CHERRY LANE: Corrie: At this time I will open the public hearing and first hear from staff. Staff, do you have any questions as far as the recommendation on the Planning and Zoning Recommendations? Shari. Stiles: Mr. Mayor and Council, I don't really have any questions. I'd kind of like to let you know what has happened on this project. It's gone on since I think they initially submitted in November. They're proposing one acre lots on septic systems. They are immediately adjacent to the Parkside Creek Subdivision and there is no sewer available at this time to serve the property. So they came in for the annexation and zoning to an R-2 density. They then also submitted a preliminary plat. There was extensive discussion because of the fact that a five acre parcel exists to the south of this property that they also want to develop, but the staff told them that we wouldn't recommend that more than the four lots be on a private road. They're proposing a 30 foot wide gravel road to serve these three additional units, two additional units. There is an existing house on the property on Cherry Lane. As we were going through the process with Planning and Zoning Commission, one of the commissioners noted a paragraph in our comprehensive plan that said if density below three units per acre were proposed, it had to be considered as part of a conditional use under the planned development guidelines and also that they had to provide a cost benefit analysis to the city. There has been an additional development since this project has come in. It's something that you will see in the future. I don't know how much I'll say without Mr. Gigray stopping me, but there is an application in the process for 40 acres at the southeast corner of Black Cat and Cherry. I'm not sure how the Public Works Department is going to review that and what their comments might be as far as using the existing sewer system to serve that as part of the Planning and Zoning Department's review, we would require that at least the stub be extended to the Brown property, which is the five acres to the south of this property. I don't know if that will have any impact on your recommendation. Staff did have a very hard time with this project because of the many terms in our comprehensive plan that it was not consistent with. Other than that, Mr. Manship is here and anxious to at least J.1 0 Meridian City Council Meeting June 15, 1999 Page 35 get some kind of decision so he knows where he's going and what he can do with his property. If you have any questions of me, that's about the history I have of this project. Corrie: Shari, I had a question. There's a lot of conditions on this from the Planning and Zoning Commission. Do you feel we need the developer's agreement on this or not? Stiles: I believe we did request a development agreement. Corrie: You could have. I didn't notice one, just a question to you. Have you seen any of the plans of the stuff that's going to go in now to the west of your property and how does that tie in with what you're thinking about developing? Manship: The last I heard, a doctor out of Seattle purchased the property next to me and was sitting on it as an investment. This is news to me tonight about the future development of that property. Every month that goes with this, it's gone on since November, is dollars out of my pocket keep going on it and I'd hate to wait another year or so to see what the other gentleman is doing. Anderson: Is this like a flag lot just has a narrow 30 foot entrance coming in off of Cherry Lane and then goes back in the back. Manship: It's actually about 120 something feet of Cherry Lane frontage and the 30 foot easement goes along the north / south on the west side of the property to service the five acres behind me. I'd like to add a note. A gentleman just put earnest money down I guess for an agreement to purchase the back five acres and just hold on to it as farm ground and keep it and he is here and I don't know if he's going to speak or not. But he has no plans on developing it. We had a discussion today about it. Thank you. Anderson: Thank you. Gigray: Mr. Mayor and members of the Council, point of information and you may want to inquire of the staff about this. As I was preparing for this meeting reviewing the recommendations to the City Council from the Planning and Zoning Commission, it didn't appear to me that there was a recommendation on this particular matter that a development agreement be entered into although it appeared that the recommendation posed a number of conditions of annexation, which I don't believe we can do without doing a development agreement. Although it looked like many of these conditions were relative to the platting process and I know that there's a preliminary plat I believe is the next public hearing and what would be helpful I would think in your consideration would be to clarify with staff whether or not they feel that the conditions are important to have for annexation in case something happened and the plat didn't go through or whatever and whether they would recommend that a development agreement be prepared in conjunction with the annexation and zoning and then you would probably if that question were asked and then answered, I think Mr. Manship should have an opportunity to respond as to what his position is since it's not specifically stated in the recommendations. Corrie: Shari, comment? Stiles: Mr. Mayor and Council, I would agree that one of our comments should have been that a development agreement should be entered into for this property. Rountree: Mr. Mayor as much as I sympathize with what Mr. Manship has gone through since November, I have a real difficult time seeing that this annexation and subsequent plat is of any particular benefit to the City of Meridian. I can see that given the amount of land around it that's within the city that apparently is going to be developed that there's future inconsistencies with what it's zoned, what it could developed at, what's being asked for here or living with these little piece meal annexations in some instances and some rather large ones in other instances that are inconsistent with what's going on around them and I for one have a real difficult time supporting this application. Though as I said before, I really sympathize with what you've got and gone through to try to do something with this. We can't service it. I think that is something that we need to consider if we're going to be annexing properties that we cannot service even on a relatively small scale in my opinion that establishes a precedence and makes it difficult to say no the next time. The Applicant, Jeff Manship, is the record owner of the subject property. 6. The property is presently zoned by Ada County as Rural Medium Density Residential District (R-3), and contains one house. 7. The Applicant requests the property be zoned (R-2), Rural Low Density Residential District . S. There are two R-4 subdivisions to the north and southwest of the subject property. The proposed site is bordered to the west by vacant land also designated R-4. 9. There are three small acreage ranchettes that lie to the east of the proposed site. The proposed site of the subject property is within one-half mile of Albertsons, Fuller Elementary, and the Cherry Lane Golf Course. 10. The city limits of the City of Meridian are adjacent and abut on the west of the subject property. 11. The property which is the subject of this application is within the Area of Impact of the City of Meridian. 12. The entire parcel of the property is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area as defined in the Meridian Comprehensive Plan. 13, The Applicant proposes to develop the subject property in the following FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 3 AND DECISION AND ORDER OF DENIAL / JEFF MANSIP - PROPOSED CHERRY LANE ESTATES 0 0 manner: Subdivide the proposed site and construct and develop single-family residential lots of one acre in size or larger. 14. The Applicant's requested zoning of the subject property as Rural Low Density Residential (R-2), is consistent with the designation on the Meridian Comprehensive Plan Generalized Land Use Map which designates the subject property as Existing Urban. 15. There are no major or scenic features of major importance that affect the consideration of this application. 16. The City at this time cannot provide sewer utility service to the subject property and the application does not propose to provide for the extension of Citv sewer utility service to the subject property and the subject property is not considered desirable for annexation and development as proposed under such conditions. 17. The City of Meridian has authority to annex real property upon written request for annexation and the real j being g contiguous or adjacent - t to city boundaries and that said property lies within the area of cit Y impact as provided by Idaho Code Section 50-222. The Municipal Code of the City of Meridian Section 11- 2-417 provides the City may annex real property that is within the Meridian Urban Service Planning Area as set forth in the City's Comprehensive Plan. 2. The City Council may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 3. The City of Meridian has exercised its authority and responsibility as provided by "Local Land Use Planning Act of 1975', codified at Chapter 65, Title 67 Idaho Code by the adoption of `Comprehensive Plan City of Meridian adopted December 21, 1993, Ord. No. 629, January 4, 1994. 4. CHERRY LANE: MacCoy: Staff do you have any comments on this one now before we start the= public hearing? Freckleton: Mr. Chairman, members of the commission, from the public works standpoint, probably the biggest issue that I would like to point out would be sewer and water service to the proposed subdivision. Back when Cherry Lane was rebuilt two years ago, I believe it was. There was a ten inch water main stubbed into the 30 foot easement that transverses along the westerly boundary of this project site. That water main stub was funded by Mike and Cheryl Brown and their partners in the property that is south of this subdivision. Ownership of that particular stub remains with them as far as I know until it is extended. So that's where that line stops right now. They've put it in to the right-of-way to get it outside of the public street improvements for Cherry Lane in that road. Sewer for the site, this would have to sewer to a future trunk line that would come up Black Cat and then follow Ten Mile Creek. It's our recommendation that a dry line sewer be installed at this point in time in that 30 feet so that it would sewer, in the future when the trunk line is there to the south to that trunk line. So as far as sewer and water goes that's about where we are at. MacCoy: Okay, thank you. Shari? Stiles: Chairman MacCoy, commissioners, you have our comments that have been submitted that are dated December 7, 1998 because we did get these prepared so late, we requested that the applicant come prepared tonight to address each of the items on this memo. It's not typical that the city would consider annexation and subdivision of a plat without provision of sewer service. We would not like it to be a president to think that everyone within the city does PLANNING & ZON111COMMISSION DECEMBER 8, 1998 PAGE 49 not have sewer available to them at this time would be able to just go out and subdivide their property into one acre lots. Because this is pretty much at the end of the line and such a small piece, I didn't think it was particularly a terrible idea, there are some issues as far as the 30 feet easement. We would like to get a copy of that easement that accesses the property to the south to make sure that they have the right to use it as a private drive for addition lots. The size of the easement being 30 feet wide would not meet any public road requirements and may restrict future development options for the enclave that would be created at the south of this property. We don't have any particular private road standards, but have followed to so degree what Ada County requires is that unless it is a public street, development would be restricted to no more than four lots. With this development that there would be two lots on it already. They are proposing, I guess, access directly to Cherry Lane from the northern most lot, currently has access to Cherry Lane. There are ditches on the property that they don't show any kind of easements or how those ditches are to be handled. We would like information on that. Pressurized irrigation system would be required per city ordinance unless that is waived or a variance is applied for by the applicant and granted by City Council. One comment that we have made is that they would need to create a 15 foot wide easement adjacent to the south boundary of Lot 1, Block 1 for a sewer service line to the house that is = immediately east of this proposed development. This whole little area in there, probably due to the fact that there is not sewer available at this time is pretty much all of it is an enclave, it would further make an enclave of the approximately seven and a half acre parcel to the south. We ask for landscape setback on Cherry Lane, there is live stock, currently live stock on Lot 1, Block 1. If annexed, we would request that the right to that would cease to exist if they didn't use the property for that purpose for a period of one year and that additional animals beyond those that are presently there not be permitted. A development agreement could be required as a condition of annexation taking care of some of these items at your discretion. MacCoy: Okay, thank you. We are trying, like I said four weeks ago we submitted a preliminary to determine if it was feasible and worth while purchasing that piece of ground. It is for sale right now. I just bring that up just in case there is any concern or anything. I don't have any complaint—I don't really care what goes on, I'm just letting you know what the status of that south piece and we looked in to the private lane and yes Ada County will only let us put four residence on the that and it has to be a private lane and we plan on putting in a paved private lane down to that site, (Inaudible) four residences. Anyway, a little bit of insight. MacCoy: Anybody else want to get up here and speak for behalf of the project? If not, anybody ready up to speak on the other side of the fence. Brown: I just have some concerns about what Mr. Manship is trying to do with the two lots and the sewer system also which is going down the south side of this property which is our and the water main, or the water line that we have stubbed in across Cherry Lane at our expense. That's all I wanted to say. Borup: AT present time here, what's your access to your property? Brown: We have a 30 foot ingress/egress easement coming down off of Cherry Lane. How it's stating in the deed. Borup: So is it a separate deeded property or an easement through his property? Freckleton Mr. Borup, when I read Mr. Manships warranty deed, it is an easement. His property is subject to a 30 foot easement on it's west boundary according to his warranty deed. Cheryl and her file had some legals, they weren't recorded easement or anything, so that's why I requested that she get me some documentation of what she has recorded on her property as far as the access to her property, so that we can take a look at that and see what that—you know, maybe have legal counsel take a look at it and see what kind of legal rights that legal easement granted them on that 30 feet. We need to look at the language of the easement. I guess one of my concerns is what legal rights are there for the Manships? Borup: That was my question, if there is an easement there, who has access for use of that easement? Is that strictly the Brown Property or is that? Freckleton: That's my concern, is who is that easement benefiting? Borup: What was your understanding Ms. Brown? Brown: That it was for us, since we have... Borup: ...And no one else could use it? Brown: No, I think, you know Mr. Manship can use it too, but it was specifically wrote in there for us, since that is our only way back to our property. Rossman: Typically an easement will just grant Ms. Brown access. It's not an open ended easement that would grant the public -4 mean it's not a public road. Brown: Right. Borup: How about the easement that the property goes through? Rossman: The owner of the property that is granting the easement? Sure, he's got access. Unless it's a deed, he's not deeding the property, it's just an easement. Does anybody have a copy of it? Freckleton: That's what I've requested. The only thing that concerns me is—you know, they are talking four houses on the back five, he's talking two. So you are looking at six more houses on there running septic, not actually hooking up to it. They are proposing septic, I don't know if they are proposing well, but Ada County allows, and I think Meridian does too, doesn't it—a hookup if you are on one acre to a well. So I'm on well and septic and without—do they do any kind of studies on that kind of stuff as far as, you know, potential well contamination and that kind of stuff. So that is my biggest concern. MacCoy: Bruce do you have any comment to what he said? Freckleton: Just address the water issue. City ordinance does specify that if you are in the city limits and you are within 300 feet of a city municipal main, you have to connect. There is no provision that I know of to allow them to hook to a well when they are that close to a main. Borup: With 300 feet? At the time Cherry Lane was rebuilt, service lines were extended to Mr. Manships property and this gentleman's property, on the frontage of Cherry Lane, for existing homes. Borup: Is Mr. Turner in the city limits? Freckleton: No, he is an enclave. MacCoy: Okay, is there anyone here who would like to make a comment at this time? Staff do you have anything left you want to say? Borup: I have a question for staff. Any comments on how this relates to Comprehensive Plan? Stiles: Comprehensive Plan I'm not sure the exact wording of it, if it says they would be required to hook up to municipal services. It is in a R-3 zone, if they would go through the county, it's likely that they would get approved. I'm not sure if you'd gone to the county or—I mean they have existing rights on the property as far as the existing zoning. Our Comprehensive Plan in dealing with the 5 acre lots, that is the minimum in an RT zone without hooking up to sewer and water. I don't know specifically what... Borup: Since it's already R-3 rather than RT then. Stiles: Right. MacCoy: Okay, we've got a public hearing open here, what's the commissioners viewpoint? De Weerd: There aren't any further comments? Borup: Before we close the public hearing, I had meant to—I want to make sure I understood Mr. Manships statement. I believe he said he had no problems with any of the site specific staff comments.
