
such requirements as a condition of approval of the application for a conditional use
permit.
5. This order shall be automatically amended for the description of said parcel at
such time as the approval and recording of the final plat of Meridian Acres Subdivision.
6. Notice to Permit Holder, this conditional use permit is not transferable without
complying with the provisions of § 11-2-418 J of the Municipal Code of the City of
Meridian, a copy of which is attached to this permit.

Gigray: Mr. Mayor, members of the Council, we have prepared at the request of the
Council Findings of Fact and Conclusions of Law and Decision and Order in this
particular matter, and I believe you have that in your packet. This has to do with the
request for conditional use permit. I would point out in these Findings, I have included
the Comprehensive Plan analysis of your decision, which is contained in part 12 thereof
at page 8. That of course is part of any analysis of the Comprehensive Plan so I just
want to draw that to your attention. You take judicial notice of your own Comprehensive
Plan and those provisions are outlined there and then the conditions of the conditional
use permit are set out in the Order of Decision and then the Order of Decision has also
been prepared so that there's a separate Order of conditional use permit which would
be signed by the Mayor if you authorize these findings and this decision. The conditions
of the approval are under part one of the Order of Decision starting at page 14 and
running through page 17. There are 23 conditions on this one.

because this was — we prepared the findings based on your decision at the last meeting
and this being a conditional use permit for the home salon. We have those findings and
also a proposed order for your consideration. We have worded the proposed order so

Corrie: At this time I will open the public hearing and since this was a continued public
hearing, Shari why don't you give us the run down of what it is and then we'll have the
developer or representative here.
Stiles: Mr. Mayor and Council, this was one of the public hearing that was not heard
last meeting because of the lateness of the hour. This is for a subdivision at the end of
Idaho Street. It is bounded mostly by apartments. There is a little property to the west
that is not yet subdivided. They have complied with all of our conditions, have supplied
a landscape plan that hopefully is in your packet and staff recommends approval of this
subdivision.
Corrie: Okay.
Stipa: Good evening. I'm Mike Stipa, the owner and developer of the property here in
front of us. I'd like to address my comments to items 8 and 9 at the same time since
they be virtually the same. As Shari mentioned to you the property is here at the end of
Idaho which would be about 4th Street directly west of here. It consists of six lots and
the property is zoned R-15. It's vacant land at the present time. Four units that are four
plexes and two duplexes, the ingress and egress into each unit can be done in a
forward manner by the vehicles. I've tried to work with Shari and the staff here
extensively over the last year to accommodate something that would work here on the
property. The units themselves would be higher end type units that I have in mind.
They all have garages. That's something similar to the elevation that I intend being
higher end of garages for each unit. Two bedroom, primarily the duplexes will be three
bedroom. There is one issue of the water supply for irrigation purposes and you're
familiar with this project to a certain extent. It's adjacent to the Seabury Subdivision that
was brought in front of you by Becky of Briggs Engineering and I was here at the
meeting on the 16th of February I believe it was and it was left with the water supply was
there an issue too for irrigation purposes and the three conditions were left there were
either domestic water, Nampa Meridian Irrigation or a shallow well and I'm still working
with Nampa Meridian and looking into the other two issues also the other two
possibilities at this time. I would request those conditions would apply too if possible.

March 16, 1999, and continued until April 6, 1999, before the City Council, the first
publication appearing and written notice having been mailed to property owners or
purchasers of record within three hundred (300') feet of the external boundaries of
the property under consideration more than fifteen (15) days prior to said hearing
and with the notice of public hearing having been posted upon the property under
consideration more than one week before said hearing and the copies of all notices
were made available to newspaper, radio and television stations as public service
announcements; and the matter having been duly considered by the City Council at
the March 16, 1999, and continued until April 6, 1999, public hearing; and the
applicant, affected property owners, and government subdivisions providing services

2. There has been compliance with all notice and hearing requirements set
forth in Idaho Code §67-6509, 6512, and §11-2-416E and 418E as evidenced by the
Affidavit of Mailing, and the Affidavit of Publication and Proof of Posting filed with
the staff report.
3. This proposed development request is in a (R-15 ), Medium High
Density Residential District, by reason of the provisions of § 11-2-418E of the
Municipal Code, a public hearing was required before the City Council on this
application.
4. The property is located at the end of Idaho St., north of Broadway
south of Pine Ave., and west of W. Fourth St., Meridian, Idaho.
5. The owner of record of the subject property is Mike Stipa of 9260 Cory
Lane, Boise, Idaho.
6. Applicant is the owner of record.
7. The subject property is currently zoned Medium High Density
Residential (R-15). The zoning district of Medium High Density Residential (R-15)
is defined within the City of Meridian Zoning and Development Ordinance, Section
11-2-408(5).
8. The proposed application requests a conditional use permit for a six (6)
lot subdivision containing two (2) duplex and four (4) four-plex units. The R-15

requires a conditional use permit be obtained for most uses including those requested
by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-2-
409).
9. The use proposed within the subject application will in fact, constitute a
conditional use as determined by City Ordinance.
10. The Meridian City Council takes judicial notice of its Zoning,
Subdivision and Development Ordinances codified at Title 11, Municipal Code of
the City of Meridian and all current zoning maps thereof and the Comprehensive
Plan of the City of Meridian, adopted December 21, 1993, Ord. No. 629 -Jan. 4,
1994 and Maps and the Ordinance establishing the Impact Area Boundary.
11. Giving due consideration to the comment received from the
governmental subdivisions providing services in the City of Meridian planning
jurisdiction public facilities and services required by the proposed development will
not impose expense upon the public if the following conditions of development are
imposed and the following is also found to be required to midegate the effects of the
proposed use and development upon services delivered by political subdivisions
providing services to the subject real property within the planning jurisdiction of the
City of Meridian:

11.1 Adopt the Planning and Zoning Administrator and Assistant to City
Engineer Recommendations as follows:
11.1.1 Any existing irrigation/drainage ditches crossing the
property to be included in this project, shall be tiled per
City Ordinance 1 1- 9-605.M. Plans will need to be
approved by the appropriate irrigation/drainage district, or
lateral users association, with written confirmation of said
approval submitted to the Public Works Department. No
variances have been requested for tiling of any ditches
crossing this project.
11.1.2 Any existing domestic wells and/or septic systems within
this project will have to be removed from their domestic
service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape
irrigation.
11.1.3 Submit letter from the Ada County Street Name
Committee, approving the subdivision and street names.
Make any corrections necessary to conform.
11.1.4 Provide five -foot -wide sidewalks in accordance with City
Ordinance Section 1 1-9-606.B.
11.1.5 Coordinate fire hydrant placement with the City of
Meridian's Water Works Superintendent.
11.1.6 Indicate any existing FEMA Flood Plain Boundaries on the
Preliminary Plat Map, and/or any plans to reduce said
boundaries.
11.1.7 Sanitary sewer services to this site is proposed to be
extended into the subject site from W. Pine Avenue.
Special attention needs to be given to the design of this
main due to the shallow depth. Minimum cover over

of pipe.) In all cases where there is less than three feet of
cover from sub -grade to top of pipe, ASTM D-2241, Class
200 pipe will be required. If the Applicant proposes for this
main to be a public main, i.e. City owned and maintained,
a twenty foot wide sanitary sewer easement, centered over
the main, must be granted to the City of Meridian over the
portion that is outside of the subdivision boundary.
Applicant shall construct the sewer main through this
proposed development. Subdivision designer to coordinate
main sizing and routing with the Public Works
Department.
11.1.8 Water services to this site is proposed to be extended into
the private lanes from W. Idaho Avenue. Applicant shall
construct the water system improvements to and through
this proposed development. Subdivision designer to
coordinate sizing and routing with the Public Works
Department.
11.1.9 Applicant shall indicate any existing ditch easements on
the preliminary plat map.
11.1.10 Applicant shall provide for temporary turnaround at the
terminus of W. Idaho Avenue.
11.1.11 Applicant shall be required to install a pressurized
irrigation system within this development per Meridian
City Ordinance 9-606-B-14. If the system is to be owned
and maintained by the homeowners association, plans and
specifications shall be reviewed by the Public Works
Department as part of the development plan review
process. A substantially complete copy of the O&M
manual shall be required prior to development plan
approval, and the final complete copy, including as -built
drawings, shall be required prior to the City's final
subdivision approval.

11.1.12 Permanent perimeter fencing is required to be in place
along the exterior subdivision boundary prior to obtaining
building permits, unless expressly waived in writing by the
Planning &. Zoning Administrator. A letter of credit, cash,
or appropriate bonding will be required for this item prior
to signature on the final plat.
11.1.13 100 watt high pressure sodium street lights will be required
at locations designated by the Public Works Department.
All street lights shall be installed, at subdivider's expense.
Typical locations are at street intersections and/or fire
hydrants.
11.1.14 Street signs are to be in place, water system shall be
approved and activated, fencing installed, pressurized
irrigation system approved and activated, and road base
approved by the Ada County Highway District prior to any
building permits being issued.

11.1.19 The Applicant's central sewage and central water plans
must be submitted to and approved by the Idaho
Department of Health and Welfare, Division of
Environmental Quality.
11.1.20 Run-off is not to create a mosquito breeding problem.
11.1.21 Stormwater shall be reviewed by the Idaho Dept. of Water
Resources relative to the injection well rules and
groundwater protection.
11.1.22 Stormwater must be pretreated through a grassy swale
prior to the discharge to the subsurface to prevent impact
to groundwater and surface water quality.
11.1.23 Applicant shall obtain current best management practices
for stormwater disposal and design a stormwater
management system that prevents groundwater and surface
water degradation.
12. The proposed uses within the subject application will be
harmonious with and in accordance with the Meridian Comprehensive Plan and the
City of Meridian Zoning and Development Ordinance because:
12.1 The subject property is designated on the "Generalized Land Use
Map" as "existing urban"; and
12.2 It meets the following Goals of the Comprehensive Plan Goals 2,
4, and 8 at page 5 of the Comprehensive Plan; the Land Use Goal
Statement General Policies nos. 1, 3, and 1AU at page 23; and
the Residential Policies nos. 2.1 U, 2.3U, and 2.5U at page 23;
and Housing Goal Statement under Housing Policies nos. 1. 1,
1.4, 1.6, 1.12, 1.13, and 1.14 at pages 67 and 68 of the Meridian
Comprehensive Plan.

13. The uses proposed within the subject application subject to the
conditions herein ordered will be designed, constructed, operated and maintained to
be harmonious and appropriate in appearance or intended character of the general
vicinity and that such uses will not change the intended essential character of the
same area.
14. The uses proposed within the subject application will not be
hazardous or disturbing to existing or future neighboring uses.
15. The uses proposed within the subject application will be served
adequately by central public facilities and services such as highways, streets, police
and fire protection, drainage structures, refuse disposal, water, and sewer.
16. The uses proposed within the subject application will not involve
uses, activities, processes, materials, equipment and conditions of operation that will
be detrimental to any persons, property or the general welfare by reason of excessive
production of traffic, noise, smoke, fumes, glare or odors.
17. Sufficient off-street parking for the property and the proposed
uses of the property will be provided.
18. The development will not result in the destruction, loss or
damage of natural or scenic feature of major importance relating to the property.

CONCLUSIONS OF LAW
1. The City of Meridian shall exercise the powers conferred upon it by
the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the
"Act" codified at Chapter 65, Title 67, Idaho Code (I.C. §67-6503).
2. The Meridian Planning and Zoning Commission may exercise all the
powers required and authorized under the "Act" except the power to adopt ordinances by
the establishment of a Planning and Zoning Commission by ordinance pursuant to Idaho
Code Section 67-6504 which the City Council of the City of Meridian has established by
the passage of the "City of Meridian Zoning and Development Ordinance" at Title XI,
Chapter I, Municipal Code of the City of Meridian.
3. As part of a zoning ordinance the City Council can, subject to
hearing and notice provision required, provide for the process of special and/or
conditional use permits which a proposed use is otherwise prohibited by the terms of the
ordinance but allowed with conditions under the specific provisions of the ordinance
which the City of Meridian has done in the adoption of its zoning ordinances.
4. The City Council has the duty and responsibility to review the facts
and circumstances of each application for special use permit to determine prior to

granting the same that the evidential showing supports the finding that the following
standards are met and that the proposed development:
(Section 11-2-418, City of Meridian Zoning and Development Ord.):
a. Will, in fact, constitute a conditional use as determined by City
policy;
b Will be harmonious with and in accordance with the Comprehensive
Plan and this Ordinance;
c Will be designed, constructed, operated and maintained to be
harmonious and appropriate in appearance with the existing or
intended character of the general vicinity and that such use will not
change the essential character of the same area;
d. Will not be hazardous or disturbing to existing or future neighboring
uses;
e. Will be served adequately by essential public facilities and services
such as highways, streets, police and fire protection, drainage
structures, refuse disposal, water, sewer or that the person
responsible for the establishment of proposed conditional use shall
be able to provide adequately any such services;
f. Will not create excessive additional requirements at public cost for
public facilities and services and will not be detrimental to the
economic welfare of the community;
g. Will not involve uses, activities, processes, materials, equipment and
conditions of operation that will be detrimental to any persons,
property or the general welfare by reason of excessive production of
traffic, noise, smoke, fumes, glare or odors;

h. Will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding
public streets; and
Will not result in the destruction, loss or damage of a natural or
scenic feature of major importance.
5. Prior to granting a conditional use permit in a Medium High Density
Residential District (R-15), a public hearing shall be conducted with notice to be
published and provided to property owners or purchasers of record within three hundred
feet (300') of the external boundaries of the land under consideration for the conditional
use permit all in accordance with the provisions of Section 11-2-418E City of Meridian
Zoning and Development Ordinance, which provides as follows:
"Prior to approving a Conditional Use Permit, the applicant and the Commission
and Council shall follow notice and hearing procedures provided in Section 11-2-
416, Zoning Amendment Procedures, of this Ordinance. Provided, however, that
Conditional Use applications for land in Old Town and in Industrial and
Commercial Districts shall only be required to have one public hearing which shall
be held before the Planning and Zoning Commission and after the
recommendation of the Commission is made the application shall go before the
City Council without a public hearing and the Council may approve, deny, or
modify the recommendation of the Commission."
6. Following the public hearing and within 45 days after the conclusion of the
public hearing the Commission shall, transmit its recommendations to the Meridian City
Council with supportive reasons. The Commission shall recommend that the application
be approved, approved with conditions or denied. The Commission shall ensure that any

approval or approval with conditions of an application shall be in accordance with
Meridian Comprehensive Plan, City of Meridian Zoning and Development Ordinance,
and Idaho State law. (Section 11-2-418(f), City of Meridian Zoning and Development
Ordinance.)
7. When the City Council approves a conditional use permit it may impose
conditions of that approval that reasonably:
a. Minimize adverse impact on other development;
b. Control the sequence and timing of development;
C. Control the duration of development;
d. Assure that the development is maintained property;
e. Designate the exact location and nature of the development;
f. Require the provision for on-site public facilities or services; and
g. Require more restrictive standards than those generally required, in
this Ordinance.
8. The City of Meridian has, by ordinance, established the Impact Area and
the Comprehensive Plan of the City of Meridian, which was adopted December 21,
1993, Ord. 629, January 4, 1994 and Maps.

NOW, THEREFORE, BASED UPON THE ABOVE AND FOREGOING FINDINGS
OF FACT AND CONCLUSIONS OF LAW, the City Council does hereby ORDER and
this does Order that:
1. That the above named applicant is granted a conditional use permit to use
the property for the construction and use of a six (6) lot subdivision, containing thereon
two (2) duplex and four (4) four-plex units, subject to the following conditions of use and
development:

then a copy served by the Cleric upon the applicant, the Planning and Zoning
Department, the Public Works Department and any affected party requesting notice.

this decision and order seek a judicial review as provided by Chapter 52, Title 67, Idaho
Code.

property for the construction and use of a six (6) lot subdivision, containing thereon

2.1 Any existing irrigation/drainage ditches crossing the property to be
included in this project, shall be tiled per City Ordinance 1 1-9-605.M.
Plans will need to be approved by the appropriate irrigation/drainage
district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department. No variances
have been requested for tiling of any ditches crossing this project.
2.2 Any existing domestic wells and/or septic systems within this project
will have to be removed from their domestic service per City

Ordinance Section 5-7-517. Wells may be used for non-domestic

2.3 Submit letter from the Ada County Street Name Committee,
approving the subdivision and street names. Make any corrections
necessary to conform.
2.4 Provide five -foot -wide sidewalks in accordance with City Ordinance
Section 1 1-9-606.B.
2.5 Coordinate fire hydrant placement with the City of Meridian's Water
Works Superintendent.
2.6 Indicate any existing FEMA Flood Plain Boundaries on the
Preliminary Plat Map, and/or any plans to reduce said boundaries.
2.7 Sanitary sewer services to this site is proposed to be extended into
the subject site from W. Pine Avenue. Special attention needs to be
given to the design of this main due to the shallow depth. Minimum
cover over sanitary sewer mainlines is three feet, (finish grade to top
of pipe.) In all cases where there is less than three feet of cover from
sub -grade to top of pipe, ASTM D-2241, Class 200 pipe will be
required. If the Applicant proposes for this main to be a public main,
i.e. City owned and maintained, a twenty foot wide sanitary sewer
easement, centered over the main, must be granted to the City of
Meridian over the portion that is outside of the subdivision boundary.
Applicant shall construct the sewer main through this proposed
development. Subdivision designer to coordinate main sizing and
routing with the Public Works Department.
2.8 Water services to this site is proposed to be extended into the private
lanes from W. Idaho Avenue. Applicant shall construct the water
system improvements to and through this proposed development.

2.9 Applicant shall indicate any existing ditch easements on the
preliminary plat map.
2.10 Applicant shall provide for temporary turnaround at the terminus of
W. Idaho Avenue.

2.11 Applicant shall be required to install a pressurized irrigation system
within this development per Meridian City Ordinance 9-606-B-14. If
the system is to be owned and maintained by the homeowners
association, plans and specifications shall be reviewed by the Public
Works Department as part of the development plan review process.
A substantially complete copy of the O&M manual shall be required
prior to development plan approval, and the final complete copy,
including as -built drawings, shall be required prior to the City's final
subdivision approval.
2.12 Permanent perimeter fencing is required to be in place along the
exterior subdivision boundary prior to obtaining building permits,
unless expressly waived in writing by the Planning & Zoning
Administrator. A letter of credit, cash, or appropriate bonding will be
required for this item prior to signature on the final plat.
2.13 100 watt high pressure sodium street lights will be required at
locations designated by the Public Works Department. All street
lights shall be installed, at subdivider's expense. Typical locations
are at street intersections and/or fire hydrants.
2.14 Street signs are to be in place, water system shall be approved and
activated, fencing installed, pressurized irrigation system approved
and activated, and road base approved by the Ada County Highway
District prior to any building permits being issued.
2.15 All fire codes must be met.
2.16 Hydrant and water supply requirements must be met.
2.17 The two water mains must be tied together as designated on the map
submitted by the Water Dept. on Jan. 22, 1999.
2.18 The Applicant obtain written approval for the central sewage and
central water prior to approval of the conditional use permit.
2.19 The Applicant's central sewage and central water plans must be
submitted to and approved by the Idaho Department of Health and
Welfare, Division of Environmental Quality.
2.20 Run-off is not to create a mosquito breeding problem.

2.21 Stormwater shall be reviewed by the Idaho Dept. of Water Resources
relative to the injection well rules and groundwater protection.
2.22 Stormwater must be pretreated through a grassy swale prior to the
discharge to the subsurface to prevent impact to groundwater and
surface water quality.
2.23 Applicant shall obtain current best management practices for
stormwater disposal and design a stormwater management system
that prevents groundwater and surface water degradation.
3. The conditions shall be reviewable by the Council pursuant to Section 1-2-418(K) of
the City of Meridian Planning and Zoning Ordinance.
4. The above conditions are concluded to be reasonable and the applicant shall meet
such requirements as a condition of approval of the application for a conditional use
permit.
5. This order shall be automatically amended for the description of said parcel at
such time as the approval and recording of the final plat of Meridian Acres Subdivision.
6. Notice to Permit Holder, this conditional use permit is not transferable without
complying with the provisions of § 11-2-418 J of the Municipal Code of the City of
Meridian, a copy of which is attached to this permit.

MacCoy: Okay let's reconvene here. It's now midnight and we're only halfway
through our agenda, so we're going to be here for a while. Staff what do you
got? Shari, do you want us to come back to you or what?
Stiles: Chairman McCoy, Commissioners, this is for an infill project that's located
at the end of Idaho Avenue. It is zoned R-15. It permits with a conditional use
permit the apartments that they have proposed. They're showing a 60 foot
roadway which is the existing right-of-way I believe through there. Ada County
Highway District I think in their comments said they could taper that back down to
the 50 foot right-of-way which will allow them to have some additional
landscaping. It looks like they're a little shy on some of their widths maybe not.
Borup: I don't think it shows any landscaping width. Isn't that just an easement?
Stiles: Well I don't see a landscape plans that's been proposed as part of this
application. That would need to be approved as part of this application. They
would need to have a minimum of 4 feet of landscaping between the right-of-way
and any parking area. They do not have direct access to either Pine or
Broadway at this time. The property has been split up extensively in this area,
but they're proposing the — they're going to have garages and with the garages
and the driveways should be able to have more than adequate parking to meet
the ordinance requirements. I didn't specifically check the lot sizes, but in my
pre -application meetings with the applicant's engineer surveyor we detailed those
requirements. I believe Bruce probably has some comments about sewer and
water issues.
Freckleton: Mr. Chairman and members of the Commission as far as existing
services to the site, sewer is going to have to come in from Pine Street. You can
see on the plan they have a ten foot wide ingress/egress easement that comes in
from Pine Street into the site. That's where the sewer would have to traverse.
I've talked with Colleen Marks about the need for a 20 foot wide easement for
that utility going through there. She didn't see a problem with that. Water is
existing in Idaho Street. It would have to be extended on to the west. That kind
of takes care of sewer and water. The applicant is probably going to be talking
about the pressurized irrigation situation and we'll let him make that presentation
and if there are any questions I can follow up with that.

Stipa: My name is Michael Stipa. I'm the owner of the property on the agenda.
I'd like to address —
MacCoy: Just a minute here. I've got to publicly open the public hearing so you
start this thing and it's all legal. Okay we open the public hearing now and you're
the applicant. Now you can go on from there.
Stipa: Michael Stipa and I'd like to address my comments toward 7 and 8 at the
same time.
MacCoy: Go right ahead.
Stipa: And I'll keep them as brief as possible being that it's quite late. The
project name is Meridian Acres and as the staff mentioned it's located at the end
of Idaho between what would be 4t" and 5t" if it were to run through. It is zoned
R-15 and our proposal is for four 4-plex lots and two duplex lots which is
consistent with the buildings in the surrounding area. The plat and Shari I think
there should be landscaping plan in that.
Stiles: I'm not sure that I got the entire packet for this project.
Stipa: Basically this is a plat. This is Idaho Street through the center which
would be continued on and then private lanes running north and south off of
Idaho. The green is the landscape area around each unit. The white represents
the building (inaudible) and I have a copy of this here Shari if you don't. I believe
I do. To go on we would buffer the property with the required fencing and
between the lots. The private lanes themselves are 25 feet width exceeding the
code which is 20 feet. The site itself is very similar to the Seabury Subdivision
which was presented here last month in January's meeting by Becky from Briggs
Engineering. As a matter of fact the layout is virtually identical and that — mine
came out this way. I've been bothering the staff for about a year on this project
trying to get all the bases covered, but they are very similar in design. As you
can see by the — there is plenty of parking as you can see by the layout. The
cars can ingress and egress forward into Idaho into the traffic zones. I intend to
put higher end units there. The rentals themselves are garaged. The four-plexes
each have a garage. The duplexes have two car garages. Here's a sample of
the elevations which could vary too. (Inaudible) could be added and some
(inaudible) this type of thing. But the upper one is a four-plex and the lower one
is a duplex. They both have a garage as I indicated. One issue which came up
with Seabury also was the pressurized irrigation, and I met Mr. Bill Hensen from
Nampa Meridian Irrigation out there. He sent me a letter and the gist of it is that
the property is below the point of delivery of Nampa Meridian's water source and
they can't guarantee water. I talked to Bruce about this today and done some

quick calculations on landscaped areas and they averaged between four and five
thousand square feet per lot so that's an issue I guess primarily for City Council.
I don't know, but Bruce suggested that I bring this up. Because it is something
that has to be resolved. That's about it. If I can answer any questions, I'll try to.
Borup: I have none for Mr. Stipa. I had one for Bruce.
MacCoy: Okay you can sit down then we can ask one for Bruce.
Borup: Mr. Freckleton question on sewer and water. You had addressed that
earlier and said an applicant show that sewer needs to come from Pine. I was
concerned about the property to the west and also the water department's
comment on tying the two mains together. They .look like down at the — probably
close at the Seabury property and so isn't there still a section of land in between
these two projects?
Freckleton: Mr. Chairman Commissioner Borup, Seabury I'm going from memory
here, but it seems to me like it sewers back to the west with an existing main in
Idaho.
Borup: That's what you stated last time.
Freckleton: Yeah. That main I believe is deep enough to adequately serve the
parcel that is west of this proposed development. Eventually yeah I'd like to see
those water mains tied through to Seabury through that future that parcel that's
between them.
Borup: But at this point the applicant has no control over that other parcel.
Freckleton: Correct.
Borup: Both this and Seabury will be bringing the water lines to their boundaries
though; is that correct?
Freckleton: That's correct. We're growing together.
Borup: Okay. That was all I had. Unless you had —
Freckleton: Just maybe a point of clarification on the pressurized irrigation.
Borup: Oh yes that was another question I had.
Freckleton: I did get a copy of the letter that he's referring to from Nampa
Meridian. Our permits with Water Resources don't allow us to water areas larger

than a half acre. That was why I had asked him to prepare some calculations as
to what his square footage of landscaping would be.
Borup: Half acre per subdivision or per what?
Freckleton: A half acre over all yeah. For like this development we couldn't
water more than a half acre of open space.
Borup: It doesn't make any difference what the size of the development is. What
if he just developing on the south side of the street?
Freckleton: The same requirement.
Borup: Same requirement. Or if it was a 50 acre subdivision it would be the
same requirement a half acre.
Freckleton: Right.
Borup: Okay that's something new to me. I'm just trying to learn.
Freckleton: So what I suggested he do is request the waiver for the pressurized
irrigation system at Council level. If we don't have water to the site via Nampa
Meridian Irrigation District and he's less than a half acre, feasibly he could use
domestic water for his landscaping.
Borup: Is that what normally has transpired in the past on these little parcels like
this?
Freckleton: Yes, correct.
Borup: Not much other choice is there?
Freckleton: You kind of get to a point too where you get a project that's small

Haney: One of these four-plexes would look right into our backyard. But beyond
that counting Seabury this is 39 new families in a two block area, and I just
wanted to question the density as far as schools and traffic, water pressure, and
that type of thing. It just seems like a lot of families in a short space, which I
maybe mistaken. He says apartments would be a lot denser, but will it drop our
water pressure and do you have a study on the schools? Or what this many new
families will do in those areas?
MacCoy: Well the schools tell us that they're all over booked already so anybody
we add to the area is not going to help them any for the present time.
De Weerd: The school didn't comment on this particular project.
Haney: Well we just came to oppose it for the reasons that it's so much density
in such a small area and because they are two stories and we have a one story
home.
MacCoy: Okay let's ask Bruce, did you hear her comment about the water
pressure?
Freckleton: Chairman MacCoy, Members of the Commission, we do as you
know have a hydraulic model computer model that we punch these projects into.
I have not ran the model on this yet. I don't anticipate that there will be any
problems in that area. Have you had any problems with water pressure at your
location?
Haney: No, not yet.
Freckleton: I was going to say because that's one area of town where we
shouldn't have any problems, but that will be done. I will run that through the
model.
Haney: And can you tell me how far off the fence their building is or the property
line? We're at 502 W. Broadway, which is —
Borup: You're on the east side of the project or the west side?
Haney: The east side.
Freckleton: The building setback being a two story structure would be ten feet. It
would be five per story. So sitting at ten from the property line.

Freckleton: Right they could be setting 20 feet back. The setback line is as far
as the zoning. The building code would require —
Borup: With the private road that is considered a side setback. Isn't that what

Freckleton: The building that they're showing on lot 3 oriented with the front of it
facing west so the rear...

side of the building. Back of your property has to be facing the property to the
east. Her backyard would be facing the side of your building. That's what you
have drawn on the plat.

Stiles: Because they have lots—they are proposing private roads, they are
having lots that don't have any frontage. That's the main reason.

Stiles: We would like to get a landscape plan, we have something that says it is
a landscape plan, but there is nothing on it. There are two trees on it, I think that
was about it or trees or some other identified squiggly thing.
De Weerd: Shari does a landscape plan fulfill that four foot minimum between
the right-of-way and parking that you had mentioned?
Stiles: They will be able to accommodate it, the minimum four feet between the
right-of-way and the parking area because Ada County Highway District is
allowing them to taper this back down to 50 feet. So they are going to have an
additional five feet on each side of the road.
De Weerd: Does that need to be a condition?
Stiles: No, they just need to meet ordinance requirements, I think that covers it.
De Weerd: Okay.
MacCoy: Anything else? Shari anything else?
Stiles: No sir.
MacCoy: Commissioners what do you want to do?
Freckleton: Shari was just pointing out to me that I may be all wet as far as the
pressurized irrigation system. As far as getting a waiver. Going to have to get
some clarification on that whether that is allowed or whether they would have to

Stiles: It says they can be waived if they don't have any water rights.
Nelson: Or access thereof.
Stiles: Or if they deed the city land for a well, drill the well, and place the well on
line, they could also have that waived.

1. Sanitary sewer services to this site is proposed to be extended into the subject site from
W. Pine Avenue. Special attention needs to be given to the design of this main due to the
shallow depth. Minimum cover over sanitary sewer mainlines is three feet, (finish grade
to top of pipe.) In all cases where there is less than three feet of cover from sub -grade to
top of pipe, ASTM D-2241, Class 200 pipe will be required. If the applicant proposes for
this main to be a public main, ie. City owned and maintained, a twenty foot wide sanitary
sewer easement, centered over the main, must be granted to the City of Meridian over the
portion that is outside of the subdivision boundary. Applicant will be responsible to
construct the sewer main through this proposed development. Subdivision designer to
coordinate main sizing and routing with the Public Works Department.
2. Water services to this site is proposed to be extended into the private lanes from W. Idaho
Avenue. Applicant will be responsible to construct the water system improvements to

STOR VIWATER MANAGEMENT RECOMMENDATIONS
We recommend that stormwater be pretreated through a grassy swale prior to
discharge to the subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of this project

should obtain current best management practices_ for stormwater disposal and
design a stormwater management system that is preventing groundwater -and
surface water degradation. Manuals that could be used for guidance are:
1) State Of Idaho Catalog Of Stormwater Best Management Practices For
Idaho Cities And Counties. Prepared by the Idaho Division Of
Environmental Quality, July 1997.
