The development will connect to the existing sewer and water facilities within the Salmon Rapids Development. This area was initially intended to sewer to the Ten Mile trunk. However, difficulty in extending the sewer main through Kachina Estates, has brought a change in the development plan of the project. 4. The development complies with the standards of the R-4 zone and the City Subdivision Ordinance. 5. No easements exist on this property with the exception of temporary storm drainage easements. 6. The monitoring pipe only measures to a depth of 35" below ground level due to some sediment build-up in the bottom ofthe pipe. Irrigation water was tuned into the Ridenbaugh Canal (bordering the proposed subdivision) on March 30, 1998. None of the fields were irrigated until the week of April 27m because of the frequent rains up until that time. At( of the monitoring wells remained dry until April 27°i which indicates no seepage laterally from the Ridenbaugh Canal into the subdivision area. Any movement of the water from the canal appears to be vertical (downward) through the underlying course sands and gravels. Two pomlble exceptions are TH24 and TH29 that both have water in them after April 2r. TH24 had water at depths of 105", 95", and 98" when measured on 4/27/98, 5/7/98 and 5/18198 respectively. Prior to 4/27/98, and after 5118/98, TH24 was dry to 112" depth. The water in TH24 came from irrigation only, not from the'Ridenbaugh Canal. TH29 had a water table in it from 4/27/98 to 9/15/98 at depths ranging from 87" (on 4/27/98) to a high of 31" (on 9/3/98). When TH29 was monitored on 9/15/98, the water table had dropped to 42" below ground level. believe the water table in the T1429 area was created primarily from irrigation waste water because it did not appear until April 27", just after irrigation started, but it may also have some water seeping from the Ridenbaugh Canal (about 25' away from the test hole). As a result of the test hole water table monitoring, I would make the following recommendations: 1) No basements in the sgutftM partof Salm Rapids Subdivision. what test hole twenty one (TH21) is located. If footings are placed no deeper than 18" below the natural ground level of this area, I am of the opinion that crawl spaces of divEngs would restrain dry, but 1 do not think base a=ts would be advisable. 2) Basements (6' below ground level and T above ground level), should have no ground water seepage problems on the 120 acre proposed subdivision (lbousand springs) with the possible exception of the lots ly' next to the Ridenbaugh Canal on the north sl�ie of the Property (200' west of TH26 through TH29 to Eagle Road). This information will be used to determine suitability for the construction of residential dwellings and storm drains on the subdivision areas. A previous investigation, for the same purpose, was completed on phase 1 of these subdivisions on March 3, 1994. At that time five backhoe pits were excavated, examined and recorded. The current study, completed on July 7th and 9th, 1995, consisted of examining and logging nine additional backhoe pits, in representative areas, on the subdivision. Soil textures, soil restrictive layers, soil colors (indicators of drainage conditions), and depth of plant rooting were observed and logged for each significant soil layer. Field notes for the nine additional backhoe pits are attached. These pits are numbered 6 through 14, as a continuation of the first five pits in the earlier study. I will continue measuring water table depths in the three test wells, once every 10 days, through Monday, October 9th. Also, I have considered the potential for building houses with basements on the Salmon Rapids Subdivision No. 3 phase 2 area and the Los Alimitos Parks Subdivision No. 3 phase 2 area, as you requested. Subdivision maps are enclosed that show the areas where it is suitable for building houses with basements, areas where there is still some question about building houses with basements (need some additional testpits,, and areas that would not be suitable for building houses with basements. I met with Gary Smith at Meridian on August 28th, to fill him in and to get his reaction on our approach to determining the possibilities for placing storm drains, and houses with basements, on the two subdivision areas. ke-;,.: ', s Imo. The following is more detail on my activities and findings to this point: 8/18/95: Measured depth from ground level to the water table (if any) in pit #6 (just east of Nine Mile Drain on the north boundary of Salmon Rapids Sub No. 3, phase 2), in pit #13 (about 50' west of Eight Mile Lateral in the NW comer of Salmon Rapids Sub. No. 3, phase 2) and pit #14 (about 200' from the SW corner of Salmon Rapid Sub. No. 3, phase 2). At this time there was 4" of water in the bottom of the test pipe for pit #6, which was dry at the time we dug the pit and installed the test pipe on July 7, 1995. This test pipe was installed to a depth of 110" below the ground level so the ground water level, on 8/18/95, was at 106". Pit #13 (potential storm drain area) was dry when we dug the pit and installed the test pipe on July 9, 1995, and was still dry when I monitored it on 8/18/95. Pit #14 (low-lying area in SW part of Salmon Rapids Sub) had a high water table level at 45" below the ground surface when we dug the pit and installed the test pipe on July 9, 1995, and the water table level had risen to within 25" of the ground level when I measured it on 8/18/95. In addition to monitoring the three test pipes, on 8/18/95, I also determined what platted lots, in the area represented by pit #14, would be affected by the high water table showed by the test pipe in pit #14. It appears that part or aof Lots 49-58, and Lots 13 (SW corn• and 14 would be subject to high water table. I have measured the water table two times (8/28 and 9/7/95) since 8/18/95 and the water table continues to rise in the pit #14 area. 8/28/98: I monitored the test pipes a second time and met with Gary Smith at Meridian. The water tables in pit #6 and pit #14 were still rising at this second monitoring. Pit #14 was still totally dry. Gary Smith is receptive to the soil investigations and water table monitoring that we are doing, but he does have some concern about the possibility of "perched water tables", occurring over top of the restrictive cemented hardpans in the soils of the two subdivisions. I don't believe that is a problem, but we may want to do a few more-excavafions.4LojL1caLpiW.to make sure. We would need to do the additional soil test pits within the next two weeks while canal water and irrigation is still going full tilt and before the water tables (if any) start dropping. 9/7/95: I monitored the test pipes a third time and did some more checking of areas that may or may not be suitable for basements in the two subdivision areas. The water table in test pit #6 had risen 14" from the time the pit was excavated and was 96" below ground level. The water table in pit #14 had risen to a level 19" below the ground surface from a depth of 45" when we installed the test pipe on July 9, 1995. I talked to the owner of the house at 2230 Locust Grove. This house has a full basement (8' deep) and is about 30 years old. It is located on the east side and adjacent to Locust Grove Road, just across the street from Salmon Rapids Sub. The owner told me the house has a perforated drain pipe around the outside of the foundation that has a piped outlet to Nine -Mile Drain about 100' behind (east of) the house. He also told me that the basement flooded once when the exterior perforated drain pipe was plugged. I believe this is the only older house along Locust Grove (between Salmon Rapids Sub and Los Alimitos Sub) that has a basement. I also checked the crawl space, for moisture, in a new house (2431 South China Rapids) which is located in the lowest area in the east part of Salmon Rapids Subdivision. No moisture was apparent. The Nine -Mile Drain culvert that goes under the road on the north edge of Los Alimitos Subdivision is either too small or partially clogged. It appears to be presently backing up water, to some degree, south of the road and could be a problem to houses along Nine -Mile Drain if conditions were not right (rapid snow melt and heavier than normal rain, orlpossible icejamming of the drain). The owner of the 2230 Locust Grove house told me that ice had jammed in Nine - Mile Drain one time causing the water to back up in the drain and flood his back yard. These observations may not be anything to be alarmed about, but you may want to check them out a little more. I am enclosing two platted maps that have areas delineated where I would not recommend basements, would not recommend houses with crawl spaces, (unless built up with fill material), and areas it would be suitable to build houses with basements. Also, I have delineated areas on the two platted maps where additional test pits are needed before I could safely recommend where houses with basements could be built. The area delineated and designated as "A" (in SW corner of Salmon Rapids Subdivision) would definitely not be suited for houses with basements and is a questionable area for houses with crawl spaces. I will need to finish monitoring test pipe #14 before we c�dete`rmine how much fill material would be required to get the footings at least 1" above the seasonal watertable-level in this �azda. The areas designated "B" and "D" will need some additional test pits before we can be sure those lots would be suitable for houses with basements. The area designated "C" would be suitable for houses with crawl spaces (if the culvert on Nine -Mile Drain is corrected), but I would not recommend houses with basements in this area. The free water (water table) level in this pit is directly affected by the level of water in Nine Mile Drain. Water could potentially be backed up in Nine Mile Drain, due to the culvert that appears to be too small, or from possible ice jams at the culvert. From the water table measurements, the maximum high water table level of 87" would allow the required 48" separation from the bottom of the storm drain trench (or bed), to the seasonal high water table, if the bottom of the trench (or bed) was no more than 39" below the natural ground level. Mr. Marty Goldsmith Page 2 Pit #7 was also located next to "Ninemile Drain" and had very similar soil characteristics to pit #6. No monitoring well pipe was placed in this pit because drainage would be the same as determined in pit #6. Pit #8 was located next to the Ridenbaugh canal and the Hunter Lateral. There was currently no free water to a 92" depth, but the soil was moist below 84". A monitoring well pipe was placed in this pit and should also be monitored for water table during the next two months. Pit #9 was located next to the Hunter Lateral. No free water (water table) was found to a 108" depth. No monitoring well pipe was placed in this pit. Pit #10 was located next to the Ridenbaugh Canal. No free water (water table) was found to a 110" depth. The soil appeared very well drained and no monitoring well was placed in this pit. Pit #11 appeared very well drained and no free water was found to a 108" depth. No monitoring well was placed in this pit. Pit #12 was located near the Hunter Lateral. No free water (water table) was encountered to a depth of 132". The soil appeared very well drained and no monitoring well was placed in this pit. Pit #13 was located next to "Eightmile Lateral" ' an area where a storm drain isyronosed. There was no free water (water table) to a 108" depth and the soil appeared to be very well drained. To make sure, however, a monitoring pipe was placed in this pit and should be monitored over the next two months. Pit #14 was excavated in a low terrace landscape area in the SW corner of Salmon Rapids Subdivision. The soils on this low terrace are poorly drained and free water (water tablet is presently at a 45" depth. The soil colors and mottling indicates water rises to within 16" of the ground surface for extended periods of time. A monitoring well was placed in this pit and should be monitored over the next two months. It is my opinion, there is adequate drainage for construction of residential dwellings in all areas, gxcevt the low terrace area represented by pit #14 Pit areas #6 and #13 should be suitable for locating storm drain facilities but the monitoring wells in those locations will need to be checked for the next two months. (Inaudible) MacCoy: Salmon Rapids? Just a minute before we get to you then. Shari, would you do your piece? (inaudible) Stiles: Mr. Chairman, Commissioners, I think if there's any activity going on out there, it's wishful thinking on the part of the developer. I don't know what exactly they are doing. This is the area that they're proposing to develop — do you all have the memo from Gary Smith dated July 9th? Borup: Yes. Stiles: It's stated he told this developer previously that it cannot be served by public sewer until well you can't see it on this map, but sewer is currently stopped on the eastern boundary of Meridian Greens. It has to be extended somehow through this property or somehow extended. We don't know which direction it's going to take to serve this area. What the Public Works Department determined when they were looking at their plans was that they proposed to put six feet of fill in this location just to sewer it back to the other drainage area. They were proposing to put this six feet of fill and then have daylight basements. But Gary's comments — we're basically asking that you just deny this preliminary plat straight up without having to put it on another agenda. We don't need — well I don't feel that we need a presentation from the applicant's representative or the applicant. Bruce Freckleton has something to add. Freckleton: Mr. Chairman, members of the commission, the applicant's representative spoke to me earlier tonight. After getting Gary's latest memo, they basically have a couple of options available to them. One is they construct the Ten Mile trunk line, they make it happen, which it's a long ways off, but that's an option that's open to them. Their other option is to totally withdraw and wait for someone else to bring it to them. So they got the memo fairly late. They didn't really have time to digest it a whole lot yet, so that's why they submitted the letter requesting the tabling is so that they can kind of group and figure out how they want to proceed. Borup: So they originally submitted the application based on the earlier comments that it could go into the Nine Mile Drain? Is that correct? Freckleton: That's correct. Borup: Was that way back a couple of years ago or several years ago or so when they were doing the earlier phases? Or is that when they were told — Meridian Planning and wing Commission Meeting July 13, 1999 Page 55 Freckleton: No, when they did the earlier phases it was determined that this corner would not sewer into the Nine Mile Drain. It had to go to the Ten Mile trunk line. It was some later discussions that they had with Gary that I think Gary kind of left it up to some design to see if they could make it work. The only way like Shari said that they can make it work is to import six to six and a half feet of fill dirt to raise that development up out of the Ten Mile drainage area and put it back into the Nine Mile drainage area. The sewer pipe that they have designed in this latest information that they submitted is actually above the natural grade that sits out there today. Borup: The sewer line itself is above the natural grade? Freckleton: And so after Brad's preliminary analysis of the sewer trunk computer model and looking at the design with that much fill, it's just not going to work. It's going to have to go back into the Ten Mile trunk as originally designed. That Nine Mile trunk line is getting overwhelmed fast and so anybody that we bring into that Nine Mile trunk it just drops somebody else off that's within the service area of the Nine Mile trunk, it drops them out of the game. It's a trade off. Borup: I question whether they have marketable lots if they're talking six feet of fill. Freckleton: Well like Shari said — Borup: And the cost to do that is — Freckleton: The proposal l believe those lots that are along the southern boundary was to do a daylight basement type concept so that they would have 6 feet of fill on those lots from to rear. I would assume that they would end up with something similar along the western boundary because there is going to have to be a lot of fill along there too. (Inaudible) MacCoy: We are still discussing with the staff yet. You'll get your chance here. Freckleton: Did I answer your question Commissioner Borup? Borup: Yes, sure. MacCoy: All right, since the applicant is not here we will look to the public. It's a public hearing and your part of the public, so now you can talk. McDonald: Greg McDonald by the way and I live right here. I see that he's got 22 lot's MacCoy: Would you please pick up the mic. It's up on the stand right there. Anyway, I live right here, right there and I counted all the lots and Ray Lorando counted them and actually there is 24. Now I am sitting there saying, if there is 24 and he wants to develop 22 lots, apparently he wants to put a pumping station in. If you wants to put a pumping station in, put it here. Don't put it here. I live. here. Ray lives here. Gene Schultz lives here. You know, I mean I get a deal (inaudible) wood duck island and people don't think they give off fumes. They do. They also are noisy and they cost money. Mr. McCall, I don't know if you know who Mr. McCall is or not, but he's the attorney the representing Marty Goldsmith, he was, came up in his fancy little Mercedes and was giving me some guff one day, but they want to come down here, what they want to do they want to come like this and go down this creek. It is what they want to do. That is still my creek and I've lived there 22 years. From here to there is very well landscaped. There is a water pool over there. There's a bridge there. They've cleaned all the rest of the debris I mean all the shrubbery and everything else out of there, so guess where all the animals live. The raccoons live here. The coyotes live here. The muskrats live here. The crayfish live here. The fish live here. Everything lives here and I told McCall that, you know. But I didn't, I'm not a -I've been (inaudible) for years. Keith knows that. I am not against development at all. Use a little common sense. If he gets this thing put in, if somebody else hooks up to it, he can just collect the money down the road, you know. It's kind of what is amount to. I told him about 4 or 5 years ago, and a couple other developers came and approached me and I told them what it would cost them to go across my property. They could come right here like this and go across my property like that. It wouldn't be a problem. They don't want to spend the money, They want to put a lift station in and other stuff to save bucks. Well, you know, if they go down that creek, you guys might argue with me a little bit, but I told McCall I would get environmentalists out there in ten seconds is what I would do, because I do have animals there. Not that I like the raccoons, by the way, because I paid a lot of money on my chow chow dog for all the plastic surgery and everything, but you know the guys have to use a little common sense. He charging X amount of dollars for lots, he wants a pumping station in, put it up some place else. Don't put it down in the corner. I've lived there 22 years. Ray has lived there 21 years. Schultz has lived there 23 years. They did put a little drainage in and it costs Schultz got $500 for it from Marty Goldsmith. But, you know, the first thing I am going to tell you, another thing 1 want to tell you about. He sent me a letter one time. He says, we're going to seek a temporary easement to go Ten Mile creek with a sewer line. Before the letter ended, and you guys probably have a record of this, we're going to get a temporary one. You know what I did with that letter? I threw it in the garbage.. I absolutely threw it in the garbage. I don't know if any of you have driven by my piece of property, but my suggestion is, and my suggestion only, but I guarantee that everybody that lives here, here, here, here, here, here, here, and here and here and here—make a public park out of it. I think they need a public park there. If they don't guess where the public park is going to be? (Inaudible) got real close to 70 (inaudible). If they (inaudible). I can guarantee they would but you know, I mean, I don't know what you guys —in planning and zoning want to do, but I am just here to represent myself. When I bought that piece of property I owned to the middle of the creek. 1 owned to the middle Meridian Planning and Wing Commission Meeting July 13, 1999 Page 57 of the road. (Inaudible) this piece of property and that's what was going on there too. If they went down this side, they would have to take his house out. I don't know what you guys really want to do. I don't want to stop development, don't get me wrong, I really don't. But I told Marty Goldsmith's attorney, Mr. Call, what it would cost him to go across my property. He kind of—and I even showed him how he could go across it— the only thing of it is that he came back to me saying, well we can go down your side of the creek because Meridian irrigation has an easement. Which they do. They have a road easement. I have lived there 22 years and they have not driven down my driveway yet—in 22 years. So I told him the same thing. What it was going to cost him. Replace the (inaudible) 45 days. That is going down my road like this. (Inaudible). I don't know. But, I am here to represent myself. Roy was going to be here but his dad is really sick tonight and of course with well I don't want anymore 2 story houses and I don't want any yellow houses built there, in that subdivision. There's a yellow house that's sitting about right there. My gosh through my pine trees, I can see it. I said, I can't control that Ray. You know on 2 story houses, but you know I think we need another park to be honest with you. De Weerd: Well Tammy there you go. You can work on that one. McDonald: Well, I hope I gave you guys a fairly good representation here on this thing, but they've been moving dirt over there —a couple weeks ago they started moving dirt. thought they're getting real excited here, but it could be an easy deal, but they want to make it a difficult deal, I guess it could be a difficult deal, so—I haven't dealt with Marty Goldsmith myself, but (inaudible) has 85 acres and I guess they finally sold it. The guy who bought it was supposed to come and talk to me, but you know but sewer doesn't run up hill unless you have a pumping station. I hope I gave you guys a good presentation. Freckleton: I wanted to clarify one thing. Their current proposal is gravity. There is no pump station. That's why they wanted to fill that entire end of that side up so they could get a gravity line to go out to the northeast into the existing portion. McDonald: So where you going to take it—down Mesa Way—northeast or northwest? Freckleton: Northeast back into Salmon Rapids. They were going to fill that entire corner enough to get a gravity line to drain out to the north and to the existing street in Salmon Rapids. McDonald: Six foot of fill from here to go up here? Freckleton: There was about 6-1/2 feet where it says site, right there. McDonald: Yeah, I see where it says site. 6-1/2 feet is not going to do it. I'll tell you something about engineers. They better and get out there (inaudible). Wood Duck Island, when I built houses down there, I watched that (inaudible) canal and all I did was Meridian Planning and Oning Commission Meeting July 13, 1999 Page 58 look at the water level where the gates were and when Hubble and those guys put that bridge in, I told Sandy Johnson, I said you know, I don't think that bridge is tall enough. She said well Hubble engineered it and I says, well I am telling you right now it's not going to make it. They turned the water down Ridenbaugh Canal, went over the top of the bridge and had to redo it. Because (Inaudible) is not going to put the sewer back up to here. I can guarantee you right now. He won't do it. There's no way. Sewage isn't going to run uphill unless you know the good Lord makes it run uphill. I mean (inaudible) over the years. I tried to do my best in building and that is (inaudible) feel about it. (Inaudible) I built a house right next door to one of the building stations, it gave out smell. They can say what they want to. It made noise. The kids got in there and if you read the Statesman a few years ago, they wrote their names on it and everybody arrested them and all this kind of stuff. It's just not — I think most of the people would like to see a park there. I mean that's my feeling. You know 22 lots, it's a lot of money. He'd rather pay the piper. (Inaudible) I can guarantee you. Thank you. MacCoy: I wish we put you on earlier. — McDonald: Yeah, it gets boring I'm sure. MacCoy: -- some time ago. McDonald: I'm not an architect, I'm not an engineer. But you know I know what works and what doesn't work and I know what kind of job you guys got. I also know the Mayor very well. Well that's what l understood by reading everything, just that didn't jive with the rest of the paperwork. What's this down here? Freckleton: A storm drainage retention. Borup: Oh, that's what all that is, okay. (Inaudible) Borup: Oh, this isn't the sewer plat I was talking about. That's the storm drain right there. Okay, that is sewer. Freckleton: The reason the number of lots don't jive is because that's the storm drain lot, it's common area. Borup: The whole lot there is. MacCoy: All right, Shari. Where are you? You made a comment earlier about the fact that we should be able to — I don't know where this letter came from. It says August 10th. Is that something that you and he worked out? Are you going to continue this? Stiles: That was probably a request from Marty Goldsmith's secretary. MacCoy: So there's no agreement here. It's just a request. Stiles: Right. MacCoy: Okay, so we could deny it. Stiles: Gary said that this was about coming out of the ground now as it was, isn't it? Minimum cover on that sewer? Borup: I couldn't see any — Stiles: This is the high point of the whole subdivision and it drops, it really drops down there. (Inaudible) Stiles: That's why they wanted six and a half feet of fill. But that is still not going to work. If they are daylighted with the sewer right now, and they've got 12 — (Inaudible) Freckleton: The other street up there Redside Way, the sewer is a little deeper up there. Up here. This is where they plan on bringing the drainage out to existing (inaudible) right here. Stiles: That's how deep? Freckleton: Maybe six feet. Stiles: And three foot is minimum. Freckleton: Yeah, by the time it back up to here, (inaudible). De Weerd: Well just to end the torture here, I would just say let's close the public hearing. MacCoy: I didn't hear anything else. Borup: Well she wants to close the public hearing she said. De Weerd: I would move to close it. Borup: We haven't even had a presentation from the applicant. De Weerd: Well I would move to deny this. W hen I received the initial results of this analysis, it appeared that the sewer flow from this phase could be accepted into the Nine Mile Drain interceptor, even though it, along with a sizable portion of other phases of this subdivision, should naturally drain to the Ten Mile Drain interceptor. Atter more detailed study of the engineering analysis it is nowGear that this N0.5 phase must drain to the Ten Mile Drain Interceptor. This proposed phase cannot be served by our Public sewer until such time as the Ten Mile Drain interceptor is extended. Secondarily, even if the Nine Mile Drain had capacity to accept this flow, a sizable length of roadway would require a fill of approximately 6 feet, This would undoubtedly cause other problems in construction of homes on the lots adjacent to the roadway fill area. The Declarent now intends that the pressurized irrigation system be conveyed to, owned and operated by the Nampa -Meridian Irrigation District, if accepted by them. A_ 1.2 ronatructiort. The irrigation water system shall be conveyed by the Declarant to either the Association or the Nampa -Meridian Irrigation District, which entity shall thereupon be responsible for the operation and maintenance of the irrigation system. A.1.4 Assessments. § 5.1(c) of Article 5 shall be deleted in its entirety and the following paragraph shall be inserted in place thereof; 5-11(c) To the Association and/or the Nampa Meridian Irrigation District regular periodic assessments, special assessments or charges for the operation, maintenance and delivery of water with respect to irrigation water system. It is contemplated that the Nampa and Meridian irrigation District shall provide pressurized irrigation water services to all lots. In addition to any assessments made by the Nampa and Meridian Irrigation District for Irrigation water, owners shall be required to pay an additional assessment to the Association, or in the event the pressurized irrigation system is conveyed to Nampa and Meridian Irrigation District, then to the District, an additional assessment under Idaho Code §43-330(f) for the operation, maintenance and repair of the pressurized irrigation water system. Each owner is prohibited from making any cross -connection or tie-in between the irrigation water system and the domestic water system. WATER FROM THE IRRIGATION WATER SYSTEM IS NOT DRINKABLE; EACH OWNER SHALL BE RESPONSIBLE TO INSURE THAT IRRIGATION WATER WITHIN THE BOUNDARIES OF THE OWNERS LOT IS NOT CONSUMED BY ANY PERSON OR USED FOR* CULINARY PURPOSES. A.1.5 n fin . Any and all references in the Declaration to the pressurized irrigation water system, including but not limited to the references In paragraphs 3.1(c), 4.1, 5.1(c) and 11.2 are hereby amended in such a manner to be deemed consistent with the provisions of this Amendment Article and in the event any provision in the Declaration regarding the pressurized irrigation system is Inconsistent with the provisions herein, the latter shall govern. Any mention of ownership, maintenance or assessments associated with the pressurized irrigation system, by the Declarant, throughout the Declaration shall be deemed amended to reflect that pressurized irrigation system shall be owned, maintained and assessments levied by the Association or the Nampa -Meridian Irrigation district. FIRST AMENDMENT TO DECLARATION OF COVENANTS - 2 P.04 Article 2. DrainageLots Maintenance. A.2.1 Recital. 1 4.1 of the Declaration sets forth that among its other responsibilities, the association shall maintain all common areas. Lot 31, Block 2 and Lot 8, dock 2 are those particular common area lots that shall be used primarily for retention pond/drainage basins (hereinafter the "Drainage Lots") which shall be maintained as follows: A.2.2 Heavy Mgintenance of Drainage Loth. Heavy maintenance consists of periodically inspecting the Drainage Lots to insure they are functioning properly; cleaning out the piping and mucking out the Drainage tots when the sediment level exceeds the designated storage level. All other maintenance shall be referred to herein as "light maintenance". Ada County Highway District (ACHD) has opted to perform this heavy maintenance and shall be allowed, by the Homeowners Association, to perform this maintenance work. in the event ACHD shall decide not to do such "heavy maintenance" then the Association shall do it. A.2.3 Easementto ACH12 for Heavy Maintenance. Each Drainage Lot shall have an access road along one side of it to support a HS -20 truck loading. Such access road shall be accessible from the adjacent subdivision street, extend along an entire side of such drainage lot and be at least 12' wide. ACHD is hereby granted an easement along one side of each drainage lot for the purpose of access to perform this heavy maintenance. An easement is granted across each entire Drainage Lot as needed for maintenance of the retention ponds by ACHD, and no landscaping or other obstruction shall be placed on the Drainage Lots in a manner that would interfere with the heavy maintenance. In the event that it Is necessary to replace sny improvements to the Drainage lots such as fences, trees and/or sod, the removal of which has been necessary to perform maintenance, such replacement shall be the responsibility of the Homeowners Association. A.2.4 Light Maintenange of Drainage Lots. The Association shall perform all "light maintenance" of the Drainage Lots pursuant to that certain Manual for Light Maintenance the original of which shall be kept on file with the Homeowners Association with copies made available to any interested party upon request. Said Manual for Light Maintenance is incorporated herein by this reference. 11UM M,717 A.3.1 Recital. Article 5 of the Declaration is hereby amended by adding thereto the following paragraphs: FIRST AMENDMENT TO DECLARATION OF COVENANTS - 3 A.3.2 Limited Assessments. In addition to the regular and special assessments, the Association shall have the power to levy a limited assessment against owners and lots for maintenance and repair of any lot or any improvement on a lot, if such maintenance and repair is necessary to preserve the quality of the Subdivision; and/or to correct a violation of the Declaration or any amendment thereto or the ACC Rules. No such limited assessment shall be levied until (a) the Board ar ACC has given written notice to the owner of the maintenance or violation cure required; (b) the owner has refused to perform the required maintenance or correct the violation within a reasonable time; and (c) the Association has incprrsd expenses for maintenance or correcting the violation. Thereupon, the Board shall have the power to levy a limited assessment against the owner to pay for the costs of such maintenance and repair or correction of violation and any other costs or expenses, including attorney fees, arising out of or incident to such malhtenance and repair of the Association. A.3.3 The last paragraph in Article 5, § 5.1 of the Declaration, shall be deleted in its entirety and the following paragraph shall be inserted in place thereof: The regular, special, limited and irrigation water assessments, together with interest thereon and costs of collection and reasonable attorney fees, shall be a charge on the lot and shalt be a continuing lien upon the lot against which such assessment is made. Each such assessment, together with interest, costs of collection and reasonable attorney fees. shall also be the personal obligation of the owner at the time when the assessment fell due. The right to collect and enforce payment of the assessments is vested in the Association. If an owner fails to pay an assessment within thirty (30) days of its due date, the Association shall prepare a written notice of assessment setting forth the type of assessment, the amount of the assessment,'the amount remaining unpaid, the name of the record owner of the lot,' and a legal description of the lot. Such notice shall be signed by the President and Secretary of the Association, whose signatures shall be acknowledged by a notary republic, and such notice shall be recorded in the office of the Ada County Recorder. Thereupon, and upon the continuing failure of the owner to pay an assessment, the lien for assessment herein created may be foreclosed upon as provided by law for foreclosure of a mortgage on real property and other real property liens. Such notice shall specify the amount and due date of the unpaid assessments and the legal description of the lot. A-3.4 Initial Regular Assessments. Initial regular assessments shall commence upon the closing of the first sale of each lot from the Declarant. At each such closing, the owner thereof shall pay the sum of 8100.00 and such portion of the greater of either an additional 8100.00 or any existing regular assessment set by the Association prorated for the remainder of the calendar year. The initial 8100.00 shall be paid to the Declarantto reimburse the Declarant for Association fees incurred by the Declarant prior to the assumption by the Association of the Association's duties and obligations with the pro rata portion of the initial regular assessment paid to the Association if the Association has conducted its first annual meeting, elected a board of directors, established a regular assessment, and assumed the obligations and expenses of the Association; otherwise, to the Declarant. Regular ensuing assessments of the Association shall commence at such time as the Association has held its first meeting, elected a board, and set the amount of the regular assessment. If -the Declarant has paid all or any portion of the expenses of the Association in excess of the initial fees collected by the Declarant, such excess amounts so paid shall constitute a credit to the Declarant of any regular assessments assessed to lots owned. by the Declarant. A.3.5 Assessment Due Date. The due date for regular assessment shall be March 1, unless some other due date(s) is established by the board. Each assessment shall be delinquent if not paid within fifteen days after the due date set forth in any notice of assessment. Any regular, special, limited or irrigation assessments levied on lots if not paid when due, shall bear interest at an annual rate as shall be set by the board from time to time, or if none is so set, at an annual rate of 12% Such interest shall commence on the date the assessment becomes due and payable. In addition to the interest charged, the board may, in accordance with Rules and Regulations promulgated by it, impose additional fines or charges for the failure of an owner to timely pay any assessment when due. The right of the board to charge interest or impose additional fines or charges shall be In addition to, and not in lieu of, any other right of enforcement or sanction available to the board in the event of non payment of an assessment.
