FIRST STREET, MERIDIAN, IDAHO ) CONDITIONAL USE PERMIT ~ This matter coming before the City Council on the 19th.day of October, 1999, for final .action on conditional use ,.permit application and the Council having received and approving,the recommendation of the Planning and Zoning Commission the Council takes the following action: 1. That the Applicant, Raymond Chase, and Regent Business Co., Inc., owner of the property, are granted a conditional use permit to add an 830 sq. ft. building to be used for office and classroom space, located at 1302 E. First=Street, Meridian, Idaho. In February of 1997 this applicant received a conditional use permit for a child care center for 12 + children. ~ The proposed 830. sq: ft. building represents a significant change to the: existing conditional use permit requiring a new conditional use permit. The requested conditional use, is described in the Addition Plan dated 07-10-97, DRAWN BY: RJS, CHECKED BY: ROGER J. SMITH, P.E., PROJECT NO. 97454, SHEET C 1.0, PROJECT NAME: NEW MERIDIAN DAY CARE -CINDY CHACE, PINNACLE ENGINEERS, INC., ARCHITECTS, for the development of the aforementioned projects and which property is described hereinbelow to-wit: A parcel of land located in the Northwest quarter Northwest quarter of Section 7, Township 3 North, Range 1 East, Boise Meridian, Ada County, Idaho, more particularly described as follows: ORDER-0F CONDITIONAL APPROVAL OF CONDITIONAL USE PERMIT - PAGE I OF 4 RAY CHASE/REGENT BUSINESS CO., INC. -KID'S CLUB 4' ,~. That the above named applicant is granted a conditional use permit to add an 830 sq. ft. building to be used for office and classroom space, located at 1302 E: First Street, Meridian, Idaho ,Meridian, Idaho, subject to the following conditions of use and development: 2.1 Construction shall meet all Codes applicable to commercial property which have been adopted by the City. Construction needs to meet ADA requirements for handicap accessibility. 2.2 Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance. All parking areas are to be paved. Paving and striping shall be in accordance with the standards set forth in Sections 1 1-2-414.D.4 and 1 1-2-414.D.5 of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements. 2.3 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 1091) for all off-street parking areas. All site drainage shall be contained and disposed of on-site. Existing trees shown on site plan exceed this requirement. ;; ~~ < ~ ~. 2.5 Outside lighting shall be designed and placed so as not toy direct illumination on any nearby residential areas or traffic and in accordance with City Ordinance Section 11-2-41 4.D.3. 2.6 Zoning Certificate ands Certificate of Occupancy are required prior to operation. -~• 2.7 a~ Applicant shall provide for- adequate screening of adjacent residential properties to provide needed buffers. 2.8 New trash enclosures associated with the building shall be screened per City Ordinance Section 1 1~-2-414.A.3. Dumpsters shall not impede fire access. 2.9 No signage has been proposed, and none is approved with this application. All signage shall. be in accordance with the standards set forth in Section 11-2- 415 of the City of Meridian Zoning and Development Ordinance. All signage shall be subject to design review. No temporary, A-frame or flashing signage will be permitted. Nonconforming signage will be removed by the City upon 3 days' notice to the applicant. 2.10 All outdoor storage of equipment and materials shall be screened from public view. 2.11 Applicant should coordinate sewer and water service locations with the City's Plumbing Official. (See 1997 Uniform Plumbing Code 312.0.) 2.12 All findings and conditions included in the existing daycare C.U.P. of February 1997 shall apply to this application. 2.13 No additional signage has been proposed for the second building. Any additional signs require a separate permit. 2.14 Applicant shall construct some type of architectural features (i.e. awnings, windows) on the west side of proposed building. for greater aesthetic appeal, and such architectural feature plans shall be submitted for approval. If this second building is approved, it should be noted that it does not deem the City's approval for an increased number of children. 2.17 Applicants shall satisfy all fire code requirements including those pertaining to water flow and fire hydrants. 3. The above conditions are concluded to be reasonable and the applicant shall meet such requirements as a condition of approval of the application for a conditional use permit. 4. Notice to Permit Holder, this conditional use permit is not transferable without complying with the provisions of § 11-2-418 J of the Municipal Code of the City of Meridian, a copy of which is attached to this permit. MERIDIAN ROAD: Stiles: Item 1, I believe`we're still waiting for an annexation and zoning request for the parcel that was left out. There's a triangular piece that's an enclave, and staff had requested that be included as part of their request. Their attorney, Mr. Shoemaker, said the City had the ability to do that, and the City should be responsible for preparing that annexation and zoning, and Council did not agree or they didn't state they agree with them, and so I think we're still stuck at having that enclave and not being able to proceed with Items 1 and 2. As far as Item 2, they've also proposed some changes for the public roadway that was approved by Ada County, Highway District Commission to come from Fairview Avenue. Now they have verbally discussed coming in through the Michner property for their access, and we haven't seen a new plan on that. Conditional use permits for a daycare, I don't know that there were any problems with that one. Let's see. On four, this was the Kids Club, conditional use permit to add another building to expand their facility for the daycare. The only thing that we had added to those Findings was to ask that they add some kind of architectural feature to the west side of the building such as awnings or windows or some kind of treatment that would be reviewed by staff. Number 5 is pretty straightforward, just to add some storage units on the remainder of the parcel owned by Berta Wagner where the Napa store is now. Number 6 is for expansion of a non- conforming use in a C-C zone. They're asking to add an attachedtwo-car garage and a carport and relocate their detached garage. Besides being the non-conforming use, we'd ask that if that detached garage were going to be relocated that it meet all uniform building codes, uniform building and fire codes. This application befiore~-you is-for a conditional use permit to add a second building to the Kids Club parcel which is one parcel north of the U.S. Post Office. We do ask that you incorporate our comments from August 30 which details most of the issues. The project is situated is completely surrounded with C-C zoning other than the U.S. Post Office. The Post Office is R-15 and as in the first paragraph in the staff report the reason for this is -the applicant did appeal the original planning and zoning administrators decision to not allow accessory use. That is the reason for this. The staff felt that the size of the building was large enough-that it was not represented in the original use application and because of the size, I believe it is between 800 and 900 square feet, they were required to come in for this conditional use. The principal issue that I will point out in the staff report is the elevation. The applicant may or may not have modified that, but the ordinal elevation did not include any kind of a window or architectural project on the East First side of the building. Our compliance is for parents or guardians who fall under. that guidance. If I could use a pointer. Access, like Cindy stated, this is concrete area here. Access pursuant to ADA brings you into the building from the driveway to the concrete area. This wi!! be level as well. !don't want to use the term grandfather but because the building was so old there are no ramps to the building to get into it because it would not be feasible. As far as any guardians or parents that needed to pick them up that fall under the guidelines of ADA, they would have access up to the building. Barbeiro: If I may ask our board member architect, in your experience if another building is built on the same site, does that not require both buildings to be brought up to ADA standards. , Hatcher: Not typically. Under this condition the existing building if it does not require sufficient modifications to the existing building then ADA upgrades are not required. The new building will need to meet, whether its being serviced for disabled people or not. It~will still need to meet those requirements. Other then that, the one question you and I talked about earlier, that is whether or not splitting the lot for 2 separate b~.~ildings is a concern. As to whether or not this is a separate- building, or an addition to an existing building, it is something that needs to be considered. These conditions shall be considered in full, T unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION BACKGROUND In February 1997, this same applicant received a C.U.P. for a Child Care Center for 12+ children. The City has on file all pertinent state Health and Welfare licenses and original approvals for the day care operation and no violations or complaints are on record. Earlier this year, the applicant submitted an Accessory Use Application to the P&Z Department to construct an additional building on the lot to expand the day care. Upon determination that the second building would result in a "significant modification to the original C.U.P.", the P&Z Administrator required an application to modify the C.U.P. At their July 20 meeting, the City Council denied the Applicant's appeal of the P&Z Administrator's decision. Therefore, this application before you is to modify the existing C.U.P. for "Kid's Club" through the addition of a second building on the lot. CONDITIONAL USE REQUIREMENTS 1. All construction shall meet all Codes applicable to commercial property which have been adopted by the City. Construction needs to meet ADA requirements for handicap accessibility. 2. Off-street parking shall be provided in accordance with Section 11-2-414 of the City of Meridian Zoning and Development Ordinance. All parking areas are to be paved. Paving and striping shall be in accordance with the standards set forth in Sections 11-2-414.D.4 and 11-2-414.D.5 of the City of Meridian Zoning and Development Ordinance and in accordance with Americans with Disabilities Act (ADA) requirements.
