These spaces will accommodate the total number of rooms available plus one for two employees. ~.~... 1 The existing Best Western averages one airport pick-up each day, whichdoes not require ~ parking space for guest rooms. n The new Microtel Inn is a separate franchise from -the existing Best Western, with a' separas~ reservation system and, therefore, it is assumed that airport pick-up would be the same as the B Western (one per day)... F: Even without the airport pick-ups, evenings would be in compliance with one parking space per room plus one parking space for each two employees: During the day, the employees begin work at 9:30 a.m. At this time most motel guests have left and there are adequate parking spaces for employees. Subsequently, when the majority of :guests` amve for the evening the majority of employees have gone. R Without the variance, the number of rooms in the new motel would have to be reduced substantially. This variance on the number of parking spaces will not confer upon- the applicant any special privilege that is denied to other lands, structures or buildings in the same district. The majority of the rooms are occupied during the evening and overnight hours while the majority of employees are at the building during the daytime hours. This rotation would allow the employees to use the K unoccupied spaces during the day. These spaces will accommodate the total number of rooms available plus one for two employees. • The existing Best Western averages one airport pick-up each day, which does not require a parking space for guest rooms. The new Microtel Inn is a separate franchise from the existing Best Western, with a separate reservation system and, therefore, it is assumed that airport pick-up would be the same as,the Best Western (one per day). Even without the airport pick-ups, evenings would be in compliance with one parking space per room plus one parking space foi each two employees. During the day, the employees begin work at 9:30 a.m. At this time most motel guests have left and there are adequate parking spaces for employees. Subsequently, when the majority of guests arrive for the evening the majority of employees have gone. Without the variance, the number of rooms in the new motel would have to be reduced substantially. This variance on the number of parking spaces will not confer upon the applicant any special privilege that is denied to other lands, structures or buildings in the same district. The majority of the rooms are occupied during the evening and overnight hours while the majority of employees are at the building during the daytime hours. That Ordinance 11-2-414 A, OFF.-STREET PARKING AND LOADING FACILITIES, l., requires `that no building or structure shall be erected, altered or its use changed unless permanently maintained off-street parking and loading have been provided in accordance-with the provisions of this Ordinance. ` 4. That Ordinance 11-2-414 A, OFF-STREET PARKING AND LOADING FACILITIES, 7., requires all development applications shall include a site plan (drawn to a minimum' scale of one inch equals fifty feet (50') which is fully dimensioned and shows any parking ~~ or loading facilities to be provided in compliance with thisr° Ordinance. Such site plan shall be submitted to the Commission for approval when the required off-street parking is more than six (6) parking spaces and shall indicate ingress and egress to the area and traffic patterns in adjacent streets and alleys and appropriate t landscaping. The Applicant did submit a site plan. 5. The Applicant proposes to have sixty-two (62) motel rooms which require 62 parking spaces, and the Ordinance .requires parking spaces for employees. The Applicant proposed that it have 63 parking spaces which is not enough spaces for the Applicant's employees and room guests. 6, That the Applicants have requested to be granted a variance from the above Ordinance requirements .so that they may reduce the number of parking spaces required for the new motel rooms and employees. The Applicants did submit a drawing of their property with the Application; the drawing does show space that` could. bed used for off-street parking but sufficient space for the required e parking spaces was not shown. 8. ~ The' property in question is described in the variance application and. is incorporated herein as if set-forth in full. R i 9. That the Applicant does own the property: ~; 10. That the Applicant, Jim Coles;, gave a brief summary of the variance request. Mr. Coles presented a large plan pertaining to the number of parking spaces and the overall layout of the protect. He was unsure. of the motel occupancy and the number of parking spaces required for the.. employees. This will be a three. story building with maximized parking spaces, staying within the twenty-five foot setback, the twenty foot drive ways, etc.. TYhe total number of spaces will be sixty-three with a sixty-two unit motel. There are sixty-two rooms, thus leaving one space for employee parking. This would be the total .:site. The existing Best Western Motel has a total of sixty-two spaces, with one space for a employees, and sixty-one for the. motel rooms., Sequencing and occupancy plays`~into the number of parking spaces. Staff members, mainly- maids and maintenance, would arrive around 9:00 a.m.,~'and~` therefore leaving a -fairly vacate parking lot . This is the' basis g for the variance request. Councilman Rountree'- questioned what Mr. Coles was unclear~• about with`the parking requirement regarding his discussion with Shari Stiles. a;, Jim Coles: responded he thought one space for each two employees,~or one space covers two employees, employees are there during the day time. There is no time frame for day time employees and there can be up to eight to ten during the~day. Mainly, he was R concerned about the intent of the code and he felt it wasj a functional system.. . Councilman Ander"son questioned the Applicant about the numerous cars parked out on the street since it was basically a dead.end street. He noted when driving by earlier in the day a parked tractor- trailer rig. He questioned if it was normal for guests to park there or ....employees, or what 'the circumstances were. Eventually the street will be punched through` with other. businesses farther down that street. Since parking is a problem, .. ., what would the opened street cause? 11. Mark Kreizenbeck, a partner in the Limited Liability Corporation gave the following comments at the hearing.~Pertaining to the truck,. parking, they park 'there because there is no other ,parking for them. Bob Nahas of the Nahas Group informed him when r the street gets punched through the trucks will not be able to park in the street. The parking is set°up for cars and pick-up trucks and not for semi's. Basically, when the trucks were parked, there it did not interfere with the parking spaces. There 4 ~ seems to be enough parking for"everyone. a `" Councilman Anderson questioned if a driver had a tractor- trailer if he would be allowed to stay, to which Mr. Kreizenbeck replie°d, "No they can't park there." If they could find somewhere else to park that's legal -then they 'could stay. The Meridian Police informed Joe Dunn when the street goes through there will~be no more parking permitted on the street. Mr:~Kreizenbeck further stated that if, some guy walked into, the motel they would rent him a ,room, but not if he had a truck, unless it was moved or parked E somewhere else. The parking lot is for cars and pick-up trucks. Councilman Anderson. questioned Chief Gordon if the enforcement would be a "problem with the department. Chief Gordon responded that people will park where space is available but the Ordinances allow trucks to park inacommercial areas, and this street is, in the. 7 commercial area. "Mr.~ Kreizenbeck had spoke with the Manager, .Joe. Dunn, about' the parking and right now it doesn't have any parking along it. ~It does have a center turn lane and a lane going each way, so there r isn't any place to park... As far as night parking, there is plenty. of room and ,room for the employee parking, and still one space per room. There was ~no parking planned for big trucks. Gordon and Mr. Kreizenbeck .. had to do with development of• the area and when development ~~. ,~ happened the general area will have parking problems, whether cars or trucks. Mr. Kreizenbeck added that there is enough parking places for the rooms, but Chief Gordan questioned where the trucks, .. ;3:.: that are presently parking there would go. In response, Mr". t Kreizenbeck stated the trucks are like the tractor-trailers and they only take up one space, no trailer, just the tractor, which. `~ ,_ x fits in a ten by twenty parking spot. Chief Gordon inquired f1they were renting rooms, to which Mr. Kreizenbeck replied, "Right, they're ,renting rooms and they're fitting in a ten by twenty parking space. There's only one company that's doing that, all the rest of them were going down to the i terminals and picking them up; their companies. won't let them park :~ their truck down there". Chief Gordon noted there were no parking signs along the road. Enforcement of the no parking•~will be a .major problem for the . Police Department. Mr. Kreizenbeck stated the developer was the one who informed him of the "no parking" along. the road. • Councilman Anderson had one more question for Shari Stiles and it pertained to the confusion over the number of ,parking spaces . ' h He asked her to explain whether it was the number of space's for all ~~~ employees or the maximum a,t any time and to explain how it works-. ' ,{s Councilman Anderson added that he had eight employees inr~ k addition to the number of ,guest ~rboms of sixty-.two, to which Mr. ~; Kreizenbeck confirmed the eight employees and sixty-two spaces, also adding the employees arrive at 9:00 a.m. There was one desk clerk at night, one in each motel. Councilman Anderson inquired if thedesk clerk shad to leave the' desk if that was the` only employee at night. Mr. Kreizenbeck. ' added there is a van driver, but he's going to and from the- 'truck terminals. He comes and goes from seven until about midnight because the trucking companies require=they be picked up and taken back. Also, Best Western has one airport pick up per night on ~. ~,.. average: Councilman Anderson questioned the policies on landscaping `so there is no way the parking lot can be redesigned to add more" spaces. 12. Jim Coles concluded his testimony by saying he is with „ z Design West Architects working with Mark on the project. Every spaces. has been squeezed to the maximum. The only other option would be the large lawn area at the main front entry. He's met thew landscaping requirements, trees and setbacks, and therefore '•there; ' ~, was~no space for additional parking. By combining, the two motel sites, one handicapped parking space could be eliminated, and this would allow one more parking space. °, 13. Her only concern was if theyF would continue to operate the same way-as now and if they do fill up with .y . the public, what happens when the Chamber of Commerce meets. That would create a parking ,problem. She stated that possibly Home Depot might be able to work the parking out. As long as they've met all the other requirements,a dimensions and driveways, and they r , continue to operate as now, she has no problem. 14. .:There was discussion about even if the' variance was granted. there could not be tractors and/or trailers parked on the streets or in the parking lot. 15. That there was no public comment at the public hearing. CONCLUSIONS 1. That all the procedural requirements of the Local + Planning Act and of the Ordinances of the City of Meridian have been met =including the mailing of notice- to owners of property within 300 feet of the external boundaries of the Applicant's property. ~. 2. That the City has authority'to~ grant variances pursuant '~~ ~. .4. to Sect-ion 11-2-419 of the Zoning Ordinance and pursuant to Section 11-9-612 of the Development Ordinances. ~; , ~. _3. That the specific requirements•°regarding a variance that must be evidenced and found by the City Council, are as follows: A variance shall not be granted unless the Council makes a statement. of supportive reasons based directly on the evidence presented to it which supports conclusions that the mentioned standards and conditions'of this Ordinance have been met by the Applicant and unless all of the following exist: a. That there are no special circumstances or conditions. affecting the property that the strict application 'of the provisions of this Ordinance would be clearly impracticable or unreasonable; in such cases, the .~ subdivider shall first state his reasons in writing ~as to the specific provision or' requirement involved; ' b. ~ That strict compliance with the requirements of this Ordinance would result in extraordinary hardship to the subdivider because of unusual topography, the nature or condition of adjacent development, other physical Condit-ions or other conditions that make strict compliance wwith this Ordinance unreasonable under the circumstances, or that •the conditions and. requirements of this Ordinance will result in inhibiting the. ~{ achievement or objectives of this Ordinance; a, c. Crookston: Would you state your name and address please. Coles: Jim Coles, 15176 Horseshoe Drive, Caldwell. Crookston: You need to be sworn. Do you promise, swear or affirm that the testimony you give tonight at this public hearing be the truth the whole truth and nothing but the truth so help you? Coles: I do. Crookston: Please proceed. Coles: What I'd like to do is just do a brief summary. I think in-our request for a variance I think we went through the numbers and some of the comments about the new proposed project. With me is Mark Kreizenbeck, President of K-2 + Meridian City Coun~ February 17, 1998 Page 5 Construction, he's also a partner in the Limited Liability Corporation B-II which is the applicant for the variance. What I'd like to do is just talk a-little bit about the number of parking spaces and a little bit about the overall layout. In the proposal you've seen some of the information but I brought along a large plan so we could just talk for a moment about it. From talking with Shari earlier I was somewhat unclear about the interpretation on the situation of a motel occupancy and the number of parking spaces required for employees. This new Micro Tel Inn is located directly adjacent to the existing Best Western there at the interchange of the interstate.. What we have done is we have basically set up a three story building and we've maximized the number of parking spaces we can get still staying with the twenty-eve foot setbacks, twenty foot drive ways, etc. What we've ended up with as far as total number of spaces is sixty-three spaces with a sixty-two-unit motel and I think as we had ident~ed in our request for a variance we have sixty-two rooms which leaves one space for employees at the new facility. We also in talking with Shari, we want to look at this as a total site also. The existing Best Western motel we have a total of sixty-two spaces which gives us one for the employees and sixty-one, one for each room. A lot of this has to. do with the sequencing and the occupancy type of a motel. During the evening hours when you would assume we have a hundred percent occupancy if we had' a car for every room, that gives us two spaces for employees which according to' the Ordinance would give you space for four employees. I really couldn't determine from the Ordinance how you deal with the maid staff and that's the big' issue I guess. The reason for the request for the variance is I think, and we identified that in our proposal, is that maintenance and the maid staff doesn't come on till about 9:00 in the morning and I think probably you've all been in a ' parking lot at 9:00 in the morning at a motel, it's quite vacant. And so that really is the basis for requesting the variance is basicaNy based on the employee situation. We feel we have two employee spaces which v+rould cover us in the evening but then the additional staff that would come on would be at a time when there was not occupancy in the building. Any question about that? Rountree: You said you were unclear about the parking requirement per your discussion with Shari. What's unclear to you? Coles: Well Iguess -- it says one space for each two employees - or one space covers two employees - obviously with a motel you have employees that are there during the daytime -Iguess that the fact that there's not a time frame for those employees, at times there are only four and at times there's up to eight, eight to ten, so I guess that's the question so far as the intent of the code and basically Iguess we feel it's very functional the number of spaces that we've identified and I think Mark will talk here in a minute about the history of the number of parking spaces at the existing Best Western and how that's worked. Anderson: 1 have a question. G2uite often, and maybe you guys can explain to me, quite often that's a dead end street right now I see numerous cars parked out Meridian City Counc February 17, 1998 Page 6 on the street. This morning l went by there and there was a tractor trailer rig, appeared to be one of the guests there, ~is that normal for employees or are these guests that are parking out there on the street? Eventually that street is going to be punched through and we're going to have some other businesses down there. If parking's a problem now what are we going to with the one's that are parking in the street? Coles: I think I'd like to let Mark respond to that, I assume he needs to be sworn in also. Crookston: Please proceed. Kreizenbeck: Well the trucks that park there park in the street because there's not any parking for them. Bob Nahas or the Nahas group has informed us, that when .the. street gets punched through that they can't park there so they won't be staying there because they won't have a place to park. Our parking space is set up for cars and pick-up trucks but not for semi's and so unless there was some other kind of agreement made with some other property owner around in the subdivision they won't be staying there because Bob said the Meridian Police will clear them out. Basically as far as the truckers go they won't be staying there except we do have some yellow freight people that we pick up over at the terminal and bring back, and we do that every day. The reason we didn't mention ' that is because Shari said what if your occupancy changes -what if you don't have those people anymore. We basically operated the Best Western for three years in March and we've had sixty-one spaces .and when those trucks are parked out there there's still spaces in the parking lot, they just park there because that wasn't made for those things. to go in there and turn around. Anderson: So basically if they drive atractor-trailer then you'll not allow them to stay there? ~ ~ l ~. Kreizenbeck: No they can't park there. If they can go find. somewhere else to park, we can't tell them they can't stay there, if they can find a legal place to park but we don't have any legal places for them to park. Basically I guess the t street oes throu h there the trucks go, so .Meridian Police told Joe that when the g 9 -but he wasn't going to do anything until they. punch the street through so - if a Meridiam City Counci~ • February 17, 1998 Page 7 guy walks into the motel we're going to rent him the room but if he's got a truck there he's going to have to move it or find somewhere else to put it, but those trucks don't go in our parking lot anyway, that's for cars, and pick-up trucks and things like that. Anderson: I guess a question for the Pofice Chief, is that going to be an enforcement .problem for your agency? , Gordon: Mr. Mayor, Councilman Anderson, I believe on the response to this , request I was a bit apprehensive to say the least because the motel is going to draw traffic and parking and people are going to park where there's room and if ' that's on the street that's where they're going to be. I can see opposing problems" by forcing cars onto the street, as far as the trucks go our Ordinance allows them.. to parkin commercial areas. This is a commercial area and they're allowed to park on the street out there. I don't know which officer you talked to about the trucks are going to go, they're allowed to park out there according to our Ordinance. Kreizenbeck: Well I talked to Joe Dunn the Manager there and the street as it's ' set up right now doesn't have any parking along it, it has a center turn lane and a lane going each way so there really isn't any place to park and so 1 just talked to Joe about the thing - as far as parking cars at night there's plenty of room f because we have room for the employees and we have one parking place for every room -every room in the motel - as far as parking a big truck there it wasn't planned that way and there's not room for trucks and like Isay-Bob Nahas' the Developer has informed us that when they punch the street through we can't E park there. C Gordon: Looking at some of the development that's coming down the road I can just foresee problems as far as parking goes in that general area whether it be trucks or cars. Kreizenbeck: But we have enough parking places for the rooms. Gordon: Yeah, the trucks that are there now though they're in your lot where are they going to go? Kreizenbeck: The only trucks that t see in our lot are like the tractor-trailers just the trailers that come through there and they only take up one space, they're not I the -they're just the -they don't have a trailer on them they're just the tractor and they fit in a ten by twenty parking spot. Gordon: They're renting rooms then. Kreizenbeck: Right, they're renting rooms and they're fitting in a ten by twenty parking. There's only one company that's doing that all the rest of them we're Meridian City Counc~ • February 17, 1998 Page 8 going down to the terminals and .picking them up their companies won't let them park their truck down there. Gordon: Yeah, the no parking signs along that road were put in by the Developer. Kreizenbeck: Right and he's the one that informed us that we were out of here. Gordon: Correct. The enforcement of that is definitely going to be a major problem for us. Anderson: Just one more question then for Shari. They had some confusion over the required number of spaces maybe you can explain whether we're talking about the number of spaces for all employees or the maximum that would be there at any time or how that's supposed to vrork. Stiles: I don't think the Ordinance specifrcally spells it out but the way I interpret it would be the maximum number of employees that are on the site at any one time. Anderson: And so you have eight employees in addition to the number of guestrooms of sixty-two? Kreizenbeck: That's correct we have eight employees, sixty-two but the employees come to work at 9:00 A.M. because they can't clean the rooms until people leave so - we have one desk clerk at night, there would be one in each motel. Anderson: So if somebody needs something at a room the desk clerk leaves the desk, there's only one employee there at night? Is that what you're saying? Kreizenbeck: There's a van driver but he's usually going to and from the truck terminals. They come and go probably starting at about seven till midnight or so because the trucking companies require that we go over to -like Yellow Freight's over at Eagle and Fairview and they require v~ go over and pick their guys up and bring them back and take them back. Also we have -Best Western has one airport pick-up a night that's the average, t mean some nights they don't have any, some nights they have two. We're kind of far from the airport but we have a phone out there and when they call us the van driver goes down and picks them up and brings them. out so that's an extra parking place that people aren't using. Basically at night we don't have the problem because we don't have the employees, in the daytime the people are gone by the time the employees get ' there. - y Meridian City Counc~ February 17, 1998 ' Page 9 Anderson: And !guess my last question would be then according to our policies on landscaping and stuff they"e's no way the parking lot can be redesigned to pick up any more spaces? . Coles: 1've squeezed every space that we can possibly unless you want to - excuse me. By the way I'm with Design West Architects I'm working with Mark on the project. I have basically massaged every space that 1 could out of-the site area, I'd say it is very maximized as far as the overall layout and the only thing that we could .do beyond that would be -you know there's a large lawn area right at the main front entry and I could have basically-taken a portion of that out because i do, with the amount of space I have around the perimeter, I'm meeting the landscaping requirements and the trees and setbacks, etc. And we have put in no compact spaces either, these are all sixty-three of these spaces are full size spaces according to the Ordinance. So you can see that we basically we come down and basically one way loaded the traffic with three handicap spaces and I could probably if we were doing a combined site t could play some games, not that 1 want to play games, but the total number of handicap if t .combined the tyro sites would only have to be five handicapped parking spaces so I could eliminate one here and probably gain one more space down here which would still give me a total of five handicap spaces I just (inaudible) very good workable site plan and I guess just my personal opinion is trying to meet the intent of the code I think with obviously with the maids can't come clean the rooms if the people are in them it seems to me it all works as far as being a usable situation. Believe me we've massaged this about twenty times to get to where we are. Anderson: Thank you. Corrie: Any further questions from Council? Thank you very much. Stiles: Mr.-Mayor, Councilman Rountree, as Mr. Kreizenbeck said the only concern 1 have is if their operation would not be continued to operate the same way as it is now and if they do fill up with just the general public with one car for every room and then we also have the times when the Chamber of Commerce meets there in the meeting. room there's some parking problems right now too, but it may be that they can work something out with Home Depot, but as long as they've met all the other requirements as far as the dimensions and the driveways and they continue to operate as they are now with bringing people in I didn't have that big of a problem but that-was my biggest concem is that they would not continue operating in the same way or sell it off to somebody else that doesn't go pick up the truckers and bring them back.
