MEMORANDUM OF A~EEIDfEWT
BETWEEN
PKG, INCORPORATED
AND
THE CITY OF MERIDIAN
THIS MEMORANDUM OF AGREEMENT ("Agreement") is made and entered
into this day of - , 201 ~ , by and between the City of
Meridian, by and through its Publi Works Department, hereinafter referred to as
"City" and PKG, Incorporated, an Idaho company, hereinafter referred to as
"Developer".
WHEREAS, the Developer owns certain real property located in Ada County,
Idaho, as described on Exhibit A attached hereto and incorporated by reference,
hereinafter referred to as the "Project", which Project will be constructed on
future lots in the Pinebridge Subdivision, and,
WHEREAS, the Pinebridge Subdivision will be constructed in phases, and
currently the Developer's land is not adjacent to an existing pressurized irrigation
system, and will not have access to a pressurized irrigation system until the
Pinebridge Subdivision is constructed in a later phase.
NOW, THEREFORE, in consideration of the foregoing, the Developer and the
City do hereby agree as follows:
Connection to Pressurized Irrigation System. The City permits the Developer to
connect the Developer's Project to the City's domestic water system, for the
purpose of providing irrigation water to landscape areas, until such time as the
Project has access to a pressurized irrigation system. The Developer shall
connect to the pressurized irrigation system within 30 days of the system being
operational and readily available, and will disconnect from the City's domestic
Ovate r syste m .
Ins ection. Inspection of the approved piping installation shall be by the
appropriate irrigation district claiming jurisdiction, or in the event that no irrigation
district claims jurisdiction, then the CITY will inspect the construction of the piping
to ensure that they meet the approved plans.
Payment of Costs. The Developer shall be responsible at its sole cost and
expense for all amounts incurred to install, connect, and disconnect to and from
the domestic water system as contemplated in this Agreement.
Term of A reement. Upon Developer's connection to the pressurized irrigation
system and disconnection from the City's domestic water system as provided
above, this Agreement shall automatically terminate and be of no further force or
effect.
IN WITNESS WHEREOF, the parties do execute this Memorandum of
Agreement the day and year first above written.
