We have reviewed this submittal and offer the following comments, as conditions of the Applicant. These conditions shall be considered in full, anlesa expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUIVIMARY & BACKGROUND The Applicant, RF Construction, has requested approval of a conditional use permit to replace an existing single-family home with a new 1,125 square-foot single-family home at 500 East Victory Road. The subject site was recently annexed into the City and zoned to R-4. In 2002, a plat was recorded that included this property as Lot 2, Block 2, Observation Point Subdivision. A note (# 14) was placed on the face ofthe plat of Observation Point Subdivision restricting the issuance of building permit(s) for Lot 2, Block 2, until a sewer line had been constructed servicing said lot. Further, a note (#8) was placed on the face ofthe Observation Point Plat that requires all single-family lots to contain structures being a minimum 2,100 square-feet, excluding the garage. The site is located on the north side of Victory Road, approximately 1,000-feet east of Meridian Road, commonly known as Lot 2, Block 2, Observation Point Subdivision. The subject property islocated in an R-4 (Low Density Residential) zone. ADevelopment Agreement was drafted and is in effect for the site that restricts the use and development ofthe subject property. The Applicant is proposing to construct asingle-family home within a residential zoning district, utilizing the existing septic system. MCC 11-5-S.E states that: "Where a nonconforming use applies to a structure and land in combination, removal or destruction of the structure shall not eliminate the nonconforming status of the land." Further MCC 11-5-S.A states that: "No existing structure (devoted to a use not permitted by the Title in the district in which it is located) maybe enlarged, extended, constructed, reconstructed, moved or structurally altered except by conditional use and except where the use of the structure changes to a use permitted in the district in which it is located." Although asingle-family home is an allowed use inthe R-4 zone, the Applicant's proposal requires a conditional use permit because connection to the Municipal water and sewer systems of the City of Meridian is required in the R-4 zone (MCC 11-7-2.C). Further, Meridian City Code (MCC) 11-10- CUPA3-047 ObservaGOn Point Sub, Lol 2, Block 2 Planning & Zoning Commission, Mayor & City Council Transmittal Date: October 7, 2003 Page 2 4. A requires all new single-family detached houses inthe R-4 District to contain at least 1,400 square- feet of living space, excluding the garage. In order to construct a home that does not meet either dimensional standards for minimum house size nor use standards (utilizing septic and not connecting to sewer) that the City has established, a conditional use permit is required. NOTE: On June 10, 2003, the Meridian City Council detemuned that a public hearing for the Applicant's proposal to violate recorded plat notes would require a public hearing and noticing. Staff is recommending denial of the Applicant's request to extend the non-conforming use and structure on Lot 2, Block 2, Observation Point Subdivision. (See staff's findings and analysis in Standards for Conditional Use Permits, and the formal recommendation below.) LOCATION & SURROUNDING USES The subject property is located at 500 E. Victory Road, approximately 1,000-feet east of Meridian Road, within Observation Point Subdivision. The following uses surround the subject property: North -Kennedy LateraUObservation Point Subdivision, zoned R-4 South -Single-family home on large agricultural lot, zoned RUT (County) East -Kennedy Lateral/Observation Point Subdivision, zoned R-4 West -Victory Greens Nursery/Single-family home, zoned C2 (County) OWNER OF RECORD The property owner of record is Jerry L. Caven, 6874 Fairview Avenue, Boise, ID 83704, who has provided notarized consent for Elliott Sheffield ofRF Construction to submit the subject application STANDARDS FOR CONDITIONAL USE PERMITS The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms of the following and may approve a conditional use permit and planned development ifthey shall find evidence presented at the hearing(s) is adequate to establish (11-17-3): A. That the site is large enough to accommodate the proposed use and all yards, open spaces, parking, landscaping and other features as may be required by this Ordinance; Staff finds that the site is large enough to accommodate the proposed use and all other features required by Meridian City Code (MCC). Lot 2, Block 2, contains approximately 1.88-acres. The Applicant is proposing to construct afront-entry (facing Victory Road) garage approximately 30-feet from the existing right-of--way for Victory Road. Victory Road is CUP-03-047 Observation Point Sub, Lot 2, Block 2 Planning & Zoning Commission, Mayor & City Council Transmittal Date: October 7, 2003 Page 3 designated as a collector on the 2025 Functional Street Classification Map. The Meridian Comprehensive Plan requires a 20-foot wide landscape buffer along collector roadways. Except for the subject lot, a 20-foot wide landscape buffer was provided along Victory Road with Observation Poixrt Subdivision. When a 20-foot landscape buffer is constructed abutting the site on Victory Road, the face of the proposed garage would be approximately 10-feet from the back of the buffer. Meridian City Code requires a 30.foot front setback along collector roadways in the R-4 zone. Staff recommends that in order to be consistent with required setbacks on Victory Road an~structure~) constructed on Lot 131ock 2 be located a m;nirrn,m of 40-feet back (for structures taking direct access to Victory Road) from the current Victory Road ri t-of--way line This recommendation accounts for the future 20-foot wide landscape buffer and reauired front setback in the R- 4zone as well as accounting for the off-street parkins to be located outside of the future landscape buffer on Victory Road. NOTE: In order to limit direct lot access to Victory Road in the future, staff recommends that the Applicant orient the garage so access can be taken from a fixture internal street and not Victory Road when this lot redevelops. Should the Applicant provide staff with a diagram showing how access will be taken internally in the future, the setback from Victory Road maybe reduced to the less-restrictive side or rear setbacks, depending on orientation. This would only be necessary if the Council decides to extend the non- confomvne use. B. That the proposed use and development plan will be harmonious with the Meridian Comprehensive Plan and in accordance with the requirements of this Ordinance; The Comprehensive Plan Land Use Map designates the property as "Low-Density Residential". In Chapter 7, Future Conditions, Land Use, ofthe Meridian Comprehensive Plan (MCP), it is stated that the purpose of Low Density Residential is "to adlaw for the development of single family homes on large lots where urban services are provided." In Chapter 6 of the MCP, it is stated that "new development should protect street and road corridors so that they can mesh with the existing street system to accommodate future transportation demands. "Also in Chapter 6 of the MCP, it is stated that "the capacity of arterial acrd collector roadways can be greatly diminished by excessive driveway connections to the roadways. The City should cooperate withrlCHD to minimize accesspoints onarterial and collector roadways as development applications are reviewed " Stafffinds that if urban services are not provided and the Victor r~Road corridor/buffer is not protected, then the proposed non-conforming single-family use is not harmonious with the Meridian Comprehensive Plan or Meridian City Code. C. That the design, construction, operation, and maintenance will be compatible with other uses in the general neighborhood and with the existing or intended character of CUP-03-047 Observation Point Sub, Lot 2, Block 2 Planning & Zoning Commission, Mayor & City Council Transmittal Date: October 7, 2003 Page 4 the general vicinity and that such use will not adversely change the essential character of the same area; Staff finds that the single: family residential use is compatible with the other existing and intended character/uses in the general vicinity. However, the design operation. and When Observation Point Subdivisionwas processed, the City and the Central District Health Department (CDHD) intended for any new residernial structure(s) constructed on Lot 2, Block 2, to be_serviced with sewer and water from the City. Staff has received a recommendation for denial for the proposed conditional use permit from the Central District Health Department (see referral dated 9-10-03 from CDHDI. The referral from R~ike Reno at the CDHD, states that because this development (Observation Point) was approved and sanitary restrictions were released for central sewer and water, he cannot approve this CUP (application) unless the lot were to have city water and sewer services. The Council should consider public testimom+, as well as comments from staff and other agencies, when determining if the proposed house size and the design, construction, operation, and maintenance of the proposal will be compatible with other uses in the general neighborhood and with the existing or intended character of the general vicinity. D. That the proposed use, if it complies with all conditions of the approval imposed, will not adversely affect other property in the viciuity; The Council should rely upon public testimony, staff's analysis. and other agency comments when determining if the proposed house size and use will adversely affect the other properties in the vicinity. E. That the proposed use will be served adequately by essential public facilities and services such as highways, street, police, and fire protection, drainage sdvctures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; Stafffinds that the proposed develo~3ment can be ade~uatel~served by all ofthe above listed public facilities and public services with the exception of sanitarysewer Currently, the only option for providing sewer service is for the dwelling to install a temporary private sewage pump station and pump sewage under the Kennedy Lateral to the gravity sewer system in Observation Point. Due to existing topography and other physical barriers, serving the subject lot with city gavity sewer at this time would be a costly project. F. That the proposed use will not create excessive additional requirements at public cost for public fac~7ities and services and will not be detrimental to the economic welfare of the community; Staff finds that the proposed septic use would not create additional requirements at public CUP-03-047 Observation Pond Sub, Lot 2, Black 2 Planning & Zoning Commission, Mayor & City Council Transmittal Date: October 7, 2003 Page 5 cost for public facilities and sen+ices at this time. It is anticipated that a sewer line will have to be installed in Victory Road in the future to service the development of properties hi the general vicinity. The construction of a trunk line in Victory Road is in the Public Works Departments long-range plan. When sewer is provided, the subject lot will be able to pay a sewer assessment fee and hook up to the trunk line. The proposed use should not be detrimental to the economic welfare of the community. G. That the proposed use will not involve activities or processes, materials, equipment, and conditions of operation that will be detrimental to any persons, properly, or general welfare by reason of excessn+e production of traffic, noise, smoke, fumes, glare orodors; The Council should rely upon public testimony, staffi s analysis and other agencies comments when determining if the proposed development will produce excessive traffic, noise, smoke, fumes, glare or odor and if the use would be detrimental to any person, property or the general welfare of the community. H. That the proposed use will Gave vehicular approaches to the properly which shall be so designed as not to create an interference with traffic on surrounding public streets; The subject site has one existing driveway to/from Victory Road. Victory Road is the only public street frontage that this site has. Therefore, direct lot access to Victory Road is needed at this time. Staff Ends that the location of the existing vehicle approach should not interfere with traffic on the surrounding public streets. NOTE: In order to ensure that vehicular approaches to the property do not interfere with traffic in the future, staff recommends that any garage on Lot 2, Block 2, be designed so vehicular access can be taken irrternally, and not from Victory Road, when the lot redevelops. L That the proposed use will not result in the destruction, loss or damage of a natural, scenic or historic feature considered to be of major importance. Staff is not aware of any natural or scenic feature(s) that will be lost, damaged or destroyed by issuance of this conditional use. SITE SPECIFIC liEOUiREMENTS Staff has not included any site specific requirements, since the recommendation is for denial. Discussion of Observation Point Subdivision - Exception to Final Plat Notes Regarding Lot 2, Block 2: Corrie: Next is the Public Works Department, discussion on the Observation Point Subdivision exception to Final Plat notes regarding Lot 2, Block 2. Brad. Watson: Thank you, Mr. Mayor and Council Members. This is a somewhat unusual issue, just a little background on it. There is a lot in Observation Point, the southwest corner, it's south of the Ridenbaugh Canal, and when it was recorded one of the plat notes stated that no Building Permit could be issued on that lot. The reason for that, if you have read this memo, hopefully, that gives you a little background on it -- there was no sanitary sewer service to it without a lift station and that's how that got in there. Elliott Sheffield of R.F. Custom Homes, I believe, is representing Victory 41, the developer, who is hoping to simply replace the existing house that is on that lot. It is, evidently, a caretaker's house and that's what it would continue as. They have proposed a -- I think about a 1,150 square foot replacement house. The other plat note that is a bit troublesome is that it requires aminimum -- let me see -- 2,100 square feet house in that subdivision. I spoke with Mr. Nichols about this and I guess this is at least our initial step in getting it before Council. I could see no other way to interpret that plat note or those plat notes in order to issue a Building Permit. I haven't met Mr. Sheffield I have only talked to him on the phone. Well, he's here, evidently. He could probably answer any additional questions you might have, but I'm here, too, if you have any for me. Corrie: Okay. Nichols: Mr. Mayor, Members of the Council, one of the reasons for bringing this in front of you is to look back at what was in the intent of the Council when the plat note was placed on that particular lot. It's a very large lot and I think there was some consideration that it might be further subdivided or might be a commercial use or might be some other use. You didn't want to have a bunch of houses on there that couldn't be sewered and you didn't want to have a commercial use on there that couldn't be sewered, so the request has come, as it did outside of what at least was contemplated for that lot at the time that that subdivision was approved. That's why it's at least for your discussion to see how you want staff to handle it. The proposal would be that the house would be connected to city water it's just that they would maintain their septic system. I think that one compromise might be that so long as it's owned by the current Meridian City Council Meeting June 10,2003 Page 7 of 41 owner that the septic system could continue, that sort of thing. It would be an exception to the existing ordinance. Corrie: Okay. Nary: Mr. Mayor? Corrie: Mr. Nary. Nary: Yes. I just had a question for Mr. Nichols. For the plat note, what they are asking for is, essentially, an amendment or an exception to the plat note. Would we need to have a hearing about that, so that we can provide adequate notice and -- I guess I just can't remember what process we -- Nichols: Councilman Nary, Members of the Council, I think that's what we have done, we have got one that will come before you on Packard Subdivision No. 2 to remove a plat note. This is likely not one that will generate any public interest, but it's preservation and integrity of process, but we didn't even want to go there if it was the kind of thing where we said, well, there is no sense in entertaining the issue. De Weerd: Mr. Mayor? Corrie: Mrs. de Weerd. De Weerd: It seems to me I recall some of that was also in question as the sewer capabilities and I think some additional work was done by the developer to bring more capacity on line is that correct, Brad? I'm relying on my memory on that one. Watson: Council Member de Weerd, Mayor, and Council Members, that's kind of a yes and no answer to your question. They changed from their original concept of serving that whole subdivision by gravity sewer, sort of in midstream, because they would have had some sewer that was over 30 feet deep. We talked with them they, eventually, installed a lift station east of the Ridenbaugh Canal. Conceivably, this particular lot could be sewered to that lift station, but it would -- it would involve a bore under that canal and be quite expensive. This particular piece of property, this lot, is designated on our master plan to go into the future Black Cat Trunk to the west. We don't really want it going over to that lift station anyway, but -- De Weerd: It seems what our attorney has given us an option on sounds very reasonable. I don't have any problem with it. Sorry to put this on at the last moment, but I wanted to get this out to you before you attend the AIC Conference, because I think a lot of your counterparts throughout the county heard -- will be hearing about this and may question you about it, so that's why I want to get it out to you. This was a presentation done yesterday, it was organized by Ada County Development Services, and this fellow came in and talked about this piece of software. They are a nonprofit corporation that has developed this and it runs on top of Arc View, which is the database -- geographic information data base that everyone. in the county is using currently. It kind of sits on top of that and it's really a planning tool. It does three main things. It's a scenario constructor, so if you've got kind of different scenarios of development, say a North Meridian Area Plan versus the existing Comprehensive Plan, it can compare how those two would affect public service extensions, how it might impact school development, how it would affect just the overall density of the area. Depending on the input that you have in that model -- and it's set up for easy input of those parameters, then, you can compare those alternatives really quite easily.
