The staff comments said that the applicant indicates a single pylon sign 25 x 15 and a single monument sign for the center and only those signs are approved along the Fairview Avenue frontages as a condition of approval. Those were the signs that were submitted as part of the application that you have in your packets, but Later on page 16 under Item 1.42, it says that the applicant shall construct a sign not to exceed 72 square feet, which is basically what we've been requiring along the frontage. We have reviewed this submittal and offer the following comments as conditions of the application. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: 1. The application for an accessory use permit resulted in an objection from Robert D. Green; therefore, a public hearing is required. 2. The objection ailed stated the subdivision's protective covenants forbid any commercial or business use within the subdivision. The City of Meridian does not enforce protective covenants and, if the accessory use is approved, the homeowners association would need to seek legal counsel to enforce their covenants. 3. No signage shall be allowed. 4. Sanitary sewer and water to this facility would be via existing service lines. Assessments for sewer and water service will be reviewed to see if additional load would justify an adjustment. 5. Na employees that are not residents of the home will be permitted. 6. Trash/garbage collection areas must be screened from view in accordance with City Ordinance. 7. The family child care home shall not adversely impact surrounding properties due to noise, traffic, or other activities. 8. Although licensing is not required by the Idaho State Department of Health and Welfare- Child Care Licensing Division for a child care operation of this size, licensing is encouraged. However, ACHD~receives many calls from neighbors of day care centers concerning the volume of traffic and the number,of parked vehicles near existing day care centers. Each parent typically makes two round trips per day (i.e. four one-way trips). The Institute of Transportation Engineers (ITE) data show that a typical day care created 4.65 vehicle trips per day per student. Siddoway: I am not Miss Stiles but I'll go ahead and handle this one. Commissioner's this application is for a -day care which is 5 kids or less. An Accessory Use Permit because there was an objection filed with the city. We are required to send this to you. The highlighted there is the request. We would ask that all of our comments that are on the October 6th memo be included. I don't think there are any other outstanding issues related to the application. You should have a copy of the objection in your packets. Borup: Okay. Is the applicant here? Lovett: Sandra Lovett. 1835 S. Swan Avenue in Meridian. I am the applicant. I guess my situation in a nut shell, I have applied for the permit and have started going through the licensing process through the state as any full time child care would, or home day care, even though I am only just a part time half day morning. play group program planned. Just being that I have been in the early childhood profession for about 14 years I just thought it was necessary to go through all the necessary steps to prove my commitment to the professional aspect I guess to the parents who are interested in my program. Just kind of hit the snag when one of my neighbors did oppose the idea because it is stated in neighborhood covenants that there are to be no businesses run out of homes. However, before we purchased the home back in May, I spoke with the president of the neighborhood association. He told me that they do make exceptions for family home day cares; being there is such a high need for them in our area as well as other areas. He had no problem with it, the neighborhood association had no problem with it, so we went ahead and purchased the house and went through with the plans to do this but as I stated before, one of the neighbors did object. According to the neighbor, from what I understand from the neighborhood association who has kept in good contact with me just to update me how things were going from their end, the main objection was not the traffic. It wasn't the additional children because there is so many children in our neighborhood anyway. It was just the fact that it was going to be okay to let a business be run out of the neighborhood. He did not feel comfortable with that. He wanted to stick to the original agreement in the neighborhood covenants that said no businesses. The City of Meridian does not enforce protective covenants and if the Accessory Use is approved the HOA would need to seek legal counsel to enforce their covenants.
