Eddy ("Seller), and Meridian Land Development LLC, an Idaho limited liability company ("Buyer") RECITALS A. Seller owns approximately 19 acres of real property located in Ada County, Idaho, described on Exhibit A, attached hereto and made a part hereof (the "Property"). The Property is comprised of three parcels. "Parcel 1" is a residential home located on approximately five acres of land. "Parcel 2" is bare ground of approximately 12.64 acres. "Parcel 3" is comprised of three subdivided lots located in Haven Cove No. 6 Subdivision. Parcel 1, Parcel 2 and Parcel 3 are sometimes collectively referred to herein as the Property. B. Seller desires to sell, transfer and convey the Property and Buyer desires to purchase the Property all according to the provisions hereinafter set forth. NOW, THEREFORE, in consideration of Ten Dollars ($10.00) and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged and agreed, and in consideration of the recitals above, and the premises and the mutual representations, covenants, undertakings and agreements hereinafter contained, Seller and Buyer represent, covenant, undertake and agree as follows: AGREEMENT OF SALE AND PURCHASE. I have reviewed this plat to check for conformance with previous review comments made by my staff for presentation to the City Council for their consideration. I find that this plat conforms to my departments prior review comments and I have therefore applied my seal and signature in the appropriate space on sheet no.2. 1 find the following information after review of my final plat project file: 1. Seven (7) streetlights are required. 2. It appears that approximately 1800 lineal feet of temporary construction debris catching fence is needed. 3. Lot 14, Block 12 will need to have engineered backfill before issuance of a building permit. Evidence of material used and compaction tests, as done by a materials testing company, will need to be submitted for our approval. 4. Lot 13, Block 17 will have a 20 -foot setback on three sides of the lot and a 15 -foot setback on one side. I can only assume that the developer is aware of this limitation. 5. Nampa/Meddian Irrigation District has approved the pressure irrigation system but has asked for a pump curve. l will follow up with them to see that they have received this information. This development is estimated to generate 1,100 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. On January 14, 1998, the Commission reviewed and approved Haven Cove No. 7. On April 15, 1998, the District received a letter from the owner of parcel to the northwest of Haven Cove No. 7, a church facility, stating that they were opposed to a stub street to their south property` line abutting this site's north property line. The applicant concurs with the church and has requested the District to delete site specific requirement # 5 to provide a stub street to the north property line "located 105 -feet east of the site's western property line. The stub street would serve the two church parcels to the north if they redeveloped in the future. In the approval of Thunder Creek Subdivision, the applicant proposed to provide a stub street to connect to Forecast Court to the subject application (Haven Cove # 7). 'Staff supported the stub street to the subject site and recommended that the applicant construct a box culvert over the Eight Mile Lateral to connect to Forecast Street. We also find that this development is located in census tract 103.10 and in the attendance zone for Chaparral Elementary School, Meridian Middle School and Meridian High School. Using the above information we can predict that these homes, when completed, will house 9 elementary aged children, 8 middle school aged children, and 7 senior high aged students. This development will cause additional overcrowding in all three schools. The cost per student for newly constructed schools, excluding site purchase price and offsite improvements, exceeds $5,000 per elementary student and $10,000 per middle or high school student. Even though, we are in a difficult position and need your help in dealing with the impact of growth on schools, we will approve this. subdivision. A few of the police officers and some of the people that work in the police department. But I would just like to thank all of the people, my wife isn't here tonight she is ill, she has the flu, I have the flu also. I would like to thank her for sticking with me for 16 years because it is a trying thing even for the wives. There are a lot of hours involved, I don't know what I am going" to do now with the extra 20 to 30 hours a.week. I see the ex -mayor back there grinning from ear to ear so he knows what it is"like. His golf game has improved 100% since. he left here. But I would just like to thank my daughter she backed me 100% and that is Rhonda Benson and the fire education fund and Walter's campaign manager. But she has dressed up and helped campaigned several times and has been a good supporter. Being as they are not here I . will thank them anyway, thank you all for letting me have the privilege of being here. We also find that this development is located in'f census'tract 103.10 and inthe attendance zone for Chaparral Elementary School, Meridian Middle School' and Meridian High School. Using the above information we can predict that these homes, when completed, will house 9 elementary aged children, 9 middle school aged children, and 7 senionhigh aged students. The cost per student for newly constructed schools, excluding site purchase price and offsite improvements, exceeds $5,000 per elementary student and $10,000 per middle or high school student. The Meridian School District will grant approval of this development, however this subdivision will cause increased overcrowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also well over capacity. We are in a difficult position and need your help in dealing with the impact of growth on schools.
