These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: This site is located in a R-15 zone, which permits home occupations with a Conditional Use Permit. The Applicant has converted the front porch of her residence to a hair salon and intends to operate the business out of this location up to three (3) days per week. With the exception of operating a Home Occupation prior to receiving a permit, the Applicant is in substantial compliance with Ordinance conditions for Home Occupations, as listed under Section 11-2- 410.D.2.c. 1 • Sanitary sewer and water to this facility would be via existing service lines. This site currently is assessed with one water hookup and one sewer hookup. Assessments for sewer and water service will be reviewed to see if additional load would justify an adjustment. Please provide any information that you may have with regard to your anticipated water demand. Applicant will be required to enter into an Assessment Agreement with the City of Meridian. 2. We had met with her and talked about the possibility of being able to use some of BMC's parking and she does have a letter here tonight that they will allow her two parking spaces on their property which would meet the requirements for off street parking. So I guess she has met the requirement on the recommendation to the City Council on page 3 that she would work with BMC West and she has received permission and that the handicapped access meet with the building department's approval. The main concerns we have are-staff doesn't particularly have real concerns about the lack of off street parking, Ada County Highway District, however, has put some pretty extensive requirements on paving the alley, and replacing curb, gutter, sidewalk on Broadway. We have had a similar request for an in home salon further down on Pine, if you will remember. She had to go through some pretty extensive renovations, had to make it handicap accessible, had to put in a parking lot. I think we need to be consistent in our requirements, but there is no off street parking in this proposal right now. MacCoy: That was also an one chair operation too. Sayko: Well I guess if that's all they require I could have one built for the front and if a handicap client does come, I can actually slide it out from the side of the house. MacCoy: You could do that. Sayko: Well, that's what I'll do then, that would be reasonable. MacCoy: One side has to have a handrail on it. Check with the building department for the requirements of that, but you have a ramp that meets certain requirements and a handrail that they will tell you about and you put it up there and move it where you want to. Sayko: That would be great then, that would be perfect, I have no problem with that. Borup: Are we saying this business would fall under the guidelines of ADA is that what you are saying? MacCoy: She is a public establishment. This is not a private situation. Borup: I thought there was some other-I just want to comment. MacCoy: I think it's a pretty good deal. Sayko: There is space in front of my house for three cars. One being my own, we have measured it and I only have my car and one other client at a time. Then there is another one that is a nail salon up on Meridian. Sayko: These are home salons as well? Stiles: They live there and they work. Sayko: Yeah, I would love to do all those things, it would be great for me to have a driveway myself in the back not have to park on the street. Unfortunately due to an illness that is taking me into the home and has left me financially exhausted. Borup: I believe the other two had existing driveways going back too. MacCoy: They did. Stiles: But they didn't have handicap parking and they weren't, in the case of Meridian Road, it was not paved. Borup: Meridian Road wasn't paved? Stiles: No, their driveway and parking area. Borup: Right, yes I know that was paved. Stiles: It may be that a ramp is not a reasonable accommodation in this case, I don't know how high that is, it looks like maybe a foot in a half, two feet, so you are looking at a 24 foot ramp. Sayko: Right, well I... Stiles: I guess whether it's a reasonable accommodation would be up to the building inspector. De Weerd: 24 foot? I can't say it would be up there all the time, because the doorway is not large enough to put steps and a ramp into the salon. Freckleton: I don't believe that a 24 foot long ramp by three foot wide would be real movable. MacCoy: I don't either. Freckleton: If it's in place, I think it's going to be in place. Sayko: Oh, okay, but it can be anywhere on the property? MacCoy: One of the things that can be done, I've seen this done, in fact I've even done it. You build the ramp over the steps and then you have a trap door, so you (Inaudible) locks in and catches on the handrail so you could use the steps to go up and down till you have somebody coming and then you drop the board down, slope down and then you have a sloped piece. So there is a way to do things, but check with them first before you do anything. Sayko: Yeah, yeah, okay. Borup: I think that the one and ten or one and twelve is intended for someone to go up the ramp unassisted by themselves usually. Gigray: Mr. Mayor and members of the Council, this is the first time we've run into this type of withdrawal of an application particularly after you have had a public hearing and you've had all the Findings and all of the paperwork drawn. I would recommend to the Mayor and to the Council as a cautionary in this regard that a notice be sent. We would prepare it for the Mayor's signature or for the Clerk's signature rather that this request has been submitted, that the Council continued this for one meeting and that it will in fact dismiss this entire proceeding and all applications if no other word is received between now and next meeting and then it can be on the consent agenda for the next meeting if no further communications are received. I just think as a cautionary. I realize Mr. Hoffman has represented this applicant all the way through this process, but there's a lot of work gone into this. It's been through a lot of processes. You just want to make sure there weren't any miscommunications. I think that would be a little~safety valve. Corrie: Okay, discussion? Bird: Mr. Mayor I wasn't on the Council, but wasn't there something in the building of that building that went in with the annexation of -there wasn't? Okay. Corrie: Before I start on 9, Mr. Gigray you made a comment to me that you'd like to have number ten and nine switched. Do you want to comment on that? Gigray: Thank you Mr. Mayor, members of the Council, I would make a recommendation to the Mayor and City. Council that you reverse the order of these. The basis upon my recommendation is the fact that the Hollister application is in fact the property that abuts the City of Meridian and these were submitted together but have been separated for purposes of holding public hearings. I would recommend that you take action on Hollister first. That you could take action on approval of the School District's Findings of Fact and Conclusions of Law if you find them in order together with Meridian City Council Meeting April 20, 1999 Page 8 approval of the proposed development agreement, but that you hold action on approval of the annexation ordinance on the school district one meeting behind approval of the annexation ordinance on Hollister so that when those are submitted to the State Tax Commission and for recording, it is clear that one has been recorded and is enacted before the other so that we don't have the State Tax Commission sending back the ordinance because of that particular issue. I checked with Bruce Freckleton today about that. I had some concern about what might happen. He indicated that that would be a possibility and that the prudent thing to do would be to move in that fashion. Corrie: Okay hearing no objections from the Council we'll move item ten back to nine if no objection. 10. Gigray: Mr. Mayor and members of the Council, we've prepared these at the direction of the City Council based on action taken at the last meeting. We have included the staff findings. There was some issue with regards to the requirement for landscaping adjacent to the road. I believe that that's been taken care of here and there's a specific finding in these proposed findings relative to that point due to the application of the School District that there wouldn't need to be landscaping adjacent to the subdivision. I would say that I have comment with a representative of the Hollisters in this matter and I think the language of all of this has been worked out. Corrie: Any other comments of Council? Rountree: Mr. Mayor, item 4.11 on page 13 is a repeat; so I would suggest that we in the motion just delete that item. 4.9 is the same. 4.11 and 4.9 are the same. Corrie: 4.11 then. Stiles: Mr. Mayor and Council, I believe the reason this was tabled last time was so they would give the applicant an opportunity to meet with staff and discuss some of the issues as relates to the ordinance requirements. We reached kind of an empass at that meeting that we really don't feel it's a staff decision to negotiate on terms of the ordinance particularly as regards the pedestrian walkways for the requirement for a sidewalk and the tiling of the ditches. Those are ordinance requirements and it would be up to the Council if they want to entertain a waiver of either one of those requirements. The sidewalk I can understand that Ada County Highway District is a little hesitant to require that at this time, because it will require the removal of the existing house, which was a recommendation of the Planning and Zoning Department as a condition of annexation. Our main issue is still with the sidewalk, that is going to be a high pedestrian traffic way with the park going across the street and also it's been observed on Sundays that their parking doesn't appear to meet their need, and there have been occasions where people are parked up and down Ustick Road with no walkway. I think that is a safety hazard. As far as the tiling of ditches, anybody else that comes in, they are required to relocate the existing ditches out of the right-of-way out of future right-of-way and relocate those on to their own property. So I guess our meeting didn't result in anything new and it's up to Council to what they deem to be in the best interest of the city. Corrie: Okay since this is a public hearing I invite Mr. Hoffman or his representative of the church here tonight. Hoffman: Mayor, Councilmen, Paul Hoffman, Boise, Idaho. That the applicant, Tina Sayko, owner of the property is granted a conditional use for a home occupation, specifically for the operation of a hair salon business out of the subject site for up to three (3) days per week. 2. This permit is subject to the following terms and conditions: 2.1 All sanitary sewer and water to this facility is to be via existing service lines. This site currently is assessed with one water hookup and one sewer hookup. Assessments for sewer and water service will be reviewed to see if additional load would justify an adjustment. Applicant shall provide information with regard to anticipated water demand. Applicant will be required to enter into an Assessment Agreement with the City of Meridian. 2..2 Handicap parking, associated signage and building construction shall meet the requirements of the Americans with Disabilities Act. 2.3 No signage has been proposed and none is approved with this application. All signage will be subject to design review and requires separate permits. The Ada County Highway District (ACRD) staff has received the above referenced application requesting conditional use approval to operate a hair salon in an existing single family dwelling. The site is located on the north side of Broadway Avenue, approximately 800-feet east of E. 1st Street. This development is estimated to generate 10 additional (20 total) vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. B. The application and site plan stamped as received by the City of Meridian on December 22, 1998, and submitted to the District on December 23, 1998, have been reviewed by the ACHD Planning and Development staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. There is only one way to get to my front door. It's a very small little walk up one step into the front door. I've been a hair dresser for 18 years. I have a set clientele, I do not do any handicap people and won't. Stiles: You can't say that though, that's against the law: What if one of your clientele, what if one of your established customers becomes handicapped? Sayko: Well, we'll carry them in. We'll lift them in. Borup: You laugh, but that's... an accepted method. Sayko: I can understand where she is coming from. It's totally unnecessary... Stiles: I don't believe carrying somebody in is an accepted method for... Sayko: I've seen it done at other shops, not with my clientele, but actually, I've worked at shops with handicap entrances but then they were two story salons and actually hairdressers would come down stairs and carry the people up, if necessary. I don't have any handicapped people and never have. I don't think I ever will, I have a set clientele. I'm confused about how I would a ramp up the front door. Stiles: It appears it would be a reasonable accommodation, I don't know what the cost would be, but you've got to two steps there. I think it would be in your best interest to look at it. MacCoy: How about the back door? If you go around the side of the house, can you get in the back door by putting a ramp up there and getting in and running them through the house. Stiles: Then they have to go clear through the house. Sayko: Yeah I could. Well I could. The dog might slide out the door, Kathy runs out her dog door, but sure. Whatever, I don't know what to say really. MacCoy: All it says is that you have to have handicap access to that floor of the building that they are going to have the work done. So you can do it any door you want to. Sayko: Well, I guess that will work. Do you have to pave those things? Concrete them in or is there a requirement, just some kind of a ramp.
