Conditions of Approval: Project is subject to all current City ofMeridian ordinances and conditions
of approval for the Aromatic Sensations conditional use permit and variance. The issuance of this
permlt does not release the applicant from any previous requirements of CUP-04-031.
Site Plan: The site plan prepared by Kathy Hinshaw, dated 7-12-04, and stamped 6-15-OS
"approved" by the Meridian Planning & Zoning Department, is approved with the following change:
1) Per MCC 11-13-6, the driveway to the parking stall shall be improved (e.g. -asphalt, recycled
asphalt, other dustless material)-and not gravel. The site plan is not to be altered without prior written
approval of the Planning & Zoning Department.

Lanclsc~in~ The submitted landscape plan, ;dated 6-15-05 and stamped "approved" on 6-15-OS by
the: Meridian Planning & Zoning Department is approved with no changes. The approved landscape
plan is not to be altered without prior written approval of the Planning & Zoning Department. No
field changes to the landscape plan permitted; prior written approval of all material changes is
required. .
Curbin Per MCC 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other
vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices.
Curbing maybe cut to allow for storm water runoff.
Parkin: The project engineer/architect shall certify that the number and size ofhandicap-accessible
spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have
signage in accordance with ADA. The applicant shall be responsible for meeting the requirements of
ACHD as they pertain to this development.
Sidewalks: All sidewalks shall be constructed as submitted and in accordance with MCC 12-5-2.K.
Sidewalks shall be constructed prior to occupancy.-

Drainage: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully
vegetated, and shall be designed in compliance with the MCC.
Irri ag tion: An underground, pressurized irrigation system must be installed to all required landscape ' ~
areas per the approved specifications and in accordance with MCC 12-13-8 and MCC 9-1-28. ~ a
Li tin :Lighting shall not cause glare or impact the traveling public or neighboring development. a f
Down-shield all lighting so it does not spill onto adjacent properties.
Si e: Except for the directional signs, no signs are approved with this CZC. All business signs
require a separate sign permit in compliance with the sign ordinance.
Trash Enclosure: The applicant has indicated that the garbage cans will be pulled to the curb (alley).
Any dumpster(s) must be screened in accordance with MCC 11-12-1.C. Trash enclosures must be
built in the location and to the size approved by SSC.
Handicap-Accessibility: The structures, site improvements and parking must be in compliance with
all federal handicap-accessibility requirements.
ACRD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If
any changes must be made to the site plan to accommodate the ACRD requirements, a new site plan
shall be submitted to the City ofMeridian Planning & Zoning stafffor approval prior to the issuance
of a building permit.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing
surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the
remaining improvements. A bid must accompany any request for Temporary Occupancy.
Plan Modifications: The approved Site and Landscape Plans, stamped "approved" on 6-15-OS are not
to be altered without prior written approval of the Planning & Zoning Department. No significant

automatic underground irrigation system. Additional requirements affecting pressurized
irrigation systems can be found in City Ordinance 9-I-28.

Use of rion-potable irrigation water is required when determined to be available by the City
Public Works Department as regulated by City Ordinance 9-1-28. If city potable water is used, a
separate water meter is recommended so theowner can avoid paying sewer fees for irrigation
water. Potable water shall not be used as a primary irrigation water source on non-residential
lots with more than '/2 acre ~ of landscaping. Year round water availability is also required by
connecting to city potable water or an on-site well as a secondary source.

An application for a Certificate of Zoning Compliance shall be filed with the Planning and Zoning
staff by the owner of the property or the applicant of the proposed use. The application shall contain

17. The property iS in Old Town and the current landscape fits in with the Surrounding
businesses that are located on 1=. Pine Ave. The {andscape that is currently on the
property complements the neighborhood.
a. There aren't any trees on the property that line the streets. The lot iS small and the
frontage is only 4-6 feet and with customers parking along the front trees may be more of
a hazard or cause Sidewalk problems because the area between the sidewalk to the Street
1 iS only about 5 ft. and aS the trees become mature the roots may break, crack or cause
damage to the Sidewalk.
b. There aren't any current street buffers on E. }'ine Ave. Currently it iS a two lane road with
no bufFerS.
c. The property because it iS so small and the odd Shape of it doesn't allow for any more
than 1 parking Stall€' in the rear. So there iS no parking" strip markings needed.
d. The buffer width is 5' to the praperty line on the'west side of the property and 12' on the
east Side of the property.
e. The property due to being .10 of an acre and the odd shape of the lot only allows for 1
parking stall. {t iS adeo~uate for handicap parking. The dimensions are 15' 4" x 25'.
f. There are only 3 trees on the property. All 3 are deciduous. I was not able to locate the
older tree, but the 2 younger trees are crab apple.
