County Engineer JP/jp 0 • SEABURY SUBDIVISION Rules and Regulations Definitions: Board of Directors: Assignment of voting rights Each Deeded Lot owner shall be a member of the Board of Directors with one vote. A Board member may assign his vote to any one he pleases. Seabury Subdivision: Seabury Subdivision shall be defined by the official recording of the plat in the records of Ada County. Community: The term Community shall be defined as all residents living in Seabury Subdivision. Property: The term Property shall be defined as any property in Seabury Subdivision either inside or outside. Meetings: The Board may meet as needed, but no less than once per year. SEABURY SUBDIVISION Rules and Regulations 1.1 ADOPTION :7 These rules and regulations were adopted by the Board of Directors of Seabury Subdivision. 2.0 GENERAL RULES AND REGULATIONS All homeowners and residents are requested to assist in the enforcement of all regulations. In cases where the rules are not understood, please take time to explain them courteously to fellow homeowners, visitors, or tenants. Each owner and resident has a vested interest in the subdivision and should therefore afford all areas the same pride of ownership and care as given their unit. The following rules should be observed to protect your investment. 2.1 GENERAL USE No individual unit shall be occupied and used except for residential purposes by the owners, their tenants and social guests, and no trade or business shall be conducted to therein. No tent, shack, trailer, basement, garage, out building or structure of a temporary character shall be used at any time as a residence, either temporarily or permanently. The use of any part of the property for commercial or related purposes is prohibited. 2.2 UNIT RIGHTS AND RESPONSIBILITIES No exterior clothes lines shall be erected or maintained and their shall be no outside laundering or drying of clothes. Further, no clothes washers, clothes dryers, water heaters, refrigerators or freezers may be kept stored or operated on any exterior area. No power equipment, hobby shops or car maintenance (other than emergency work) shall be permitted on the property except with prior written approval of the Board. No garbage cans, bottles, newspapers, boxes, or other articles shall be placed outside for longer than 24 hours. No linens, cloths, clothing, curtains, rugs, or mops shall be shaken or rung from or on any windows, doors, railings or fence. The sidewalks, entrances, driveways, stairways, and landings shall not be obstructed or used for any other purpose than entering and leaving the units. 2.3 NUISANCES No noxious, illegal, or offensive activities shall be carried on upon any unit or in any part of the property, nor shall anything be done thereon which may be or may become an annoyance or nuisance to or which may in any way interfere with the quiet enjoyment of each of the owners or his respective unit, or which shall be in any way increase the rate of insurance for the property, or cause any insurance policy to be canceled or to cause a refusal to renew the same, or which will impair the structural integrity of any building. No person shall play upon or allow to be played any musical instrument, or operate or permit to be operated any phonograph stereo, radio, television set, or other amplified sound system in any outdoor area between the hours of 10:00 p.m. and 9:00 a.m.. No persons shall permit any party or other activity in his unit which makes or causes to make noises which might tend to unreasonably interfere with the peace and quiet of the other owners or occupants. No radio or other sound system shall be operated in any outdoor area of the subdivision except at a low sound level. No offensive noise, language or behavior is allowed. The use of fireworks, firecrackers and any type of firearms in the subdivision is strictly prohibited and is subject to formal complaint to the Police Department. 2.4 SIGNS Unless written approval is first obtained from the Board of Directors, no sign of any kind shall be displayed to public view on the building or building site on said property except one professional sign if not more than five square feet advertising the property for sale or rent. 2.5 ROOF AREA Walking or climbing on roofs, cement walls and fences is not permitted under any circumstances. No one is to go onto the roof, without the consent of the Board of Directors. 2.6 LIABILITY The Board will have no liability for damage, loss, or theft of any personal property stored on any property. Owners will be held liable for any reasonable costs incurred by the association for the repair or replacement, due to negligent or willful damage or destruction, to structures, fences, gates, landscaping, and recreational areas caused by said owner, tenant or guests. Such cost, plus possible penalty assessments will be charged back to the owners. 2.7 RECREATIONAL VEHICLES/PARKING No boats, campers, recreational vehicles, trucks, trailers and no vans in excess of eighteen feet long and or six feet, eight inches wide shall be parked or maintained within property (except for temporary loading and unloading without inconvenience to resident access). Recreational vehicles, including vans, may not be used as temporary living or sleeping quarters for residents or visitors at any time. Boats and other nonwheeled mounted vehicles may not be parked in the subdivision at any time. The maximum speed limit is 10 mph on any subdivision driveway. Owners of illegally parked vehicles are subject to penalty assessments and possible tow away at the owners expense for repeated violations. Vehicles cited for any violation are 0 automatically checked through the Department of Motor Vehicles for ownership and address. To assure maximum use of the limited parking, residents must park their vehicles in a manner that does not waste a possible parking space for another vehicle. No vehicle shall be parked in such a manner as to impede or prevent ready access to any entrance to or exit from a building. Offensive vehicular noise ed.such as loud Vehicles should bundue squealing equipped with mufflers a good working tires or brakes, etc., is strictly prohibited. order to prevent excessive noise and annoying exhaust fumes. 2.8 PETS No animals, birds, insects or livestock shall be kept on said property except domesticated dogs, cats or other common household pets which do not unreasonably bother or constitute a nuisance to others and on such portion of roads and other public ways or easements as may be designated or permitted for such use from time to time. No dogs or cats in excess of two shall be kept by any residential household within said subdivision, and no animals of any kind shall be bred or kept for commercial purposes. All dogs must be leashed when outside a dwelling unit, and shall not be allowed in the common area or kenneled outside the dwelling units. 3.0 COMMON AREAS 3.1 PATIOS The hanging of laundry, towels, rugs, ladders or other unsightly items over balcony railings or patios is prohibited. Placing any items as to extend beyond a balcony or patio is prohibited and any hanging plants or other decorations from patios must be securely fastened. The storage of gasoline and other flammable fluids, explosives, fireworks, etc., anywhere on the property is prohibited. No wire screening, plastic, wood or other material may be placed on exterior of units for the retention of any pets. Debris of any kind is not to be discarded on the landscape. Any debris must be swept or picked up and disposed of properly. No articles of any type are permitted to be thrown from any balcony or patio area. 4.0 COMPLAINT AND RULE ENFORCEMENT PROCEDURE A complaint or grievance is an alleged violation, misunderstanding, misinterpretation or inequitable application of these documents and or rules and regulations guidelines. A violation is a failure of an individual to observe these documents and the subdivision Board. This can range in severity from the inconsiderate act of individual, to acts which endanger the health and safety of the community. Any violation disrupts the harmony of the community and must be addressed with wisdom, patience, and determination. The complaint procedure may be employed after attempts made to resolve a deemed violation have been unsuccessful. "Neighborhood complaints" i.e., undue noise, barking dogs, etc., should be settled between the parties involved. All efforts should be exercised to resolve the difficulty at this level. If the complaint cannot be resolved in this manner it 0 0 may then be referred to local enforcement agencies. Any resident should report a violation or infraction to member of the Board by a written report of the facts. A signed and dated letter should be submitted which comprehensively lays out the basis of the complaint and provides the information of when, where, who, what, and how the violation occurred. No enforcement procedure will be initiated without a signed written complaint. An owner is strictly liable for violations of these rules by his or her quests or tenants. Where a tenant or occupant is in violation of a rule the owner will be served notice and have the responsibility per subsequent action as outlined hereafter. When the complaint is valid a formal complaint letter will be sent to the offending owner of record at his or her last known address. Stiles: Mr. Mayor and Council, this infill project is in an R-15 zone. There is a conditional use permit that was approved — you have seen the conditional use permit and it has come through City Council. It has four fourplexes, one triplex and one single family dwelling. The biggest concern I had remaining on this project was a provision for trash enclosures. Becky had this pretty much down to the gnat's eyelash when she designed it and Sanitary Service Company did have some concerns that there was not adequate area for those trash enclosures, but we did ask that she submit a letter of approval for the location and number of those trash enclosures prior to signature on the plat. Corrie: Is the developer's representative here? Becky? Bowcutt: Becky Bowcutt, Briggs Engineering, 1800 W. Overland. I have read staffs comments. There's only one item that I need to bring up. That is the issue of pressurized irrigation. This project is really a small project. it was like I don't know it was an acre and a half or something to that effect approximately. I believe when we came before you as a preliminary plat and a conditional use application, you left it open and asked us to look at the possibility of getting our irrigation water from Nampa Meridian Irrigation District. Looking at the option of a shallow well and leaving the option open if we met requirements for utilizing domestic water. I have spoken with the developer of the other multi family project that adjoins me, Mr. Stipa. He, has indicated that they have less than a half an acre of irrigatable area when you exclude their driveways, parking, and building pad areas and therefore he has stated that he did not want to participate in say a shallow well because the pressurized irrigation option is not going to happen. We do not have a reliable source from Nampa Meridian. That's the date that I got from them. So he's opting for I guess hooking on to domestic water. I don't know if staff has discussed sh i m the first one n thehim. I don't lleve doorhls final plat or I did calculate my have been reviewed at this time so irrigatable area in my entire project. I've got .31858 so I'm less than half an acre of irrigatable area. So I'm not sure I guess what the step is here. I have never done one where I've hooked on to domestic water. We've always found some type of option but my projects are typically not this small. Smith: Mr. Mayor and Council, we have been limited by Idaho Department of Water Resources to a maximum area for use of domestic water to sprinkle of Y acre. This is less than the one half acre maximum requirement so I would suspect that we could work with the developer to connect to his irrigation system. Corrie: Questions Council? Bird: Mr. Mayor I do have a question. That still even though it's going to come off our system will be a pressurized irrigation system, won't it Becky? GARY SMITH: 0 AERATION BASIN PROJECT CHANGE ORDER NO. 3 (AMENDED) Smith: Thank you Mr. Mayor, Council members. The first item is the aeration basin project change order no. 3 amended. The last Council meeting I brought before you a partial amount for approval for the change order on this project. There were some items that we still had to discuss with the design engineer and with the contractor. We did have a meeting after that meeting. We did discuss each one of these items on change order no. 3 and arrived at some conclusions. Dennis Suihkonen is the project engineer from Keller Associates and Dennis is here this evening. At this point I would just turn the presentation over to Dennis to talk to you about the items. I think you have the change order summary with part of your packet that Dennis had prepared. Suihkonen: Mayor and Council, my name is Dennis Suihkonen with Keller Associates at 131 S.W. 5th Avenue, Meridian. We bring before you this evening change order no. 3 for the aeration and pumping facilities project. The project currently is completed and operating. These are some items that took place in the last couple of months of the project that we need to take care of. First 1 would like to say that this change order is a fairly significant change order, and we at Keller Associates like to try and keep the change order costs a lot lower than this. I should mention that we — this is the 5th major project that we've worked on at the Wastewater Treatment Plant for the City of Meridian. I think all of the other projects as Gary could probably attest we've had pretty minimal change orders. I know the budget the city likes to stretch their funds as far as they can, get as much as they possibly can at the plant, and I think that's our endeavor to do that. I'd like to just kind of go over, I've summarized the change order. Basically there were two items that comprised approximately 60% of the total cost of this change order. The first item is associated with the failure that we had of the existing structure early in the project. There was some rebar on the existing affluent trough of the erosion basins that was not properly placed some twenty years or so ago, and when the back fill was removed from that portion of the trough, there's a very small load on the trough and the trough (inaudible) over and caused a fairly significant damage a lot of which we were not able to really get in and look at until later in the project because we had to keep the existing basins on line and operational while we were working on the new basins. So what happened when we went in to do some retro fitting on the existing basins, we started to draw those down and it was apparent that there was some damage to the interior wall at the joint that we felt like we needed to put some temporary bracing in to allow for worker safety and then get in and take care of those repairs.
