cipal corporation, hereinafter
called CITY, and ST INVESTMENTS, INC., hereinafter called FAST EDDY'S:
WITNESSETH:
WHEREAS, the CITY has been permitted the first and only Class A Reclaimed Water
Program in the State of Idaho; and
WHEREAS the CITY strategically aligns its operations and services to further its vision for
the sustainable use of natural resources;
WHEREAS, the CITY has developed and operates a Class A Reclaimed Water Distribution
System that is situated in close proximity to FAST EDDY' S propert located at 750 N. Ten
Y
Mile Road; and
WHEREAS, the CITY has not yet established an assessment fee for the Class A Reclaimed
Water Distribution System, nor has the CITY established a monthly usa e fee; and

WHEREAS, FAST EDDY' S wishes to enter into a partnership with the CITY to levera e this

economical and environmentally sustainable resource for use in FAST EDDY' S car washin
g
facilities; and
WHEREAS, the utilization of this resource will reduce the demand on the munici al water
su 1 ~ ' p
pp y system, and reduce the CITY S effluent flow to the Boise River; and
WHEREAS both parties desire to have such a connection,
NOW, THEREFORE, in consideration of the foregoing, the CITY and FAST EDDY' S do
hereby agree as follows:
A. Construction of Connections: FAST EDDY' S has applied for Buildin Permits

through the Development Services Division, and is proposing to construct a
connection between their car wash facility and the existing main line of the CITY' S
Class A Reclaimed Water Distribution System. If the application is ranted, the

CITY S Public Works Department may authorize the extension at the ex ense of the

applicant and at no expense to the CITY, the followin :service i e an '

curb at the point most convenient for supplying Class A Reclaimed Water to h

that reclaimed water is not available. As a part of the reclaimed water service
FAST EDDY' S will meet the posting and labeling re uirements outlined in the

CITY S Citywide Reuse Permit.
B. Maintenance of Connections: The CITY will maintain the service line u to the
CITY' p
S side of the connection to the meter setter.
C. Reclaimed Water User A reement: The CITY will provide a utili user a reement

to be signed by FAST EDDY' S that outlines the limitations and obli ations of usin
g g
reclaimed water.
D. Initial Payments for Reclaimed Water Service: Since the CITY has not et

established an assessment fee for the Class A Reclaimed Water Distribution S stem

the CITY established a monthly usage fee, the City hereby a rees to waive

those fees for the service at this time.
E. Future Payments for Reclaimed Water Service; Once the CITY establishes the
assessment fees for the Class A Reclaimed Water Distribution System, and has
established a monthly usage fee, FAST EDDY' S shall only be res onsible for

paying to the CITY the monthly usage charge from the date of official notification of
such charge. FAST EDDY' S and CITY acknowledge and a ree that the usa e

charge may be established as a flat fee, a surcharge, or in some other form or format.
IN WITNESS WHEREOF, the parties shall cause this Memorandum of A reement to be
