RECOMMENDATION TO CITY
COUNCIL
1. The property is located on the north side of Victory Road, approximately 1,000 feet east
of Meridian Road, commonly known as Lot 2, Block 2, Observation Point Subdivision.
2. The owner of record of the subject property is Jerry L. Caven, 6874 Fairview Avenue,
Boise, ID 83704.
3. The Applicant is RF Construction, 6874 Fairview Avenue, Boise, ID 83704.
4. The subject property is currently zoned R-4. The zoning district of R-4 is defined within
the City of Meridian Zoning and Development Ordinance, Section 11-7-2.
5. The Applicant requests Conditional Use Permit approval to demolish an existing home
and to rebuild one single-family residential dwelling in the R-4 zone. Meridian City
Code 11-7-2.C requires connection to the Municipal water and sewer systems of the City
of Meridian in the R-4 zone. Meridian City Code 11-10-4 requires all new single-family
detached houses in the R-4 District to contain at least 1,400 square-feet of living space.
Meridian City Code 11-5-5.A states; no existing structure (devoted to a use not permitted
by the Title in the district in which it is located) may be enlarged, extended, constructed,
reconstructed, moved or structurally altered except by conditional use and except where
the use of the structure changes to a use permitted in the district in which it is located.
6. The Meridian Planning and Zoning Commission recognizes that the proposed application
is in compliance with the Meridian Comprehensive Plan, which designates the property
as Low Density Residential.
7. The proposed residence and the use of septic, which is the subject of this, will in fact
constitute a conditional use as determined by City policy.
RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR THE
CONSTRUCTION OF A SINGLE-FAMILY HOME IN THE R-4 ZONE, BY RF CONSTRUCTION, CUP-03-047

RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends to the City Council
of the City of Meridian that they approve the requested Conditional Use Permit as requested by
the Applicant for the property described in the application, subject to the following:
A. Adopt the Recommendations of the Planning and Zoning Commission, as follows:
1. Any new home on Lot 2, Block 2, Observation Point Subdivision shall be a minimum
1,400 square feet.
2. The Applicant shall install landscaping and buffering along Victory Road per the
Subdivision Ordinance and in a manner similar to the existing landscaping adjacent to
the improved portion of Observation Point Subdivision.
3. The Applicant shall green-up the remaining acreage of the property.
4. Prior to the issuance of a building permit, submit a site plan to the Planning & Zoning
Department showing how the proposed garage can be accessible from the west.
5. The Applicant is not required to hook up to City services at this time, however, no
building permit shall be issued on this site until the sanitary restrictions placed on this
lot is resolved with the Central District Health Department.
B. Adopt the Recommendations of the Nampa & Meridian Irrigation District as follows:
1. All municipal surface drainage must be retained on site. If any surface drainage
leaves the site, the Nampa & Meridian Irrigation District must review drainage plans.
2. The developer must comply with Idaho Code 31-3805.
