The City Council takes judicial notice of its Zoning, Subdivisions and - ~ r FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 1 , AND ORDER-OF DECISION GRANTING A VARIANCE FOR GENE -AND ROSE KLEFMAN /REDUCE SETBACK FOR KITCHEN ADDITION a. E . a s i, 1 ~ ~ ~ _ ~. a • s 4 Development Ordinances codified at Title 11 Municipal Code of the City of Meridian `ti and all current zoning maps thereof and the Comprehensive Plan of the City of Meridian adopted December 21, 1993 Ordinance #629 -January 4, 1994 and Maps. °~ 2:, The requirements of Idaho Code §§ 67-6509, 6516 and §§ 11-2-416~E and 419 D as evidenced in the record of this matter have been complied with. i3:" This is an application for a variance from the provisions of § 11=2-410(A) ZONING SCHEDULE OF BULK AND COVERAGE CONTROLS (REAR), which require a 15' rear set back, which the Applicant seeks to "reduce to 12', for the construction of;a small addition to their existing residence to accommodate their need ,. to replace an existing porch. 4. The Applicants are Gene and Rose IQefman, whose. address is 3725 N: e Sea Cove Way, Meridian, Idaho 83642.. The location of the_subject property is Lot 10 Block 3 of the Lakes:at Cherry Lane No. 2, Meridian, Idaho. 5. , The legal description of the property appertains to the .real property that is included within the variance application, and which description is attached hereto as ,, Exhibit "A". ., ~' 6. The. existence of special circumstances or conditions affecting the property are: That by`reason of the unique dimensions of. the property and the actions of the . a contractor, the residence was not~placed'upon the subject property facing Harbor Point,. FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 2 . AND ORDER OF DECISION GRANTING A VARIANCE >: FOR GENE AND -ROSE KLEFMAN /REDUCE SETBACK FOR KITCHEN ADDITION .. There is no other place to~'expand and construct other a than that 'area"presented in the proposed Site Plan, denoted as: "John Frazier Construction, Inc., THE LAKE AT CHERRY LANE #2, LOT 10 BLOCK 3". ¢ 7. Strict compliance with the requirements of § 11.2-410(A) of the i Municipal .Code of the City of Meridian would result in extraordinary hardship to-the owner, and developer, because the conditions and-requirements of the ordinance would result in inhibiting the achievements or the- objective of .the ordinance. t 8`. The granting of the requested variance will not be detrimental to the public's welfare or injurious,to other property in the area of'the proposed plat. r ,~ 9. The granting of this variance will not have an effect of altering the interest and purp'ose'of the Subdivision or Development .Ordinance and or the City's Comprehensive Plan for the reasons stated in finding of fact number 12 and 13. 10. The applicant paid the fee established by the City Council for application variance. CONCLUSIONS OF LAW 1. ThetCity of Meridian. has authority pursuant to the enactment of the Local Land Use Planning Act of 1975 codified at Chapter 65, Title 67, and in particular, by the provisions of Idaho Code § 67-6516 to provide as part of its zoning ordinance for the .~ r FINDINGS OF FACT AND.CONCLUSIONS OF LAW - Page 3 AND ORDER OF DECISION GRANTING A VARIANCE ` FOR GENE AND ROSE KLEFMAN /REDUCE SETBACK FOR KITCHEN ADDITION • s p ~ d S ~. ~: • .' _ ~ ,"' process of`applications for variance permits. 2. The City of Meridian has exercised:its:authority of Idaho Code § 67-.6516 a a by the enactment as a part of its Zoning and Development Ordinance variances,:. as set .forth in § 11-2-419 of the Municipal Code of the City of Meridian. 3. That the requirements for the processing of a variance request are set forth in Idaho Code §§ 67-6509, 6516 and §§ 11-2-416E and 418E,Municipal Code of the City of Meridian. 4: Application and standards for variances are set forth in § 11-2-419B ~1Vlunicipal Code of the City of Meridian, and the findings which are required are set forth in § 11-2-4190, include required findings that there are special circumstances or conditions` affecting the property that strict application of the provisions of Zoning and ,. We understand that Gene-and Rose Klefman.are applying for a variance in order to turn an encroaching porch into an encroaching kitchen addition. In so doing ..the setback would be reduced to 12 feet. - s Although I can certainly understand that any property owner would like to be able to remodel and change the configuration of his/her home as he/she likes, in this case I believe that it would reduce the space between houses to an unacceptable amount of space. The two houses that join"this property are,very close to the property lines and encroachment would make the already small space even smaller. For fire .protection in the neighborhood, we are opposed to this encroachment. Another reason that we are opposed to this variance is that an addition has already been added to the Klefman home that does not appear on the residential design page. This addition is on he right hand of the dwelling behind the garage. It has similar siding, but does not meet the. shake shingle requirement of Lakes at Cherry Lane No. 2. We are opposed to additions that do not meet the CCNR's of the subdivision and therefore jeopardize the integrity of the covenants. We are unable to attend the meeting on August 17, 1999, but would like to go on.record in opposition of this variance. Staff members told our client that they were to file an appeal .on the recommendation. Of course it wasn't a final decision from which to appeal because only a recommendation was coming up to this Council. So I think there was a miscommunication between staff members and us and that in effect there should not have been an appeal filed because there was no final decision. And maybe you would like to - Corrie: We can consider it, but I still think that the motion also included that recommendations of the Planning and Zoning Commission be followed by the Council as well Butler: It's just a clarification. Klefman: This is new to me, so if you think you're confused. Mayor and City Councilmen, t'm Gene Klefman at 3725 N. Sea Cove Way which is the property in question. eMy wife and I knew I was going to retire so we entered info a contract with a builder a local builder in the fall of 1988 and they've got the house done in 1989. I was still employed and traveling and so I had to leave it in his hands and by the contract wee had with him, he would get all the permits and variances because I was never home. So until this year when we decided to try~to upgrade our home for two reasons. Number one, we've lived there for ten years and Sea Cove has been a dead end street and all of a sudden it's opened up and we got a lot of nice homes. We'd like to upgrade our home to bring property value a little bit more in line. Number two, we originally wanted that home to face toward Harbor Point. The contractor said oh yeah it will so we put out the money to Mr. Barney and bought the lot and then after he gets to laying it out, it won't fit so he had,to turn it so it faced Sea Cove Way. Well the problem is and we didn't realize it at the time that put the back of our house facing the very southwest sunset and you can come to the back of my house any time around 4:00 on 7:00 it's` 110 degrees out there and we just have no patio, no place to be cool. So we got a hold of a remodeler a local remodeler through my insurance company that .recommended him and he come in with a design and that design said let's replace this existing porch and at the same time we can add a gable there and give you a covered patio and that will give you some more shade. So boy this sounds good so $20,000 contract later and he goes to work and he finds out that well the presumption is we already have a variance. The trouble is when you go and look, there isn't any variance. So your staffing folks worded it correctly. They said an existing encroachment. Well I didn't know that I was encroaching. I thought I had a variance. Now if you look at the handout I gave you, you can see that the property line is quite your regular. It's very difficult to put anything square on that piece of property. Nevertheless, what I've tried to do is not make a profit. I just tried to improve my home and gain a little bit of shade and we're elderly. I've been retired ten years, and we'd just like to have a place that we can enjoy and stay in Meridian, and so I'm at your mercy and I put it in your hands, gentlemen. If you have any questions. DEPARTMENT REPORTS: GARY SMITH: A. CHANGE ORDER NO. 1 FOR WELL NO. 18 PUMP AND PUMPHOUSE: (APPROVE) Smith: Thank you Mr. Mayor and Council members. The first item I have is change order number one for the well no. 18 pump and pump house project. This is a final adjustment to the bid quantities for the project. The majority of the costs as I've noted in my interoffice memo to you has to do with replacement of sod and sprinkler system that got kind of torn up with the drilling of the well. We had a problem with the weather conditions at the time that the well was drilled. And the fact that the park area or the lot that we were drilling the well on had been sodded by the homeowners association and a sprinkler system had been installed by them. So we replaced those two items. Such that the ground surface would be restored similar to what it was when, we started. This will close out the contract with Iminger Construction for this project. Because it is a corner lot, the west side is the rear and ought to be 15 ft. This proposed change would reduce the house-orientation designated rear set back to 12 ft. .. Item # 16 Special conditions and circumstances exist which are peculiar to the land, structure and buildings involved which. are not applicable to other lands, structures and buildings' in the same district. This particular house was built with a porch which encroached into the rear setback because the builder recognized the need for shade in the kitchen and at the rear door and could not provide it otherwise. He assured the Klefmans that he had obtained permission from Meridian to do so and the inspector subsequently gave final approval to the home and issued an occupancy permit: Item # 20 The existing 1993.. Comprehensive Plan contains no relevant policies for setback encroachments. The Klefmans will sign an affidavit stating that the property will be posted 1 week prior to the hearing... . '1---- l ,, Gene a man July 11, 1999 Subject: Statement for item 18 of Application and Standards for Variances "Originally, the contract with the Builder of the property at 3725 N. Sea Cove Way, Meridian, ID was intended to face Westerly thereby providing shade to the rear of the house. Based on the builders assurance "that based on the plans provided by ourselves the house would fit on the lot," we completed our purchase of the lot.. After purchase of the lot the builder began his layout and discovered the house would not fit and recommended that we turn the house to face N. Sea Cove to which we had little recourse but to agree and ultimately the existing house was built accordingly. Our original plans called for a rear deck covered and enclosed to provide shade from the westerly afternoon sun and protection from the elements to enjoy the outdoors to eat and relax, The afternoon sun gets extremely hot and is not tolerable. The builder told us he had to get a variance for the deck area and that he had accomplished this according to our contract (copy enclosed). As time went on we had to have the covered deck removed because it was leaking water for so many years it rotted out. Then we discovered that no flashing had been installed when he attached the cover over the deck to the house. We are seniors (young seniors) and have no intention of selling our home at this time, but to simply make it more livable and enjoyable.
