The applicant is requesting a Comprehensive Plan revision from a Single Family Residential designation to Mixed/Planned Use Development. 2~. The property consists of two parcels (G. L. Voigt and Overland, LLC), the total acreage is 50:72. The Hunter Lateral°divides the two properties. The owners/applicants intend to develop the two parcels under one overall master plan. Draft of the master plan is included for review. :. { ., 3. The parcels are currently designated Single Family Residential. However, development in the area has beeri commercial/industrial in nature. The developments include Cesco Equipment Company, a contractor's yard, and the proposed Freightliner facility. These two uses directly across from the subject properties are not conducive to single family residential. The Meridian School District has purchased approximately 55 acres south of the subject property. They intend to construct a high school within the next 5 years. The School District stated the north portion of the Voigt property should not be developed as single family. Due to the high volumes of traffic and noise generated by a High School, single family neighborhoods are not compatible. Considering the existing and future development factors, it is reasonable to change the use designation of these properties. Good planning utilizes transitional uses which buffer less intensive uses. 4. ' If the designation cannot be changed to mixed/planned use, the parcel cannot be developed with a use that could coexist with existing and proposed uses in the area. The applicant, Gary Voigt, is currently working on a sewer line extension across the interstate to provide service to this area, which includes the school site. The applicant is also cooperating with City of Meridian to coordinate a water line extension across the interstate at the same time. This coordination will save the City money and provide additional water service to the St. Luke's facility. With the current Single Family designation, a rezone request for CG or LO could not be supported by the Comprehensive Plan. The current Comprehensive Plan did not consider 990123\Comprehensive change 990123\Comprehensive change transitional uses or buffers for non-compatible uses allowed within the Ordinance. 6. A concept plan has been included with this application. The plan shows a mixed use of commercial, office and multi-family. 7. The change in designation is a logical request. The change would allow uses compatible with the proposed High School and the industrial/commercial uses to the north. This request will not cause any hazard nuisance or injury to adjoining parcels. The mixed/planned use designation abuts the subject parcel on the north and east. The applicant will be required to submit a rezone application and development plan for City review. If any of the uses are not appropriate for the area the City has the authority to limit the uses through a development agreement. This change in designation will not cost the City any monies. In order to develop the parcel there are no other solutions in order to have zoning compatible to the Comprehensive Plan than to amend the Generalized Land Use Map component as applied for herein. 21. It has been more than 6 months prior to the date of the receipt of the recommendations of the Planning and Zoning Commission in this matter that the Commission has recommended amendments to the Land Use Map component of the Comprehensive Plan to the City Council. . 22. The proposed designation change within the subject application would, in .fact, require an amendment to the Comprehensive Plan. CONCLUSIONS OF LAW 1. The procedural requirements of the Land Use Planning Act and of the Comprehensive Plan of the City of Meridian require notice of the time, place, and a summary of the proposed amendment to the Plan, the publication of which. is to be fifteen (15) days prior to said'hearing; copies of all notices were made available to newspaper, radio, and television stations. (Meridian Comprehensive Plan Implementation Chapter, Comprehensive Plan Amendment Section; Idaho Code § 67-6509(b)). VOIGT DEVELOPMENT AND OVERLAND 16, LLC (MILLENNIUM BUSINESS PARK -CPA-99-005) 2. The City of Meridian shall exercise the powers conferred upon it by the "Local Land Use Planning Act of 1975" hereinafter referred to for convenience as the "Land Use Planning Act" codified at Chapter 65, Title 67, Idaho Code (LC. § 67-6509). 3. The Meridian Planning and Zoning Commission may exercise all the powers required and authorized under the "Land Use Planning Act" except the power to adopt ordinances by the establishment of a Planning and Zoning,Commission by ordinance pursuant to'Idaho Code § 67-6504 which the City Council of the City of Meridian has established by the passage of the "City of Meridian Zoning and Development Ordinance" at Title XI, Chapter I, Municipal Code of the City of Meridian. 4. The City Council or any group or person may petition the Planning and Zoning Commission for a plan amendment at any time. The following requirements, time tables, and procedures to amend Meridian's Comprehensive Plan at pages 78 - 79 must be satisfied: A. Application to amend the Comprehensive Plan may be filed with the Planning and Zoning Commission at any time. B. VOIGT DEVELOPMENT AND OVERLAND 16, LLC (MILLENNIUM BUSINESS PARK -CPA-99-005) 4.B.1 Specific definition of the change requested. 4.B.2• Specific information-on any property involved. ~• 4.B.3 The condition or situation which warrants a change being made in the Plan. 4.B.4 The public need for and benefit from such a change in the Plan. 4.B.5 Documentation that no other solutions to the problem are presented by the current policy of the Plan are possible or reasonable. 4.B.6 Development intentions for.any land involved. 4.B.7 Any other data and information needed by the Planning and Zoning Commission in evaluating the proposal, such as who does it help, who does it hurt, how much is it going to cost and who is going to pay for it. C. No application will be considered until the required information is complete. (Meridian Comprehensive Plan Implementation Chapter, Comprehensive Plan Amendments Section). 5. The Commission may recommend amendments to the land use map component of the Comprehensive Plan to the City Council not-more frequently than ,. one every six (6) months. The City Council may conduct a public hearing in addition to the public hearing conducted by the Planning and Zoning Commission as provided by Ordinance, prior to adoption, amendment, or repeal of the Comprehensive Plan using the same notice and hearing-procedures as the Commission, only after having received the Recommendations from the Planning and Zoning Commission. Idaho Code § 67-6509(b). 7. The Comprehensive Plan of the City of Meridian provides at page 79 in Section F, G and H of the Section entitled "Comprehensive Plan Amendments" for the procedure to be followed bythe City Council upon receipt of the Planning and Zoning Commission's recommendations to as follows: F: Upon receipt of the Planning and Zoning Commission's recommendations on Plan amendments, the City Council will set a date for public hearing on the application. At the public hearing, the proposed amendments will be presented and the City Council will 'receive the report of is Committee, if one has been appointed;' and public testimony on each application. G: At the public hearing or within 45 days thereafter, the City Council shall approve or deny the application (except that with the written agreement of the applicant, an additional amount of time, which shall be specified, may be taken). All applicants shall be notified by mail of the City Council's decision and the decision shall be supported by findings of fact and conclusions of law. County and City Coordination: All applications for Ada County and Meridian amendments to their respective comprehensive plans and implementing ordinances which apply within the area of City impact shall be sent by the entity considering such amendment~to the other entity. A separate referral process shall be adopted by resolution by each entity regarding procedures and time periods for, and the effect of, sending such amendments, and such resolution may be amended from time to time upon mutual agreement in writing by Ada County and the City. B. Applications To City: All Ada County applications for planned developments, subdivisions, rezones, private roads, and conditional use permits within the area of City impact shall be sent to Meridian, in accordance with the referral process arrived at pursuant to subsection A of this Section." Upon review of an amendment application relating to land use designations, the Council should take the following objectives into account: 10.1 Mixed-planned uses along the I-84 corridor, which are attractive and compatible with high-volume traffic corridors. 10.2 Designating ample land for urban expansion and infill. 10.3 Quality residential neighborhoods; north, south, east, and west of ~~ Old Town. 10.4 Planned mixed uses along I-84, Franklin Road, U.P. Railroad, and Fairview Avenue corridors. 10.5 Buffers to the waste ktreatment plant. 10.6 Adequate school and park sites for quality living. E 10.7 The importance of ,maintaining. compatible land uses to ensure an optimum quality of life. 10.8 Respect for the responsibilities and rights of land ownership. 10.9 Reinforce the role of the City in regulating the use of land resources for the benefit of future generations. Upon review of an amendment application affecting residential designations, the Council should take the following policies into account: 11.1 Support a variety of residential categories (urban, rural, single- family, multi-family, townhouses, duplexes, apartments, . condominiums, etc.) for the purpose of providing the City with a range of affordable housing opportunities. 11.2 'Support strategies for the development of neighborhood parks within all residential areas. ~ 11.3 Protect and maintain residential neighborhood property values, improve each neighborhood's physical condition and enhance its quality of life for residents. 11.4 Encourage sidewalks and paved: streets for all existing neighborhoods through joint ACHD/Local Improvement District programs. z l 1.5 Encourage compatible infill development which will improve existing neighborhoods. 12. The requirements for a Comp"rehensive Plan are set forth in I.C. § 67- 6508. The statute provides in part that: "The plan shall consider previous and existing conditions, trends, desirable goals and objectives, or desirable future situations for each planning component. The maps and charts are based on the components of the written plan." The requested Mixed/Planned Use Development designation would support both zones. Other~uses could potentially be proposed in the Mixed/Planned Use Development district include mixed commercial uses, medical, combined medium-to- high density residential, open space uses, lodging, offices, and public uses. 10. The general character and use of the properties that surround the subject real property is as follows: North: Across Overland Road on the north are seven to eight (7-8), contiguous, commercially-zoned parcels (C-G), including an R.V. park, CESCO/John Deere and the proposed Freightliner facility. The new Jabil site is north on Locust Grove approximately 1,400 feet across I-84 from the intersection; South: Abutting the subject properties on the Southwest is Rim View Subdivision (Ada Co. subdivision), which is abutted to the south by Raven Hill Subdivision. Directly south is the 55-acre, future Meridian High School site; East: There are three (3) large parcels immediately to the east that are primarily agricultural and rural residential uses; West: Directly across Locust Grove Road is Sportsman Pointe Subdivision. 11. The.real properties which are the subject of this application consist of 2 parcels, one owned by the Applicant, G.L. Voigt, a single person, and R. VOIGT DEVELOPMENT AND OVERLAND 16, LLC (MILLENNIUM BUSINESS PARK -CPA-99-005) Groves, a married man as his sole°and separate property, which property is in the City limits of Meridian and currently zoned R=4Y (L-ow Density Residential District), the other parcel owned by Overland I6, LLC, lies adjacent and to the west, which parcel is in the county and zoned RT Rural Transitional, and which parcels are divided by the Hunter Lateral. ~12. The subject properties are presently designated on the Meridian Comprehensive Plan Generalized Land Use Map as Single-Family Residential. 13. The Applicant submitted a concept plan. showing proposed development, the subject parcels to include commercial, office and multi-family use and development. 14. Considering the previous and existing conditions, trends, desirablei3goals and objectives, and desirable future situations of the Generalized Land Use Map of the Comprehensive Plan it is found that since the adoption of the Generalized Land Use Map there have been significant changes iri the area, including most notably more recent development in the area has been commercial industrial in nature. The developments include: CESCO Equipment Company, a contractor's yard, an'd the proposed Freightliner facility, which are directly across from the subject properties. Amending the Land Use Map to Mixed/Planned Use Development would allow for a broad range of potential uses and zones. Currently, all properties annexed to the City located in a Med/Planned Development area require Conditional Use Permits. This requirement allows greater design and site development control in these districts. The,proposed concept•plan situates the high density residential directly across Overland Road from the heavy commercial CESCO operation. Depending upon the buffering techniques used; an office or commercial use/zone may provide a more compatible use. 16. The Mixed/Planned Use Development designation will allow for uses compatible-with the existing and emerging commercial uses along Overland Road. 17. The Public Works' Facility Plan forecasts this property to be served with sewer by the Five Mile Trunk. As stated in the application, Gary Voigt is currently working with the City on sewer and water extension under I-84 to service the area east of Locust Grove. 18. Overland 16, LLC's real property lies outside of the City limits but lies within the City of Meridian Impact Area. 19. I guess I'm a little confused as to how this is -what we're doing on the Findings because we've already got Findings on all of these. I didn't know if you've had a chance to review them and whether you're going to make changes to these as a result of anything that's happened tonight, or -anyway, this project is the parcel that's directly across the street from there would be the John Deere, SYSCO, the Freightliner parcel: This is recently approved for Treasure Valley Music. This is the high-school site. This four acres here was donated to the City for a park site. This is the undeveloped corner here. This has recently been split. I believe this is approximately five acres has been sold to the LDS Church for a church facility. This is another problem with the splitting. Obviously, they've made one parcel into three now, and there's been platting take place. We did recommend because of the changes in the area, if you may remember, this entire 97 acres at one time was zoned R-4 and proposed as Sundance Subdivision. Because of the changes in the area, that was abandoned. Staff recommended approval of the mixed/planned use designation, and it came through as annexation and zoning with a conditional use permit. Corrie: All right. This is a public hearing. I'd like the developer -Becky. Bowcutt: Becky Bowcutt, Briggs Engineering, 1800 West Overland. As Shari indicated, we got some intensive uses on the north side. The'single-family designation is not appropriate for this property. When we sold that parcel to the high school, just south of what you see there, the School District indicated they did not want this property to be developed as single-family. Their preference would be something like office or commercial. They don't want to have another Borah High School situation. We did make a commitment to them that this would not be single-family. We got some concepts that we've bounced off the school district. This is just a rough concept. It shows some mixed use and that was what was intended for the mixed/planned use development zones. We got a little office, a little commercial, daycare, seminaries,. multi-family, a nice well-rounded type of project for this area. Right now we're in the process of getting the sewer across the Interstate. I believe I got a schedule on that and they're hoping to begin next week. We'll begin boring the freeway and bringing these sewer trunk across. This is a good project. We'll be submitting rezone application, PUD and a plat to clean up the previous divisions that have taken place on the property. We think this is a good designation. Gigray: Well, it's a matter of probably review of exactly what was said and whether or not there'was an actual vote taken at the time that said.you were going to continue them. l remember,there was an announcement. i don't , remember a vote that was taken by the Council to in fact do that. !guess the question would be whether or not anyone would be prejudiced by this and as an additional. assurance, you might request that anyone at the next Council meeting, is anyone appearing on any of these have anything to say? I think at that point you could determine whether or.riot there might be any prejudice that would have issued from any announcements that may have been made, and you could delay decision with regards to the matter to see what the situation looks at the time. If you want to head on the course you're going on now, if you want to rescind the course that you're going on now, then 1 think you're going to have to go back on each of these items and unclose the public hearing and undirect me to make Findings and continue the public hearing on each one of them. Bentley: My pointis, if we get to this point in two weeks and somebody walks in and says, yes, I want to get some testimony, re-open, then we're going to have to turn around and take the whole block of items and move them back two more weeks. Gigray: Well, it may depend. There may be someone there that could appear - it could happen on each one of them or it might only happen on one of them or it may not happen `on any'of them. .Bentley: But the point is you can't make Comp Plan changes in two weeks and then come back two weeks later and do it again. They have to be done as a block. Gigray: No. That's the only -the. State Law was changed by the Legislature in the last year, and even before, it only restricted recommendations by the Planning and Zoning Commission to the City Council, and then they amended it this last year to provide that it only affected Planning Map changes which these applications are, but that statute's very specific in it only references the Commission and it does not reference the City Council. The proposed application requests a Comprehensive Plan amendment to change the designation of the subject property from Single Family Residential to FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND RECOMMENDATION COMPREHENSIVE PLAN AMENDMENT .MILLENNIUM BUSINESS PARK - 2 • Mixed/Planned Use Development. The designation change requires 'an .amendment to the Comprehensive Plan of the City of Meridian as requested by the Applicant. (City of Meridian Comprehensive Plan, pg. 78-79). 9. The Applicant's representative testified at the public hearing that the 'particular characteristics of the affected property make the amendment desirable. f 0. The Assistant to the City Engineer, Bruce Freckleton, and the Assistant Planner, Brad Hawkins-Clark, submitted comments by-and through a Memorandum dated September 28, 1999, and Bruce Freckleton and Shari Stiles, Planning and Zoning Administrator submitted comments by and through testimony during the September 30, 1999, public hearing on this matter. Such report and comments are hereby incorporated herein, as follows: 10.1. PROPOSED SL POTENTIAL USES OF THE PROPERTY: If the Commission recommends approval of this Comprehensive Plan Amendment, the applicant proposes to develop amixed-use project incorporating retail, apartments, offices, a church and a daycare facility. The Applicant refers. to a potential rezone request to CG or LO for the proposed uses. The requested Mixed/Planned Use Development designation would support both zones. Other uses that could potentially be proposed in the Mixed/Planned Use Development district include mixed commercial uses, medical, combined medium-to-high density residential, open space uses, lodging, offices, and public uses. 10.2 COMPATIBILITY ~ DESIGN ISSUES: Amending the Land Use Map to Mixed/Planned Use Development would, as stated above, allow for a broad range of potential uses and zones. Currently, all properties annexed to the City located in a Mixed/Planned Development area require Conditional Use Permits. This requirement allows greater design and site development control in these districts. Depending upon the buffering techniques used, an office or commercial use/zone may provide a more compatible use. 10.3 Staff generally believes the Mixed/Planned Use Development designation will allow for uses compatible with the existing and emerging commercial uses along Overland Road. However, careful consideration will need to be given to compatibility with the concentrated single-family residential developments along Locust Grove and at the intersection. The Sportsman Pointe, Salmon Rapids and Raven Hill residents have voiced a strong concern regarding traffic and safety issues in the area and desire children- compatible uses. The primary alternative to re-designating the entire 55=acres as Mixed/Planned Use Development is to limit the Locust Grove frontage (e.g. the first 150-300 feet from right-of- way into the property interior} to a Neighborhood .Commercial and/or Office zoning, narrowing the future zoning to a C'-N or LO and eliminating the possibility of CG or high-density residential. The exact allocation and boundaries of future zones could be left open to the, developer at the time of annexation and zoning. 10.4 PUBLIC WORKS ISSUES: The Public Works' Facility Plan forecasts this property to be served with sewer by the Five Mile Trunk. As stated in the application. Gary Voigt is currently working with the City on sewer and water extension under I-84 to service the area east of Locust Grove. 10.5 OTHER: A portion of this property is the result of an illegal split. In fact, because of this split, the parcel purchased by the Meridian School District for a future high school site is also an illegal parcel. Appropriate subdivision platting will need to be accomplished before any development of this area. 10.6 RECOMMENDATION: Alarge majority of the above-stated goals and policies support the proposed Comprehensive Plan Amendment from Single-family Residential (SFR) to Mixed/Planned Use Development. Staff agrees that the current SFR designation on the Generalized Land Use Map and the existing R-4 zone should be changed. The question becomes one of how to most appropriately re-designate the designations to FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND RECOMMENDATION COMPREHENSIVE PLAN AMENDMENT MILLENNIUM BUSINESS PARK - 4 • achieve the highest and best use of this property while protecting the land values and safety of local residents. 10.7 Staff agrees with the Mixed/Planned Use Development designation along Overland Road. While concerned with the potential for high-impact, intensive uses along Locust Grove, we feel the Mixed/Planned Use Development designation is the most appropriate to allow a variety of compatible planned uses. Should the Applicant receive approval and submit the conceptual plan to the Commission, staff supports designating the Locust Grove frontage (e.g., the first 150-300 feet from right-of-way into the property interior) to a Neighborhood Commercial and/or Office zoning, narrowing the future zoning to a C-N or LO and eliminating the possibility of CG or high-density residential. Approval of a change in the land use designation in no way indicates approval of any concept plans presented. The applicant needs to also clean up the illegal splitting of the property by applying for a subdivision of the acreage involved. 10.8 The Comprehensive Plan analysis set forth in the staff's comments of September 29 are hereby incorporated by reference. 11. The proposed designation change within the subject application would, in fact, require an amendment to the Comprehensive Plan as determined by City policy. CONCLUSIONS OF LAW All the procedural requirements of the Land Use Planning Act and of the Comprehensive Plan of the City of Meridian were met including: notice of the time, place, and a summary of the proposed amendment to the Plan, the publication of which was fifteen (15) days prior to said hearing; copies of all notices were made available to newspaper, radio, and television stations. Land Use Chapter l .5U Encourage a balance of land uses to ensure that Meridian remains a desirable, stable and self- sufficient community. 1.8U Promote the development ofhigh-quality and environmentally compatible residential areas that contain -the necessary parks, schools .and commercial facilities ~ to maintain and form identifiable neighborhoods. 2.1U Support a variety of residential categories for the purpose of providing...a range of affordable housing opportunities. Commercial Policies (pg. 26) -several of these policies apply to the proposed project, including discouraging isolated neighborhood commercial development. Mixed Use Policies (pg. 27) -several of these policies apply, most of which encourage well designed, compatible projects which combine and integrate different uses. Transportation Chapter 1.SU Encourage clustering of uses and controlled access points along arterial, collector and section line roads. 1.8U Preserve and protect future transportation corridor rights-of--way through land use planning. Require all new development to provide adequate easements for future pathways. Housing Chapter High-density development...should be located near open space corridors or other permanent major open space and park facilities, and near major access thoroughfares. Community Design Chapter 1.4 Major entrances to the City should be enhanced and emphasized. PROPOSED & POTENTIAL USES OF THE PROPERTY If the Commission recommends approval of this Comprehensive Plan Amendment, the applicant proposes to develop amixed-use project incorporating retail, apartments, offices, a church and a daycare facility. The Applicant refers to a potential rezone request to CG or LO for the proposed uses. The requested MixedlPlanned Use Development designation would support both zones. Other uses that could potentially be proposed in the Mixed/Planned Use Development district include mixed commercial uses, medical, combined medium-to-high density residential, open space uses, lodging, offices, and public uses. COMPATIBILITY & DESIGN ISSUES Amending the Land Use Map to Mixed/Planned Use Development would, as stated above, allow for a broad range of potential uses and zones. Currently, all properties annexed to the City located in a Mixed/Planned Development area require Conditional Use Permits. This requirement allows greater design and site development control in these districts.
