~~i~'~E IDIAN~-- IDAHO June 2, 2011 MEMORANDUM T0: Mayor & City Council FROM: Sonya Watters, Associate City Planner CC: City Clerk, Jason Smith MayorTammy de Weerd City Council Members: Keith Bird Brad Hoaglun Charles Rountree David Zaremba RE: Meridian Vision -Development Agreement Modification (MDA-11-003) The applicant's request for a modification to the development agreement (MDA) for the Meridian Vision property was approved by City Council on April 26, 2011. The modification included changes to the conceptual development plan and building elevations and materials approved with the annexation of the property (AZ-06-062). Following the hearing on the 26~, prior to approval of the findings, the applicant notified staff that it is not financially feasible for them to develop the site as proposed. The applicant submitted a revised site development plan and building elevations for review by Staff to determine if the revisions substantially comply with the plans approved by City Council, as required by the development agreement. The site is still proposed to develop in two phases; however, the amount of the site to develop with Phase I is proposed to change. Changes to the site plan consist of the elimination of the courtyard between the two buildings; and elimination of 2 parking stalls on the east side of the southern portion of the site and 5 stalls on the northern portion of the site. The building elevations have been revised to reflect approximately a 50% reduction in the amount of stone veneer on the face of the building; stone veneer is now only proposed on the corners and the entryway instead of all the way around the building as wainscoting. Please see the attached site plan and building elevations that depict what was approved with the MDA versus what is now proposed. Staff is of the opinion the proposed changes do not "substantially" comply with the plans approved by City Council. Therefore, Staff requests City Council determine if the Planning Department • 33 E. If Council deems the proposed changes are acceptable, staff has prepared findings for approval at the June 7~ meeting that include the revised plans. If Council deems the proposed changes are not acceptable, staff has also prepared findings for approval at the same meeting that include the original plans approved with the MDA. Another option would be to require a new public hearing for review of the proposed changes if Council deems appropriate. In doing this we have re-evaluated the amount of site development associated with the Meridian Vision building and its proposed lot. On the attached site plan we have reduced the courtyard to the North of the building and reduced the parking lot area to a size that better serves the 2,700 sq. ft. Meridian Vision building. The 17 parking stalls being shown on the revised plan exceed both our clients requirements and Meridian City code requirements. By reducing the courtyard and parking lot we are allowing more flexibilty for the build out of the future building pads to the north. If the site was built as originally submitted, it would provide an excessive amount of parking and impose unnecessary limitations on the future pads which would likely result in demolition of site elements built underthis first phase of development.
