NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Orclinances of the City of Meridian
and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:00 p.m, on June 8, 1999 for the purpose of reviewing
and considering the application of Brian Champion for a conditional use permit for an
office /retail building, which is located at 129 E. Pine Street.

circulation, open spaces, landscaping, refuse and service azeas, utilities, signs and yazd (submit
35 copies). Also include one. 8 % " x 11" copy of site plan, elevations and list of construction
materials for all buildings.
11. A list of the mailing addresses of all property owners within three hundred feet (300 of the
external boundaries of the land being considered. This list can be obtainrrd from the City of
Meridian Planning & Zoning Department. Please request list seven days prior to submitting
application.

Corrie: Sure. Shari, they'd like a little back ground on this just to get it on the record.
Stiles: Mr. Mayor and council I didn't bring my slides or my transparency for this project.
This is the project that's immediately east of the city's parking lot on Pine Street. If
you've driven past there he's done considerable amount of work. It really fits in with the
neighborhood now, he's paved his back parking lot. He had come to an agreement
with the ACHD that he would deposit the funds for paving of the alley immediately
adjacent to his property. He's replaced the sidewalk and the curb on Pine and it'll make
a nice little office project there.

This matter is before the City Council for decision without public hearing
by reason of the provisions of § 11-2-418E, and the City Council having received the staff
report and the record made before the Planning and Zoning Commission, including the
Planning and Zoning Commission's Recommendation to the City Council, and Shari
Stiles, Planning and Zoning Administrator, having given a report, and the Council having
duly considered the matter makes the following Findings of Fact and Conclusions of Law
and Decision and Order Granting Conditional Use Permit.

1. A notice of a public hearing on the conditional use permit was
published for two (2) consecutive weeks prior to the said public hearing scheduled for
July 6, 1999, before the City Council, the first publication appearing and written notice
having been mailed to property owners or purchasers of record within three hundred
(300') feet of the external boundaries of the property under consideration more than
fifteen (15) days prior to said hearing and with the notice of public hearings having
been posted upon the property under consideration more than one week before said
hearing and the copies of all notices were made available to newspaper, radio and
television stations as public service announcements; and the matter having been duly
considered by the City Council at the said public hearing; and the Applicant, affected
property owners, and government subdivisions providing services within the planning
jurisdiction of the City of Meridian, having been given full opportunity to express
comments and submit evidence.
2. There has been compliance with all notice and hearing
requirements set forth in Idaho Code §§67-6509 and 67-6512; and §§11-2-416E and
11-2-418E as evidenced by the Affidavit of Mailing, and the Affidavit of Publication
and Proof of Posting filed with the staff report.

Development Ordinances codified at Title 11 Municipal Code of the City of Meridian
and all current zoning maps thereof and the Comprehensive Plan of the City of
Meridian adopted December 21, 1993 Ordinance #629 -January 4, 1994 and Maps
and the Ordinance establishing the Impact Area Boundary Ordinance and Map.
4. The application for the conditional use permit is complete.
5. The property is located at 129 E. Pine Street, Meridian, Idaho.
6. The owner of record of the subject property is Demond Deppe of
11725 W. Iowa, Nampa, Idaho.
7. Applicant is Brian Champion of 415 E. Trailside Drive, Eagle,
Idaho.
8. The subject property is currently zoned Old Town (O-T). The
zoning district of Old Town (O-T) is defined within the City of Meridian Zoning and
Development Ordinance, Section 11-2-408(12).
9. The proposed application requests a conditional use permit for use
of a 950 sq. ft. single family dwelling as an office and retail facility. The Old Town (O-
T) zoning designation within the City of Meridian Zoning and Development
Ordinance requires a conditional use permit be obtained for most uses including those
requested by the Applicant. (Meridian City Zoning and Development Ordinance,
Section 11-2-409).

10. The use proposed within the subject application will in fact,
constitute a conditional use as determined by City Policy.
11. The Ada County Highway District will agree to accept a deposit
from the applicant for the cost of paving the alley and will not at this time require the
paving of the alley adjacent to the subject real property.
12. The proposed conditional use permit request is harmonious with
and in accordance with the Comprehensive Plan, in that, it is consistent with the Old
Town (O-T) Policies as set forth at page 27 of the Comprehensive Plan, and in
particular section 5.1 thereof, and section 4.8U of the Commercial Policies at page 26
and Old Town (O-T) Policy at page 25 of the Comprehensive Plan.
13. The Meridian City Council takes note of and
recognizes the concerns of Blake Hatchet, 124 E. Pine Ave., Meridian, Idaho, dated
June 8, 1999, who offered testimony at the Planning and Zoning hearing.
14. To insure that the proposed conditional use and development are
in compliance with the standards of § 11-2-418C of the Municipal Code of the City of
Meridian the following considerations must be taken into account which the
application is found to be in compliance with:
14.1 Will be designed, constructed, operated and maintained to be
harmonious and appropriate in appearance with the existing and

intended character of the general vicinity and that such use will
not change the essential character of the same area; and
14.2 Will not involve uses, activities, processes, materials, equipment
and conditions of operation that will be detrimental to any
persons, property or the general welfare by reason of excessive
production of traffic, noise, smoke, fumes, glare or odors; and
14.3 Will not interfere with essential public facilities and services such
as highways, streets, police and fire protection, drainage structures,
refuse disposal, water, sewer or other public services to the affected
and subject area.
15. The following conditions of the granting of the conditional use
permit shall be imposed:
Adopt the Planning and Zoning Administrator and Assistant City Engineer
Recommendations as follows:
15.1 Applicant will be required to enter into an Assessment Agreement
with the City of Meridian.
15.2 Handicap parking, associated signage and building construction
shall meet the requirements of the Americans with Disabilities Act.
The four-foot-wide proposed walkway needs to be a minimum of
five feet wide per City Ordinance.
15.3 No signage has been proposed and none is approved with this
application. All signage will be subject to design review and
requires separate permits.
15.4 This Conditional Use Permit shall be subject to review upon ten
(10) days notice to the Applicant. A transfer of conditional use
permit application will need to be submitted and approved for any
new owners/tenants.

15.6 All development and use shall be in accordance with the Site Plan
submitted by the applicant, which is part of the record of this
application unless modified by the other conditions herein set
forth.
Adopt the Meridian Fire Department's Recommendations as follows:
15.7 Applicants shall satisfy all fire code requirements.
Adopt the Ada County Highway District Recommendations as follows:
15.8 Utility street cuts in the new pavement on Meridian Road are not
allowed unless approved in writing by the District.
15.9 Replace damaged curb, gutter and/or sidewalk on Pine Street with
new curb, gutter and/or concrete sidewalk to match existing
improvements. Segments to be replaced shall be determined by
ACRD Construction Services staff.
15.10 Provide a minimum of 30-feet of backing on the alley, measured
from the south side of the alley to the face of the curb.
15.11 No direct lot access to Pine Street has been proposed and none is
approved with this application.
Adopt the recommendations of the Nampa and Meridian Irrigation District as follows:
15.12 All laterals and wasteways are to be protected.
15.13 All municipal surface drainage shall be retained on site. If any
surface drainage leaves the site, the Nampa SL Meridian Irrigation
District must review drainage plans.
15.14 Developer must comply with Idaho Code § 31-3805 .

The Planning and Zoning Commission further advises:
15.15 The Applicant shall pave the alleyway sixteen feet wide by sixty
feet long (16' x 60'), or tender a deposit with the Ada County
Highway District an amount as they determine for the paving of
the said alleyway.
CONCLUSIONS OF LAW
Idaho Code § 67-6512 provides in part that:
(A) As part of a zoning ordinance the City Council may provide for the
processing of applications for special or conditional use permits;
and
(B) That a special use permit may be granted to an applicant if the
proposed use is otherwise prohibited by the terms of the zoning
ordinance, but maybe allowed with conditions under specific
provisions of the zoning ordinance, subject to the ability of
political subdivisions, including school districts, to provide services
for the proposed use, and when it is not in conflict with the plan;
and
(C) That upon the granting of a special use permit, conditions maybe
attached to a special use permit, including, but not limited to,
those:
1) Minimizing adverse impact on other development;
2) Controlling the sequence and timing of development;
3) Controlling the duration of development;
4) Assuring that development is maintained properly;

5) Designating the exact location and nature of development;
requiring the provision for on-site or off-site public facilities
or services; requiring more restrictive standards than those
generally required in an ordinance;, requiring mitigation of
effects of the proposed development upon service delivery
by any political subdivision, including school districts,
providing services within the planning jurisdiction.
2. The City of Meridian has exercised its authority to provide for the
processing of applications for Conditional Use Permits by the enactment of § 11-2-418
Municipal Code.
3. Idaho Code § 67-6504 provides that the City Council may exercise all of
the powers required and authorized by Chapter 65 of Title 67 Idaho Code which Act is
known as the "Local Land Use Planning Act of 1975."
4. The City of Meridian has enacted the Comprehensive Plan City of
Meridian adopted December 21, 1993, Ordinance No. 629, January 4, 1994, which
provides in part:

ORDER and this does Order that:

Gigray: Mr. Mayor and members of the Council, just a matter of procedure and advice
to the Council since this is one of these that is not subject to public hearing by
ordinance, my recommendation is that the Council's action in these matters is either
accept the recommendation of Planning and Zoning Commission since the record has
been made before them and then direct me to prepare the appropriate findings and
order in relation thereto, or if upon your review of the recommendation of the Planning
and Zoning Commission, you feel that there is further information that is needed or you
can't accept it then I would say your choices are to determine whether or not to hold a

Rountree: I have a question of Shari, if she would just give us a little rundown on this.
It looks like she is ready to do that.
Stiles: Mayor and Council, this is for the property that's directly adjacent to the city's
parking lot on Pine Street, Piasano's would be over here. There's a single family home
here and of course Stan's Mowers and Dave's Body Shop would be here on E. 1 St
Street. The applicant has gone through significant pains to remodel this house, the
existing house. It would have been very tempting for him to demolish it and start over,
but he has done quite a bit of remodeling. If you have a chance, you should go by there
and see what he's done. The only issue that was really remaining was that Ada County
Highway District wanted the alley dug out and paved the entire length back to 2"d Street.
It's my understanding the applicant has since worked with Ada County Highway District
and they have come to an agreement that he would deposit the monies with Ada
County Highway District so that at such time as they can repave the alley in its entirety,
they would do that, and he has written a check out to them. He hasn't submitted it to
them yet, but that was really the only issue that remained.

Stiles: Mr. Mayor and Council, this is the existing location where TCBY and Moxie Java
are, the Fred Meyer site. The storage units are down in this area here. At the last
public hearing before Planning and Zoning Commission, the applicant did indicate they
will probably be coming back in for this area here. They feel they've saturated the
storage unit market there, and would possibly be requesting limited office use for that
area, but an application has not been submitted yet. Planning and Zoning Commission
did recommend that it be approved. There is an existing drive through lane that goes to
the TCBY here. Originally when this project was proposed and came through a
conditional use permit, the two drive throughs were not approved due to the impact on
the adjacent residential use across Locust Grove. They are now proposing -this is two
way drive way here. They're proposing that the drive through would be coming through.
They'd have to cross the traffic, have the drive through herd and then they would be
coming back on this loop road. Staff did not recommend this configuration due to what
we feel would conflicts in the parking area. But that's about it. Do you have any
questions? ,
Bird: They're coming down the road there Shari and coming up on the east side of the
building is where the drive through is going to be, right?
Stiles: Yes, they would be coming this direction and then cross traffic to go in this drive
through lane and then they would exit through the loop road.

Stiles: Mr. Chairman, commissioners, this is for the property that is immediately
east of the cities parking lot on Pine Street. They are requesting for a variety use
office or retail. I believe that you have Ada County Highway District comments.
Staff would concur with those, with the exception that staff would recommend in
lieu of requiring them to pay the entire alley clear to second street,. that they only
be required to pave adjacent to their property. They have also requested that
sewer, sidewalk and curb be replaced. I'm not sure of the condition of the curb,
the sidewalk is in disrepair and probably does need to be replaced just from a
liability standpoint for the owner of the property. The city has replaced the
sidewalk that was in front of the portion of their lot. It would be nice if theirs were
also replaced. Other than that, we have nothing in addition to the comments that
we have submitted dated June 3, 1999.
MacCoy: The applicant stands before us I guess. Would you state your name?
BRIAN CHAMPION, 415 E. TRAILSIDE DRIVE, EAGLE, ID.
Champion: My plan for conditional use permit is pretty self explanatory. There
was an existing house of 950 square feet. The exterior was in complete
disrepair. I've gone in and since purchasing this property I've been refurbishing it
with all new siding, new windows and putting the roofs on. The project will look
basically new, as it once was. I'm adding no new square footage to the property
of the project. Myself, I'm a mortgage broker and I would like to run my office out
of there and lease another office space out. That's about it.
MacCoy: Okay, thank you. Commissioners, do you have any questions of Mr.
Champion?
Borup: Have you had a chance to review staff comments?
Champion: Yes, I find no problem...
Borup: With ACRD also?
Champion: With the revised comment that Shari mentioned I could, I would
appreciate if that could be taken into consideration. As the alley is the main
access to your new city park, there is going to be an awful lot of traffic created to
your park as it is a one way. I don't think I should be made to pay the half of the
alley for that 60 feet by 16, is a pretty good area.
Borup: So that was the only concern was the paving of the alley. Do you have
30 feet? Comment No. 4 provide a minimum of 30 feet of backing on the alley.

Borup: What is the width of the alley now?
Champion: The width of the alley is 16 feet. The backing that they are speaking
of, perhaps Shari could speak towards that, but that's on my property. I have to
have 30 feet on my property.
Borup: In addition to the parking or does that count the parking stalls.
Champion: That's for the parking.
Borup: That counts the parking stall?
Champion: Yes.
Borup: Okay. And you are going to have plenty of that when the garage comes
out and you move into the (Inaudible).
Champion: Plus the handicap accessible parking place and... ,
Borup: I have no other questions.
MacCoy: I was going to ask you about that, that's okay, you've answered that.

Borup: Oh, maybe, I'm song. Just dne quick one. I expected Shari to say
something about the parking stall sizes, as indicated on the plat. I think was
showing 9 X 18?
Stiles: That does meet the ordinance requirements for the angled parking.
Borup: Oh, because it's angled. I was thinking 19. Thank you. That's all.

Barbeiro: Mr. Champion, staff made note of the existing sidewalk out front as far
as your concerned replacing of that sidewalk if necessary is acceptable.

MacCoy: I noticed-I'm glad you talked about the refurbishment of the place. I
am going to ask you along with the ACRD questions was about your ramp and
hope that it was going to stay in there before the ADA requirements. Prior to
purchasing the property I did meet with the building inspector and Planning and
Zoning and wanted to make sure that the project could fully meet the
requirements and intent for the Planning and Zoning requirements. It does. The
building inspector did tell me that he would require a handicap accessible ramps
and parking places into the building which have been noted on the plan. Any
other questions for Mr. Champion? If not, you could sit down. Anyone here who
would like to speak in favor of the project. Seeing none, anybody here who
would like to speak ~on the other side of the fence for this? All right, in the back of
the room, you come forward.

Hatchet: I guess mostly my questions is I thought I heard him say that the
parking is going to be in the back. So there is going to be no parking of any
vehicles to the front on Pine Avenue?

Hatchet: Right, there is a handicap in the back then access?
MacCoy: Yes there is on this map.
Hatchet: I don't know if this really has-it has to do with the parking on Pine
Avenue and it also has to do with the parking lot that they were talking about right

MacCoy: City lot?
Hatchet: Yeah, the city lot. Kind of a question about-a lot of people don't use
that lot, because there is no sign saying like you know, parking or anything. Are
you guys aware of that at all?
MacCoy: Let me turn it over to Shari over here. What do you want to say about
that Shari?
Stiles: Well, the parking lot does seem to get a lot of use, particularly when
Piasano's is open there is a lot of parking in there. I guess with the lot next to it,
had the big sign up say no parking, no trespassing, private property. You know, I
don't know if people associate that with the parking lot. It might be a good idea

to put the public parking up when it gets to a point when the use becomes more
intensive and we need it just for people that come down to shop or eat. We may
have to actually sign it with a two hour parking so that employees at certain
businesses aren't just using that for their parking all day long. It's probably a
good idea to designate that as a public parking lot.
Hatchet: A sign would be great, the only reason I brought that up is because we
have a sign in front of our house because on Friday and Saturday nights they
have quite a lot of people and there is only like-I don't know if you have ever
seen the front of the building there. The whole office retail building section next
to Paisano's, there is only maybe 10 slots in the whole place. I haven't gotten
into detail, maybe I should've on how many exact slots there is, but I'm sure
there is not enough for that-the main capacity of the restaurant. So they are
overflowing onto Pine Avenue and like I said, half of them don't use that and we
have a sign saying please no parking because technically the law says you can't
tell someone-it's a public street, I don't want to tell anybody that they can't park.
You know, we just have a sign of our own, it seems to help, but we still have a
problem with parking, that's the only reason I was up here, kind of concerned
about it. Mostly the sign about saying public parking or anything. That would be
good. I guess that's it, thank you.
Smith: Just for your information he does have five spaces off the alley...
Hatchet: Oh, he does?
Smith: Which should be more than adequate.
Hatchet: Oh, I would say so. That's why I was up here trying to find out. Thank
you.

1.8 Replace damaged curb, gutter and/or sidewalk on Pine Street with new
curb, gutter and/or concrete sidewalk to match existing improvements.
Segments to be replaced shall be determined by ACHD Construction
Services staff.
1.9 Provide a minimum of 30-feet of backing on the alley, measured from
the south side of the alley to the face of the curb.
1.10 No direct lot access to Pine Street has been proposed and none is

Adopt the recommendations of the Nampa and Meridian Irrigation District as

1.11 All laterals and wasteways are to be protected.
1.12 All municipal surface drainage shall be retained on site. If any surface

Facts and Findings:
A. The Ada .County Highway District (ACRD) staff has received the above referenced
application requesting conditional use approval to convert a 950-square foot single family
dwelling to an office and retail facility. The 0.2-acre site is located on the south side of Pine
Street approximately 300-feet east of 1st Street. This development is estimated to generate
20 additional (10 existing) vehicle trips per day based on the Institute of Transportation
Engineers Trip Generation manual.
B. The application and site plan stamped as received by the City of Meridian on Apri120, 1999,
and submitted to the District on May 5, 1999, have been reviewed by the ACRD Planning
and Development staff and conforms to applicable District standards/policy, or can be made
to conform with the change(s) to the plan described in the requirements stated below.
This is a staff level approval and will not be heard by the ACHD Commission unless the site
plan is changed in such a manner as to not conform with District standards/policy or an
appeal of the Planning and Development staff decision is submitted as described within the
Standard Requirements outlined below.
The following requirements are provided as conditions for approval:
Site Specific Requirements:
1. Utility street cuts in the new pavement are not allowed unless approved in writing by the
District. Contact Construction Services at 387-6280 (with file number) for details.
2. Replace damaged curb, gutter and/or sidewalk on Pine Street with new curb, gutter and/or
concrete sidewalk to match existing improvements. Segments to be replaced shall be
determined by ACHD Construction Services staff. Contact Construction Services at 387-
6280 (with file number) for details.

3. Pave the alley~ll required width of 16-feet wide alor~e south property line, from the
site's western property line to 2nd Street.
4. Provide a minimum of 30-feet of backing on the alley, measured from the south side of the
alley to the face of curb.
No direct lot access to Pine Street has been proposed and none is approved with this
application.
Standard Requirements:
1. This decision of the Planning and Development Supervisor may be appealed to the Ada
County Highway District Commission by the applicant or by another party within 15
calendar days from the date of this report. Th_e request shall specificall, id n ify each

Commission at an evening meeting within 20 calendar days of the District's receipt of the
appeal letter. The appellant will be notified of the date and time of the Commission meeting.
2. After ACHD Commission action, any request for reconsideration ofthe Commission's action
shall be made in writing to the Planning and Development Supervisor within two days of the
action and shall include a minimum fee of $110.00. Thy r~auest for reconsideratinn shall

request for reconsideration will be heard by the District Commission at the next regular
meeting of the Commission. If the Commission agrees to reconsider the action, the applicant
will be notified of the date and time of the Commission meeting at which the reconsideration
will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACRD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building
permit (or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances,
plans, or other regulatory and legal restrictions in force at the time the applicant or its
successors in interest advises the Highway District of its intent to change the planned use of
the subject property unless awaiver/variance of said requirements or other legal relief is
granted pursuant to the law in effect at the time the change in use is sought.

8. No change in the terms and conditions of this approval shall be valid unless they are in
writing and signed by the applicant or the applicant's authorized representative and an
authorized representative of the Ada County Highway District. The burden shall be upon
the applicant to obtain written confirmation of any change from the Ada County Highway
District.
Conclusion of Law:
1. ACRD requirements are intended to assure that the proposed use/development will not place
an undue burden on the existing vehicular and pedestrian transportation system within the
vicinity impacted by the proposed development.

The Nampa & Meridian Irrigation District requires that a Land Use Change/Site
Development application be filed for review prior to final platting. Contact Donna
Moore at 466-7861 for further information.
All laterals and waste ways must be protected. All municipal surface drainage
must be retained on site. If any surface drainage leaves the site, the Nampa &
Meridian Irrigation Disbict must- review drainage plans. The developer must
comply with Idaho Code 31-3805. It is recommended that irrigation water be
made available tD all developments within the Nampa & Meridian Irrigation
District.
