Recommendation: Approve with conditions (3 Ayes, 1 Absent)
Summary of Public Hearing:
The applicant’s representative, Daren Fluke, testified in favor of the application.
Ray Kane, Robert White, and Louis Serino testified with concerns about reducing the
lot size to accommodate “little cracker box buildings” instead of the larger lots and
buildings that were previously approved and with concerns about exacerbating the
traffic congestion problem at River Valley Street and Eagle Road.
Key issues of discussion and questioning by the Commission included:
1. Landscape setbacks vs. common lot
2. Parking
3. Building elevations
Key Commission Changes to Staff Recommendation:
None.
Outstanding Issues for City Council:
The Commission noted that the applicant must convince Council that a common lot is
not necessary and that the proposed easement is sufficient for the street buffer along
Eagle Road. As noted in the staff report on page 3, staff supports the arrangement
based on past precedent.
A new letter from ITD has not been addressed by staff, the Commission, nor the
applicant. The recommended conditions from ITD have been included in the
Recommendation as Item F on page 6 to facilitate discussion with City Council.
However, staff has concerns about some of the proposed language.
